EARNEST EFFORT TO COMPROMISE

Dear Mr. De Guzman,


Greetings!
It has come to the attention of my clients, Angelo De Guzman, Beth De Guzman and Cardo
De Guzman, that the status of the properties left intestate by your parents Esmeraldo De Guzman
and Fatima Garcia under TCT No. 12345 located at Capirpirawan, Cordon, Isabela with the land
area of 40 square meters and upon inquiry made before the Register of Deeds, previos title was
cancelled due to the execution of a Deed of Donation by your parents dated November 5, 2011
which was executed in your favor.

This has resulted to the cancellation of the previous title and TCT No 67890 was constituted
in your favor. However, the inconsistency of the date of execution of said deed of donation and of
the demise of the Spouses Esmeraldo De Guzman who perished in the year 1999 and of Fatima
Garcia who perished in the year 2007 showed discrepancies which caused prejudice to the rights
set forth by law of my clients, specifically as they are also legitimate heirs of the decedents.

My clients are seeking earnest efforts to settle this family matters outside of litigation as
provided under Art 151 (1) of the Family Code, viz, “No suit between members of the same family
shall prosper unless it should appear from the verified complaint or petition that earnest efforts
toward a compromise have been made, but that the same have failed. If it is shown that no such
efforts were in fact made, the same case must be dismissed.”

To avoid needless expense and embarrassment brought about by court litigation, I advise you to
visit my client who has expressed their willingness to settle the problem out of Court.
