 ORDER 
     

1. The   applicant/accused   against   whom   crime   No.   I­   344   of

2019 ( Pundliknagar Police Station) under Section 392 r.w.s 34 of Indian
Penal Code is registered, has applied for regular bail under Section 439
of the Cr.P.C. The A.P.P. has filed reply and copies of documents  Exh.5.
I. O. is absent.

2. The learned Advocate for the applicant submitted that the
applicant is of tender age. He has been falsely implicated in the crime at
the say of co­accused and arrested after one month. There is inordinate

delay   in   lodging   F.I.R.   He   further   submitted   that   the   investigation   is

completed and there is no need to keep him behind bars.

3. On  the   other   hand,  the   learned  A.P.P.  submitted   that   the

offence   is   very   serious.   Muddemal   property   is   recovered   from   the
applicant / accused. He has filed a fake receipt about the purchase of
gold   chain.   According   to   her,   there   is   no   delay   in   lodging   F.I.R.   or
arresting   the   accused.  Lastly,  she  submitted   that   in   all   three   crimes
registered against the applicant and he is habitual offender and should
not be released on bail. She also submitted that his presence is necessary
for conducting test identification parade. 

4. Considering   the   rival   submissions,  application,   reply   and

copies of documents placed on record, it  prima facie  appears that the
alleged crime took place at about 9:15 p.m. of 20­08­2019 and the F.I.R.
was   lodged   at   00:35   a.m.   on   21­08­2019   and   there   is   no   delay.   It
appears from police papers that the investigation is almost completed by
recovery of the muddemal property from the accused. The apprehension
expressed about tampering with the evidence or absconding etc. will be
taken care of by putting certain conditions. So far as the conducting of
test identification parade etc. is concerned, it appears that the same was
fixed on 04­09­2019, however, it could not be conducted due to absence
of witnesses. The I.O. has not explained as to why it was not conducted
thereafter, till today. Under such circumstances, no fruitful purpose will
be   served   by   keeping   the   applicant   behind   bar   for   indefinite   period.
Therefore, the following order is passed. 
ORDER

(i) The application is allowed. 

(ii) The   applicant/accused   be   released   on   execution   of   his   P.R.

Rs.15,000/­ and surety in the like amount.

(iii) The accused/applicant is directed to attend Pundliknagar police
station on every Saturday between 11:00 a.m and 1:00 p.m. till
filing   of   the   charge­sheet   and   he   shall   co­operate   with   the
investigating   officer   by   remaining   present   for   the   purpose   of
investigation as and when directed. 

(iv) Applicant / accused to furnish bail before the concerned learned
J.M.F.C.
