DEED OF HEIRSHIP AND SALE OF AN UNDIVIDED SHARE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by,

REGINO G. CORDOVA, JR. of legal age, Filipino, married to Carmen Trasmonte, and a
resident of Dumaguete City, hereinafter called the HEIR-VENDOR, in favor of,

CHRISTIAN FAITH G. EVANGELISTA, also of legal age, Filipino, single, and a

resident of barangay Cabulotan, Tayasan, Negros Oriental, hereinafter referred to as the
VENDEE;

WITNESSETH:

That LOURDES G. CORDOVA, through inheritance, is an absolute owner of a certain

parcel of land known as Lot 209-D, being a portion of Lot No. 209 located at barangay
Kabulotn, Tayasan, Negros Oriental, as shown in a Deed of Extrajudicial Pawrtition known as
Doc. No. 1; Page No.VI, Series of 1994, notarized before Judge Tirso F. Banquerigo, Ex-Officio
Notary Public; and which parcel of land is more particularly described as follows, to wit:

“A parcel of land (Lot No.209-D of the Cadastral Survey of Tayasan, being a portion of
Lot No.209, Pls-665, the latter parcel of land is covered by OCT No. FV-2722), situated in
barangay Cabulotan, Tayasan, Negros Oriental. Bounded on the N. by Lot No. 209-C; on the
East by Provincial Road; on the South. by Lot No. 209-E; and on the West by Lot No. 216;
containing an area of THREE THOUSAND NINETY SEVEN (3,097) square meters, more or
less;

That LOURDES G. CORDOVA died intestate sometime in October 16, 2005, leaving
without any testamentary will nor debts not settled until the present and upon her death she was
survived by her only legitimate children and only compulsory heirs, namely JAYME, ERLINDA,
WILHELMINA, REGINALDO, BIMBO, LORY, EVELYN, REGINO, JR., REGINITO,
CYNDY and REYNATO, all surnamed CORDOVA;
NOW THEREFORE, invoking the provisions of Section 1, Rule 74 of the Rules of Court,
the herein vendor, REGINO CORDOVA, JR. have settled and adjudicated unto himself his one-
Eleventh (1/11) undivided shares over the above-described parcel of land, consisting of around
TWO HUNDRED EIGHTY ONE (281) square meters, more or less;

WITNESSETH FURTHER:

That for and in consideration of the sum of TWENTY THOUSAND PESOS (Php
20,000), Philippine Currency, in hand paid by the herein Vendee, Christian Faith Evangelista and
receipt in full is hereby acknowledged by the Vendor, Regino Cordova, Jr. to his entire
satisfactions and that by virtue of these presents, the herein Vendor does hereby SELL,
TRANSFER, and CONVEY unto the vendee, her heirs and assigns, all the vendor’s rights and
interests over his one-eleventh share over the aforementioned parcel of land, Lot No. 209-D,
consisting of TWO HUNDRED EIGHTY ONE (281) square meters, more or less, including all
the improvements found therein, free from all liens and encumbrances;

That the vendor herein declares that due notice has been given to all persons affected by
this transaction in compliance with the provisions of the New Civil Code of the Philippines,
pertaining to the rights of the redemptioner and preemptioner, but nobody opted to exercise the

 said rights and the sale of these parcels land is in consonance with the provisions of the
Comprehensive Agrarian Reform Law because this parcel of land is within the retention limits of
the vendor, further, the vendor warrants her ownership over the said parcel of land and will
defend the rights of the herein vendee against any adverse claim whatsoever.

IN WITNESS WHEREOF, I have hereunto affixed our signatures this ___day of April
2007, at Dumaguete City, Negros Oriental.

appeared the Vendee and the vendor, who exhibited their respective Com. Tax Certificates, as
printed below their names, both known to me to be the same persons who executed the foregoing
deed, consisting of two (2) pages, including this page of acknowledgement and all pages were
duly signed by the parties herein, together with their two instrumental witnesses and that they
acknowledged to me that the same is their free act and voluntary deed.
