The undersigned, a sworn law enforcement officer for the Sturgeon Bay Police Department,
being first duly sworn, states that:
Count 1: CHILD ENTICEMENT
The above-named defendant on or about Monday, January 6, 2020, in the City of Sturgeon
Bay, Door County, Wisconsin, with intent to have sexual contact with the child in violation of
Section 948.02, Wis. Stats., did attempt to cause an individual who the actor believed or had
reason to believe had not attained the age of 18 years to go into a vehicle, contrary to sec.
948.07(1), 939.50(3)(d) Wis. Stats., a Class D Felony, and upon conviction may be fined not
more than One Hundred Thousand Dollars ($100,000), or imprisoned not more than twenty
five (25) years, or both.
Count 2: USE OF A COMPUTER TO FACILITATE A CHILD SEX CRIME
Bay, Door County, Wisconsin, did use a computerized communication system to communicate
with an individual who the actor believed or had reason to believe had not attained the age of
16 years with intent to have sexual contact or sexual intercourse with the individual in violation
of s. 948.02 (1) or (2), contrary to sec. 948.075(1r), 939.50(3)(c) Wis. Stats., a Class C Felony,
and upon conviction may be fined not more than One Hundred Thousand Dollars ($100,000),
or imprisoned not more than forty (40) years, or both.
And furthermore, invoking the provisions of Wisconsin Statute Section 939.617(1), upon
conviction the Court shall impose a bifurcated sentence including a term of initial confinement
for at least five years.
Count 3: EXPOSING A CHILD TO HARMFUL MATERIAL
Bay, Door County, Wisconsin, with knowledge of the character and content of the material, did
exhibit or display harmful material to an individual who the actor believed or had reason to

believe had not attained the age of 18 years, with or without monetary consideration, contrary
to sec. 948.11(2)(a), 939.50(3)(i) Wis. Stats., a Class I Felony, and upon conviction may be
fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than three (3)
years and six (6) months, or both.
PROBABLE CAUSE:
Officer Brandon Shew, of the Sturgeon Bay Police Department, reports that on January 6,
2020, he began an Internet Crimes Against Children (ICAC) investigation. Officer Shew
reports that he set up an undercover profile on the mobile phone/device application called
“Grindr”. Grindr is a platform commonly used by gay males to meet other males to meet up for
sexual encounters. Officer Shew utilized a screenname of “Tyler” for the undercover profile,
and the profile displayed an age of 19 years old. The undercover profile did not have a photo.
For the purposes of this complaint, Officer Shew’s undercover profile will be referred to as
“Tyler”.
Officer Shew reports that on January 6, 2020, at approximately 1329 hours, he began an
undercover chat investigation utilizing the “Tyler” profile on the Grindr application.
“Tyler” was chatting with a profile with the name of “Top4yngr4fun”. The suspect’s profile listed
an age of 53 years old, and the biography read in part, “Enjoy the company of younger men.
Confident. Mature. Generally enjoy clean cut type guys, for chat/friends/hang/chill/fun/fwb.
Casual=hangout and see. Don’t’ like taps? Really? Learn how to take a compliment”
Officer Shew reports that at 1329 hours, “Tyler” received a message from the suspect’s profile.
The suspect said, "Hi" "thanks for the tap" and, "How're you?" “Tyler” responded, "Haha I did
on accident" and, "I'm too young.” The suspect responded, "You're not too young for me :)"
The following is an excerpt from the Grindr chat that ensued between “Tyler” and the suspect
from 1:35 p.m. to 1:50 p.m. on January 6, 2020.

Officer Shew reports that after making arrangements to meet at the McDonald’s restaurant
located on Egg Harbor Road, in the City of Sturgeon Bay, Door County, Wisconsin, a team of
officers was assembled to conduct surveillance to see if the suspect would show up at the
meet location.
Once staged at the McDonald’s, Officer Shew, posing as “Tyler”, continued to chat with the
suspect to determine whether he arrived and what type of vehicle he was driving. Beginning at
approximately 8:38 pm, the suspect sent messages indicating that he had arrived at
McDonald’s and asked “Tyler” if he was there yet. The suspect sent a message stating that
he was nervous, and that he was driving around the building. The suspect sent a message to
“Tyler” describing his vehicle and where it was parked. Officers confirmed the suspect’s
presence at McDonald’s, made contact with the suspect vehicle. Officers observed a lone
male occupant in the driver’s seat, who was later identified as Thomas J. Minar, the defendant,
ordered that he exit the vehicle, and then placed him under arrest.
While seated in the back seat of Officer Shew’s squad car, Minar stated that he was meeting
with a young man that lives in Sturgeon Bay. Minar admitted that “Tyler’s” profile indicated he
was 19 years old, but that “Tyler” said he was 15 years old. Minar said that he met with “Tyler”
to be a “friend” and to be his “mentor.”
Minar stated to Officer Shew, “I know where your mind goes, and I know where other people’s
minds go.” Minar claimed that he likes making friends and that he was not looking for “sexual
things.” Minar stated that he is a “distinguished person” and that he works in higher education.
Minar denied that anything sexual would have occurred had the 15 year old shown up at
McDonald’s. Minar stated that he thinks young gay people need “resources” and “non-sexual
affirmations and mentorship and role models” and this was probably a “misguided way to
provide an opportunity.”
Minar was subsequently transported to the Door County Jail, where he agreed to an interview
with Officer Shew. During the interview, Minar admitted to knowing that he was
communicating with a 15 year old high school student. Minar admitted that he was
communicating with the 15 year old via his cell phone. Minar said the profile indicated that
“Tyler” was a 19 year old boy but that later it "became clear he was a high school student."
Minar said he talked with the child because he was curious and bored. Minar said the purpose
of Grindr is to meet with people and some use it as a sex tool. Minar said the principle of using
Grindr for himself is to chat. Minar said that the purpose of chat, specifically with the 15 year
old boy, could lead to conversation, education, and friendship. Minar said that he often talks to
young people about “education.”
Officer Shew asked Minar about the sexually explicit chat messages with “Tyler.” Minar said
that to him it was fantasy chat. Minar stated, "Yes, I'm 56 years old. Yes I'm attracted to young
males."
Minar said that he is normally attracted to young adult men. Minar said he has never been
sexually interested in children. When asked about what officers may find on his cell phone,
Minar said officers may find terms such as "twink" and "older for younger." Minar said it is

unlikely that officers would find child pornography. Minar said that if child pornography was
found on his phone, it would be from pornography sites he cannot control.
Minar said he has communicated with minors on Grindr in the past. Minar said that he
normally blocks their profiles. Officer Shew asked Minar why he was asking “Tyler” sexually
explicit questions, such as question in regards to the child's penis. Minar would not answer
certain questions or would resort back to this having been a "fantasy chat".
Officer Shew asked Minar multiple times why he didn't block “Tyler’s” profile since he believed
he was 15 years old. Minar said he did not know. Officer Shew asked Minar if he would have
had a sexual encounter with the “Tyler”. Minar responded that he did not see that happening,
and that he has “never done it”. Minar went on to state, “I've been with 18 year olds."
Minar said that the purpose of his "fantasy chat" was "sexual curiosity." Minar said that he
would have drawn a line between a sexually explicit chat and having a sexual contact with a 15
year old boy. Minar said that the situation was a mistake on his part, that going to Sturgeon
Bay was a mistake, and that he agreed he should not have had this type of conversation with a
child.
Based on the foregoing, the complainant believes this complaint to be true and correct.
