CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This Contract of Lease, made and executed by and between:

_______________________, of legal age, single/married, Filipino, and with


residence address _____________________________________ who represents the
registered property owner, hereinafter called the LESSOR; and

___________________________________,of legal age, and with address at


___________________________________, hereinafter called the LESSEES,

WITNESSETH:

The LESSEES desire to lease the residential house located at


_________________________________, owned by the LESSOR, under the
following terms and conditions, to wit:
1. PERIOD OF LEASE – This lease shall be for a period of ___ months starting on
____________ to ______________, subject to re-negotiation/renewal, the parties
may renew the contract under the terms they agree a t least a month before the
expiration of this contract;

2. RENTAL – The LESSEE shall pay the LESSOR a monthly rental of


_________________________ PESOS ONLY (Php___________) , Philippine
currency, payable in advance, plus _____ month/s deposit and _____ month/s
advance payment Philippines Currency, duly received and acknowledged by the
Lessor. The monthly rentals shall be due and payable every _____th day of each
month.

3. DEPOSIT & other obligations –The Lessee have paid LESSOR mentioned above
and the same shall be reconciled and used to answer for the unpaid/unsettled lessee
cost of utilities (electric, water, association dues/bills, etc) prior to lessee’s leaving
the leased property. All utilities such as electric bills, water, home owner’s
association dues/fees and the like shall be paid and the sole responsibility of the
LESSEE;

4. The above-mentioned advance & deposit/s shall be forfeited in favor of the Lessor,
in the event that the LESSEE would pre-terminate this contract prior or before the
expiration of lease.

5. It is also understood that LESSEE shall observe proper sanitation and cleanliness in
the entire duration of the contract, in accordance with national, municipal ordinance
and barangay, or other applicable laws.

6. Insurance - Either party to this contract may at its option and expense, secure
appropriate insurance policy over its respective insurable interest on the premises
subject of this lease.

7. INSPECTION OF THE PROPERTY- The LESSOR or his authorized representative


shall, during reasonable time, have free access to the premises for the purpose of
inspecting the same.

8. USE OF THE LEASE PREMISES: The LESSEE warrants that the leased premises
shall be used as residence only. Lessee shall not store any flammable or explosive
materials or any prohibited/illegal materials within the premises under lease. Lessee
shall not use the premises for illegal purpose/s and LESSEE shall be solely
responsible to the authorities for such violation/s.

9. ADDITIONAL IMPROVEMENT ON THE PREMISES: The LESSEE is hereby


allowed and permitted to introduce useful improvement/s on the leased premises,
appropriate for his requirements. However all constructions shall be with prior
approval of the LESSOR. Permanent improvements which cannot be removed
without causing damage to the property to which it is attached shall belong to the
LESSOR upon the expiration of this contract, without reimbursement.

10. SUBLEASE OR ASSIGNMENT – The LESSEE shall not sublease or assign the
leased premises or any portion thereof without the written consent of the LESSOR;

11. NUMBER OF OCCUPANTS. Except for the patients who stay temporarily at the premises,
the LESSEE shall limit the number of regular occupants & household members to their
immediate member of their family of not more than (__3___), plus one (1) helper. If she
exceeds the number, then she must seek the approval of the LESSOR in writing

12. IN CASE OF DEFAULT / AUTHORITY AND WAIVER OF LIABILITY – In case the


LESSEE fails to pay ________ months rentals of the premises, the LESSOR shall have the
right to eject the LESSEE by informing the latter in writing and after the lapse of five (5) days
may secure and enforce possession of the premises and take valuables/appliances etc.
equivalent to the LESSEE’s outstanding balance, with the help of the Barangay Officials, in
which case the LESSEE, under the circumstances, hereby waives any right whatsoever
against the LESSOR, her duly authorized representative/s and/or the BARANGAY
OFFICIALS/REPRESENTATIVES for any criminal and/or civil liability.. By this
agreement, LESSEE hereby gives the authority to LESSOR and the Barangay Officials for
the said action, even without going to the court, to settle their differences and allow them
inside the leased premises to enforce payment or such action as may be necessary. . The
LESSOR is, likewise, entitled to enforce five (5) per cent additional penalty ON
OUTSTANDING BALANCES on rentals until fully paid.

13. TRANSFER/TERMINATION OF CONTRACT –
Upon termination of this contract or if for any other reason LESSEE intends to leave the
premises and transfers to other place, the LESSEE shall not vacate and take out their things
unless written clearance is issued by the LESSOR.. Lessee, if he/she wishes to pre-terminate
this contract must advise Lessor in writing at least 30 days in advance and shall then forfeit
his/her _______ month deposit. Lessee shall also pay/clear all utilities/bills that they
consumed/incurred prior to leaving the premises. Lessee shall maintain the premises and
restore to its original state and condition the said premises at the expiration or prior to their
leaving the premises.

14. VIOLATION/S - Any violation of the above terms and conditions by the Lessee or violation
of laws/ordinances shall be sufficient ground by the Lessor to terminate this contract.

15. ATTORNEYS FEES –


If the LESSOR is constrained to enforce the provisions of this contract with the assistance of
an attorney, through any venue, whether out of court or with judicial intervention, or thru the
courts, the LESSEE shall pay for such attorneys fees in the amount of at least 10% of the
outstanding obligation but not lower than P20,000.00, plus other costs and damages that may
be incurred by the LESSOR.

That the parties have fully read and understood the foregoing contents of the contract
and accept all the provisions herein.
