JOINT AFFIDAVIT OF ARREST

We, PO3 MARK ANTHONY J. AMIN, PO1 JOMER M GUINGONA

and ALEX FORTES of legal age, members of the Philippine National
Police and presently assigned at the San Juan City Police Station, City of
San Juan, after having been sworn to in accordance with law do hereby
depose and state:

1. That, we are presently assigned at the City Police Drug Enforcement

Unit of San Juan City Police Station, EPD, San Juan City with a
broken hour of duty;

2. That, we are the complainant/ arresting officer in filing of criminal

case of the suspects identified as NANCY BARUIAD y SANTOS, 44
years old, single, jobless, born on August 21, 1973 in Cainta Rizal
and residence of No. 012 Lourdes Drive Street, Brgy. Ermitaño, San
Juan City for Violation of RA 9165 Sec 13 and Sec 14;

3. That prior to the arrest of the above-named suspect, a confidential

informant went to the office of CPDEU and reported about the
rampant illegal drugs activities of the above-names suspect NANCY
BARUIAD y SANTOS particularly along Lourdes Street, Brgy.
Ermitaño, San Juan City;

4. That, at about 6:00 PM of September 09, 2018, the above-name

suspect Nancy was seen along Lourdes Street, Brgy. Ermitaño, San
Juan City actually dispensing and selling illegal drugs or shabu;

5. That, said, information, was relayed to Police Inspector EDWIN F.

GO, Chief of CPDEU, San Juan City Police Station, who in turn
organized a team to coordinate to PDEA to conduct a buy bust
operation against subject NANCY and after the coordination with the
PDEA, at about 9:30 PM of September 09, 2018, the PDEA RO-
NCR Office gave a control number 1001-092017-0182 and the target
person is NANCY and cohorts;

6. That, before the buy-bust operation was conducted, on our briefing

prior to the operation, I, PO3 MARK ANTHONY J. AMIN, was
designated as police poseur-buyer and will be introduced by the said
confidential informant to NANCY to buy shabu in the amount of
Three Hundred Peso bill (P 300.00) or three (3) pieces P 100.00 bill
as buy bust money, with serial nos. AH298780, EQ885345 and
 EB654871 while PO1 JOMER M GUINGONA and SPO1 ALEX
FORTES will act as immediate back up to the poseur buyer and the
rest of the team will act as perimeter guard and secure the area;

7. That, the buy-bust money was given to me by Chief CPDEU PINP

EDWIN GO and also pre-arranged to my companions when I bought
illegal drugs and pay the same to the target person NANCY;

8. That, at about 9:45 P.M. of September 09, 2018, after we were

dispatched from our police blotter, our team immediately proceeded
and parked our vehicle along Lourdes Street, Brgy. Ermitaño, San
Juan City, and I together with the confidential informant alighted from
the said vehicle while the rest of the team positioned themselves
strategically where they can see the transaction between me and the
target person NANCY;

9. That, upon arriving in front of No. 34 Lourdes Street, Brgy. Ermitaño,

San Juan City, the confidential informant went inside the compound
while I was waiting for them. Suddenly the confidential informant and
the subject where wearing a sando and short pants went out of the
gate. Therefore, the confidential informant introduced me to NANCY
to wit “TRPOA KO, GUSTO KUMUHA NG BATO.” Thus, I asked her
“PAISKOR HALAGANG TRES” which NANCY agreed. At that
instance, NANCY went inside the compound and after a few minutes
reappeared and handed me one (1) piece heat sealed transparent
plastic sachet containing undetermined quantity of white crystalline
substance of suspected shabu (later marked MJA 1 9/9/18 with
signature) to me;

10. That, while I shortly examined the plastic sachet I gave the buy bust
money (Php 300 peso bill of three (3) pieces one (1) hundred peso
bill) to NANCY as the payment for the said one piece plastic sachet
containing suspected shabu;

11. That, I then scratched my back head as agreed pre-arranged signal

to my companions and immediately arrested the suspect NANCY
while immediate back up immediately responded and helped me in
arresting NANCY;

12. That, after we confiscated all pieces of evidence and placed the
same to our left pocket, informed the suspect the cause of her arrest
for the VIOLATION OF RA 9165 Sec 5 in relation to Sec 26 and
apprised her of her constitutional rights in the vernacular words
known to them and anti-torture law but the same remain silent in the
absence of their counsel of own choice;
 13. That, she and recovered pieces of evidence were brought to
CPDEU office for inventory and the same were witnesses by Brgy.
Kagawad Apol G. Uy of Brgy. Ermitaño and DOJ representative Paul
Ty and then signed the document (Evidence Inventory Report);

14. That, we are executing this affidavit to attest to the truthfulness of

the foregoing.
