Dear Mr. Chairman:
‘This responds to your leter to the Attomey General dated February 10, 2020 regarding
the process by which the Department of Justice (Department) receives information related 10
potential or ongoing matters involving Ukraine
Asyou know, the Department typically doesnot provide information relating to ongoing
matters. However, the Department is aware of news report and public comments from
‘Members of Congress that have significantly distorted te public's understanding of the
Department’ handing of such cases. Accordingly, we ae pleased to provide the following
information to clarity the record
In light of several open matters being handled by different U.S. Attorney's Offices and
Department components that in some way potentially relate to Ukraine—the existence of which,
have been publicly reported—Deputy Attomey General Rosen has assigned Richard Donoghue,
the US. Attomey forthe Easter District of New York, to assist in coordinating such matters.
‘The Deputy Attorney General implemented ths policy to avoid duplication of efforts across
Department Offices and components, to facilitate information sharing, to ensure there are no
conflicts among potentially overlapping matters, and to efliciently marshal the resources ofthe
Department. To protect the integrity of ongoing mattors, particularly with ogpect to unsolicited
information offered tothe Department, the Deputy Attomey General has also assigned Scott
Brady, the U.S. Attomey for the Western Distit of Pennsylvania, to asis in the receipt,
processing, and preliminary analysis of new information provided by the public that may be
relevant to matters relating to Ukraine,
‘The Deputy Attomey General's efforts to coondinate matters potentially related to
Ukraine, and to provide forthe receipt of relevant information, does not circumvent the
Department's established channels. The Department regularly assigns US. Attorneys to‘coordinate or focus on certain matters, Nor da these procedures grant any individual unique
access to the Department, Indeed, any member of the public who has relevant information may
‘ontat the Department and make use of its intake proces for Ukrine-elated matters. As the
‘Aorney General has stated, the Department “has the obligation o have an open door to anybody
who wishes o provide us information that they thinks relevant"! Any individual who makes
tse ofthis process wil be treated just like anyone else who brings information to the
Departments attention. All information provided though this process wil be treated just ike
any other information provided tothe Deparment. Indeed, such information wil be carefully
vated and veucd by the Deparunent Bere invesgary sips any, are ken. The
Department remains vigilant against the significant threat of disinformation. As always, the
Department wil reject information it finds tobe non-cedible while continuing to discharge its
duty to pursue all meritorious leads and investigations.
Finally, your letter poses questions regarding a September 25, 2019 press statement by
the Department. That statement remains accurate, As Attomey General Barr has repeatedly
affirmed, he has not diseussed matters relating to Ukraine with Rudolph Giuliani.

‘may be brought othe attention ofthe Deparment going forward. The Deparment has assigned
Richard Donoghue the US. Attorney inthe Eastern District of New York (EDNY), who
curently is handling certain Ukrainerlaed mates, to coordinate exiting matters and to assess,
investigate, and adress any oer matters relating to Ukraine, including the opening of any new
lvestigation or the expansion of existing ones. Several of you already have heard fom and
spoken to U.S. Attorney Donoghue in connection with this role, and I appreciate the assistance
you have provided to dat,
Tnlight ofthe above, if you ae curently working on Ukraine-clted investigation, and
hae not aleady done s, please contact US. Attorney Donoghue to notify him of your mater
and to consult with him regarding sus that reasonably could relate to your current
investigations. Any ad all new mates relating to Uksane shall be dieced exclusively
EDNY for investigation and appropriate handling. Unless otherwise directed, existing matters
‘covered by this memorandum shall eman inthe Offices and components where they curently
are being handled, subject to ongoing consultation with EDNY.. Any widening o expasion of
existing mates shall require prior consultation with and approval by my office and EDNY.
‘We are implementing this policy t avoid duplication of efforts across Offices and
‘components, to obviate the need for decoction at later stage of potentially overlapping
investigations, and to efficiently marshal the resources of te Department to address the
appropriate handling of potentially relevant new information. As always, the Department will,
continue to purse all credible, meritorious leads and investigations. Thnk you for working
