NOTICE OF PLAINTIFFS’ ENTITLEMENT TO & COMPLIANCE WITH ORDER OF

“ADDITIONAL TIME”

DEMAND FOR FBI’S NECESSARY RETURN OF RAIDED FILES & COMPLAINT

“12/13/2010” “ORDER OF ADDITIONAL TIME TO SERVE COMPLAINT”[DOC. # 15]

1. The Hon. Magistrate Judge Landya B. McCafferty had ordered:

12/13/2010 15 ORDER granting in part and denying in part 9 Motion for for judicial
notice of FBI file. The motion is granted in part, to the extent that
plaintiffs shall have additional time to serve the complaint. The motion
is denied in all other respects. The Clerks Office is directed to provide
plaintiffs with the necessary blank summonses and waivers. Signed by
Magistrate Judge Landya B. McCafferty. (cmp) (Entered: 12/13/2010)

FBI NEEDS TO RETURN NECESSARY COMPUTER FILES AND COMPLAINT

2. Here, ‘plaintiffs shall have additional time to serve the complaint’, and the FBI needs to

return the absolutely necessary files and Complaint so that the Plaintiff whistleblowers can

actually “serve the Complaint”. Otherwise, Government Officials will continue to obstruct

justice, court access, and any ‘service of the Complaint’.

FBI OBSTRUCTED & INTERFERED WITH ‘SERVICE OF COMPLAINT’

3. After Plaintiffs had repeatedly and directly complained to the FBI and then filed their

Government racketeering Complaint on 07/29/2010, Doc. # 1, the FBI proximately and

directly obstructed and interfered with the “service of Complaint”. Here, “additional time”

alone cannot possibly cure the FBI’s obstruction, and Plaintiffs have no control over the FBI.

4. Maliciously misconstruing the rightful and privileged prosecution of Defendant corrupt

Judges and Officials since 2006 as “stalking” was on its very face

a. Unlawful and/or criminal;

b. Without any basis and/or merit;

ENTITLEMENT TO MEANINGFUL ‘ADDITIONAL TIME TO SERVE COMPLAINT’

5. Pursuant to the Rules, Plaintiffs are entitled to “serve the Complaint [Doc. # 1]” of publicly

recorded Government racketeering and corruption upon the crooked Government

Defendants. Here however, said corrupt Defendants agreed with the Federal Bureau of

Investigation in Tampa, FL, U.S.A., to raid Plaintiffs’ files, public corruption evidence,

and computer equipment for unlawful and/or criminal purposes of obstructing proper

prosecution and justice and coercing the pro se Plaintiff to refrain from any further

prosecution.

F.B.I. FILE 316A-TP-73337 – ILLEGAL SEIZURE OF COMPLAINT & CRIME PROOF

6. Here, the Governmental raid, F.B.I. file 316A-TP-73337, and illegal seizure of tools

essential to litigation were for facially unlawful purposes of, e.g.:

a. Intimidation of the Plaintiff Government corruption victims;

b. Racketeering and extortion of, e.g., Plaintiffs’ Gulf-front lands and easements, Lot 15A;
c. Extortion of more than $5,000 under false pretenses of “frivolity” and a purported non-
existent “judgment”;
d. Retaliation and oppression of the pro se Plaintiff whistleblowers.

CIVIL RICO ENTITLED PLAINTIFFS TO COMPLAIN ABOUT CRIMINAL ACTS

2
7. Here expressly, civil RICO had invoked jurisdiction over Defendant crooked Officials’

racketeering and criminal acts. Here under color of a “criminal investigation”, Defendant

corrupt Officials have been extending their record crimes, concealment, and cover-up.

RECORDED EXTORTION OF LAND (LOT 15A) AND MONEY; CONSPIRACY

8. Under fraudulent pretenses of, e.g., purported “frivolity”, and “criminality” of Plaintiffs’

multi-year litigation, Defendants conspired to extort Plaintiff’s Gulf-front Lot 15A, Parcel #

12-44-20-01-00015.015A, Lee County, FL, and more than $5,000.00 without any

justification. Here frivolously and illegally, Lee County had “claimed” private Gulf-front

easements and lands in the private “Cayo Costa” Subdivision on Cayo Costa Island, Lee

County, FL, under color of publicly recorded fraud and extortion scheme “O.R. 569/875”.

See attached fraud & racketeering scheme “O.R. 569/875”; www.leeclerk.org.

CHARADE OF COURT ACCESS AFTER FBI RAID:

A CONFISCATED COMPLAINT CANNOT POSSIBLY BE “SERVED”

9. Here after Plaintiff whistleblowers had filed their Government racketeering Complaint,

Tampa FBI Officials physically confiscated and conspired with other Officials to

confiscate Plaintiffs’ Complaint files and public corruption evidence, because a

confiscated Complaint can simply not be “served”. Under the law, Plaintiffs have been

entitled to meaningful prosecution, and access to the Court(s) and their computer files and

Complaint. Here, said confiscation turned Plaintiffs’ fundamental Constitutionally protected

rights into a charade.

PLAINTIFFS FEAR FOR THEIR LIVES - RECKLESS GOVERNMENT RETALIATION

10. Because over 40 (forty) Cases since 2006 had exposed an entire judicial system to be

corrupted, Defendant Government Officials and Judges resorted to retaliation, multi-year

3
threats, coercion, and further racketeering acts against the Plaintiff whistle-blowers.

However here, the publicly recorded proof of cover-up and concealment of facially

fabricated land parcels “lot A” and “block 1” exposed ever-increasing screaming fraud on

the Court(s). See, e.g., Lee County Plat Book 3, Page 25 (1912) and attached fake “parcels”

a. 12-44-20-01-00000.00A0 and

b. 07-44-21-01-00001.0000. See published fraud at www.leepa.gov.

JUDICIAL LIES & PUBLIC CORRUPTION ON THE RECORD

11. Here, said 1912 “Cayo Costa” Plat of Survey did not lie but corrupt Judges and Officials

lied. Only public corruption can explain WHY in more than 40 Cases since 2006 judge

after judge and official after official “dismissed” and concealed public corruption

Complaints and the fabrications and forgeries of said fake land parcels.

CONCEALMENT OF JUDICIAL LIES & PERVERSIONS OF A “resolution”

FRAUD & RACKETEERING SCHEME “O.R. 569/875”

12. Here, Defendant Government Officials conspired to conceal on the public record that, e.g.:

a. No lawmaker could possibly involuntarily divest private land owners without a court

order and/or judicial proceedings;

b. No legislator could possibly “transfer” Plaintiffs’ unimpeachable record title to Lot 15A

against their will by illegal means of a “legislative act” or “resolution O.R. 569/875”;

c. No Official had any authority to fabricate fake “lot A” and “block 1”, which had never

appeared on the public “Cayo Costa” Subdivision Plat in Lee County PB 3 PG 25 (1912).

RETALIATION & “RUSE” – NO probable cause

13. Here under false pretenses of a “criminal investigation” and without any probable cause,

Government Officials had engaged in an admitted “ruse” when they deceptively “reported”

4
a fictitious break-in into Plaintiff(s)’ real estate. Upon Plaintiff’s arrival at the property,

armed FBI agents appeared with crowbars and demanded Plaintiffs’ prosecution materials

and computing gear. However, Plaintiff(s) asserted that they had fundamental rights and

privileges under, e.g., the 1st, 4th, 14th, 7th, and 5th U.S. Constitutional Amendments. Here

under both the Florida and Federal Constitutions, Plaintiffs have fundamental rights to, e.g.:

a. Sue corrupt Government Officials;

b. Serve their Complaint despite unlawful FBI obstruction & interference;
c. Redress Government grievances and racketeering & public corruption, Doc. # 1;
d. Own property;
e. Exclude Government from private property;
f. Defend against illegal seizure and invasion of privacy without any probable cause;
g. Defend against malicious criminalization of privileged activities and prosecution.

CRIMINALIZATION OF RIGHTFUL PROSECUTION OF PUBLIC CORRUPTION

14. By unlawfully criminalizing rightful prosecution of public corruption and Constitutionally

protected and privileged activities in the absence of any “credible threat” and probable

cause, Government Officials steamrolled and flattened the Plaintiffs just like bloody tanks

of Government oppression rolled over dissidents and whistleblowers in dictatorial regimes.

See Plaintiffs’ publications worldwide; e.g., www.youtube.com; www.scribd.com;

www.google.com.

ABSOLUTE AND INDISPUTABLE “GROUNDS” – FRAUD ON THE COURT(S)

15. Here, it has been indisputable that said FBI raid deliberately deprived the Plaintiffs of said

fundamental rights and kept them away from the Court(s). Here because of said massive

fraud on the Court(s), the Plaintiffs were given “additional time” to pursue prosecution and

justice and reclaim their files and Complaint from the FBI.

5
HISTORY OF JUDICIAL OBSTRUCTION OF JUSTICE & PROPER PROSECUTION

16. Under the Florida and Federal Constitutions, the FBI is not authorized to hold up prosecution

in State and Federal Courts by threatening the Plaintiffs and illegally seizing their litigation

materials. Here, e.g., corrupt Judges John Edwin Steele and Sheri Polster Chappell had

themselves removed Plaintiffs’ Case from Florida to Federal Court. See Plaintiffs’

prosecution of, e.g., Judges Steele and Polster Chappell in Florida State Court Case # 2006-

CA-003185, BUSSE et al. v. STATE OF FLORIDA et al.

“ADDITIONAL TIME” FOR FBI’S RETURN OF COMPLAINT & EVIDENCE FILES

17. Here so far, the FBI in Tampa has not yet returned Plaintiffs’ seized computer evidence and

files, which are absolutely essential to the Plaintiff Government corruption victims for their

privileged and Constitutionally protected prosecution of Defendant crooked Government

Officials. Rightfully prosecuting said Government crooks and “serving the complaint” upon

them are privileged and Constitutionally protected activities.

FBI’S PHYSICAL REMOVAL OF COMPLAINT FILES TO KEEP PLAINTIFFS AWAY

18. Here, the FBI agreed to physically remove Plaintiffs’ Complaint files and incapacitate the

Plaintiffs for criminal and/or unlawful purposes of e.g.:

a. Coercing the Plaintiffs to refrain from any further prosecution after more than 40 Cases;
b. Keeping the Plaintiffs away from Court;
c. Concealing and covering up for crooked Judges and Officials in over 40 Cases.
d. Perpetrating fraud upon the Court;
e. Obstructing justice and rightful prosecution of Defendant Government crooks;
f. Expanding record Government racketeering and corruption.

If corrupt Government Defendants can simply agree and/or conspire with the FBI to

unlawfully confiscate pro se Plaintiffs’ prosecution materials and files, the floodgates of

Government corruption in the United States will only open further and wider:

g. WHAT more “grounds” is and could the Court possibly be looking for?

6
h. WHAT better and latest “new grounds” could the Court possibly desire?
i. WHAT further conclusive proof and grounds could the Court possibly ask for?

MORE THAN 40 (FORTY) CASES HAD PROVEN GOVERNMENT CORRUPTION:

PRIMA FACIE ILLEGALITY & NULLITY OF FAKE “land parcels”

19. In more than 40 (forty) Cases of record, the Plaintiffs had indisputably evidenced the

fabrications of land parcels, cover-up, and concealment of Government corruption in the

United States. Here, no reasonable person, juror, and/or judge could possibly believe that the

“dismissals” in over 40 Cases have been any coincidence but premeditated acts of

concealing and conspiring to conceal the prima facie illegality and nullity of fabricated

land parcels and “legal descriptions” such as, e.g., 12-44-20-01-00000.00A0 and 07-44-21-

01-00001.0000. See attachments.

JUDICIAL AND OFFICIAL CONCEALMENT OF BOGUS “legal descriptions”

20. No reasonable juror, judge, and/or person could possibly not determine the fake “legal

descriptions” of fake “lot A” and fake “block 1” to be facially fraudulent and forged:

“ALL UN-NUMBERED + UNDESIGNATED LOTS IN CAYO COSTA…”

“CAYO COSTA PB 3 PG 25 ALL UNNUMBERED AND ACCRETED LANDS”

NO probable cause – STEAMROLLING PLAINTIFF WHISTLE BLOWERS

21. Here, one brief review of the 1912 “Cayo Costa” Subdivision Plat of Survey in Lee County

Plat Book 3, Page 25 evidenced the brazen concealment of said Government fabrications

and racketeering.

7
ENDEMIC CORRUPTION EVIDENCE – 2007 COURT TRANSCRIPT

22. Here as early as 2007, the Transcript of Corrupted Judicial Proceedings, November 7, 2007,

before Crooked Magistrate Sheri Polster Chappell proved the endemic judicial corruption

in Florida’s Middle District. See attachments.

HUNDREDS OF THOUSANDS OF READERS OF PUBLIC CORRUPTION EVIDENCE

23. After hundreds of thousands of readers and listeners had taken notice of the published

Government corruption evidence, the FBI illegally interfered and seized the published

litigation materials. Here, the very Government retaliation and steamrolling the Plaintiffs

had predicted in their worldwide publications actually took place.

FEARFUL PLAINTIFFS HAVE CONTINUED THEIR LITIGATION FROM ABROAD

24. Following said retaliatory FBI seizure of Plaintiffs’ evidence and files, the Plaintiffs have

been in, e.g., Europe, Dubai, Australia, and Australasia because they must credibly fear

further retaliation by corrupt U.S. Officials.

CORRUPT JUDGES/OFFICIALS COVER UP FOR CORRUPT JUDGES IN FLORIDA

25. Here, said “search warrant [Case No. 8:10-mj-1416 (AEP)]” improperly:

a. Originated in said corrupt Court/Government system (Middle District of Florida);

b. Was signed by a partial “judicial officer” and/or judge (U.S. Magistrate Anthony E.

Porcelli, Tampa, FL, U.S.A.), who had been presiding over Plaintiffs’ prosecution of

Defendant fellow Judges for fraud in said corrupt Court system;

c. Was yet another fraud upon the Court and deliberately deprived the pro se Plaintiffs

of their fundamental Federal and Florida Constitutional rights to defend against

Government, corruption, oppression, and fraud.

8
26. Here corruptly and conveniently, Defendant Tampa Prosecutor A. Brian Albritton and

Presiding Tampa Magistrate Anthony E. Porcelli agreed to criminalize Plaintiffs’ exercise of

their fundamental Constitutional rights. Here, piecemeal litigation and compartmentalization

will not be accepted as unlawful means to further conceal these Government crimes.

FRAUDULENT AFFIDAVIT(S) FOR RACKETEERING & EXTORTION PURPOSES

27. Defendant Kenneth M. Wilkinson, Lee County Property Appraiser, conspired with other

Defendants and Officials to conceal the prima facie nullity and illegality of, e.g., fake “lot

A” and “block 1”. See said 1912 “Cayo Costa” Subdivision Plat, PB 3 PG 25.

28. Here by means of fraudulent “INSTRUMENT # 2009000309382”, Lee County, FL,

Defendant Kenneth M. Wilkinson concocted a fake “July 29, 2009” judgment for unlawful

purposes of, e.g., extorting and/or forcing the illegal sale of Plaintiffs’ Lot 15A. See

attachment.

PLAINTIFFS’ ENTITLEMENT TO SUE & REDRESS THEIR RECORD GRIEVANCES

29. Under the Rules of Civil Procedure, the Plaintiff racketeering victims are entitled to

redress their Government grievances under, e.g., the 1st, 4th, and 14th U.S. Constitutional

Amendments:

a. Without Government intimidation and threats;

b. Without fear of Government retaliation and racketeering;
c. With the use of their illegally seized computer equipment and evidence against the
Defendant Officials.

1. An Order declaring Plaintiffs’ fundamental entitlement to sue Defendant Government

Officials and have access to the files and Complaint illegally seized by the Tampa FBI

during litigation;

2. An Order declaring Plaintiffs’ fundamental Constitutionally protected rights to redress

Government grievances and have access to the Court as well as their files and Complaint,

Doc. # 1, after said illegal FBI raid;

3. An Order mandating the Government’s return of Plaintiffs’ computer files and Complaint

in order to protect Plaintiffs’ said privileges and rights under both the Florida and Federal

Constitutions during the “additional time” granted in said Order;

4. An Order declaring Plaintiffs’ fundamental rights to defend against the unlawful

criminalization of rightful litigation by criminal and/or unlawful means of confiscating

prosecution materials during said FBI raid;

5. An Order declaring the self-serving agreement between Defendant Tampa Prosecutor A.

Brian Albritton, Presiding Tampa Magistrate Anthony E. Porcelli, and other Defendant

Officials to criminalize Plaintiffs’ exercise of their fundamental Constitutional rights

outright unlawful and violative of the separation-of-powers doctrine;

6. An order declaring unlawful and/or criminal the conspiracy to extort and force the sale of

said Lot 15A under false pretenses of, e.g., “frivolity”, “criminality” and/or “stalking”;

10
7. An Order taking judicial notice of the absolute impossibility of proceeding with this and

other rightful litigation unless Plaintiffs have access to the files and Complaint unlawfully

seized by the FBI, file # 316A-TP-73337;

8. An order enjoining any further racketeering / corruption in said Middle District of Florida,

which interferes with and obstructs this litigation, and in particular, said extortion of

a. Lot 15A, PID 12-44-20-01-00015.015A; and

b. more than $5,000 without any court order;

9. An Order declaring unlawful the act of misconstruing rightful litigation as “stalking” for

illegal purposes of obstructing justice and interfering with the “service of complaint” in this

Case;

10. An order declaring Plaintiffs’ perfected record ownership of said Lot 15A, PB 3 PG 25

(1912), Parcel 12-44-20-01-00015.015A, and fundamental rights to defend said ownership

against Government racketeering by ‘serving the Complaint’ created on Plaintiffs’ seized

computers;

11. An order declaring prima facie fake Government “claim” “O.R. 569/875” facially unlawful

and facially violative of both the Federal and Florida Constitutions.

hearing. Even when consolidation is not ordered, evidence that is received
on the motion and that would be admissible at trial becomes part of the trial
record and need not be repeated at trial. But the court must preserve any
party's right to a jury trial.

(b) Temporary Restraining Order.

(1) Issuing Without Notice.

The court may issue a temporary restraining order without written or oral
notice to the adverse party or its attorney only if:

(A) specific facts in an affidavit or a verified complaint clearly show that

immediate and irreparable injury, loss, or damage will result to the movant
before the adverse party can be heard in opposition; and

(B) the movant's attorney certifies in writing any efforts made to give
notice and the reasons why it should not be required.

(2) Contents; Expiration.

Every temporary restraining order issued without notice must state the date
and hour it was issued; describe the injury and state why it is irreparable;
state why the order was issued without notice; and be promptly filed in the
clerk's office and entered in the record. The order expires at the time after
entry — not to exceed 14 days — that the court sets, unless before that
time the court, for good cause, extends it for a like period or the adverse
party consents to a longer extension. The reasons for an extension must be
entered in the record.

(3) Expediting the Preliminary-Injunction Hearing.

If the order is issued without notice, the motion for a preliminary injunction
must be set for hearing at the earliest possible time, taking precedence over
all other matters except hearings on older matters of the same character. At
the hearing, the party who obtained the order must proceed with the
motion; if the party does not, the court must dissolve the order.

(4) Motion to Dissolve.

On 2 days' notice to the party who obtained the order without notice — or
on shorter notice set by the court — the adverse party may appear and
move to dissolve or modify the order. The court must then hear and decide
the motion as promptly as justice requires.

(c) Security.
The court may issue a preliminary injunction or a temporary restraining order
only if the movant gives security in an amount that the court considers proper
to pay the costs and damages sustained by any party found to have been
wrongfully enjoined or restrained. The United States, its officers, and its
agencies are not required to give security.

(d) Contents and Scope of Every Injunction and Restraining

Order.
(1) Contents.

Every order granting an injunction and every restraining order must:

(A) state the reasons why it issued;

(B) state its terms specifically; and

(C) describe in reasonable detail — and not by referring to the complaint or

other document — the act or acts restrained or required.

(2) Persons Bound.

The order binds only the following who receive actual notice of it by
personal service or otherwise:

(A) the parties;

(B) the parties' officers, agents, servants, employees, and attorneys; and

(C) other persons who are in active concert or participation with anyone
described in Rule 65(d)(2)(A) or (B).

(e) Other Laws Not Modified.

(1) any federal statute relating to temporary restraining orders or preliminary
injunctions in actions affecting employer and employee;

(2) 28 U.S.C. § 2361, which relates to preliminary injunctions in actions of

interpleader or in the nature of interpleader; or

(3) 28 U.S.C. § 2284, which relates to actions that must be heard and
decided by a three-judge district court.

(f) Copyright Impoundment.

This rule applies to copyright-impoundment proceedings.

Presseschau zu WikiLeaks

"Massenvernichtungswaffe gegen das

Vertrauen"
T ausender diplom atischer Dokum ente v or allem die US-Außenpolitik beschädigt.

"Lunte ans Pulverfass legen"

"Eine riesige Blamage für die amerikanische Diplomatie sind nicht die Inhalte", betont die "Neue
Westfälische", "sondern die Tatsache, dass sie an die Öffentlichkeit gelangt sind. Mit wie v iel kindlichem
Glauben an V orschriftenhörigkeit, Wohlv erhalten und V erschlüsselungstechnik muss man ausgestattet sein,
wenn man im Jahr 201 0 glaubt, über das Internet v erbreitete Daten geheim halten zu können? Muss man das
State Department für so ausgesprochen tumb halten?

hohes Maß an Transparenz aufweisen.

angeblichen Botschaftsberichten sind, was für ihre A uthentizität spricht, wenig originell. 'Mutti' risikoscheu,

wieder: Mehr Demokratie wagen!"
