Subject: RESOLUTION NO. 2018-2495 OF THE SANGGUNIANG PANLALAWIGAN

OF BUKIDNON, OTHERWISE KNOWN AS A RESOLUTION SUPPORTING
HOUSE BILL NO. 7424 INTRODUCED BY HONORABLE CONGRESSMAN
MANUEL F. ZUBIRI

Sir:

Local government units in the Philippines are vested with the local legislative power by
Republic Act 7160, otherwise known as the Local Government Code of 1991. Section
48 of said Act provides that “Local legislative power shall be exercised by the
sangguniang panlalawigan for the province; the sangguniang panlungsod for the city;
the sangguniang bayan for the municipality; and the sangguniang barangay for the
barangay.”

It is clearly stated that the Sangguniang Panlalawigan of Bukidnon performed its

mandate provided by the aforementioned Code by passing a resolution, which is
expressive of the opinion of said legislative body concerning a given matter. In this
case, said resolution was passed to convey SP Bukidnon’s support to House Bill 7424
introduced by Congressman Manuel F. Zubiri.

Moreover, Section 25 of Article II of the 1987 Philippine Constitution provides that

“The State shall ensure autonomy of local governments.” The enactment and the
passage of a resolution is a glaring manifestation of the fruition of the State’s declared
policies. Also, enhancing the autonomy of local governments is basically the main
thrust upon which the Local Government Code of 1991 is anchored.

Thus, in view of the abovementioned facts, our office was able to ascertain that
Resolution No. 2018-2495 is not contrary to regulation, law or the Constitution.
