BARANGAY ORDINANCE NO.

01, Series of 2010

AN ORDINANCE PRESCRIBING RULES AND GUIDELINES FOR THE


PROTECTION OF THE ENVIRONMENT FROM STRAY ANIMALS AND
PROVIDING PENALTIES FOR VIOLATIONS THEREOF

BE IT ORDAINED, by the Sangguniang Barangay of Barangay Panapaan VII,


Municipality of Baccor, Province of Cavite, in session assembled, that:

SECTION 1. TITLE. – An ordinance prescribing rules and guidelines for the


protection of the environment from stray animals and providing penalties for
violations thereof.

SECTION 2. REGULATED ACTS. – No dogs, cattle, swine, goat and any other
members of the bovine family shall be allowed to stray in any public places, plaza or,
streets.

SECTION 3. DEFINITION OF TERMS. – The following terms are hereby defined as


follows:

a. CATTLE – includes horse, mule, ass, carabao and other domesticated member of
the bovine family.

b. DOG – a common quadruped domestic animal belonging to the order carnivora


(male or female), scientifically known as canis familiaris.

c. IMPOUND – refers to seize and hold in the custody of the law.

d. OWNER - refers to any person keeping, harboring or having charge, care or control
of an animal enumerated above including his/her representative.

e. POUND - refers to a public enclosure for stray animals.

f. PUBLIC PLACE -- refers to any place open to the public like parks, malls, markets,
streets, etc.

g. STRAY ANIMALS - refers to any animal enumerated leaving its Owner's place or
premise and no longer under the effective control of the Owner.

SECTION 4. IMPOUNDING OF STRAY ANIMALS - Stray animals, when caught,


shall be put in pounds, corral or place duly designated for such purpose taking into
consideration the following guidelines:

a. Not later than the following day after the animal is impoundedImpounded animals
not claimed after 3 days

POSSESSION OF DOGS. – Any person or institution is allowed only to own not


more than four (4) registered and vaccinated dogs. However, a person or institution
may be allowed to own more than four (4) dogs provided, they will pay an “excess
dog tax” of Twenty Five Pesos (P 25.00) for each excess dog and provided further,
that they can provide and appropriate care and management to the animal.

SECTION 4. REGISTRATIOON AND VACCINATION OF DOGS. – It shall be


unlawful for any person or institution to keep an unregistered, unvaccinated and
unsecured dog within their territorial domain. All dogs owned three (3) months old
and above shall be registered and vaccinated. Dog registration and vaccination shall
be undertaken by the office of the Municipal Agriculturist in each manner that it will
be feasible, convenient and safe to all concerned. After vaccination, owners will be
provided with certificates of vaccination which will serve as proof of compliance.

A registration fee of Fifty Pesos (P 50.00) per dog shall be collected which shall
include a dog tag and vaccination.

Owners should present their dog for registration and vaccination every two years.

SECTION 5. LEASHING AND PROPER KEEPING OF DOGS. – All dogs must be


properly kept on leash within the premises of the owner. Dogs that are brought
outside the owner’s premises shall be at all times be leashed and appropriately
muzzled, otherwise the dog will considered a stray dog.

SECTION 6. IMPOUNDING OF STRAY DOGS. – Dogs found outside the premises


of the owner, are considered stray dogs. Stray dogs are immediately secured for
impounding at the dog pound.

An impounding fee of P10.00 per day per dog will be collected from the owner
claiming his dog.

SECTION 7. ADOPTION OF IMPOUNDED STRAY DOGS. – Unregistered dogs


confined within three (3) days in the impounding area can be adopted by any person
provided that he will pay for the registration and impounding fee of the animal and
provided further, he can provide proper and appropriate care and management to the
animal.

SECTION 8. CONSTRUCTION OF A BARANGAY DOG POUND. – The barangay


shall construct a safe and clean dog pound taken from the barangay fund. The
maintenance of the dog pound shall be taken from the barangay’s 50% share on all
fees and fines collected within their jurisdiction.

SECTION 9. DISPOSAL OF IMPOUNDED STRAY DOGS. – Impounded stray dogs


which are not claimed after three (3) days are considered abandoned by its owners and
are subsequently be disposed by gas poisoning or poisoned baiting or in such other
legally and morally acceptable manner.

SECTION 10. AGENCIES / OFFICES TO ENFORCE AND IMPLEMENT THIS


ORDINANCE. – The following agencies/office are tasked and enjoined to provide
assistance and utilize all its available resources as are necessary for the
implementation and enforcement of this ordinance.

Coordinating Agencies and Offices
1. Philippine National Police
2. Rural Health Unit / DOH
3. Barangay Officials

SECTION 11. BARANGAY SHARE ON PROCEEDS OF FEES AND FINES. – The


Barangay is entitled to fifty percent (50%) share on all fees and fines collected within
their jurisdiction.

SECTION 12. LIABILITY OF DOG OWNERS OR OS PERSONS IN POSSESSION


OF DOGS. – Dog owners or any person or institution in possession of a dog shall be
civilly liable for any injury or damage that the dog may cause to another person,
although it may have escaped or got lost, except where the injury should come from
the fault of the person who suffered the injury, for example, trespass to dwelling or
violation of domicile.

SECTION 13. PENALTY CLAUSE. – Any person or institution found guilty of


violating any of the provision of this Ordinance shall be penalized with:

13.1 – Fine of not less than P500.00 but not more than P1,000.00 on the first offense;
13.2 – Fine of not less than P1,000.00 but not more than P1,500.00 on the second
offense;

13.3 – Fine of not less than P1,500.00 but not more than P2,000.00 on the third
offense.

SECTION 14. SEPARABILITY CLAUSE. – If any provision of this Ordinance is


declared unconstitutional, other provision or parts thereof not declared as such shall
remain valid and enforceable.

SECTION 15. REPEALING CLAUSE. – Ordinances, Resolutions, and other


issuances inconsistent with this Ordinance are hereby repealed or modified
accordingly.

SECTION 16. EFFECTIVITY. – This Ordinance shall take effect after compliance
with the provisions of Section 59 of RA 7160, otherwise known as the Local
Government Code of 1991.
