Background
New Law

• SWMPC Act 2007 approved by Parliament on 17 July


2007 and gazetted on 30th August 2007

• Provide executive power to the Federal Government to


implement solid waste management and public cleansing

• Will come into effect first quarter of 2008

• Applicable throughout the Peninsular, Federal Territories


of Putrajaya and Labuan

1. Department of National Solid Waste Management

Propose policies, plan and strategies


Exercise regulatory functions
Grant licenses and approval,
Set standards, specifications and codes of practices

2. Solid Waste and Public Cleansing Management


Corporation
Recommend and implement policies, strategies and
enforce the law and regulations
Background

Privatisation

Cabinet decided that full privatisation will be


carried out in the Central and Southern Region
while the North will be under interim regime for
a year

3rd Outline Perspective


Plan (2001-
(2001-2010)

The government will consider the adoption of a


comprehensive waste management policy
including the installation of incinerators for safe
and efficient disposal of waste as well as to
formulate strategies for waste reduction, reuse and
recycling

9th Malaysia Plan


• National Strategic Plan for Solid Waste
Management will be implemented

• upgrading of unsanitary landfills as well as the


construction of new sanitary landfills and transfer
stations with integrated material recovery
facilities.

• Legislation to streamline the strategies and


measures in the Strategic Plan will be enacted. 7

• A solid waste department will be established to


implement these measures and to administer
solid waste policy, planning and management in
a holistic manner

Aims :

To establish a comprehensive, integrated,


cost-effective, sustainable and socially
acceptable of SWM; and

To implement SWM based on waste


management hierarchy that give priority to
waste reduction through 3R, intermediate
treatment and final disposal

ACT 2007
• Aim: To provide for and regulate the management of controlled solid waste
and public cleansing for the purpose of maintaining proper sanitation and
for matters incidental thereto

• Application: Peninsular Malaysia, Federal Territories of Putrajaya and


Labuan

• Definition of Solid Waste:

- any scrap material or other unwanted surplus substance or


rejected products arising from the application of any process;

- any substance required to be disposed of as being broken,


worn out, contaminated or otherwise spoiled; or

- any other material that is required by the authority to be 12


disposed of

• SWM services: separation, storage, collection, transportation,
transfer, processing, recycling, treatment and disposal of
controlled solid waste

• Controlled solid waste: 8 categories


- commercial, construction, household, industrial, institutional,
imported, public and others which can be prescribed from time
to time.

• Provides the function and authority for the DG


- policy, plan, strategies on SWM
- standards, specification and guidelines
- monitoring
- giving approval and license

• Control of solid waste generators and persons in


possession of controlled solid waste:

- Waste to be separated, handled and stored

• Reduction and recovery of controlled solid waste:


- Prescribed recycling and separation of recyclables
- Take back system and deposit refund system

• provides power for Federal Government to enter into


agreement with any person to undertake,manage,
operate and carry out solid waste management services
or public cleansing

• Establishing PSP Tribunal to enable the various stake


holders to lodge claim concerning his interest or any loss
suffered,

Strategies

• Immediate Safe closure of 16 landfills that are


in critical areas;

• Upgrading of non sanitary landfills

• Building new sanitary landfills

• Building MRF, incinerators

• Enhance Quality of Services : KPI, Monitoring
and Quality Control; courses and training

• Improve delivery system – inventories and


database, clear guidelines and regulations

• Public awareness and information dissemination
