AMENDED CLASS ACTION COMPLAINT

COMES NOW the Plaintiffs, Sac and Fox Nation of Oklahoma, the NAGPRA and Cultural

Resources Committee of the Sac and Fox Nation of Oklahoma, and Richard Black (as an individual and

as appointed Repatriation Agent for The Sac and Fox Nation of Oklahoma) on behalf of themselves

and the Class described herein and for their complaint, allege as follows:

Preliminary Statement

1) This is an action for injunctive relief, declaratory judgment, and for a judgment of damages pursuant to

42 U.S.C. § 1983. Plaintiffs Sac and Fox Nation of Oklahoma (Nation), the NAGPRA and Cultural

Resources Committee of the Sac and Fox Nation of Oklahoma (Committee), Richard Black, and the

3,115 individual members of the Sac and Fox Nation of Oklahoma as listed in complaint exhibit “A”

attached hereto, bring an action pursuant to § 3013 of the Native American Graves Protection and

Repatriation Act (NAGPRA), 25 U.S.C. §§ 3001-3013 individually and as representatives of the

class as described herein, they ask this court for an order prohibiting the defendants from further

actions, or omissions, which violate federal law protecting gravesites, Native American remains, and

sacred objects; an order enjoining the named Defendants from committing present and future violations of

NAGPRA; a declaratory judgment that the defendants are museums, as defined by 25 U.S.C. §§ 3001-

3013; and are in violation of provisions of NAGPRA by not compiling, completing and filing the required

inventories; and damages under 25 U.S.C. § 1983 for compensation of lost remains, cultural items and

protected funerary objects under NAGPRA; as well as for damages arising out of procedural violations of

NAGPRA since 1990. Plaintiffs also seek judgment against the defendants for costs of this action,

including reasonable attorneys fees and expert witness fees authorized by the Department of the Interior

regulations, 43 CFR § 10.12 (d) (ii), and 25 U.S.C. § 1983. Defendants have violated NAGPRA by

failing to notify Plaintiffs or the members of the class that Native American human remains have been

removed from their burial sites by the defendants. The defendants refused to and have failed to consult in

the compilation of an inventory of Native American human remains and cultural items in the custody of the

Defendants. Defendants have failed and continue to fail to consult with Plaintiff and the members of the

class in the determination of cultural affiliation of Native American human remains in Defendant’s custody,

and by failing to repatriate those remains and cultural items to Plaintiffs and other culturally affiliated tribes

in accordance with NAGPRA. Defendants are not in compliance with the inventory requirements of

NAGPRA and have failed to publish such an inventory with the National Park Service as required by

NAGPRA since at least 1993. Defendants have failed and continue to fail to protect, guard, respect the

sanctity of the Native American remains and funerary objects and have allowed the transfer of such items

out of their custody to non-tribal delegates in violation of NAGPRA resulting in the loss of ancestral

remains that can never be retrieved.

2) Defendants’ persistent and willful failure to adhere to the dictates of NAGPRA, despite repeated and

exhaustive requests from the Plaintiffs and its representatives amount to the substantial infringement on and

impairment of rights of substance and procedure secured to Plaintiffs and the members of the class

under the laws of the United States. Plaintiffs thus bring an action, individually and on behalf of the

class, against the named Defendants pursuant to 42 U.S.C. § 1983 seeking an injunction against present

and future violations, and seeking monetary damages, punitive damages and attorneys fees as

compensation for violations in the past.

2 a) The Defendants owe duties to the Plaintiffs and the Class Members as mandated by

NAGPRA, 25 U.S.C. § 3001-3013, and 43 C.F.R. part 10. The Defendants have breached their

duties to the Plaintiffs and Members of the Class in the following ways:

a) The Defendants have failed to consult with the Plaintiffs and with Members of the Class

before making an inventory as required by NAGPRA, 25 U.S.C. § 3003, 43 C.F.R. § 10.9

(b)(2)

b) The Defendants have failed to construct an inventory as required by NAGPRA, 25

U.S.C. § 3003, 43 C.F.R. § 10.10(f)

c) The Defendants have failed to construct a summary as required by NAGPRA, 25 U.S.C.

§ 3004, 43 C.F.R. § 10.8

d) The Defendants have failed to consult with Plaintiffs and Members of the Class prior to

determining cultural affiliation as required by NAGPRA, 25 U.S.C. § 3004, 43 C.F.R. §

10.9 (b) (2).

e) The Defendants have failed to consult with Plaintiffs and Members of the Class in

making the inventory as required by NAGPRA, 25 U.S.C. § 3003, 43 C.F.R. § 10.9.

f) The Defendants have failed to request information from the Plaintiffs and Members of

the Class during the inventory process as required by NAGPRA, 43 C.F.R. § 10.9 (b) (4).

g) The Defendants have failed to initiate consultation with the Plaintiffs and Members of

the Class as required by NAGPRA, 43 C.F.R. § 10.9 (b) (2).

h) The Defendants have failed to consult with Plaintiffs and Members of the Class in

making the summary as required by NAGPRA, 43 C.F.R. § 10.8 (d).

i) The Defendants have failed to request information from Plaintiffs and Members of the

Class during the summary process as required by NAGPRA, 43 C.F.R. § 10.8 (d) (4).

j) The Defendants have failed to send Notice of Inventory Completion to the Secretary of

the Interior / Departmental Consulting Archaeologist as required by NAGPRA, 25 U.S.C.

§ 3003, 43 C.F.R. § 10.10 (e)(4).

k) The Defendants have failed to complete summaries by November 16, 1993 as required

by NAGPRA, 25 U.S.C. § 3004, 43 C.F.R. § 10.8 (c).

l) The Defendants have failed to complete inventories by November 16, 1995 as required

by NAGPRA, 25 U.S.C. § 3003 (d), 43 C.F.R. § 10.9 (f).

m) The Defendants have failed to include in the inventory the information required by 43

C.F.R. § 10.9 (c), including but not limited to the results from consultation as required by

NAGPRA.

n) If after consultation has taken place, and after the filing of a legitimate inventory, the

Defendants have failed in repatriating culturally affiliated remains and items to the

Plaintiffs and the Members of the Class as required by NAGPRA, 25 U.S.C. § 3005, 43

C.F.R. § 10.10.

o) If after consultation has taken place, and after the filing of a legitimate inventory, the

Defendants have failed to allow the Plaintiffs and the Members of the Class an

opportunity to request repatriation of remains and items they can show are affiliated with

them, 25 U.S.C. § 3005, 43 C.F.R. § 10.10.

p) The Defendants breached their duties to the Plaintiffs and the Members of the Class by

transferring remains or items in violation of NAGPRA, 43 C.F.R. § 10.12 (b) (i).

q) The Defendants have breached their duties to the Plaintiffs and the Members of the

Class by transferring remains or items without publishing a notice in the Federal

Register, 43 C.F.R. § 10.12 (b)(vi).

PARTIES

3) Plaintiff, and class representative, Sac and Fox Nation of Oklahoma (Nation) is a federally

recognized Indian Nation with its main office in Stroud, Oklahoma, and with substantial aboriginal and

historic range in Northeastern Missouri. The Nation holds multiple land title claims in the State of Missouri

were violations have occurred or are presently pending. This action is brought by the individual members

of the Sac and Fox Nation of Oklahoma on their own individual behalves and on behalf of the Nation as a

whole. For purposes of this suit, and at trial, the individual plaintiffs named in attachment “A” designate the

members of the business committee as their representatives with all rights of determination until this action

is completed.

4) Plaintiff, and class representative, NAGPRA and Cultural Resources Committee of the Sac and

Fox Nation is a separate entity created by the Nation’s Business Committee to assure the continued

protection and sanctity of the Nation’s ancestors, their burial sites and other related resources important

and sacred to the Nation. The committee is made up of individual members of the Nation and it is these

individuals who now bring this action. This action is brought by the individual members of this committee as

distinct and separate individuals on their own behalf and on the behalf of the committee itself.

5) Mr. Richard Black is an individual who resides in Missouri and has been the Nation’s designated tribal

representative and repatriation agent to the State of Missouri since 1990.

6) Defendants are either directors or agents of Departments of the State of Missouri who currently, or in

the past but after 1991, hold Native American human remains or artifacts, and are responsible for

inventorying and consulting under NAGPRA, or the individuals, present, past and future, who serve on or

for the Unmarked Human Burial Consultation Committee of the Missouri Department of Natural

Resources, each defendant makes or contributes to decisions on the disposition of Native American

human remains and cultural items found in unmarked Missouri graves, and each defendant has played a

role in deciding whether and how the procedures and repatriation provisions of NAGPRA will be

observed or not observed and followed. The individual Defendants are Stephen Mahfood, Doyle

Childers, David Shorr, Mark Miles, Henry Hungerbeeler, Robert Reeder, Joe Mickes, Judith Deel,

Sarah Parker, Larry Grantham, Chet Ellis, Jerome Glick, Michael Connor, Gayle Fritz and Debra Greene

as well as unknown past members of the Unmarked burial Committee, John Doe, Jane Doe, John Roe,

Jane Roe.

JURISDICTION AND VENUE

7) This court has jurisdiction pursuant to 28 U.S.C. § 1331 (federal question), 28 U.S.C. § 1362 (Indian

Tribes), and 28 U.S.C. § 2201-2202 (declaratory judgment and injunctive relief).

8) This court also has jurisdiction under 42 U.S.C. § 1983 pursuant to 28 U.S.C. § 1343 (4), as well as

pursuant to 25 U.S.C. § 3013, and 28 U.S.C. § 1331 which grant the Court jurisdiction over any alleged

violation of NAGPRA. There is a present and actual controversy between the parties.

9) Venue is proper in the Western District of Missouri pursuant to 28 U.S.C. § 1391(b) because it is the

judicial district in which the Defendants hold their meetings and in which unrepatriated remains and artifacts

are housed.

FACTS – ALLEGATIONS OF PLAINTIFFS/CLASS REPRESENTATIVES

10) Plaintiff Sac and Fox Nation was the aboriginal and historic occupant of parts of the State of Missouri.

Human remains and cultural items located within these parts of Missouri are part of Plaintiff’s cultural

heritage.

11) The Missouri Department of Natural Resources (MODNR) and The Missouri Department of

Transportation (MODOT) are is a state agencies agency that receives federal funds and, pursuant to

state law, have possession, custody, or control over Native American remains, associated funerary objects

and other cultural items. They are, therefore, a museum under NAGPRA. 25 U.S.C. § 3002(8). The

individual defendants are employees, agents, or directors of the state agency museums and individually

have each acted outside their official capacity under color of state law in their roles as officers of their

respective agencies to violate the rights of plaintiffs as protected under the provisions of NAGPRA.

12) Defendants have received Native American remains, associated funerary objects, and other cultural

items from burial sites within the State of Missouri. The defendants have been entrusted with the duty to

enforce and abide by the requirements of NAGPRA in their dealings with the Native American remains,

associated funerary objects, and other cultural items that are in the possession of, or under the control of,

the MODNR and MODOT.

13) Defendants improperly stored and, upon information and belief, continue to improperly store Native

American remains, associated funerary objects, and other cultural items at a Missouri Department of

Natural Resources facility located in the Union Hotel in Jefferson City, Missouri and the State Mus eum

in Jefferson City, Missouri in Columbia, Missouri at the University of Missouri.

14) Defendants have not, in the past, and are not presently notifying or consulting with the Sac and Fox

Nation, as required by NAGPRA and by regulations of the Department of the Interior, 43 C.F.R. § 10.9.

15) Upon information and belief, Defendants have transferred possession of Native American remains,

associated funerary objects, and other cultural items to unauthorized individuals in violation of NAGPRA

25 U.S.C. § 3005. Such transactions are also in violation of NAGPRA and the Archaeological Resources

Protection Act of 1979 (ARPA) criminal statutes for trafficking in cultural and Native American remains

18 U.S.C. § 1170 and 16 U.S.C. § 470. More specifically, defendants MoDot and its listed agents,

employees, and directors in particular, Robert Reeder, and Joe Mickes allowed and assisted with the

transfers of Native Human remains from sites 23JA388, and 23SC501 through Defendants DNR and its

listed agents, employees and directors in particular, Judith Deel, David Shorr, Larry Grantham, and Chet

Ellis along with other sets of Native American remains to Chet Ellis for reburial and distribution outside of

the agencies’ control. This occurred on at least three other occasions as well. These sites are within the

traditional historic range of the plaintiffs and within the final judgments of judicially established Indian lands

per the court of claims assigned to the plaintiffs.

16) Upon information and belief, Defendants have had possession of and/or control over Native American

remains, associated funerary objects and other cultural items from the State of Missouri for more than

Seven years. During this time, Defendants have failed to consult, in consultation with the Sac and Fox

Nation in the compilation of an inventory and summary of such remains and items, as required by

NAGPRA 25 U.S.C. §§ 3003, 3004 and 3007. Furthermore, as recently as June 10, 2002, the

defendants publicly acknowledged at the Unmarked Burial Committee meeting that they had not

completed nor published an inventory for the collection of remains that are in the State Historic

Preservation Office custody or in the custody of the State Museum. Some of these remains have been in

the defendants’ custody for over ten (10) years or longer. Defendant MoDot and its individual employees,

agents and directors defendants have failed to consult with the plaintiffs and other Native American tribes

known to have been in Missouri and to have buried their members in Missouri in their efforts, or through

the efforts of their agents, to compile an inventory of their two collections of remains, artifacts and sacred

objects (the pre-1987 collection housed at the University of Missouri, and the post-1987 collection which

they transferred to Defendant DNR and its agents, employees and directors in further violation of

NAGPRA). In fact the inventory the MoDot defendants finally filed in June of 2003, a year after this suit

was filed, is still not in compliance with NAGPRA as it states on the inventories face that on every site

“MoDot has conducted general consultation about MoDot NAGPRA collections but there has been no

consultation specific to these remains.” Because the MoDot defendants have failed to consult with any

tribes specifically on any remains the result is that every set of remains in their filed inventory have been

deemed by them to be culturally unidentifiable. This determination is again violative of NAGPRA and

contemplated by the MoDot defendants intentionally to avoid further compliance with NAGPRA and

sending on the part of the defendants. They in essence have made a conscious decision to avoid further

obligations under the statute by omissions of actions to apparently have no set of remains that are culturally

identifiable.

17) Because of Defendants’ failure to consult in the compilation of the inventory and summary required by

NAGPRA 25 U.S.C.§§ 3003 and 3004, and their failure to consult with, or provide notification to the

Sac and Fox Nation of their possession and control of Native American remains, associated funerary

objects and other cultural items as required by those provisions of NAGPRA, the Sac and Fox Nation has

been deprived of their right to request repatriation of those remains and items pursuant to NAGPRA 25

U.S.C. § 3005.

18) Defendants have failed to repatriate to the Sac and Fox Nation any remains associated funerary

objects, or other cultural items as required by NAGPRA 25 U.S.C. § 3005.

19) By permitting Defendants to retain custody over the Native American remains, associated funerary

objects and other cultural items removed from sites within the State of Missouri, there is a risk that those

remains and items will be concealed, lost, transported out of state, or transferred to unauthorized entities.

20) Plaintiffs allege that they have suffered actual procedural and substantive injuries in fact and under law.

These injuries were directly occasioned by the acts and omissions of the individuals named as Defendants,

and would be redressable by the judicial award of the relief requested herein.

21) The Plaintiffs present their own interests and seek to remedy their own injuries, although the relief

requested herein would benefit other federally recognized tribes with aboriginal and historic range in the

State of Missouri.

22) Plaintiffs have, in accordance with 43 C.F.R. § § 10.5 (c), made repeated oral and written requests

that the Defendants adhere to dictates of NAGPRA and the regulations of the Department of the Interior.

The Defendants persist in their failure to notify and consult with the Plaintiffs regarding the determination of

cultural affiliation and the repatriation of remains in the Defendants’ possession.

23) Defendants are not authorized by the State of Missouri to disregard the provisions of NAGPRA and

the Department of Interior regulations.

24) Though not authorized by the State of Missouri to disregard the federal law, Defendants hold

themselves out as representatives of the state and thus act under the color of state law.

25) As recently, as on or about June 8, 2002, defendant MODOT took possession of items collected

from a known burial mound in northern Missouri north of the City of Lucerne where there is a proposed

MODOT highway project underway to divert the highway around the city. The items were unearthed in

preparation for excavating for the highway expansion. Defendants’ archeologists are currently studying the

items taken from the site to determine whether Native American cultures were present at that location. The

Defendants have been contacted by the Plaintiffs and asked to return the items to them as the site is a

known Native American burial mound. Yet, Defendant MODOT refuses to consult with the Plaintiffs

regarding the items and presently does not acknowledge the existence of the burial mounds at that location.

26) Defendant MODNR has most recently, taken fifty-one (51) Native American human remains into its

possession from a mass burial mound in Fenton, Missouri. These remains have been in their custody for

many months and the defendant has failed to contact the plaintiff or any other tribes or nations in an effort

to consult toward inventory and repatriation of the remains.

27) Defendants have been in custody and control of mass Native American remains and funerary objects

and have failed to compile and file an inventory of such items as required by NAGPRA. The defendants

have gained control of Native American remains, artifacts, sacred objects from the following counties in

Missouri each of which the plaintiff has a legal, historical, traditional and cultural right to: Atchison,

Nodaway, Worth, Holt, Andrew, Buchanan, Platte, Jackson, Clay, Clinton, Lafeyette, Ray, Caldwell,

Dekalb, Davies, Gentry, Harrison, Mercer, Grundy, Livingston, Carroll, Saline, Cooper, Howard,

Randolph, Chariton, Linn, Macon, Adair, Sullivan, Putam, Schuyler, Moniteau, Cole, Osage, Gasconade,

Franklin, Jefferson, St. Louis, St. Charles, Warren, Lincoln, Montgomery, Callaway, Boone, Audrain,

Pike, Monroe, Ralls, Shelby, Marion, Knox, Lewis, Scotland, and Clark.

CLASS ALLEGATIONS

27 a) Plaintiffs re -allege paragraphs 1-27 above.

27 b) Plaintiffs sue on behalf of themselves and a Class of similarly situated Federally

Recognized Tribes pursuant to Federal Rule of Civil Procedure 23(a) and 23(b) (1). The Class

that Plaintiffs seek to represent consists of all Federally Recognized Tribes that had a historic,

prehistoric, or aboriginal presence within the State of Missouri.

27 c) Subsection (a) (1) of Rule 23 is satisfied in that the class Plaintiffs seek to represent is so

numerous that joinder is impracticable. Upon information and belief, the number of Federally

Recognized Tribes that had a historic, prehistoric, or aboriginal presence within the State of

Missouri is at least 23.

27 d) Subsection (a)(2) of Rule 23 is satisfied in that there are questions of fact and law common

to the members of the Class which predominate over any questions affecting only individual

members, to wit: what are the duties under NAGPRA that the Defendants owe to the Plaintiffs

and the members of the class, what are the rights of the Plaintiffs and the members of the class

under NAGPRA, whether the Defendants have breached their duties to the class under

NAGPRA in the past, whether the Defendants are currently breaching their duties to the class

under NAGPRA and whether the Defendants have violated NAGPRA.

27 e) Subsection (a)(3) of Rule 23 is satisfied in that the claims of Class Representatives Sac

and Fox Nation of Oklahoma and the NAGPRA and Cultural Resources Committee of the Sac

and Fox Nation of Oklahoma are typical of the claims of the class.

27 f) Subsection (a)(4) of Rule 23 is satisfied in that the Representative Plaintiffs will fairly and

adequately protect the interests of the class through qualified counsel.

27 g) Subsection (b)(1) of Rule 23 is satisfied in that the prosecution of separate actions by

individual members of the class would create a risk of inconsistent or vary varying adjudications

with respect to individual members of the class would establish incompatible standards of

conduct for the Defendants.

COUNT I:

COMPLAINT FOR INJUNCTION

28) Plaintiffs re-allege paragraphs 1-27 (g) above.

29) The Missouri Department of Natural Resources (MODNR) and Missouri Department of

Transportation (MODOT) receive federal funds and have possession, custody, or control over Native

American human remains and associated funerary objects. They each are therefore a museum within the

meaning of NAGPRA, 25 U.S.C. § 3002(8).

30) The named defendants at all relevant times have acted, under color of state law, as agents or

employees of MODNR or MODOT.

31) Defendants, collectively and in their individual capacity each, have failed repeatedly to notify or consult

with Class Members’ or Plaintiffs’ authorized Tribal representatives in the compilations of inventories or

the preparation of summaries of Native American human remains and associated funerary objects in

violation of 25 U.S.C. § 3003(b) (1) (A), 25 U.S.C. § 3003(d) (1), 25 U.S.C. § 3004(b) (1) (B), and 43

CFR §§ 10.8 and 10.9.

32) The defendants, collectively and in their individual capacity each, have failed to notify and consult with

Plaintiff and Class Members on the determination of the cultural affiliation of remains, in violation of 25

U.S.C. § 3003(b) (1) (A), and 43 CFR 10.8, 10.9, and 10.14, then failed to expeditiously repatriate

human remains and associated funerary objects to the Plaintiff and Class Members , in violation of 25

U.S.C. § 3005, and 43 CFR § 10.10.

33) Plaintiff alleges, on information and belief, that defendants have intentionally and unlawfully given

custody of native American human remains to persons not authorized under federal law to receive them, in

violation of 25 U.S.C. § 3005 and 43 CFR § 10.10, 18 U.S.C. 1170, and 16 U.S.C. 470. The

Defendants have also transferred remains artifacts and sacred objects that where once in their possession

to third parties or each other in an intentional effort to alleviate themselves of complying with their

obligations under NAGPRA.

34) Defendant MoDot and its employees including, but not limited to, individual defendant Hungerbeeler

have also committed the following specific acts or omissions in violation of NAGPRA, 25 U.S.C. 1983,

and their collective trust duty to Indian tribes, including the plaintiffs who have protected interests and rights

of possession to Native American human remains, burial artifacts, and sacred sites in the State of Missouri:

a) These defendants have contracted with a number of third party corporations to dig up Indian

remains, burial artifacts and related objects at MoDot sites. These third party agents then

become responsible for identifying and separating the human remains from the artifacts and

delivering them to two separate fourth party entities for curation. The result of this relationship

gives these defendants possession and supervision over the remains and artifacts but they do

not follow the requisite requirements under NAGPRA of consultation, identification, filing an

inventory and repatriation. In addition, the creation of these relationships are intentionally

constructed in an effort to avoid the provisions of NAGPRA and to further complicate the

consultation, and identification requirements of NAGPRA by adding a third and fourth party

and by separating the artifacts which are the primary means of identifying the affiliation of the

Indian remains to certain tribal entities, from the remains themselves.

b) These defendants have not filed an inventory of either, human remains under their control and

ownership, nor the burial artifacts under their control or ownership with the department of the

interior as required by NAGPRA in over twelve (12) years.

c) These defendants have not consulted with the plaintiffs on any remains or artifacts they have

under their control or ownership.

d) These defendants have given Indian human remains without consultation with the plaintiffs to

unaffiliated representative third parties for reburial (specifically Jerry Long-Knife).

e) These defendants have stored, or caused to be stored, Indian human remains and artifacts in

rat-poison boxes and other unacceptable containers in the past.

f) These defendants continue to transfer human remains and artifacts separately to third-parties

without consultation, or notice to the plaintiffs; even after being placed on notice by the

plaintiffs and in complete disregard to both their fiduciary duty as a trustee of Indian human

remains and artifacts as well as, their duties under NAGPRA, resulting in at least, a twelve

year pattern and practice of avoiding their obligations and, in numerous and repeated civil

rights violations of, not only these plaintiffs, but numerous other Indian Tribes throughout the

Midwest.

g) These defendants are further alleged here to have committed those facts alleged in paragraphs

11, 12, 13, 14, 15, 17, 18, 19, 20, 22, 23, 24, 27, above.

35. Defendant Department of Natural Resources (DNR) and its employees, collectively and individually,

have and continue to commit the following acts and omissions in violation of NAGPRA, 25 U.S.C. 1983,

and their collective trust duty to Indian tribes, including the plaintiffs and Class Members who have

protected interests and rights of possession to Native American human remains, burial artifacts, and sacred

sites in the State of Missouri:

a) These defendants have not filed an inventory of either, human remains under their control and

ownership, nor the burial artifacts under their control or ownership with the department of the

interior as required by NAGPRA in over twelve (12) years.

b) These defendants have not consulted with the plaintiffs on any remains or artifacts they have

under their control or ownership.

c) These defendants have given Indian human remains without consultation with the plaintiffs to

unaffiliated representative third parties for reburial (specifically Jerry Long-Knife).

d) These defendants have at least Fifty-one (51) Indian human remains in their possession from

Fenton, Missouri, which are within the plaintiffs’ historical territories, granted land claims and

are affiliated with their ancestors. The plaintiffs have requested consultation regarding these

remains. These defendants knew about the existence of the burial mounds in Fenton prior to

their destruction and failed to protect them from being destroyed and the remains from being

disturbed, dug up, lost and destroyed. These defendants continue to fail to protect the burial

artifacts that were collected from the Fenton mounds as they are in the custody of a third party

who have not provided them to the State of Missouri.

e) These defendants are in control and have supervision over hundreds, if not, thousands of

Indian human remains. A large portion of these remains and associated burial objects or

artifacts the plaintiffs have rights to possession and interests in repatriation. These defendants

have created a system of collection, identification and control that unduly delay the duties of

consultation, filing an inventory, and repatriation as required under NAGPRA.

f) These defendants are further alleged here to have committed those facts alleged in paragraphs

2(a) – (q), 11, 12, 14, 15, 16, 17, 18, 19, 20, 22, 23, 24, 25, 26, and 27 above.

36. Plaintiffs and Class Members will suffer irreparable injury in that, without intervention of the court,

defendants will continue to act outside the dictates of NAGPRA, remains of tribal members and ancestors

will be subject to excavation and be continuously tested and studied without limit toward repatriation.

Plaintiffs will not be able to ensure the remains in defendants’ custody will be returned. They can not

ensure the remains and objects currently in the earth will not be disturbed without consultation, nor can

they ensure, against unauthorized distribution of remains by the defendants. Because no inventories are

completed by the defendants the plaintiffs, without intervention by the court, have no way to ensure that

remains, objects and artifacts will not be injured, lost, misplaced or sold, and will not have grounds to

believe these items will ever be found again until they are officially listed in an inventory.

37. Plaintiffs and Class Members will further suffer irreparable injury in that living tribal members have a

duty to their ancestors, clans, tribes and all native peoples under their tribal custom and religion, to protect

and care for the graves and bodies of the deceased. Current tribal members will continue to fail in their

mission if they do not perform the needed religious ceremonies for the unearthed remains and return the

remains and sacred objects of the deceased to their burial places. Each day these remains and objects go

unlisted on a published inventory is another day lost towards repatriation of these items and another day

the plaintiffs and their ancestors suffer the desecration of physical burial and spiritual unrest.

38. Plaintiffs and Class Members have attempted to remedy their complaints to the defendants through

writing and face to face meetings over the last ten years with no affect. The defendants continue to violate

NAGPRA and have stated on numerous occasions they do not need to comply with its requirements.

39. Plaintiffs and Class Members have no adequate or speedy remedy at law for the above-mentioned

conduct of the defendants, and this action for injunctive relief is the plaintiffs’ only means for securing relief.

Due to the defendants repeated refusal to comply with NAGPRA the Defendants have caused the plaintiffs

to suffer the costs of this action, including reasonable attorney fees and expert witness fees.

COUNT II

DECLARATORY JUDGMENT

40. Plaintiffs re-allege paragraphs 1-39.

41. Each of the Defendants have Native American remains in their custody or control.

42. All Defendants receive federal funds for projects which involve the collection or storage of Native

American remains or burial items.

43. Defendant DNR and its employees or agents listed as individual defendants have acknowledged at an

open and public meeting held on June 10, 2002, that they are qualified as a “museum” for the purposes of

complying with the provisions of NAGPRA.

44. Defendants MoDot or DNR have not ever completed an inventory of items covered by NAGPRA.

The first deadline set out by the committee for the department of the interior for inventories to be

completed was in 1993. The second deadline was set for 1995. The defendants have not met either

deadline and continue to be in violation of the inventory provisions of NAGPRA.

45. The defendants have never consulted with the plaintiffs and Class Members on any human remains

or artifacts from any site in an effort to show, even good faith, at complying with the consultation provisions

of NAGPRA. The defendants efforts to complete an inventory to date is in violation with the provisions of

NAGPRA as any compilation of an inventory to date has been without consultation with the plaintiffs and

Class Members who have legal and historic land claims for all of Missouri.

46. Plaintiffs seek a declaratory judgment that the defendants qualify as “museums” for purposes of

NAGPRA and as such they are in violation of the inventory and consultation provisions of NAGRPA.

Further, due to the defendants repeated refusal to comply with NAGPRA the Defendants have caused the

plaintiffs to suffer the costs of this action, including reasonable attorney fees and expert witness fees.

COUNT III

1983 Violations of Protected Rights-Damages

47. Plaintiffs re-allege paragraphs 1-46.

48. Defendants, as individuals without actual authority, but acting under color of state law, knowingly,

intentionally and willfully deprived Plaintiffs and Class Members of rights, accorded under federal law, to

notification, consultation, and repatriation, in violation of 42 U.S.C. § 1983.

49. As a result the plaintiffs and Class Members have suffered and continue to suffer desecration,

destruction, loss, trespass, disruption, disrespect, and unnecessary delay to Native American remains and

artifacts. These breaches cause religious and spiritual turmoil for the plaintiffs, Class Members and their

individual members, as they are the protectors and keepers of their ancestors’ remains and sacred places.

The plaintiffs and Class Members believe that tribal members and ancestors who remain unburied are

not at rest and remain uneasy and forever disturbed until a proper spiritual reburial.

50. The defendants have been on notice of the plaintiffs’ and Class Members’ claims for repatriation of

human remains and cultural items since 1990 and have been contacted numerous times in writing and in

person each year since 1990.

51. The defendants repeated refusals to comply with NAGPRA, after repeated requests from the plaintiffs

to do so, has resulted in additional delay and damage and ultimately, this litigation. Due to the defendants

repeated refusal to comply with NAGPRA the Defendants have caused the plaintiffs to suffer the costs of

this action, including reasonable attorney fees and expert witness fees.

COUNT IV

NAGPRA CLAIMS FOR DAMAGES

52. Plaintiffs re-allege paragraphs 1-51.

53. Defendants have caused the plaintiffs and Class Members to suffer expenses they or their agents

have incurred in attempting to have the defendants comply with NAGPRA over the last ten years.

54. Due to the defendants repeated refusal to comply with NAGPRA the Defendant has caused the

plaintiffs to suffer the costs of this action, including reasonable attorney fees and expert witness fees,

authorized to claimed by the plaintiffs by the Department of Interior regulations, 43 CFR § 10.12

55. Plaintiffs have suffered immeasurable damage and harm and seek restitution from the defendants

pursuant to 43 CFR § 10.12 (D) for such damage.

COUNT V

BREACH OF TRUST AND FIDUCIARY DUTY

56. Plaintiffs re-allege paragraphs 1-55.

57. Plaintiffs and Class Members have rights and interest of possession in Native American human

remains and burial artifacts and objects established by NAGPRA.

58. Defendants have control and supervision over such remains and burial artifacts. Defendant MoDot and

its employees or agents own, control, and supervise numerous remains and burial objects that are stored

for them at the University of Missouri. Defendants DNR and its employees and agents own, control and

supervise numerous remains and burial objects in locations throughout the State of Missouri.

59. Defendants are charged with a fiduciary duty with respect to Native American remains and burial

objects under their control and supervision pursuant to NAGPRA and the Trust Responsibility Doctrine.

60. The Defendants have failed to adhere to the standard of reasonable fiduciary care as established by

NAGPRA.

61. Reliance by the Defendants on the State’s Unmarked Human Burial Consultation Committee is

unreasonable as the State statute is preempted by NAGPRA.

62. As a result the Defendants are collectively and individually responsible for the breach of their trust

duties to the plaintiffs and Class Members and the resulting damages caused by such continuous acts or

omissions constituting fiduciary breaches

63. Due to the defendants repeated refusal to comply with NAGPRA the Defendants have caused the

plaintiffs to suffer the costs of this action, including reasonable attorney fees and expert witness fees. The

defendants’ breach of their trust duties since 1990 has resulted in plaintiffs and Class Members suffering

and continuing to suffer desecration, destruction, loss, trespass, disruption, disrespect, and unnecessary

delay to Native American remains and artifacts. These breaches cause religious and spiritual turmoil for the

plaintiffs and their individual members, as they are the protectors and keepers of their ancestors’ remains

and sacred places. The plaintiffs and Class Members believe that tribal members and ancestors who

remain unburied are not at rest and remain uneasy and forever disturbed until a proper spiritual reburial.

The plaintiffs seek damages to compensate for these damages.

PRAYER

WHEREFORE, Plaintiffs pray for judgment against Defendants as follows:

1. A preliminary injunction pursuant to FRCP 65, enjoining the defendants from disposition of cultural

items including Native American human remains, associated funerary goods and other cultural items in the

defendants’ custody, and any disposition of records, inventories or summaries in the defendant’s

possession.

2. A preliminary injunction enjoining the defendants from receiving or spending federal funds allocated,

or to be allocated, until such time as they complete an inventory of all human remains, funerary objects and

artifacts in their collective possessions, publish the inventory in the federal register, and repatriate the

known remains in their custody to the plaintiffs and Class Members which they are known to have claim

too.

3. A preliminary injunction enjoining the defendants from any further digging, excavating, testing,

collecting, or disturbing in any way the burial mound(s) north of Lucerne, Missouri where the proposed

highway 136 expansion is planned until full consultation is done with the plaintiffs and regarding the site and

the dangers of disturbing it are resolved in writing and approved by the plaintiff.

4. A permanent injunction:

a) Enjoining Defendants from repatriating Native American remains, associated funerary objects

and other cultural items, to any entities other than federally recognized Indian tribes who were

aboriginal or historical occupants of the State of Missouri.

b) Appointing a receiver trained in the inventory, preservation and protection of human remains,

funerary objects and other cultural items, to compile, in consultation with the Sac and Fox

nation, an inventory and summary pursuant to NAGPRA §§ 3003 and 3004 of all human

remains, associated funerary objects, or other cultural items received from burial sites in

Missouri.

c) Directing Defendants to bear the costs of the inventory, preservation, and protection of the

human remains, associated funerary objects, or other cultural items in the possession of or

under the control of the Defendants, pending repatriation of those remains, objects and items

to the Sac and Fox or the appropriate federally recognized tribe.

d) Requiring Defendants in the future to comply with NAGPRA, and the Department of Interior

regulations issued under NAGPRA.

e) Requiring that in the future, before any action is taken concerning the disposition of Native

American remains, associated funerary objects and other cultural items, that Defendants

consult with and obtain written permission from the lineal descendants of the native American

remains, associated funerary objects and other cultural items in question, or in any case in

which the lineal descendants cannot be ascertained, consulting with and obtaining the written

permission of the closest culturally affiliated federally recognized Indian tribe. If the cultural

affiliation of the Native American remains, associated funerary objects and other cultural items,

cannot reasonably be determined, then consent and written permission from such federally

recognized Indian tribe which have been found to have held aboriginal or recognized title to or

historic use or occupancy of the land from which the remains and such objects were found. If

such tribe cannot be determined, then Defendants shall consult with and receive permission

from each of the federally recognized tribes that were determined to have had aboriginal title in

Missouri by the U.S. Court of Claims. Such consultation shall be fulfilled within 30 days of

receiving any Native American remains, associated funerary objects and other cultural items,

and no remains or objects shall be repatriated or disposed of until such consultation has been

completed.

5. Judgment against Defendants in the amount to be determined at trial, in favor of plaintiffs and Class

Members , constituting damages for desecration, destruction, damage, and impairment of the cultural

heritage of the people of the Sac and Fox Nation of Oklahoma, and for the expenses they or their agents

have incurred in attempting to have the defendants comply with NAGPRA over the last ten years, and

punitive damages for the willful refusal to recognize rights secured to the Sac and Fox Nation of Oklahoma

and Class Members under NAGPRA and federal regulations, the supreme law of the land.

6. Judgment against the Defendant for the costs of this action, including reasonable attorney fees and

expert witness fees.

7. Declaratory Judgment that the defendant MoDot and its agencies, and Defendant DNR and its

agencies divisions are both is a “museums” as defined by NAGPRA and consequently, are subject to the

provisions of NAGPRA.

8. Certify this case as a class action

9. Certify the Plaintiffs as Class Representatives

10. Certify Sean W. Pickett and R. Travis Willingham as Class Counsel

11. Such other and further relief as the Court deems just and proper.
