Question 1: Contractual Obligations

APE Ltd created a software application for SIN Ltd under a contract that required the
software to be compatible with the computer equipment made by a variety of manufacturers.

In fact the software is not compatible with the equipment of one of the manufacturers
specified. Subsequently, SIN transferred its business, assets and undertaking to Selling Plc.
Selling Plc has lost money as a result of marketing this software programme because of the
incompatibility problem and now wishes to sue APE in respect of what it sees as carelessness
on the part of APE.

Discuss APE Ltd’s potential liability in the above case.

Question 2: Business Torts

Tom owns a factory which manufactures furniture. Advise Tom as to his liability in tort for
each of the following situations:

(a) One day a prospective customer visits the factory and trips over some timber which
has been left on one of the gangways; the customer breaks his ankle.
(b) An employee, while working at his station is injured when a piece of timber falls from a
crane carrying timber from one part of the factory to another. At the time, the employee
was not wearing a hard hat according to the factory’s safety regulations.
(c) A second employee is out in a van delivering furniture when he knocks over a
pedestrian on a pedestrian crossing.

Question 3: Civil Jurisdiction

Where will the proceedings involving the following parties take place? Support your answers
with valid reasons.

(a) Annie would like to recover the sum of £5,500 she lent to Barry last year.
(b) Craig is claiming £80,000 from ABC Delivery Company for physical injury and
property damage caused by a negligent driver who rammed a lorry into Craig’s house.
(c) Danica claims that her employer Eric dismissed her unfairly when she became
pregnant.
(d) Fred, a contractor and Greg, a developer, are having issues with each other. Fred did
not complete the houses in time and Greg has to pay penalty sum to the house buyers.
(e) Hiram, regarding the repossession of his bungalow by DEF Finance.

General Instructions

1. For each question, you are required to write your answer within the word limit of
1,000 words. This limit excludes citations and references.

2. In addition to the essay, you are required to write a 1,000-word essay about your
contribution to the essay, reflecting on your experience and knowledge that you have
gained from this module.

3. In the event the maximum word limits are exceeded, any part or parts of the answer in
excess of the word limit will be disregarded.

4. The following is a general guide as to the report layout:


(a) Introduction: general identification of the legal issues that will be discussed;
(b) Body: elaboration of the legal issues (identified at the “Introduction” stage)
and application of those legal issues; and
(c) Conclusion: summary of the arguments presented and a persuasive
conclusion.

5. Your attention is also drawn to APIIT’s regulations on plagiarism; these regulations


apply to this coursework. Any information taken from another source (e.g. lecture notes,
text books, Internet sites) must be referenced using the Harvard Referencing method.

Assessment Criteria

This assessment will be marked based on the following criteria:-

I. Individual Assignment (50 marks)

You are required to analyse the legal issues contained within each question and discuss
possible solutions to the legal issues identified.

The answer for each question should not exceed 1,000 words; this limit excludes citation and
references. Below are the assessment criteria:

(a) Accurate identification and discussion of legal issues 20 marks


(b) Effective use of legal authority 15 marks
(c) Clarity and flow of content 5 marks
(d) Referencing and citation of sources 5 marks
(e) Overall work (language, grammar, alignment, font) 5 marks

II. Presentation and Q&A (20 marks)

You are required to present your answers in a 1 hour presentation. You must be prepared to
answer questions from the audience and defend their points of view.

III. Individual Assignment (20 marks)

You are also required to do an assignment of 1000 words which reflects on your contribution
to the group activity and your learning experiences of this module.

Performance Expectation

Marks are awarded based on the following guidelines:

Grade Description of performance level

70% – 100% Good analysis of the problem situation. Clear and convincing application of
legal issues and legal authorities to solve the issues identified. Citations must
be from between 8 to 10 solid references and interesting arguments are
presented based on selected reference sources. Legal arguments are coherent
and convincing, based on reflective reading. Points are supported with valid
explanation and good reasoning. Shows critical analysis, understanding,
thought and reflection of subject matter.

50% – 69% Sufficient points are raised and valid explanations are provided based on
accurate identification of legal issues. Arguments presented are adequate,
based on selected text and relevant areas of legal research. Citations must be
from between 5 to 8 solid references. There is sufficient critical analysis of
problem and possible solutions, reflecting understanding of subject matter.

40% – 49% Basic requirements fulfilled, reflecting some understanding of legal issues
and possible solutions. Recommendations given are based on selected texts.
Basic examples are used to illustrate points. Arguments given are
elementary/ general and explanations may either be unclear or unhelpful in
clarifying points. Citations must be from between 3 to 5 reference sources.

Below 40% No understanding of the subject matter and failure to address the needs of the
question. Points are off-topic and are not related to selected text or areas of
legal research. No understanding of theories and concepts taught. Weak or no
referencing of sources.
