Obama to end ‘Don’t Ask’ this year

President Obama earned praise from many LGBT advocates on

Tuesday for pledging during his State of the Union address to imple-
ment an end to “Don’t Ask, Don’t Tell” before the year is out.
In his speech, Obama observed that members of the U.S. military
come from “every corner of this country” and are black, white, Chris-
tian, Jewish and Muslim.
“And, yes, we know that some of them are gay,” Obama said. “Start-
ing this year, no American will be forbidden from serving the country
they love because of who they love.”
In the House chamber, where Obama delivered the speech before
a joint session of Congress, lawmakers reacted to the remarks largely
along party lines — with Democrats applauding the comments and
Republicans taking no action.
Among those who stood as they applauded were House Minority
Leader Nancy Pelosi (D-Calif.) and Sen. Joseph Lieberman (I-Conn.),
who were both seen as key in pushing forward legislation allowing for
repeal of “Don’t Ask, Don’t Tell” last year.

Lawmakers hail introduction of Md. marriage bill
Vote in Senate

Members of the Maryland Legislature
joined LGBT activists at a news confer-
ence at the state capitol in Annapolis
Tuesday to formally launch a campaign
to pass a same-sex marriage bill that
backers introduced the previous week.
The Religious Freedom and Civil Mar-
riage Protection Act is expected to come
up for a committee hearing in the State
Senate the first week of February and likely
will be sent to the Senate floor for debate
and a vote as soon as Feb. 7, according to
sources familiar with the measure.
Political insiders have said they be-
lieve supporters have the votes this year
to pass the measure in the Senate, where
it has died in committee in past years.
Sources close to the bill’s sponsors say
the bill is expected to move to the House
of Delegates for consideration in March,
where it is widely expected to pass. Final
passage is expected in early April.
“I am very proud to be a sponsor of
this legislation,” said House of Delegates
Majority Leader Kumar Barve (D-Mont.
County), who holds the No. 2 leadership
position in that body. “This bill is a testa-
ment to what it means to be an American
and what it means to be free and equal
in our society.”
Barve was one of more than 25 law-
makers and LGBT advocates and their
supporters who attended the Jan. 25
news conference in Annapolis.
Sen. Rob Garagiola (D-Mont. County),
the Senate Majority Leader and a sponsor
of the marriage bill, told the gathering that
gay and straight couples are “no differ-
ent” in their capacity to love one another.
“It’s time that the rights already en-
joyed by many who can obtain a mar-
riage license in Maryland are enjoyed
by all regardless of gender and sexual
orientation,” he said.
The official registry of bills on the
Maryland Legislature’s website shows
that the Religious Freedom and Civil
Marriage Protection Act was introduced
in the House of Delegates on Jan. 20 with
17 sponsors and referred to the Commit-
tee on the Judiciary.
The registry shows that the marriage
bill was introduced in the Senate on Jan.
21 with 18 sponsors, including Garagiola
and Richard Madaleno (D-Montgomery
County), who is gay. It was sent to the
Senate Judicial Proceedings Committee.
Morgan Meneses-Sheets, executive
director of the statewide LGBT group
Equality Maryland, the lead advocate for
the bill, said another copy of the identi-
cal bill was introduced in the House of
Delegates Tuesday with 56 sponsors, in-
cluding Barve, whose name was not on
the first House bill introduced last week.
“This is the bill we will be pushing,” she
said. “It’s very common to introduce more
than one bill. It happens all the time.”
Supporters of same-sex marriage held a news conference this week in Annapolis to introduce
a marriage equality bill.
The two-page bill calls for amending
the state’s family law, which currently
says, “Only a marriage between a man
and a woman is valid in this state.” The
new language in the Religious Freedom
and Civil Marriage Protection Act would
rewrite that provision to state, “Only a
marriage between two individuals who
are not otherwise prohibited from marry-
ing is valid in this state.”
A second provision in the bill states
that “an official of a religious institution or
body authorized to solemnize marriages
may not be required to solemnize any
marriage in violation of the right to free ex-
ercise of religion guaranteed by the First
Amendment to the United States Constitu-
tion and by the Maryland Constitution and
Maryland Declaration of Rights.”
Backers say the latter provision, which
is similar to a provision in D.C.’s same-
sex marriage law, is aimed at assuring
religious leaders that churches and other
faith-based institutions cannot be forced
to perform same-sex marriages.
Equality Maryland and the national
same-sex marriage advocacy group
Freedom to Marry jointly sponsored the
Tuesday news conference.
Officials with both groups said they were
hopeful that growing support for same-sex
marriage in the state, as reflected in public
opinion polls, would help supporters beat
back a well-funded opposition campaign
by the National Organization for Marriage
(NOM) to defeat the bill.
NOM President Brian Brown said the
group would immediately file a petition to
bring a same-sex marriage bill before vot-
ers in a referendum if the legislature pass-
es it and Gov. Martin O’Malley signs it.
O’Malley, a Democrat, has said he would
sign the bill if the legislature passes it.
A statewide poll commissioned by the
Washington Post and released this week
shows that 51 percent of Maryland voters
favor a law allowing same-sex couples to
marry, while 44 percent oppose such a law.
Five percent had no response on the issue.

John Butler, 43
John Butler, a gay man who’d lived in Arlington, Va.,
died suddenly on Dec. 31. He was 43.
Butler was at a New Year’s Eve party when he be-
came ill. He was pronounced dead en route to a hospital
and died of a brain aneurysm according to his friend,
Jack Mackey. Butler had been in good health and was a fitness instructor at a
Gold’s Gym in Arlington.
Butler was born in Fort Smith, Ark., on Aug. 23, 1967. He spent a year in Brazil
as an exchange student and graduated from Loyola University in New Orleans with
a degree in international business.
He’d lived abroad and in Atlanta before coming to the D.C. area in 2007 where
he was in the human relations department of the U.S. Postal Service.
He participated in marathons in Dublin and Amsterdam and enjoyed travel. He
was fluent in Portuguese and Spanish and also knew some Italian and French.
A funeral was held Jan. 6 in Greensboro, N.C., where his family lives. He’s sur-
vived by his parents, Nancy and Dan Butler, brother Bradley, nephew Austin, and
other relatives.
His D.C.-area friends are having a gathering in his memory Feb. 5 at the home
of one of Butler’s friends in Alexandria. The gathering will be held at 4556 Strut-

Mayor names new head of GLBT Affairs

D.C. Mayor Vincent Gray last week
named the president of the Gertrude
Stein Democratic Club, Jeffrey Richard-
son, as his new director of the mayor’s
Office of Gay, Lesbian, Bisexual & Trans-
gender Affairs.
At a news conference at the mayor’s
office Friday morning, Gray called Rich-
ardson “a respected and credible voice
for the GLBT community,” and noted that
he played a key role in efforts, which
Gray supported, to help pass the city’s
same-sex marriage law.
“The District of Columbia has one of
the largest and most diverse GLBT com-
munities in the nation,” Gray said. “And
in the spirit of one city, Mr. Richardson
will lead collaborative efforts with these
constituents, the community at-large,
and the government.”
The City Council created the Office of
GLBT Affairs through legislation signed
by former Mayor Anthony Williams. The
legislation established the office’s direc-
tor as a cabinet-level position.
Richardson replaces Christopher
Dyer, who served as director of the GLBT
Affairs Office under Mayor Adrian Fenty.
The Stein Club is the city’s largest
LGBT political organization. It endorsed
Gray for mayor over Fenty last August
following a club candidates’ forum in
which Gray and Fenty talked about their
plans for addressing LGBT issues.
Gray was asked at the news confer-
ence if he plans to meet from time to time
with Richardson in light of the disclosure
by Dyer in an interview with the Blade ear-
lier this month that he never had a face-
to-face, sit-down meeting with Fenty. Dyer
said he communicated often with Fenty
through a “chain of command” comprised
of high-level mayoral assistants.

winning screen writer Dustin Lance Black
visited pioneering gay activist Frank Ka-
meny last week at Kameny’s Washington
home to talk about the FBI for the upcom-
ing film “J. Edgar,” a dramatized biography
of founding FBI director J. Edgar Hoover.
Kameny told the Blade the one-hour
visit was arranged by Richard Socarides,
the gay former Clinton administration offi-
cial who later worked for a Hollywood film
studio. Socarides is head of the LGBT
advocacy group Equality Matters.

think there’s any question that I will spend a

At the same news conference, Gray
announced the appointment of two other
high-level city officials – Victor Hoskins as
Deputy Mayor for Planning and Economic
Development and Phillip Lattimore III as
director of the Office of Risk Management.
Richardson currently serves as director
of national programs for the Center for Pro-
gressive Leadership, where he manages
programs aimed at developing progressive
leaders to work in national politics, policy-
making, and advocacy roles, according to
information released by the mayor’s office.
Richardson previously served as a
program officer with the D.C. Children
DiCaprio and Black sought Kameny’s
insight on the chilling atmosphere of the
1950s and 1960s in Washington for gays
and others who often were targets of
Hoover’s FBI, according to Kameny.
He said the two arrived in a limousine
and were not accompanied by anyone
else other than the driver, who did not
come into the house.
“They had been over at the Justice
Department prior to coming to my place,”
Kameny said.
Kameny founded the Mattachine So-
ciety of Washington in 1961, D.C.’s first
gay organization. He told the Washington
Blade in interviews that the FBI and D.C.
police closely monitored the group and
sent “plants” and undercover investiga-
tors to attend its meetings.
DiCaprio has been selected to star as

cial work from Howard University and a

els of city government,” said a statement
released by the club.
“As a social worker, non-profit profes-
sional, and community activist, Jeffrey
has experience working with all segments
of the District’s population,” the club state-
ment says. “His experience will enable
him to bring diverse groups together and
to effectively advocate for all constituen-
cies within the LGBT community.”
Hoover in “J. Edgar,” which is being di-
rected by Clint Eastwood and produced
by Warner Brothers. Black, nationally ac-
claimed for writing the script for “Milk,”
the film about San Francisco gay rights
leader Harvey Milk, wrote the script for “J.
Edgar.” Its release is projected for 2012.
Black, who is gay, has yet to disclose
any details of the script or story line for
the film. But the film industry blog Band
of Thebes reports that Armie Hammer,
who stars in the film “Social Network,”
will play the character Clyde Tolson,
Hoover’s right-hand man at the FBI and
the notorious FBI director’s rumored lov-
er. Actress Judi Dench has been tapped
to star as Hoover’s mother.

“His knowledge of D.C. and our issues,
and the trust that Mayor Gray has in him,

ments of the LGBT community and make
progress on the issues we care about.”
Rick Rosendall, vice president of the
Gay & Lesbian Activists Alliance, char-
acterized as “good news” Richardson’s
appointment to the GLBT Affairs post.
“He has been a pleasure to work with in
his capacity as president of the Gertrude
Stein Democratic Club, during which he
was an excellent coalition partner in our
community’s final push for civil marriage
equality,” Rosendall said. “He continued a
commendable trend among recent Stein
Club presidents of amicable cooperation
with GLAA on a range of LGBT issues.”

Gibbs dodges question on
Obama’s marriage support

White House Press Secretary Rob-
ert Gibbs this week dodged a question
about whether President Obama has
“backtracked” from his earlier support of
same-sex marriage.
In 1996, while campaigning for an Il-
linois Senate seat, Obama indicated his
support on a candidate questionnaire for
the Windy City Times, writing, “I favor le-
galizing same-sex marriages, and would
fight efforts to prohibit such marriages.”
Asked Monday about the question-
naire by the Washington Blade, Gibbs
declined to address it directly.
“I think there’s a whole host of issues
that I would direct you to the campaign on
— on different questionnaires and I would
again reiterate what the president has
said recently on that issue,” Gibbs said.
Asked whether he questions the accu-
racy of the 1996 questionnaire response,
Gibbs replied, “Again, I’m happy to send
you the several thousand clips of which
went around during the course of 2008
on a whole host of those issues.”
Following his response to the second
Blade question, Gibbs said, “Thanks
guys,” seeming to indicate that he would
take no more questions. Gibbs stayed at
the podium after reporters in the White
House press corps pressed him to take
more questions.
Shin Inouye, a White House spokes-
person, clarified that press briefings tra-
ditionally wrap up when the AP reporter
signals an end to the briefing.
“As the transcript clearly shows, the
AP reporter noted the end of the press
briefing with the customary ‘thank
you.’ Even after that, Gibbs did stay on
to take 18 additional questions,” Inouye
said. ” To suggest that he would step
away from the podium before the briefing
is over is not only wrong, it’s offensive.”
In the 1996 questionnaire response,
Obama unequivocally stated his support
for same-sex marriage, which is differ-
ent from his current position on the issue.
His position since has been that marriage
should be reserved for one man and one
woman. Still, the president has suggested
his position could “evolve” on the matter
and said last month he’s “wrestling” with
the idea of marriage rights for gay couples.
“Like a lot of people, I’m wrestling with
this,” Obama said in an interview last
month with The Advocate. “I’ve wrestled
with the fact that marriage traditionally
has had a different connotation. But I
also have a lot of very close friends who
are married gay or lesbian couples.”
Although he opposes same-sex mar-
riage, Obama as a U.S. senator voted
against a U.S. constitutional amendment
banning same-sex marriage and said he

riage Act, which prohibits the federal gov-
ernment from recognizing same-sex unions.
Later during the conference, Medi-
aite’s Tommy Christopher asked whether
the president has finally reached some
new position on same-sex marriage.
“As I said earlier, I don’t have an up-
date to what — to reiterating that it’s
something that he thinks a lot about,”
Gibbs said.
A number of gay rights supporters have
called on Obama to declare support for
same-sex marriage. On Sunday, the New
York Times published an editorial from gay
political pundit and sex columnist Dan
Savage, who urged the president to ad-
dress marriage rights for gay couples.
A partial transcript of the exchange with
Gibbs over the marriage issue follows:
Washington Blade: Back in 1996,
when the president was running to be-
come an Illinois state senator, he stated in

Milk’s shop to house Trevor Project/HRC center
WASHINGTON — The Human Rights Campaign announced a long-term part-
nership with the Trevor Project, a national organization focused on suicide preven-
tion among gay youth, at the site of Harvey Milk’s old camera shop in San Fran-
cisco’s Castro neighborhood.
The late Milk was the first gay man to be elected to San Francisco’s board of su-
pervisors but was murdered. The Harvey Milk Civil Rights Academy and the GLBT
Historical Society will also partner with HRC and Trevor on the plan.
HRC recently drew criticism from gay activists for its plan to put a gift shop at the
location at 575 Castro Street. It’s open now but a grand opening is planned in May.
UCC nominates first openly gay pastor to post
WASHINGTON — The United Church of Christ has nominated its first openly
gay candidate to serve the 1.1-million-member denomination as one of its top
elected national officers.
Rev. J. Bennett Guess, 44, was selected by a search committee to serve as a
member of the UCC’s five-person Collegium of Officers and to head Local Church
Ministries, one of the church’s four national bodies. Guess’ selection must be af-
firmed by a board of directors in April, before his name is put forward for election by
1,000 delegates attending the UCC’s biennial General Synod in July in Tampa, Fla.
Guess, who directs the UCC’s publishing, identity and communication ministry,
has been a member of the denomination’s national staff for more than a decade
and has been active in LGBT activism throughout his ministry.
Activist, mother of hate crime victim, dies
TULA, Okla. — Carolyn Wagner, a straight LGBT ally and founder of Families
United Against Hate (FUAH), died Jan. 18 in Tulsa, Okla.
Wagner was the mother of William Wagner, a gay hate crime survivor who was
assaulted in 1996 at age 16. The family won a lawsuit in which the Supreme Court
upheld rights for students regardless of gender, sexual orientation or gender iden-
tity. The incident inspired Wagner to found FUAH.
She died of cancer, hepatitis and liver failure.
ROTC protests inspired by anti-trans bias
PALO ALTO, Calif. — Several student organizations have launched a campaign
against the return of ROTC to college campuses because the military doesn’t pro-

Hearing set for gay couples seeking rights
HELENA, Mont. — Arguments were set for this week in the case of six Montana
gay couples suing the state for the same rights as married couples in making deci-
sions affecting their family’s health care and finances, the Associated Press reported.
The plaintiffs, represented by the American Civil Liberties Union, say the state Con-
stitution’s equal protection and privacy clauses guarantee those legal protections.
The ACLU is asking District Judge Jeffrey Sherlock to rule in their favor without
a trial, according to the AP report.
Attorney General Steve Bullock has asked the court to dismiss the case. He
says spousal benefits are limited by definition to married couples, and the Montana
Constitution defines marriage as being between a man and a woman.
Hawaii Legislature to debate civil unions
HONOLULU — Hawaii lawmakers are beginning debate on a bill creating civil unions
that would grant same-sex couples many of the same rights as married couples, the AP
reported. A Senate Judiciary Committee was scheduled to hear testimony this week.
A nearly identical measure passed the state legislature but was vetoed by Republican
then-Gov. Linda Lingle. New Democratic Gov. Neil Abercrombie supports civil unions.
Arson of gay man’s home probed as hate crime
CARROLLTON, Ga. — Investigators in Georgia’s Carroll County Sheriff’s Office
are getting help from the FBI to find out who threatened a gay man there and fol-
lowed through with an apparent hate crime, the Times Georgian reported.
On Jan. 22 a rock wrapped with a threatening note containing anti-gay slurs was
thrown through the window of the home of Christopher Staples, a 43-year-old dis-
abled Alvin Drive resident. The next day about 6 a.m. his house was set on fire. Sta-
ples was able to escape unharmed and is staying with friends, the paper reported.
Carrollton Fire Department Chief Jimmy Bearden told the Times Georgian the
fire was started intentionally.

HUD proposes ban on gay, trans housing bias
Rule would impact federally
funded programs

The U.S. Department of Housing and
Urban Development proposed a new rule
last week that would prohibit discrimi-
nation based on sexual orientation and
gender identity in federally funded and
federally regulated housing programs.
HUD Secretary Shaun Donovan, speak-
ing on behalf of President Obama, said
the sweeping new rule would cover a wide
range of programs serving millions of Amer-
icans, including low-income subsidized
housing and Federal Housing Administra-
tion (FHA) mortgage insurance programs.
“This is a fundamental issue of fair-
ness,” Donovan said. “With this pro-
posed rule, we will make clear that a
person’s eligibility for federal housing
programs is, and should be, based on
their need and not on their sexual orien-
tation or gender identity.”
HUD officials said that under standard
rulemaking procedures, the proposed
rule would be published in the Fed-
eral Register and open for public com-
ment during a 60-day comment period.
After that, the administration expects to
finalize and fine-tune the rule and put it
into effect, HUD officials said.
In a statement released Thursday,
HUD said the proposed rule includes
these main elements:

The heads of the nation’s most promi-
nent LGBT legal organizations say that the
Obama administration has considerable
leeway in how it defends the Defense of
Marriage Act in court — even if officials be-
lieve they’re obligated to uphold the statute.
The Obama administration’s defense
of DOMA, which prohibits the federal
recognition of same-sex marriage, has
inspired debate among LGBT rights sup-
porters about whether the Justice De-
partment is required to defend the law.
The LGBT advocates commented
on the issue during an eQualityThinking
panel on Monday in response to a ques-
tion from moderator and Washington

Kate Kendell, executive director of the
National Center for Lesbian rights, noted
the Obama administration has mounted
“a more full-throated defense” than what
was necessary in its early defense of
DOMA.
The 2009 defense of DOMA in the case
of Smelt v. United States, the first brief the
Obama administration filed in defense of
the law, inspired resentment in the LGBT
community early last year for drawing on
case law to compare same-sex marriage
to pedophilia and bestiality.
“They included very offensive language
around parenting,” Kendell said. “It wasn’t
a direct comparison between LGBT rela-
tionships and pedophilia or bestiality, but
it was close enough, and it was appalling.”
Kendell said her organization has had
HUD-assisted housing or housing whose
financing is insured by HUD “from inquiring
about the sexual orientation or gender iden-
tity of an application for, or occupant of, the
dwelling, whether renter or owner-occupied.”
The HUD statement says the agency
“is proposing to institute this policy in its
rental assistance and home ownership
programs, which include the Federal
Housing Administration (FHA) mortgage
insurance programs, community devel-
opment programs, and public and as-
sisted housing programs.”
In a telephone news conference, Don-
ovan said the new rule also requires ap-
plicants seeking federal housing grants
for a wide range of housing programs to
comply with state and local anti-discrim-
ination laws that protect LGBT people in
21 states. He said the protections under
this provision would cover 43 percent of
the U.S. population.
He said HUD was also conducting a
first-ever national study of discrimination
against LGBT people in the rental and sale
of housing. He said the study broadens
HUD’s existing studies that regularly mea-
sure housing discrimination based on race.
Donovan and Deputy HUD Secretary
Neil Coleman said HUD carefully re-
viewed various federal housing laws to
determine where HUD could intervene to
bar sexual orientation and gender iden-
tity discrimination under existing law.
The Employment Non-Discrimination
Act (ENDA), an LGBT civil rights bill that
has been stalled in Congress for years,
does not include protections for housing-
related discrimination.
LGBT supportive members of Con-
conversations with the Justice Depart-
ment to make clear that those arguments
were unacceptable and baseless. Fol-
lowing those conversations, Kendell said
the Obama administration made some
changes in how it defended DOMA.
“They have made some accommoda-
tions that well reflect the values that the
administration say[s] they espouse, but
I think — I’ll speak for ourselves for our
purposes and to our case — they cer-
tainly haven’t gone as far as they should
go,” Kendell said.
Kendell added that even if the Obama
administration opted not to defend DOMA,
the Justice Department would have to for-
mally notify Congress to give lawmakers
the opportunity to defend the statute.
“There is a possibility for the Justice
Department not to defend, but that doesn’t
mean there won’t be a defense of the laws
that Congress passes,” Kendell said.

DOMA: Gill v. Office of Personnel Man-
agement, which is pending before the
U.S. First Circuit Court of Appeals, and
Pedersen v. Office of Personnel Manage-
ment, which is pending before the U.S.
District Court of Connecticut.

public accommodations and other areas
in addition to employment. So far, no law-
maker has introduced such a bill.
Most political observers say no LGBT
supportive legislation is expected to
emerge from Congress over the next two
years because the Republican-controlled
House of Representatives would block it.
HRC praised HUD’s proposed rule on
LGBT housing discrimination. In a state-
ment, it said the rule touches on some of
the proposals in a package of 70 recom-
mendations it submitted to the Obama
administration two years ago aimed at im-
proving the lives of LGBT people through
executive action rather than legislation.
“The policies proposed today will help
some of the most vulnerable people in
our community and the nationwide survey
will finally shed light on the discrimination
LGBT people face every day in trying to
make homes for themselves and their fami-
lies,” HRC president Joe Solmonese said.
“Since the administration began, HRC
staff have met and communicated with
numerous federal agencies on how to
implement these polices,” the HRC state-
ment says. “Addressing discrimination in
federal housing programs was part of
HRC’s recommendations for HUD.”

After ‘Don’t Ask’ repeal, what’s next?
‘Our goals have been met’

Groups that worked to advance “Don’t
Ask, Don’t Tell” repeal last year aren’t
resting on their laurels as they continue
to see work ahead in ensuring that open
service is implemented and gays in the
military are treated fairly.
In the near term, the main priority for
those organizations now that President
Obama has signed legislation allowing
for “Don’t Ask, Don’t Tell” repeal is to
ensure that certification of open service
happens swiftly.
Aubrey Sarvis, executive director of
the Servicemembers Legal Defense
Network, said his organization will pur-
sue open service as required by the law
signed by the president.
“Dec. 22 was a great day, but the real-
ity is, we don’t have repeal,” Sarvis said.
“The reality is ‘Don’t Ask, Don’t Tell’ is still
the law. So, our first priority is the first 90,
the first 180 days is to get certification.”
Aaron Belkin, director of the Palm
Center, a think tank on gays in the mili-
tary at the University of California, Santa
Barbara, said his organization will be in
“monitoring mode” for possibly the re-
mainder of the year.
“The finishing line is here, but we
haven’t crossed it yet, unless and until we
get certification and good regulations,”
Belkin said. “Our job at this point is to
just make sure that the process continues
and that if there’s any foot-dragging at the
Pentagon, that we call attention to it.”
Belkin said he anticipates the Palm
Center will produce another study about
three or six months after certification is
issued to determine if implementation
was successful.
The measure Obama signed would
only enact open service after the presi-
dent, the defense secretary and the
chairman of the Joint Chiefs of Staff certi-
fy that the U.S. military is ready for “Don’t
Ask, Don’t Tell” repeal.
Further, after certification takes place,
a 60-day waiting period for congressio-
nal review must pass before gays can
serve openly in the U.S. military without
fear of discharge.
In the State of the Union address on
Tuesday, Obama committed to certify-
ing “Don’t Ask, Don’t Tell” repeal before
the year is out. The president said he ex-
pects certification to happen in a “matter
of months” in an interview last month with
The Advocate.
Defense Secretary Robert Gates has
said he won’t issue certification for open
service until new regulations are drafted
and training has been instituted in the
armed forces.
Beyond certification, groups working on
“Don’t Ask, Don’t Tell” foresee a number of
outstanding tasks that will remain, includ-
ing providing legal services and ensuring
that benefits are offered to gay troops.

in service.
“I think, as an organization, SLDN
will still be here providing legal servic-
es, working with Congress on oversight
and being a resource to the Pentagon to
make open service a reality,” he said.
Sarvis said since the legislation was
signed, SLDN has heard from more than
225 service members who’ve called
with questions about continuing to serve
safely or receiving benefits in the post-
repeal military.
Further, Sarvis said ensuring gay ser-
vice members receive the same benefits
afforded to straight service members
would be another aim for SLDN.
“The post-repeal focus, in large part,
will be parity for LGBT service members
-- particularly parity with respect to ben-
efits: health benefits, GI benefits across
the board,” Sarvis said.
The Pentagon report on “Don’t Ask,
Don’t Tell” — published Nov. 30 — states
that the Defense of Marriage Act prohib-
its the U.S. military from affording many
benefits to same-sex partners of service
members, but other benefits, such as
death benefits and hospital visitation ac-
cess, would still be available.
Sarvis said a combination of DOMA
and other regulations prohibit gay ser-
vice members from receiving the same
benefits as their straight counterparts,
but there is some leeway.
“There are some instances where the
[defense] secretary has some authority
with respect to definitional changes for
dependents ... but for most benefits, par-
ticularly involving spouses ... DOMA is a
big barrier,” Sarvis said.
Belkin also acknowledged that a num-
ber of tasks will remain even after cer-
tification takes place and open service
is implemented -- although he said he
doesn’t know if the Palm Center would be
the best organization to address them.
Among the outstanding jobs that
Belkin cited are providing employee re-
sources to liaison between gay troops
and the Pentagon; promoting public
education on transgender people in the
U.S. military; and working with the De-
partment of Veterans Affairs to create
programming for gay service members.
Beyond the upcoming year, Belkin
said he isn’t sure what tasks the Palm
Center will pursue, but added he sus-
pects consultation with other organiza-
tions could be on the agenda.
“We’ll be offering advice or pro-bo-
no consulting to any organization that
wants to learn some of the lessons that
we learned along the way about public
education and how to use social science
to inform public policy conversations,”
Belkin said.
Pro-LGBT groups that took on “Don’t
Ask, Don’t Tell” as part of a portfolio that in-
cluded other issues plan to continue to use
resources for other items on the agenda.
Fred Sainz, HRC’s vice president of
communications, said his organization
last year contributed about $3.5 million
to the “Don’t Ask, Don’t Tell” repeal effort.
But he cautioned against asking where
that money would go this year.
“It’s not necessarily a fair posit to say,
‘You have these resources, which you
dedicated to “Don’t Ask, Don’t Tell,” what
are you going to do with that pot of mon-
ey now?’” Sainz said. “Because as you
know, the [‘Don’t Ask, Don’t Tell’] issue
changed considerably over the course of
the year and we don’t yet know either the
opportunities or the vulnerabilities that
we have going into this coming year.”
One lingering question: What will anti-gay
groups dedicated to keeping “Don’t Ask,
Don’t Tell” on the books do now that legisla-
tive action on repealing the law is complete.
Elaine Donnelly, president of the Mich-
igan-based Center for Military Readi-
ness, was among the leading advocates
attempting to stop gays from serving

her favorite phrases.
The Center for Military Readiness
didn’t respond to multiple requests on
what the organization will pursue now
that legislation has been passed to re-
peal “Don’t Ask, Don’t Tell.”
Belkin noted that Donnelly pursued
keeping gays out of the military as part
of a broader effort that includes prevent-
ing women from serving in combat.
“Her broad concern is the feminization of
the military,” Belkin said. “So, there are a lot of
ways in which she has tried to roll the country
back to the 20th or the 19th century, so she
has plenty of culture wars left to fight.”
Whether groups that have focused
on “Don’t Ask, Don’t Tell” will have re-
duced resources now that legislative ac-
tion is complete also remains in question.
Sarvis said “time will tell” what kind
of resources SLDN will have as he ac-
knowledged the organization’s board
approved in November -- and reaffirmed
in December -- a slightly smaller budget
from what it had last year.
According to Sarvis, SLDN’s board
approved a budget for 2011 that was
around 12.5 percent smaller than it was
in 2010. He said it decreased from $2.4
million to $2.2 million.
Belkin said he doesn’t think the Palm
Center will have same budget as it had
in previous years and said the organiza-
tion plans to stop fundraising.
“We have endowments that will keep
sustaining us at a lower level capacity,
but, I think, for the most part, once “Don’t
Ask, Don’t Tell” is gone, then the biggest
part of our mission will be over, and we’ll
be one of those organizations that’s for-
tunate enough to say, ‘Our goals have
been met,’” Belkin said.
Servicemembers United couldn’t be
reached for comment on what the orga-
nization intends to pursue now that leg-
islative action on “Don’t Ask, Don’t Tell”
repeal is complete.

Gay man accused of
assaulting panhandler

to the panhandler. A judge released him
on his own recognizance while he awaits
a possible trial.
Perry and two friends who were with
him dispute the allegations, saying the
panhandler started the incident by call-
ing Perry a faggot and raising his fists
near Perry’s face when Perry refused the
man’s request for money.
“I never assaulted the guy,” Perry told
the Blade at the courthouse after his ar-
raignment. “I called him out for calling
me a faggot,” he said. “I was on 17th
Street on a gay street and I just wasn’t
going to take that.”
A police report filed in court, based on
accounts by the panhandler and an un-
identified witness, quotes Perry as call-
ing the panhandler a “faggot” at the time
Perry allegedly assaulted him.
“I will kill you. You’re a faggot,” the re-
port quotes Perry as saying. “I’m a real
faggot, bitch. You don’t want to fuck with
a real faggot, bitch. I will fucking kill you.”
When asked about the police report,
Perry said he never threatened to kill
the panhandler and never physically as-
saulted him. He said he used the word
faggot in the form of a question after the
panhandler hurled that word at him.
“What I said was, ‘faggot? I’ll show you
a faggot. I’ll whup your ass if you hit me,’”
Perry told the Blade. “I never threatened
to kill anybody.”
Perry continued, “Had he not thrown
the first punch I would have walked away
because honestly at that time I just want-
ed to go the McDonald’s and go … home.
“And he had to throw a punch and
that’s when I lost it because I don’t take
that shit,” he said. “I refuse to be victim-
ized. You know, if you act like a victim
you’re going to be treated like a victim.”
Roy Alexander, one of two friends who
were with Perry at the time of the inci-
dent, backed up Perry’s version of what
happened. He said that while Perry did
call the panhandler names as the two
“cussed at each other,” he never heard
Perry threaten to harm the man.
“I was right there,” Alexander said. “The
police talked to me. I told them what hap-
pened … The fact that I’m not even men-
tioned in the police report says something.”
“There’s been a lot of gay bashings
in this city, and we seem to get attacked
because we come across as weak,” Al-
exander said. “And now when someone
stands up for himself he gets accused of
a crime. This is just insane.”
D.C. police initially charged Perry with
a bias-related assault with a dangerous
weapon (a chain); felony threats; and
simple assault after the panhandler and
a witness told police Perry attempted
to strike the panhandler with a chain he
pulled from his pocket and punched the
man in the back.
The report says Second District Police
Officer La Vida Ellerbe, who is an affiliate
member of the police’s Gay & Lesbian Li-
aison Unit, was on the scene and played a
role in listing the incident as a hate crime.
The police report says the panhandler
and the witness reported that Perry swung
his chain at the panhandler and missed
hitting him. An attempt to hit someone is
considered an assault even if the attempt
fails under criminal assault laws.
According to the police report, the
panhandler and the witness said the
chain fell out of Perry’s hand and land-
ed on the ground and the panhandler
picked it up and started to run away. It
says Perry chased after the man. It says
the panhandler reported Perry punched
him in the upper back with a closed fist.
The witness reported seeing Perry “throw
a punch” toward the panhandler’s back,
the police report says.
Perry denies he swung the chain at
the panhandler, saying he swung it in
the air in a circular motion as a warning
that he would use it to defend himself if
the panhandler attacked him. Perry said
the panhandler swung the chain in the
same circular motion but leaned forward
toward him when the panhandler picked
up the chain after Perry dropped it.
Perry said that in the heat of the mo-
ment, after the panhandler raised his
fists like a boxer, he may have lunged at
the man with his fist “but I never actually
made contact.”
When told of the police report’s con-
tents, Alexander said he never saw Perry
wield the chain as if to attempt to strike
the panhandler. He said he did not hear
Perry threaten to assault or kill the pan-
handler as stated in the report.
At the courthouse, Perry said he
feared that the panhandler was about to
hit him because he raised his fists and
moved toward him as if he were going to
assault him.
He pleaded not guilty to the charg-
es and was released by a judge, who
agreed to a request by Assistant U.S.
Attorney James Perez that Perry be pro-
hibited from returning to the 1500 block
of 17th Street., N.W., where JR.’s is lo-
cated, until the case is resolved. Perry is
scheduled to return to court for a hear-
ing on Feb. 14.
William Miller, a spokesperson for the
U.S. Attorney’s office, said he couldn’t
immediately determine why prosecutors
didn’t classify the charges against Perry
as a hate crime. He said that similar to
all cases at the arraignment stage, pros-
ecutors could file additional charges at a
later date if new information surfaces to
warrant such charges.
“These are the initial charges,” he
said.
The police report describes Perry’s
chain as being between two and three
feet long and of “medium gauge.”

Obama commits to open service in SOTU

The president’s remarks suggested
that he will issue certification for repeal
of “Don’t Ask, Don’t Tell” before the end
of the year. Under the law Obama signed
on Dec. 22, repeal won’t take effect until
he, the defense secretary and the chair-
man of the Joint Chiefs of Staff certify the
U.S. military is ready for repeal.
Asked via e-mail to clarify whether the
remarks indeed mean Obama is com-
mitted to issuing certification before the
year is out, Shin Inouye, a White House
spokesperson, confirmed that indeed is
the president’s plan.
In a statement, Aubrey Sarvis, execu-
tive director of the Servicemembers Le-
gal Defense Network, said his organiza-
tion is “pleased” the president expects
that gays will be able to serve openly in
the U.S. military by the end of the year.
“In fact, we think there should be cer-
tification from the president, Secretary
Robert Gates and JCS Chairman Mi-
chael Mullen in this quarter,” Sarvis said.
“We need to make ‘Don’t Ask’ repeal a
reality sooner rather than later.”
Obama immediately followed his re-
marks on allowing gays to serve in the
military by stating that the time has come
for colleges to allow military recruiters
and ROTC programs back on campus.
Some schools had prohibited the mili-
tary from recruiting on campus because
“Don’t Ask, Don’t Tell” conflicts with their
non-discrimination policies.
“And with that change, I call on all our
college campuses to open their doors
to our military recruiters and ROTC,”
Obama said. “It is time to leave behind
the divisive battles of the past. It is time
to move forward as one nation.”
But Mara Keisling, executive director
of the National Center for Transgender
Equality, said schools with non-discrim-
ination policies protecting LGBT people
should continue prohibiting the military
from coming to campus — even after re-
peal of “Don’t Ask, Don’t Tell” — because
openly transgender people still aren’t al-
lowed in the armed forces.
“Students on campuses like Stanford
and Harvard have already pointed out
that the repeal of this policy, while an
improvement, still does not allow trans-
gender people to serve openly or to join
the military,” she said. “We support the
organizing efforts of students on those
campuses and others in continuing to
advocate for the exclusion of the military
from their campuses as long as the mili-
tary continues to discriminate.”
Obama mentioned other initiatives
during his speech that were welcome
news for LGBT advocates — even though
they weren’t specifically LGBT-related —
because they represented opportunities
to pass pro-gay legislation.

he “strongly believe[s]” Congress should
“take on” the issue of illegal immigration

and renewed his call for the passage of
comprehensive immigration reform.
“I am prepared to work with Repub-
licans and Democrats to protect our
borders, enforce our laws and address
the millions of undocumented workers
who are now living in the shadows,” he
said. “And let’s stop expelling talented,
responsible young people who could be
staffing our research labs or starting a
new business, who could be further en-
riching this nation.”
Passage of immigration reform could
present an opportunity to include the
Uniting American Families Act — legisla-
tion that would end restrictions prohibit-
ing bi-national same-sex couples from
staying together in the United States.
Steve Ralls, spokesperson for Immi-
gration Equality, said “it’s good to hear”
that immigration remains a priority for the
administration.
“It is an issue where there is room for
bi-partisan agreement,” Ralls said. “I
think on both sides of the political aisle,
there’s recognition that comprehensive
immigration reform needs to be tackled.”
Ralls said a UAFA-inclusive compre-
hensive immigration reform bill “does
provide the best opportunity to move
UAFA forward” in Congress.
Also during his speech, Obama ex-
pressed his desire to renew education
laws that are currently on the books,
which could present Congress the op-
portunity to pass the Student Non-Dis-
crimination Act or the Safe Schools Im-
provement Act.
Obama said the Bush-era No Child
Left Behind law should be replaced “with
a law that’s more flexible and focused on
what’s best for our kids.”
“You see, we know what’s possible
from our children when reform isn’t just a
top-down mandate, but the work of local
teachers and principals, school boards
and communities,” he said.
Passage of federal anti-bullying leg-
islation received renewed attention late
last year in the wake of a rash of suicides
of gay teens who reportedly took their
own lives after they had been bullied.
Despite Obama’s call to update feder-
al education laws, Eliza Byard, executive
director of the Gay, Lesbian and Straight
Education Network, said she’s disap-
pointed the president didn’t explicitly ad-
dress bullying in his speech.
“It was disappointing to hear nothing
about the need for schools to foster a
culture of respect amid all the talk of high
standards and in the wake of seismic
waves of tragedy for our community last
fall,” Byard said. “Students can’t achieve,
innovate and graduate if they’re scared
to go to school, and we all lose if they
grow up in a culture where difference is
despised.”
Other LGBT rights supporters also
expressed disappointment that Obama
didn’t go further in his speech to address
other issues, such as employment non-
discrimination and marriage rights.
Rea Carey, executive director of the
National Gay & Lesbian Task Force,
said Obama shouldn’t settle on repeal of
“Don’t Ask, Don’t Tell” as the final accom-
plishment for the LGBT community.
“If the president is truly serious about
job creation and boosting America’s
economic well-being, he must provide
leadership and action in helping to pass

employment protections for lesbian, gay,
bisexual and transgender people and
ending the costly and unjust federal mar-
riage ban,” Carey said.
But the president’s State of the Union
address predominantly focused on spur-
ring job growth through education and
infrastructure improvements as well as
deficit reduction by cutting federal gov-
ernment programs.
“Our free enterprise system is what
drives innovation,” Obama said. “But
because it’s not always profitable for
companies to invest in basic research,
throughout our history, our government
has provided cutting-edge scientists and
inventors with the support that they need.
That’s what planted the seeds for the In-
ternet. That’s what helped make possible
things like computer chips and GPS.”
Obama called this time for the country
a “Sputnik moment,” recalling how even
though the Soviet Union launched the
first person into space in the 1950s, the
United States was able to beat Russia in
the space race by landing the first per-
son on the moon.
In an online video response to the State
of the Union address, lesbian Rep. Tam-
my Baldwin (D-Wis.) said the president
“put out a challenge not just to compete
to the global marketplace, but to win.”
“We know that in order to do that, we
need to have the best educated work-
force, the most innovative scientists and
the most creative entrepreneurs,” Bald-
win said. “I’m excited about this chal-
lenge because I know we can do it — and
I plan on bringing some great Wisconsin
ideas to the table as we respond to this
challenge.”

The thrill of “Don’t Ask, Don’t
Tell” repeal has left some LGBT
rights advocates whipped into
a froth about continued advanc-
es, despite the outcome of the
mid-term elections.
Suddenly, we’re expecting
the president to endorse mar-
riage equality in the State of the
Union address.
“Why not save everyone on
both sides of the debate a lot
of time, trouble and money
by approving the entire gay
rights agenda,” wrote Dan
Savage in a Sunday New York
Times piece.
Savage should stick to sex
advice. As Rep. Barney Frank
told the Blade in November,
there’s zero chance of any pro-
LGBT advances so long as Rep.

bar and boosted expectations
after “Don’t Ask” repeal and

America’s unjust immigration
laws that prohibit an American
citizen from sponsoring their
foreign-born, non-U.S. citizen

a heterosexual American citizen

President Obama will endorse
marriage equality — maybe
even before the 2012 election
— but it wasn’t going to hap-
pen in the State of the Union
address. How quickly we for-
get that in President George W.
Bush’s 2004 State of the Union
address (just seven years ago),
he said, “Our nation must de-
fend the sanctity of marriage.”
Bush added that a constitution-

We have been deprived health
and happiness while our hetero-
sexual counterparts are permit-
ted such freedoms. One can only
imagine the mental anguish that
my government has placed on
me and that it fails in promoting
my welfare as a U.S. citizen.
Over the past three years
I have been a volunteer with
a grassroots organization
called OUT4Immigration. We
have been diligently working

member watching that speech
in disbelief, stunned that a U.S.
president would use his most
prominent speech of the year,
which is watched around the
world, to denounce our relation-

of Obama’s record on LGBT
rights, there can be no doubt
that he views us as part of his
America and his agenda. Yes,
we should press him to do bet-
ter, but let’s not lose perspective
in our post-“Don’t Ask, Don’t
Tell” exuberance.
His support for same-sex
marriage is well known from that

ness and congressional sup-
port for the potential passage

States in order to be with their

too, am faced with this heart-
breaking decision of choosing
between love and country but
I cannot live my life on hold
any longer and I plead for in-
creased support for the pas-
sage of UAFA.

With a few exceptions,
Obama has been a remark-
ably supportive president
and no one believes he op-
poses marriage equality; he
just doesn’t deem it political-
ly smart to announce it right
now. But it’s coming.
In the meantime, we should
be working to advance mar-
riage rights in Maryland and
Rhode Island; to prevail in
a number of court cases on
marriage, adoption and trans
rights; and to fight GOP efforts
to repeal marriage equality in
New Hampshire. There’s plenty
of work to do and there will be
victories in the next two years.
Just don’t look to Congress to
deliver them.

Succinct cinema

The long and the short of it is that no one can really
agree on what’s a film short.
The Academy of Motion Picture Arts and Sciences,
annual purveyor of the coveted Oscars and arbiter of
film in general, draws the boundary line between feature
length and short films at 40 minutes. The Internet Movie
Database draws the line at 45 minutes.
The only rough consensus today is that short films are
not seen as commercial, that they are typically the first
stage for young filmmakers and that the main venue to see
them is at film festivals and on Internet sites like YouTube.
But some of the edgiest and most creative film work
today is in these short subjects. And the D.C. Film Alli-
ance brings a batch of them for viewing in clusters, to-
night and Saturday night, in the D.C. Shorts Film Festival
at the Atlas Performing Arts Center, on D.C.’s H Street
N.E. corridor. Some of the best from the past seven
years of the festival are being billed as “Rewind” and
some of those, grouped together under the heading of
“Diversity,” focus on LGBT issues. Four of those films are
shown tonight at 7:30 p.m.

this weekend’s shorts festival
comedies especially were the norm for early film fare —
with a total of 220 shorts alone filmed by the Hal Roach
Studio for the “Our Gang” series (otherwise known as
“The Little Rascals”), from the 1920s through 1944.
Many of Charlie Chaplin’s “Little Tramp’ comedies were
shorts and so were the early films of Buster Keaton and
Laurel and Hardy.
In the 1930s, the system of distributing film to movie
houses changed radically as studios began to insist on
sending out a package — take it or leave it — consist-
ing of a main and supporting feature and a cartoon and
newsreel. The so-called “two-reel shorts” promptly went
into commercial decline and even Hal Roach moved Lau-
rel and Hardy full-time into feature-length films after 1935.
“The magic of making a short film is in reducing a story
line to the bare essentials, getting to the heart fast and cut-
ting out all the fluff,” says D.C. Shorts festival sponsor Jon
Gann, director of the D.C. Film Alliance. He acknowledg-
es, however, that “the sad part is that nearly all short films
go unseen by audiences and we’re here to change that.
Where else can you see around 10 films in two hours?”
He’s glad that with the surge of new interest in film-
ing shorts has also come a spurt of interest in viewing
them. One pay TV channel, ShortsTV, is the first chan-

nel wholly dedicated to them, and the BBC Film Net-
work also showcases curated shorts. And every year,
London-based Shorts International, which in addition to
ShortsTV also offers an HD channel of shorts on the Dish
satellite network, arranges for the release in movie the-
aters of the current crop of Oscar-nominated shorts — to
be shown this year for one week beginning Feb. 11 at
the Landmark E Street Cinema in D.C.
Gann expects the D.C. upsurge of interest in film
shorts to continue with a sizable audience turnout for
this weekend’s festival. He also hopes that people will
be interested enough to ask to join the selection com-
mittee for the 2011 festival to be held here in September.
This weekend there are specialty blocks planned for for-
eign films, local films, documentaries and animation, as
well as those pitched to LGBT tastes. Free films for the
family are also offered at noon at Saturday.
Four of the LGBT themed shorts are shown under the
rubric of “Celebrating Diversity” tonight at 7:30. Another

The Alvin Ailey American Dance Theater is celebrating its 50th anniversary with

Breaking the ‘Rules’
Two-year-old gay-helmed
theater company takes
unexpected approach

Starting a new theater company is
daunting. To start up with a dual-city op-
eration is downright loco.
But that’s exactly what the founders of
No Rules Theatre Company did, and af-
ter almost two years of mounting produc-
tions in both Washington and Winston-
Salem, N.C., they are off and running.
Lead by three 20-something University of
North Carolina School of the Arts alums
(managing producer Anne Kohn and co-
artistic directors Brian Sutow and Joshua
Morgan, who is gay), the burgeoning
company is striving to fulfill its mission of
presenting broad-spectrum, high qual-
ity theater and making plans for a third,
vastly expanded season.
Initially, actor/director Morgan was un-
interested in being part of a new theater
company. “There were so many already. I
wasn’t so sure that the world really needed
yet another one,” he says.
But after Kohn, Morgan and Sutow de-
cided to move their North Carolina produc-
tion of John Cameron Mitchell’s trans-glam-
punk rock musical “Hedwig and the Angry
Inch” to Washington for a second run in
June of 2009, the trio (who are now all D.C.-
based) was so encouraged and embraced
by the local theater community that Morgan
rather speedily changed his mind.
Soon after, the newly formed group’s
dual city model began to take shape.
“At first I thought it was crazy to focus on
two markets, but now I see it as a major ad-
vantage in building strong projects through
longer runs and being able to tap into more
than on market for fundraising,” says Jere-
my Skidmore talented D.C. director and No
Rules board member. “Another advantage
is that No Rules was started by a group of
people who all spent years in school togeth-
er. Jumping into a venture with an ensemble
of people who actually share the load and
know how to work together is huge.”
Morgan says, “Playing in two cities
is challenging both logistically and in
terms of the plays we present. What flies

to be as well-received in Washington. For
instance, earlier this season some D.C.
theatergoers turned their noses up to
our production of ‘You’re a Good Man,
Charlie Brown.’ Similarly, some audience
members in Winston-Salem have had
problems with the sex scenes in ‘Touch’
(the company’s current production di-
rected by Morgan and opening next
week at H Street Playhouse) which are
incredibly tame by D.C. standards.”
At first, the young company shied away
from tackling “Touch,” Toni Press-Coffman’s
drama about a young astronomer who at-
tempts to rebuild his life with a vulnerable
prostitute after his wife is brutally murdered.
The 15-member group’s leadership agreed
that it was a difficult play that required in-
credibly special actors; it was something
they thought they might want to revisit after
a few seasons. But when it came time to se-
lect a play to follow their frothy fall musical
(“You’re Good Man, Charlie Brown”), they
reconsidered.
“Because our mission is truly to pres-
ent broad programming for a wise audi-
ence base that’s experiential and viscer-

Indication and Important Safety Information

VIRAMUNE is indicated for use in combination with other antiretroviral agents
for the treatment of HIV infection.
VIRAMUNE does not cure HIV or AIDS, and has not been shown to reduce the
risk of passing HIV to others through sexual contact or blood contamination.
VIRAMUNE can cause severe liver disease and skin reactions that can cause
death. These reactions occur most often during the first 18 weeks of treatment,

Do not take VIRAMUNE if you have severe liver problems.
The dose of VIRAMUNE for adults is one 200-mg tablet daily for the first 14 days,
followed by one 200-mg tablet twice daily. VIRAMUNE is always taken with
other anti-HIV medications. The 14-day lead-in period is important because it
can help reduce your chances of getting a potentially serious skin rash. If you
have a skin rash during the first 14 days, immediately contact your doctor and

VIRAMUNE® (VIH-rah-mune)
(nevirapine) Tablets
VIRAMUNE® (VIH-rah-mune)
(nevirapine) Oral Suspension
Read this Medication Guide before you start taking VIRAMUNE and each time you
get a refill. There may be new information. This information does not take the
place of talking to your doctor about your medical condition or treatment.
What is the most important information I should know about
VIRAMUNE?
VIRAMUNE can cause serious side effects. These include severe liver and
skin problems which can cause death. The risk of these problems is greatest
during the first 18 weeks of treatment, but these problems can also happen at
any time during treatment.
Severe liver problems: Anyone who takes VIRAMUNE may get severe liver
problems. In some cases, these liver problems can lead to liver failure and the
need for a liver transplant, or death. You may get a rash if you have liver problems.
People with higher risk of these problems include women or anyone with higher
CD4+ cell counts when they begin VIRAMUNE treatment. Women with CD4+ cell
counts higher than 250 cells/mm3 at the start of treatment have the greatest risk
for liver damage.
If you are a woman with CD4+ cell >250 cells/mm3 or a man with CD4+ cell >
400 cells/mm3, you and your doctor will decide if VIRAMUNE is right for you.
People who have abnormal liver test results and people with hepatitis B or C
have a greater chance of getting liver problems and further increases in liver test
results during treatment.
If you get any of the following symptoms of liver problems, stop taking
VIRAMUNE and call your doctor right away:
• fever
• “flu-like” symptoms or you do not feel well
• dark (tea-colored) urine
• tiredness
• light-colored bowel movements (stools)
• nausea (feeling sick to your stomach)
• pain or tenderness on your right side below your ribs
• loss of appetite
• yellowing of your skin or whites of your eyes
Your doctor should see you and do blood tests often to check your liver function
during the first 18 weeks of treatment with VIRAMUNE. You should continue to
have your liver checked regularly during your treatment with VIRAMUNE. It is
important for you to keep all of your doctor appointments.
Severe rash and skin reactions: Skin rash is the most common side effect of
VIRAMUNE. Most rashes happen in the first 6 weeks of taking VIRAMUNE. Rashes
and skin reactions may be severe, life-threatening, and in some people,
may lead to death. If you get a rash with any of the following symptoms,
stop using VIRAMUNE and call your doctor right away:
• “flu-like” symptoms or you do not feel well
• blisters
• fever
• mouth sores
• muscle or joint aches
• swelling of your face
• red or inflamed eyes, like “pink eye” (conjunctivitis)
• tiredness
• swollen glands (enlarged lymph nodes)
• liver problems (see symptoms of liver problems above)
If your doctor tells you to stop treatment with VIRAMUNE because you have
had the serious liver or skin problems described above, you should never
take VIRAMUNE again.

These are not all the side effects of VIRAMUNE. See the section “What are the
possible side effects of VIRAMUNE?” for more information.
What is VIRAMUNE?
VIRAMUNE is a medicine used to treat Human Immunodeficiency Virus (HIV), the
virus that causes AIDS (Acquired Immune Deficiency Syndrome).
VIRAMUNE is a type of anti-HIV medicine called a “non-nucleoside reverse
transcriptase inhibitor” (NNRTI). VIRAMUNE works by lowering the amount of
HIV in your blood (“viral load”). You must take VIRAMUNE with other anti-HIV
medicines. When you take VIRAMUNE with other anti-HIV medicines, VIRAMUNE
can lower your viral load and increase the number of CD4+ cells (“T cells”). CD4+
cells are a type of immune helper cell in the blood. VIRAMUNE may not have these
effects in every person.
VIRAMUNE does not cure HIV or AIDS, and it is not known if it will help you live
longer with HIV. People taking VIRAMUNE may still get infections common in
people with HIV (opportunistic infections). It is very important that you stay under
the care of your doctor.
Who should not take VIRAMUNE?
Tell your doctor if you have or have had liver problems. Your doctor may tell you
not to take VIRAMUNE if you have certain liver problems.
VIRAMUNE is only for people diagnosed with HIV. If you have not been diagnosed
as HIV positive, then do not take VIRAMUNE.
What should I tell my doctor before taking VIRAMUNE?
Before you take VIRAMUNE, tell your doctor if you:
• have or have had hepatitis (inflammation of your liver) or problems with your
liver. See “What is the most important information I should know about
VIRAMUNE?” and “Who should not take VIRAMUNE?”
• receive dialysis
• have skin problems, such as a rash
• are pregnant or plan to become pregnant. It is not known if VIRAMUNE will
harm your unborn baby.
Pregnancy Registry: There is a pregnancy registry for women who take
antiviral medicines during pregnancy. The purpose of the registry is to collect
information about the health of you and your baby. Talk to your doctor about
how you can take part in this registry.
• are breast-feeding or plan to breast-feed. VIRAMUNE can pass into
your breast milk and may harm your baby. It is also recommended that
HIV-positive women should not breast-feed their babies. Do not breast-feed
during treatment with VIRAMUNE. Talk to your doctor about the best way to
feed your baby.
Tell your doctor and pharmacist about all the medicines you take, including
prescription and non-prescription medicines, vitamins and herbal supplements.
VIRAMUNE may affect the way other medicines work, and other medicines may
affect how VIRAMUNE works. Especially tell your doctor if you take:
• St. John’s Wort. You should not take products containing St. John’s Wort
during treatment with VIRAMUNE because it can lower the amount of
VIRAMUNE in your body.
• efavirenz (Sustiva®, Atripla®). You should not take efavirenz during treatment
with VIRAMUNE. You may have an increased chance of side effects if this is
taken together with VIRAMUNE.
• atazanavir (Reyataz®). You should not take atazanavir during treatment
with VIRAMUNE.
• itraconazole (Sporanox®). You should not take itraconazole during treatment
with VIRAMUNE.
• ketoconazole (Nizoral®). You should not take ketoconazole during treatment
with VIRAMUNE.
• rifampin (Rifadin®, Rifamate®, Rifater®). You should not take rifampin during
treatment with VIRAMUNE.
• Birth control pills. Birth control pills taken by mouth (oral contraceptives) and
other hormone types of birth control may not work to prevent pregnancy if
you use them during VIRAMUNE treatment. Talk with your doctor about other

types of birth control that you can use to prevent pregnancy during treatment
with VIRAMUNE.
Also tell your doctor if you are taking the following drugs:
• clarithromycin (Biaxin®)
• fluconazole (Diflucan®)
• methadone
• rifabutin (Mycobutin®)
Know the medicines you take. Keep a list of them to show your doctor or
pharmacist when you get a new medicine.
How should I take VIRAMUNE?
• Take VIRAMUNE exactly as your doctor tells you to take it.
• The dose of VIRAMUNE for children is based on their size and thus may not
be the same as in adults.
• You may take VIRAMUNE with or without food.
• If you or your child takes VIRAMUNE suspension (liquid), shake it gently
before use. Use an oral dosing syringe or dosing cup to measure the
right dose. The oral dosing syringe and dosing cup are not provided with
VIRAMUNE Suspension.
• After drinking the medicine, fill the dosing cup with water and drink it to
make sure you get all the medicine. If the dose is less than 1 teaspoon
(5 mL), use the syringe instead of the dosing cup.
• Do not change your dose unless your doctor tells you to.
• Your doctor should start you with one dose each day to lower your chance
of getting a serious rash. It is important that you only take one dose of
VIRAMUNE each day for the first 14 days.
• Call your doctor right away if you get a skin rash during the first 14 days of
VIRAMUNE treatment and do not increase your dose to 2 times a day.
• You should never take your starting dose (200 mg one time each day) for
longer than 28 days. If after 28 days you are still receiving this starting dose
because you have a rash, you and your doctor should discuss replacing
VIRAMUNE with another HIV medicine. Never increase your dose to 2 times a
day if you have a rash.
• Do not miss a dose of VIRAMUNE, because this could make HIV harder to
treat. If you miss a dose of VIRAMUNE, take the missed dose as soon as you
remember. If it is almost time for your next dose, do not take the missed
dose, just take the next dose at your regular time.
• If you stop taking VIRAMUNE for more than 7 days, ask your doctor how much
to take before you start taking it again. You may need to start with one time
each day dosing again.
• If you take too much VIRAMUNE, call your local poison control center or
emergency room right away.
What are the possible side effects of VIRAMUNE?
VIRAMUNE may cause serious side effects.
• See “What is the most important information I should know about
VIRAMUNE?”
• Other common side effects of VIRAMUNE include nausea, fatigue, fever,
headache, vomiting, diarrhea, abdominal pain, and muscle pain.
• Changes in your immune system (Immune Reconstitution Syndrome)
can happen when you start taking HIV medicines. Your immune system
may get stronger and begin to fight infections that have been hidden in your
body for a long time. Tell your doctor if you start having new symptoms after
starting your HIV medicine.
• Changes in body fat can happen in some people who take antiretroviral therapy.
These changes may include increased amount of fat in the upper back and neck
(“buffalo hump”), breast, and around the middle of your body (trunk). Loss of fat
from your legs, arms, and face can also happen. The cause and long-term health
effects of these problems are not known at this time.
Tell your doctor if you have any side effect that bothers you or that does not
go away.
These are not all the possible side effects of VIRAMUNE. For more information,
ask your doctor or pharmacist.
Call your doctor for medical advice about side effects. You may report side
effects to FDA at 1-800-FDA-1088.
How should I store VIRAMUNE?
• Store VIRAMUNE at 59° to 86°F (15° to 30°C).
• Throw away VIRAMUNE that is no longer needed or out-of-date.
Keep VIRAMUNE and all medicines out of the reach of children.
General information about VIRAMUNE
Medicines are sometimes prescribed for purposes other than those listed in a
Medication Guide. Do not use VIRAMUNE for a condition for which it was not
prescribed. Do not give VIRAMUNE to other people, even if they have the same
condition you have. It may harm them.
This Medication Guide summarizes the most important information about
VIRAMUNE. If you would like more information, talk with your doctor. You can
ask your pharmacist or doctor for information about VIRAMUNE that is written for
health professionals.

Last weekend to catch
several worthy productions
in the D.C. area

Good and evil, theology and science,
past and present — these polarities
loom large in four plays now on stage in
Washington.
Closing Sunday, a Keegan Theatre
production at the Church Street The-
ater is the world premiere of Peter Coy’s
multi-layered melodrama about history, “A
Shadow of Honor,” the story of two fami-
lies, each haunted by the ghosts of two
wars — the Civil War and the Vietnam War
— and the dead who gave the last full
measure of devotion with their bloodshed.
“It is those I killed who are truly
damned by God” thunders the alcoholic
William Ruffin (ably played by Mark A.
Rhea, Keegan’s founder and produc-
ing artistic director), author of the cold-
blooded murder that happened in Nel-
son County, in Virginia’s Shenandoah
Valley in 1907, an incident discovered by
Hamner Theater co-artistic director and
playwright Coe in what he calls “a mur-
der motivated by honor.”
The scene is set in the same house, with
two troubled families in two places in time,
1907 and 2007. When past and present
collide, something must give. And in each
case, the smoking gun is murder, one
committed by an 11-year-old boy when
begged to pull the trigger by his father,
damaged goods from Vietnam where he
had earned, at great cost, a Silver Star. An-
other shadow falls with the gunfire in 1907,
when Ruffin decides he must kill the man
who deflowered his daughter and swears
that “I’m a hero in the eyes of all true South-
erners.” He tells his daughter, “I’ve taken
my stand,” and later, “I love the South even
though it exists no more!”

The play — performed in Hebrew and
Arabic, with English surtitles — is a med-
itation on trauma and how to move be-
yond such wounds. Kanafani himself, as-
sassinated in a 1972 car-bomb, probably
by the israeli Mossad, was a spokesman
for the militant Popular Front for the Lib-
eration of Palestine, viewed by Israel and
Western governments at the time as a
terrorist group. Yet in his novella, he ac-
knowledged that Jews in Israel had also
suffered, not just Arabs, and his empathy
for such suffering marked his work as an
unusual document to help build bridges.
But even so, in Israel, most theater com-
panies turned down the chance to pro-
duce “Return to Haifa” until the Cameri
Theater stepped forward, and the pro-
duction itself was dogged by protestors
from Israel’s anti-Arab far-right.
The play is gripping for its look into the
heart of anger and the soul of reconcilia-
tion. You will not soon forget the feelings it
can stir. But Theater J has sought ways to
go beyond these feelings, however, with a
companion series of other plays and dis-
cussions it calls “Voices from a Changing
Middle East: Portraits of Home,” including
on Sunday night the play by Ben Brown,
“The Promise,” set in London in 1917
when the future president of Israel, Chaim
Weitzman maneuvered with British nota-
bles to support the right of Jews to return

Your accountant is so proud of you.
Like the good saver you are, you’ve
tried to invest a little money here and
there. A few acres of land, maybe, or
a good education for you or the kids.
Perhaps you’ve even stuck a buck into
stocks or bonds for the future.
If Chester “Chess” Garrity had his
way, you’d invest in antiquities. He’s got
valuable loot on his hands and in the
new book “The Cruel Ever After” by Ellen
Hart, he needs to get rid of it, pronto.
But first, he needed to stop drinking.
That was obvious to Chess as he disen-
tangled himself from Melvin Dial’s back
porch on a sunny Minnesota morning.
Though his head was pounding, the
night of poker and booze would be worth
every minute if Dial bought the ancient
bull statue that Chess had to sell.
But that would never happen. Making
his way through the house, Chess found
himself staring at the corpse of Melvin Dial.
Stunned and panicky, Chess looked
up his old friend, Jane Lawless. He
needed someplace to think, and Jane
was goodhearted and discreet.
Years ago, they were married briefly,
just long enough for Chess to get his in-
heritance. It was a union meant only for
money, so when Chess pocketed the
cash, he gave Jane a portion and they
split amiably. Jane set herself up with
a restaurant in downtown St. Paul, and
since it wasn’t exactly a love match —
she was gay and she’d assumed Chess
was, too — she decided to keep the
whole thing secret.
But Chess wasn’t gay; in fact, he was
having an affair with a married woman.
He and Irena Nelson had met in Istan-

bul and had a quick, urgent fling. Chess
professed love and Irena agreed to help
him sell the antiquities he had in his pos-
session, all stolen from the Baghdad Mu-
seum. Irena’s mother owned Morgana
Beck Gallery of Antiquities. Getting rid of
ancient Iraqi pieces wouldn’t be difficult.
But Chess never counted on any-
body getting killed, and Irena was acting
weird. So when she “lost” the golden bull Tsunami

A successful fitness
program is one that’s
geared for the long haul

Every year since 2007, industry leader
the American College of Sports Medicine
has been conducting a survey among
fitness professionals to determine the
most widespread exercise and fitness
trends in the health and fitness industry.
The survey results in the top 20 predict-
ed worldwide fitness trends that gener-
ally have health clubs and equipment
manufacturers taking notice and making
adaptations to support this valuable in-
formation.
What’s the difference between a fad
and a trend? Fads are short lived and
can often take the general population
by storm. The fitness industry tends to
avoids fads and looks to a trend that will
sustain in the long run and avoid the stig-
ma of being labeled a fad as fads often
come and go quickly.
The College defines a trend as “gen-
eral development or continued change in
the way people are behaving” versus a
fad described as “a fashion that is taken
up with great enthusiasm for a brief pe-
riod.”
Trends are long-term changes or evo-
lutions that fitness companies base their
product development on and group ex-
ercise professionals will base their type
of exercise classes upon.
So why is it important to distinguish
between fads and trends particularly in
relation to exercise options? Because
generally fads as related to exercise
tend be geared to quick fixes with often
under-researched or unproven research.
Fads are wide-eyed claims if you will.
Whereas trends are more sustainable
over time and often increases in popu-
larity. Trends also tend to be more thor-
oughly evidence based.
Two popular fads were the no-carb
diet, and spot-reduction exercises, both
of which support little scientific evidence.

mill, which has been popular and effec-
tive for decades. The elliptical machine,
while not as popular, is another trend.
And strength training has been a consis-
tent trend for years.
The number one fitness trend four
years in a row is “educated and experi-
enced fitness professionals,” good news
once more for the consumer. The num-
ber five spot goes specifically to person-
al training. Respondents to the survey
believe that personal trainers are here to
stay and will continue to be an important
part of the professional staff of health
and fitness centers.
Strength training is number three on
the list for 2011 and has been on the list
and growing in popularity for the past
few years.
Strength training has been empha-
sized as a crucial component of an ef-
fective well-rounded exercise program
for years.
“Boot camp,” “core conditioning,”
“children and chesty” and “fitness pro-
grams for older adults” all fall within the
top 10 fitness trends for 2011. While all of
these have been on the top 20 list for a
few years, fitness programs for the older
adults jumped from number six to num-
ber two. This upswing can be attribut-
able to the baby boom generation aging
into retirement and having more discre-
tionary income.
So what fell out of popularity? Pilates.
Don’t get me wrong, I love Pilates and
it has proven core conditioning and
strengthening elements, but according
to this survey it did not make the top 20
after being at number nine last year. A
possible explanation, according to the
Personal Training Business School “is
that perhaps Pilates was a fad and not a
trend at all.”

‘Diva’
A seven-minute short from France,
this film (in French with subtitles) from the
D.C. Shorts 2007 festival is about mid-
dle-aged Vincent, a cross-dresser leav-
ing behind home and a failed romance.
His heart is broken when his lover breaks
off their 12-year relationship, telling him
bluntly on the phone, “I’m not a faggot
and I never want to see you again.”
Vincent blurts out that he will leave “this
little shit town forever” and move to Paris.
Portrayed with poignant grace by Thomas
Courcoul, we see him arrive at his Paris
hotel ready now for a new life, but still
sobbing, sniffling away his tears, until fi-
nally relief comes with his sudden laugh at
how pathetic he feels. He begins to finger
fondly a pink feather boa and then shaves
his chest (but only at the bra-line) and ap-
plies makeup, lipstick and wig. Next he is
strolling a Paris park in a dress and pink
pumps and matching pink hat and hand-
bag, conveying a touch of further glamour
(as well as to conceal any lingering tears)
with Jackie-O dark glasses.
After a park carousel ride in a private
reverie feeling so free, a young tough
suddenly snatches Vincent’s purse, and
the chase is on. Swiftly doffing wig, hat
and pumps, Vincent pursues the purse
snatcher with preternatural feline grace
and in a muscular showdown retrieves
her purse, and then stands over him, bur-
ly and strong. As the would-be thief slinks
away, Vincent looks at first triumphant but
then sobs and retraces her steps, until fi-
nally she sits alone, her face a mask of
feelings but with pride as well as resolve
and determination taking first place.
Writer-director Josephine MacKerras,
a filmmaker living now in both Paris and
London, but with a childhood spent in
Australia and China, studied filmmaking
at New York University. “Diva” is a work
of real cinema skill, a simple story that
whets your appetite to see more, leaving
you wondering about what came before
and about what might happen next.
‘Freedom on the Rocks’
The only gay bar in Jerusalem,
Shushan, is a melting pot for LGBT
Jews and Palestinian Arabs alike. In this
10-minute documentary by Yun Suh, Ko-
rean-American Buddhist and bisexual, a
TV journalist and documentarian based
in Berkeley, Calif., we hear from the bar
owner, 35-year-old Sa’ar Netanel, that
“Jerusalem is really a city of borders
— there is a border between Jews and
Palestinians, between secular and ultra-
Orthodox, between straight and gay.”
Netanel, a secular Jew, opened the bar
in 2003, the same year he won election
as Jerusalem’s first openly gay city coun-
cil member. He admit that “when I read in
the Bible that I could be killed for being
gay, I understood what it was like to be
Palestinian.”
The film features interwoven stories
of the daily fight for dignity by five Israe-
lis — three Jews and two Arabs — who
navigate the minefield of politics, religion
and discrimination to live and love open-
ly, set against the construction by Israel
of the separation wall and the struggle
for a gay pride parade in the city.
“Everyone comes from their own ghet-
to,” says Sa’ar, “and meets at Shushan.”
Yun Suh says, of the five, “here’s a
group that has been cast away by both
sides but is modeling for the larger so-
ciety what tolerance and co-existence
can look like.” But it begins as trouble
squared, for each of them is breaking
two of the biggest taboos of Middle east-
ern society — same-sex relations and in-
timacy between Jews and Arabs.
“It’s hard to be gay in Ramallah,” says
one of them, 19-year-old Boody, a nick-
name for the devout Muslim Palestinian
who is shown on his prayer rug but also
dancing at Shushan as a drag queen —
the self-styled “Queen of Palestine.” With
Yun Suh’s camera crew behind him, we
also follow the slender and attractive
Boody making his way at night from Ra-
mallah, the Palestinian city divided from
Jerusalem by the wall which he easily
scales, also crawling through razor-wire
and dodging Israeli Defense Force bor-
der patrols to reach the sanctuary of
Shushan. The film ends when Boody de-
cides he must leave home — where his
mother cannot accept that he is gay and

stills hope he will marry - for the U.S., his
eventual refuge, and he now lives in a
small town near Cleveland.

tor, Ravit Geva, lovers for four years who
work at the same hospital, who embrace
each other but also face tension between
them over ethnicity and the Intifada.
‘Gayby’
This 2010 comedy is 12 minutes of
droll social commentary and pure film
farce about the wish of Jenna, a perma-
nently single woman, to persuade her
gay best friend to help her make a baby,
the old-fashioned way, not in a test-tube
or with a turkey baster. It’s a comedy but
it’s well enough written and directed by
Jonathan Lisecki that the meeting of the
two old friends to discuss this awkward
topic and then in the bedroom to con-
summate it moves beyond the merely
topical to the truly human.
Actor Matthew Wilkas portrays the
disbelief at first and then the growing
discomfort Jenn’s friend feels as the ac-
tion moves swiftly towards the coital en-
counter. Yes, he concedes, that they had
done it before, in college, but insists that
“we were really, really drunk when we
did it” then. But when she asks him if he
thinks he can still “do it,” his male bra-
vado immediately asserts itself - “What is
this, a dare? Yes, I can do it, I can put it
in anything. I’m a guy.”
Lisecki shows a sure hand with this
short look at a real-life dilemma that
could almost be credible, between two
old friends each playing on a different
team. He lives in New York City among
those in the milieu of “Jenn” (well acted
by Jenn Harris) and her friend Matthew,
and is married to New Yorker magazine
music critic Alex Ross.
‘The Queen’
This clever-but-touching eight-minute
comedy, from the D.C. Shorts festival in
2009, is by another Korean-American
writer-director, Christina Choe, based
now in Brooklyn where she’s an master’s
of film art candidate for writing-directing
at Columbia University. She calls “The
Queen” — which was selected as “Best
of Fest” at the Palm Springs International
Short Film Festival” and has also made
the rounds of LGBT film festivals — a film
about a nerdy Korean-American teenage
boy, Bobby, stuck working at his family
dry-cleaning business on prom night.
Instead of doing his algebra, Bobby is
doodling a sketch of a superhero, outlin-
ing the crotch with hungry relish, while
being bothered by his mother (played
by Choe’s own mother) who wants only
to know about his plans for college and
lecturing him that his grades aren’t good
enough. When she departs, leaving
Bobby to clear the register and lock up,
he relents and opens the door when the
high school prom queen begs to be let in,
claiming a “fashion emergency” with her
dress. But he only agrees to admit her
after hours when he sees her hunky boy-
friend, played by actor Tamir Kapelian.
This leads to a fantasy interlude that’s
both poignant and funny. Bobby is well
played by 19-year-old Sean Tarjyoto.
