South Sudan invites Transnational
Govt of Tamileelam for their
independence celebration
Sudan Peoples’ Liberation Movement
(SPLM) has invited Transnational Govern-
ment of Tamil Eelam (TGTE) to visit South-
ern Sudan in the immediate aftermath of the
vote for an independent state.
TGTE is sending a delegation to participate in
the celebrations and to discuss possibilities of
assisting Southern Sudan in their development
efforts through Tamil Diaspora expertise in se-
lected fields. TGTE delegation will be received
by the SPLM officials and will stay as guests of
SPLM. They will also meet other foreign govern-
ment leaders.
The press release issued by the Prime Minis-
ter's Office further said:
The relationship with SPLM and TGTE is noth-
ing new. SPLM sent its Secretary General for
the United States, Mr. Domach Wal Ruach, to
speak at TGTE’s inaugural event held in
Philadelphia in May 2009. On that occasion, he
spoke of the similarities between the independ-
ence struggle of Tamil Eelam and that of South-
ern Sudan. He also spoke of the challenges

TGTE Prime Minister, Mr. Visuvanathan
Rudrakumaran in his message stated that “The
invitation received by us is considered recogni-
tion not only of the TGTE but also of the Eelam
struggle. TGTE is calling on Eelam Tamils to
celebrate the freedom of Southern Sudanese
people. Eelam Tamils can clearly understand
the joy of Southern Sudanese becoming free
people and share their happiness.”
SPLM has been leading the struggle for inde-
pendence by the people of Southern Sudan
from North Sudan. SPLM as the overwhelmingly
popular group will form the government of inde-
pendent Southern Sudan. Years of enormous
suffering of the
people of Southern Sudan will at last come to
an end with the birth of a nation of their own.
Around two million people have died during the
struggle. Civilians were massacred, and people
died of starvation and without medical help.

Eelam Tamils can reflect on the years of suffer-
ing they have undergone in the name of inde-
pendence and feel confident that Eelam too will
be free like South Sudan.
President Obama’s op-ed in New York Times on
the day of the Referendum stated: “Millions of
Sudanese are making their way to the polls to
determine their
destiny.” TGTE is applauding President
Obama’s statement and calls upon the interna-
tional community to give an opportunity for
Eelam Tamils to determine their destiny the
same way.
Eelam Tamils already spoke loud and clear dur-
ing the Parliamentary elections in 1977, when
they overwhelmingly voted for the Tamil Party
that ran on the basis of the Vaddukkoddai Reso-
lution which called for the creation of an inde-
pendent state of Tamil Eelam. This peaceful
expression of Eelam Tamils - long before the
armed struggle began in Sri Lanka - clearly indi-
cated the preferred position of the Tamils. Re-

as a remedy that ensures their very physical
survival.
Both for the Sudanese regime and present Sri
Lanka regime, China has been the influential in-
ternational patron. Sudanese President Bashir
has been indicted for genocide and the Sri
Lankan President Rajapaksa is to be indicted
for genocide at some point in time.

Today, I filed a Complaint seeking $30
million in damages on behalf of three
courageous Plaintiffs against Sri
Lankan President Mahinda Rajapaksa
in the United States District Court for
the District of Columbia. The legal ac-

Canada’s decision on Tamil refugee
claims, unrealistic
Canada rushed to take its stance on Sri
Lanka just days before the Canadians were
preparing for their holidays in December.
Tamils, now, no longer have the right to
seek refugee status in Canada. Canada no
longer considers the Sri Lankan
government a threat to the Tamil people.
The Canadian government feels the human
rights situation on the island has improved
since mid-2010, just a year after the Sri
Lankan armed forces claimed to have
eliminated the Tamil Tigers’ war for an
independent Tamil State.
Canada’s Immigration and Refugee Board
(IRB) introduced the new policy on Tamils
who seek political asylum in Canada on the
grounds that although the refugee board
adjudicators are not forced to follow the
new guidelines, for the IRB such notes “are
offered to members as models of sound
reasoning that may be adopted in appropr
iate circumstances.” This is really a
frightening decision of the IRB as it
demonstrates that the Canadian
government led by Stephen Harper has
made such a hasty decision without
knowing what is really happening on the
ground in the Tamils areas in Sri Lanka.
The new policy, no doubt, could affect
refugee claimants who arrived in Vancouver
in 2009 and 2010 aboard the Ocean Lady
and MV Sun Sea. The 76 Tamils who
arrived in 2009 applied for refugee status,
but the refugee board has not taken any
action on their files. The 492 Tamil refugees
who arrived last year have applied for
political asylum, but their cases are also
pending. It is worth mentioning that one-
fourth of the refugees who arrived last year
have been detained in detention centres in
British Columbia and two of the asylum
seekers have been branded as being
affiliated to the militant LTTE.
Canada wants precedence to reject
Tamils’ claims for refugee status
In this context, the case cited in the new
IRB policy involved a 25-year-old Tamil
male from Sri Lanka. It is worth mentioning
that this youth arrived in Canada by air. This
particular claimant had told the refugee
board that he had been and would be
persecuted by the Sri Lankan army,
government officials, and paramilitary
agents associated with the Sri Lankan
government if he returned to Sri Lanka.
The claimant also told the board that he
was arrested by Sri Lankan forces in 2006,
interrogated, hit in the stomach and pushed
against a wall. He moved to a different
location
with a friend soon afterwards, but was
detected by government forces the next
year. He said his friend was eventually
executed. The claimant fled to Malaysia in
2007 before arriving in Canada in 2009.
The IRB tribunal rejected his refugee claim
in November. It was cited in the persuasive
decision four weeks later on December17,
2010. The ruling said: “The claimant is not a
person in need of protection in that his
removal to Sri Lanka would not subject him
personally to a risk to his life.”
The IRB said: “The reasons cite the
documentary evidence which relates to
changes that took place in Sri Lanka
recently and conclude with a finding that the
changes are meaningful and durable and
that the claimant’s fear of persecution
based on his particular social group,
perceived political opinion and nationality is
not well founded.”
How does Canada not know what is
happening?

It is unfortunate that Canada employs
dozens of diplomats in Sri Lanka at the
Canadian High Commission in Colombo
who do not know the ground reality in the
North and East of Sri Lanka, which are the
traditional homeland of Tamils where over
150,000 Sri Lankan armed forces have
been deployed despite that the government
claiming that it has crushed the Tamil Tigers
in May 2009. The situation is worsens by
the day. The Sri Lankan government has
been deploying more and more armed
forces into Tamil villages to build new
military residences with China’s assistance.
Another shocking story is that the Sri
Lankan army is going to be deployed on the
islets off the shores of Jaffna where already
the Sri Lankan naval bases and the
paramilitaries supporting the government
have been put up. The Canadian High
Commissioner, along with senior officials,
paid several visits to the Tamil areas after
the LTTE silenced their guns in 2009. It is
shocking evidence that the Canadian High
Commissioner and senior officials who are
being paid from Canadian tax-payers
money have not updated the ground reality
in the North and East of Sri Lanka where
human rights abuses are on the rise daily.
Kidnapping for ransom, murder, rape,
robbery, and disappearances are increasing
in various places in the North and East,
especially Jaffna, in spite of it being a
military garrison. There is not a day that
passes without a report on crime. Many
events can be cited to demonstrate the
current situation in Tamil areas. There are
many untold stories taking place despite the
fact that many people fail to report to the
police or any other officials due to the fear
that they will be prosecuted by the armed
forces who are wandering around the
streets of Tamil villages, towns, and cities
with military uniform and arms. Even
President Rajapaksa, whose agents commit
these crimes, has stated publicly, while in
Jaffna, that these criminals underground
would not show their heads anymore.
A few of the shocking events are: A Hindu
priest was shot dead, using a gun owned by
the military, for performing rites for tsunami
victims. A government education officer was
shot dead because he objected to the
national anthem being sung in Sinhala only
in Jaffna. An environmentalist was
murdered for exposing a Sri Lankan
minister and India’s favourite,
Douglas Devananda, for making millions of
rupees by removing sand and causing
environmental damage. So the list goes on.
It is indeed frustrating that Canada falls
victim to the Sri Lankan government’s false
propaganda.
Senior government officials acknowledge
law and order worsen.
The Government Agent of Jaffna, Ms
Imelda Sukumar, the principal civil
representative of the government in Jaffna,

spoke to media personnel when they raised
question about the law and order in Jaffna,
suggesting the police should be replaced by
the military, as if Jaffna is not militarized
enough. It is surprising that over 150,000
Sri Lankan armed forces are wandering in
the streets of North and East, but the
irresponsible statement of Sukumar
demonstrates that the law and order cannot
be returned soon. She claims that more
armed forces should be deployed to return
the areas to normalcy.
Sukumar, for reasons well known to her,
shifted the blame on to another government
agency, instead of holding the government
wholly responsible for the complete
breakdown of the justice system and the
collapse of law and order in Jaffna. Jaffna is
a veritable jungle, a mini police State where
State terrorism remains.
The residents in northern Jaffna and
Vavuniya were advised by two senior Police
superintendents in leaflets widely disturbed
to wear only imitation jewellery and take
extra steps to protect their homes. They
were advised not to leave their door keys
hidden under door rugs or flower pots, but
to have a spare key if another family
member needed one. When leaving home,
lock the doors properly and inform the
neighbours about their departure. They
were told not to travel alone when wearing
gold jewellery, as criminals may trick and
rob their jewellery.
The people were told to beware of
strangers or strange vehicles coming to
their areas and to note down the numbers
and other details. This is just a usual story
to hoodwink them to show that robbery is
the motive for such crimes and to side track
the issue from the real situation and the
political and racist undertones.
Unnumbered white van kidnapping is a
common occurrence. Once they come in a
group armed with guns, there is nothing
anyone can do about it. No unnumbered
vehicle is permitted to move around in any
civilized country, let alone a militarized area,
such as Jaffna. So it is the security forces
that have to do the prevention and not
unarmed civilians.
Parents were advised not to send children
out of their homes alone. The question is,
how do the parents go about their work if
they have to follow their children to school?
The police also advised people to number
the valuable goods at home or label them
and to do the same for electric equipment,
motor bikes, and so forth.
The police have also advised the residents
to keep their doors and windows closed,
even during the day time if there is only one
person in the house. At night, they are
advised to make sure the doors and
windows are closed and to keep a bulb
switched on.

The public was told that if any member of
the defence force comes for inspection,
they should ask for their official identity
cards before opening the door and ensure
they are accompanied by a police officer
from the area. This is a guaranteed recipe
for violence and death, as most of the
uniformed personal are thugs and they
themselves commit the robbery. Moreover
they carry false identity cards with
government patronage.
Shop owners have been advised to leave a
light on outside their shops after their
closure and to keep someone inside the
shop. The police say the people have a
right to protect their lives and property in
such instances. If the criminals attempt to
flee, they have a right to take them into
custody and then inform the village officer
or the police.
What logic! How do unarmed civilians arrest
fully-armed criminals? All the above
recommendations can be carried out only
by the police as they are the only ones
empowered by the law to do so. They are
also paid to do their job.
This is Sri Lanka’s version of maintaining
‘law and order’. One of Wikileak’s
revelations was that the American
Ambassador, Patricia A. Butenis, was of the
view that the para-military groups were
given the liberty to raise their own funds by
whatever means–kidnapping, robbery,
prostitution, and child-trafficking--as the
government was no longer able to finance
their maintenance. The military has also
joined in this multi-million rupee business,
so how could the police act?
Crime is a money making business for the
armed forces. Moreover, the best means of
silencing people who oppose government
policies is to eliminate them. Only the
international community can get the Tamils
of Sri Lanka out of this culture of impunity
by imposing sanctions. The US and EU,
who have awoken to the realities of the
situation, may be willing to do so, but India
and China will continue to support
Rajapaksa and Company of brothers and
close relatives.
The current situation in the Tamil homeland
shows that there is no protection for the
Tamils whatsoever. They are exposed to the
worst of crimes. The human rights situation
has gotten worse. When the LTTE was in
action militarily, the enemies thought a
second before conducting any violation
against the Tamils, but after the LTTE
entered into ceasefire agreement with the
Sri Lankan government in 2002 with the
facilitation of Norwegian government, the
atrocities of Sri Lankan armed forces ran
rampant against Tamils. With the complete
silence of the LTTE guns, human rights
abuses have worsened.
Canada’s Immigration and Refugee Board’s
(IRB) new policy is dangerous and violates
its own Charter and the international
convention. Unless the Tamil Canadians
wake up and rise to the level where they
can exert pressure upon the Canadian
government to intervene in altering the new
policy introduced by the IRB, many other
countries will follow suit with the Canadian
policy not to acknowledge the Tamils who
are lacking protection in Sri Lanka and will
help
deteriorate to the efforts of countries which
are taking steps to bring the perpetrators of
the war crimes to book.

South Sudan walk
to freedom
South Sudan walk to freedom has almost
ended. It is now poised to take its place in
the United Nations Organization sooner than
anyone thought a year ago. If everything
goes well South Sudan will be the 194th na-
tion to be admitted to UN membership.
When UNO was formed in 1945 following
WW11 there were only 51 countries on its
roll. Since then membership has increased
by leaps and bounds especially after the
break up of the Soviet Union and Yu-
goslavia in the early nineties. Between
1991 - 1994 membership rose from 166 to
184 an increase of 19 states. The youngest
nation to join the UNO was Montenegro
(192) which voted for independence from
Serbia in a referendum on May 21, 2006.
Before that East Timor formally joined the
world body in 2002 after centuries of Por-
tuguese rule and years of often brutal In-
donesian occupation.
Sudan's centuries of association with Egypt
formally ended in 1956, when joint British-
Egyptian rule over the country ended. Inde-
pendence was rapidly overshadowed by
unresolved constitutional tensions with the
south, which flared up into full-scale civil war
that the coup-prone central government was
ill-equipped to suppress. The military-led
government of President Jaafar Numeiri
agreed to autonomy for the south in 1972,
but fighting broke out again in 1983. After
two years of bargaining, the rebels signed a
comprehensive peace deal with the govern-
ment to end the civil war in January 2005.
Decades of fighting have left Sudan's infra-
structure in tatters. With the return of millions
of displaced southerners, there is a pressing
need for reconstruction. The economic divi-
dends of peace could be great. Sudan has
large areas of cultivatable land, as well as
gold and cotton. Its oil reserves are ripe for
further exploitation. Arabic is the official lan-
guage and Islam is the state religion, but the
large non-Arab, non-Muslim minority has re-
jected attempts by the government in Khar-
toum to impose Islamic Sharia law on the
country as a whole.
The referendum to split Sudan into a pre-
dominantly Muslim North and a predomi-
nantly Christian South, after years of fighting
and repression, was concluded on January
15,2011. The popular mandate catapulted a
collective dream towards the much awaited
freedom, off the yoke of a presumptively ter-
rorist state Sudan. The referendum came ex-
actly five years after the Comprehensive
Peace Agreement was accorded in 2005 be-
tween a cornered Government of Sudan and
South Sudan’s People’s Liberation Move-
ment. Eelam Thamils join the South Su-
danese people in their moment of rejoice.
Sixty percent out of the 4.5 million regis-
tered voters casted their votes confirming
the turnout passed the 60 percent mark
needed to make the result binding. Almost
99 percent of south Sudanese who voted for
independence in the referendum chose to
split away from the north, the first official but
incomplete figures published by the referen-
dum commission. This is an indication of a
January 31 2011
landslide vote for southern independence
promised in a 2005 peace deal that ended
decades of north-south civil war. The final of-
ficial figures are expected in February.
The website for the Southern Sudan Refer-
endum Commission
(southernsudan2011.com/) showed a 98.6
percent vote for secession, with more than
80 percent of the votes from the south
counted, and 100 percent counted in other
areas.
International observers gave south Sudan's
independence referendum their seal of ap-
proval on January 17, 2011 and said that a
vote for secession was now "virtually certain"
in their first official judgment on the poll.
Early results from last week's plebiscite sug-
gest that people from Sudan's oil-producing
south voted overwhelmingly to split away
from the north following decades of civil war.
Observers from the Carter Center and the
European Union both said that the vote had
been credible -- an endorsement that moved
the region a step closer to independence.
The main political division of Africa was de-
cided at the Berlin Conference in 1884/85.
The participating European powers had little
information about the people of inland Africa.
They had explored the coastline, but their in-
terest was access to the mineral wealth of
the continent.
If one looks at the political boundaries of
Africa it becomes clear that no regard was
given to the cultural and ethnic diversity of its
people. Local people who had little in com-
mon were lumped together, and people with
a common culture and tradition were sepa-
rated. The Zulus and the "boers" were the
first to offer military resistance to the land-
grabbing and mineral interests of colonial
powers, but they succumbed to superior mili-
tary power. Only Abyssinia and Liberia were
not "colonised". Bloody ethnic wars in Africa
were the result of decisions taken at the
1884/5 conference.
South Sudan was already there during the
European scramble for Africa in Berlin.
South Sudan was also there during the
British Colonialists “Closed District Ordi-
nance.” South Sudan was there in the histor-
ical 1947 Juba Conference. South Sudan
was there in the historical 1955 Torit mutiny
and rebellion. South Sudan was there during
1965 Round-table Conference. South Sudan
was there during the initial historical 1982-
1983 rebellions.
South Sudan’s sovereignty is now mere a
matter of time. People who fled to distant
shores in search of peace are now ecstatic
of a peaceful future in their homeland. More
than 2000 families have started returning
back to the swampy tracts of the White Nile.
But the question pops up, can South Sudan
ensure, rather sustain peace? Only time will
tell. The new government at Juba has to en-
sure equal opportunity, democratic represen-
tation of all ethnic sects. South Sudan
comprises of composite clusters of ethnicity,
and hence their respective aspirations, be-
liefs, customs, languages and seeking in
unity in diversity will be the greatest chal-
lenge the leaders of the new government
will face. Southern Sudan shares its borders
with Ethiopia, Kenya, Uganda and Congo.
Each country poses a unique assortment of
threats. Ethiopia’s political instability, insur-
gences and fast penetrating roots of Islamist
terrorism are poised to be the greatest chal-
lenges to South Sudan, all the more as the
latter is not an Islamic one. Tunisia is a re-
cent example of how a country under the
jackboot of a corrupt dictator backed by the
army could collapse like nine-pins overnight
for lack of democracy, transparency and rule
of law.

It shall be H.E. Salva Kiir Mayardit to lower
the Sudan flag and raise high the flag of the
Republic of South Sudan on 9th July, 2011 at
the Presidential Republican Palace in Juba.
He is going to be the first President of the
Republic of South Sudan as already agreed
by the political parties of Southern Sudan. It
shall be the very GoSS and SPLM/A Flag
which is being used now. Dr. Mayardit shall
lift up this flag with honour on that greatest
First Independent Day of South Sudan.
South Sudan will have the ‘Buffalo’ as the
“Coat of Arms (Emblem)” and with “Motto”
under its design written: ‘Peace and Pros-
perity’. The current proposed “National An-
them” shall be amended to remove irrelevant
attributes like the Land of Cush, Milk and
Black Warriors. South Sudan will issue Ordi-
nary “Black Passport” save for the diplo-
matic ones which should be red. Their
“Nationality” shall be ‘South Sudanese’ and
have ‘South Sudanese Pound’ as their
“Currency”.
It is widely expected that recognition of the
new government from other nations around
the globe will be swift and decisive.
Russia has expressed a willingness to rec-
ognize an independent state in Southern
Sudan if the results of January 15 referen-
dum are accepted by the two governments
north and south according to the special
envoy of the President Dmitry Medvedev to
Sudan. On Wednesday, the ruling National
Congress Party (NCP) declared recognizing
the results of the Southern Sudan referen-
dum on independence.
“If a new independent state appears on
Africa’s map as a result of the referendum
and this is not accompanied with conflicts,
this outcome can be described as a most
favourable one,” said Mikhail Margelov spe-
cial Russian envoy to Sudan. “We act as an
honest partner: we have no burden of the
colonial past either in Sudan or in neighbour-
ing African countries, nor have we invest-
ments running into billions or the mentality of
an international policeman. Russia in this
case can only show its goodwill,” he
stressed.
Margelov said the northern and southern
Sudan governments expressed readiness to
reach agreement on the pending issues to
prevent another civil war. "The political
forces of Sudan were able now to reach
agreement: they have common interests,
and, one would like to hope, not only eco-
nomic."
Last December, during a visit to Khartoum,
the Russian envoy met with the Sudanese
First Vice President and head of southern
Sudan government to discuss the future re-
lations between Russia and South Sudan.
"Russia is interested in its economic pres-
ence in Sudan, whether in a unified one, or
with the South separated from it," he said.
“From the business point of view, (Sudan) of-
fers a multitude of perspective trends - oil,

pipelines, energy, water resources and rail-
way transport,” he stressed.
China is the biggest foreign stakeholder in
the Sudanese oil industry, via China National
Petroleum Company’s interests in various
production and exploration blocks, and it re-
ceives approximately three-quarters of
Sudan’s oil exports. The oil industry is
acutely vulnerable to any conflict because
about 75 per cent of Sudan’s proven re-
serves of 6.3bn barrels are in the south, but
the pipeline that carries the oil to export ter-
minals and refineries runs through the north.
The south needs Khartoum’s co-operation to
sell its oil; the north needs revenues from its
neighbour’s resources; and the two sides of
the country have yet to agree how they will
cooperate to keep the oil flowing after inde-
pendence.
There is an adage that behind every man's
success there lies a woman. The same is
true of nations which freed themselves from
tyranny and slavery. East Timor independ-
ence was backed by Portugal its former
colony. Kosovo shook off Serbia's yoke with
the help of European Union and the NATO
forces. South Sudan had the backing of a
majority of Christian organizations which
wield considerable political clout in US poli-
tics.
Freedom don't come easily. South Sudan
paid a price. More than 2 million people died
during the civil war which began in 1983.
Sudan's holocaust, includes village raids,
massacres, refugees and slavery. Civil war
in Darfur region is seen as "one of the worst
nightmares in recent history".
The birth of South Sudan after a painful and
destructive civil war gives hope to other na-
tional minorities like the Palestinians,
Chechens, Kashmiris, Kurds and Eelam
Thamils fighting for their own freedom. The
borders of countries are not cast in stone.
Adding another ten members to the will not
cause the sky to fall!
Sudan Peoples’ Liberation Movement
(SPLM) has invited Transnational Govern-
ment of Tamil Eelam (TGTE) to visit South-
ern Sudan in the immediate aftermath of the
vote for an independent state. TGTE is send-
ing a delegation to participate in the celebra-
tions and to discuss possibilities of assisting
Southern Sudan in their development efforts
through Tamil Diaspora expertise in selected
fields. TGTE delegation will be received by
the SPLM officials and will stay as guests of
SPLM. This is a giant step in our struggle
for statehood. There are many similarities
between the South Sudanese people libera-
tion struggle and the Eelam Thamils. Both
faced persecution and a genocidal war. Su-
danese President Bashir has been indicted
for genocide and the Sri Lankan President
Rajapaksa is to be indicted for genocide at
some point in time. World leaders must rec-
ognize the legitimate struggle of Eelam
Thamils to restore and reconstitute the sov-
ereign state of Thamil Eelam. Thamil Eelam
is good for Thamils, but better for the Sin-
halese and the world at large!.

Tamils Pay Humble Tribute
to Tamil Martyr
Muthukumar
Two years have rolled down since the self-
immolation of Muthukumar. In commemo-
ration, Tamils all over the world are paying
their humble tribute to Muthukumar, the
young martyr who made the ultimate sacri-
fice on January 29, 2009 by giving his life
to save Eelam Tamils. He was just enter-
ing his 26th year when he made a solemn
vow to himself he would give his life to
make a difference to the lives of Eelam
Tamils.
Muthukumar made the crucial decision
after deep thought and contemplation, ar-
guing within himself as to what he could
do to focus world attention on the plight of
Eelam Tamils. He was saddened that
speeches, writings and mass demonstra-
tions did not bring the desired change to
the Indian thinking. He was equally hurt
that the Tamil Nadu government was tow-
ing the line of the Delhi government for its
political survival and was not doing any-
thing to stop the mass killing of Eelam
Tamils in Sri Lanka.
It is thought that the Delhi regime domi-
nated by north Indians – the Aryans,
backed by the ‘south block’ in Delhi con-
sisting of Aiyars, Aiyangars and the
Menons of Kerala are shaping the foreign
policy of the country. According to rough
censes, 35% of the ‘south block’ consists
of Menons. Often the disease called
‘Menonism’ is discussed in the Delhi cir-
cles. So long as this ‘south block’ remains
in power the destiny of Tamils as well as
the policy of the Delhi government no mat-
ter who is in power will not be altered. The
added factor in the Delhi thinking is the
vindictive attitude of Sonia Gandhi.
All these factors were working in the mind
of Muthukumar. Any appeal on behalf of
Eelam Tamils will not have the desired
change when the Delhi regime is itself a
prisoner of its prejudices and a victim of its
preconceived notions. Muthukumar be-
lieved Mr. Karunanidhi, the Chief Minister
of Tamil Nadu could have come to the
recue of Eelam Tamils if he really wanted
to. In October 2008, Karunanidhi issued a
verbal threat that he would withdraw 40
MPs from Tamil Nadu if Delhi did not act to
rescue Eelam Tamils. Even if he wasn’t
Sri Lanka wants to export war crimes – UN Dispatch
Sri Lankan Army (SLA) is planning to
share with other countries its success in
crushing ethnic Tamil Tiger rebels and
ending the island’s 37-year-old separatist
war, according to a report published in the
UN Dispatch.
SLA Commander Lieutenant General Ja-
gath Jayasuriya said this while addressing
a press conference in Colombo Wednes-
day.
“We are inviting heads of military and de-
fence establishments in 54 countries to a
three-day forum starting in Colombo from
May 31, he added.
The SLA chief said after the war ended
many countries requested them to share
some of Lankan military’s strategies with
them.
“They want us to share our experience
and expertise with them.”

his ways that he was submissive to the
Delhi government.
Muthukumar, a journalist by profession
weighed the pros and cons of the issue
and came to the inevitable conclusion that
words would not carry any weight but only
extreme action whatever the conse-
quences will focus world attention. He
made the decision to self-immolate, al-
though a difficult one, to stop the atrocities
perpetrated against Eelam Tamils.
This was indeed an extreme step not to be
encouraged. Here I quote a Tamil aca-
demic who said of Muthukumar’s self-im-
molation: “The sacrifice of young and
idealistic Muthukumar is lamentable be-
yond words; any thoughts of re-enactment
should never become a necessity to any-
one. It is reminiscent of Vietnam in the
1960s when self-immolation of monks,
protesting brutal atrocities as a conse-
quence to US military campaign was com-
mon. Such acts occur as a last resort of
public frustration when governments sup-
press democratic space and don’t respect
over-whelming public opinion of emotional
importance. In this line of thinking
Muthukumar’s self- immolation is a classic
cess in crushing ethnic Tamil Tiger rebels
and ending the island’s 37-year-old sepa-
ratist war.
Army chief Lieutenant General Jagath
Jayasuriya said they were inviting heads
of military and defence establishments in
54 countries to a three-day forum starting
in Colombo from May 31.
“After the war ended many countries have
requested us to share some of our strate-
gies with them,” Jayasuriya told reporters
in Colombo. “They want us to share our
experience and expertise with them.”
For the record, the Sri Lankan military did
launch a remarkably successful counter-
insurgency which appears to have
crushed, once and for all, the brutal Tamil
Tigers. The thing is, the strategy was
predicated upon committing massive war
crimes. E.g:

and security forces encouraged hundreds
of thousands of civilians to move into ever
smaller government-declared No Fire
Zones (NFZs) and then subjected them to

Muthukumar who stayed with his sister
Thamil Arasi in Kolathur, Madras was
working for a Tamil Magazine. On the night
he stayed in his office. The next morning
on Thursday 29, January 2009 at 10.40
am before dousing himself with petrol,
Muthukumar flung several copies of his
statement charging the Indian government
for working with the Sri Lankan govern-
ment to wipe out Eelam Tamils.
Police officials are normally careful with
their words and often tow the line of the
government’s thinking. But in this case
even Police officials paid tribute to
Muthukumar. They said “Muthukumar had
not experienced any fear or wavering, he
had been resolute in his decision to sacri-
fice his life to highlight the need for a per-
manent cease-fire in the war in Sri Lanka.”
When doctors asked him why such an ed-
ucated person like him committed self-im-
molation, Muthukumar had replied that
several thousands of more intelligent and
educated Tamils were dying in Eelam and
that he intended to save thousands of lives
by sacrificing his life. It may not be out of
context to remember Sivakumar, another
hero of the Eelam Tamil cause, the first to
swallow cyanide in the mid- seventies. He
repeated and increasingly intense artillery
and mortar barrages and other fire. This
continued through May despite the gov-
ernment and security forces knowing the
size and location of the civilian population
and scale of civilian casualties.
There are two potential lessons that gov-
ernments which struggle with insurgency
can take from the Sri Lanka example. The
first is that the ends justify the means;
slaughtering 10,000 non-combatants is
worth it if you can crush a rebellion. Given
the fact that the Sri Lankan military is cele-
brating the manner in which it defeated the
Tamil Tigers that is presumably the lesson
that they have drawn.
On the other hand, if there was some sort
of credible criminal investigation into these
war crimes–and if that investigation ended
up with the arrest and trial of the accused–
other regimes might think twice before
they use the counter-insurgency-by-mass
atrocity tactic.
So far, though, there is no credible inter-
national or local judicial process to look

pleaded with Dr Vethanayagam who was
treating him not to save his life. A hero is a
hero anywhere.
When the news of Muthukumar’s self im-
molation spread like wildfire leading fig-
ures in Tamil Nadu who have been
consistently campaigning for the Eelam
Tamil cause like Pala Nedumaran, Vaikho,
Dr Ramdas and Thrumavalavan rushed to
the spot to console Muthukumar’s rela-
tives. The Lawyers announced an indefi-
nite boycott of courts and colleges and
schools in Tamil Nadu came to a standstill.
The situation was very tense and riotous
the whole day.
Muthukumar’s statement covering fourteen
points, in essence states that the Indian
leadership including Karunanithi and Jay-
alalitha should not be trusted and a new
leadership must emerge from the student
population.
Although Muthukumar is no more he lives
in the hearts of Eelam Tamils and will be
part of the annals of Eelam Tamil History
and the Tamil Eelam freedom struggle.
I conclude my tribute to Muthukumar with
a moving verse from Poet Guna Jeyasee-
lan:
Oh! Muthukumar
You are the eternal fire,
That burns in every Eelam Tamil’s heart.
By your supreme sacrifice
You are giving life and light
To not only Tamil Eelam
But also to Tamilaham.
Although we do not measure up
To your ultimate sacrifice,
Please accept our humble tribute
Which we lay at your feet.

into allegations of crimes against hu-
manity. One credible mechanism would
be the International Criminal Court. But
since Sri Lanka is not a member, it
would take an act of the Security Coun-
cil to grant the ICC the jurisdiction to in-
vestigate. That does not seem likely
any time soon.
For now impunity is ruling the day. So
much so, that Sri Lanka is apparently
seeking to export its brand of counter-in-
surgency to other countries.
This is the biggest challenge to interna-
tional justice in the world today. Will the
Sri Lankan method of dealing with rebel-
lion and insurgency catch on else-
where? Or will the long arm of
international justice give pause to
would-be war criminals?
This is pretty much the defining question
of international justice these days. So
far, the good guys seem to be losing.

TGTE salutes Southern Sudan
on gaining its independence after a long
drawn out widespread bitter struggle
The South Sudanese liberation struggle
was no afternoon tea party. Freedom was
not served on a silver plate; we the Eelam
Tamils have closely watched the untold
suffering of the South Sudanese people in
their liberation struggle. We the Eelam
Tamils have suffered in an immeasurable
manner for the last 64 years; hence we
are equally conscious of what the South
Sudanese people have undergone for
many years. The TGTE’s Prime Minister,
Visvanathan Rudrakumaran has conveyed
his wishes and congratulations on behalf
of the TGTE to the Sudan Peoples’ Liber-
ation Movement. Mr. Rudrakumaran adds
that TGTE is calling the Eelam Tamils to
celebrate the freedom of Southern Su-
danese, Eelam Tamils can clearly under-
stand the joy of Southern Sudanese
becoming a free people and therefore we
share their happiness. This statement of
Mr. Rudrakumaran, the Prime Minister of
TGTE is endorsed, echoed and re-echoed
by the Canadian chapter of the TGTE.

(New York) - The Sri Lankan government re-
fuses to investigate alleged war crimes despite
growing evidence of widespread atrocities dur-
ing the civil war that ended in 2009, Human
Rights Watch said today in its World Report
2011. The government has threatened and in-
timidated journalists, opposition politicians, and
civil society activists, and has consolidated
President Mahinda Rajapaksa's grip on power
by extending executive power over previously
independent government commissions, Human
Rights Watch said.
The 649-page World Report 2011, the organiza-
tion's 21st annual review of human rights prac-
tices around the globe, summarizes major
human rights trends in more than 90 nations
and territories worldwide. In Sri Lanka, the re-
port says, the government rejected domestic
and international calls for an independent inter-
national investigation into allegations of war
crimes by government forces and the defeated
rebel Tamil Tigers.

"Sri Lanka's aggressive rejection of accountabil-
ity for war crimes is an affront to the victims' of
the country's long civil war," said Elaine Pear-
son, deputy Asia director at Human Rights
Watch. "The government undermines its claims

TGTE’s inaugural function was held in
Philadelphia in May 2010. We remember
with deep gratitude, the presence and par-
ticipation of the Secretary General for the
United States, Domach Wal Rucah, at the
inaugural function. His participation was a
source of inspiration to us. He totally iden-
tified with our struggle for liberation. He
drew interesting parallels in our struggle
for freedom; the Southern Sudanese peo-
ple have lost about two million people in
the struggle. Civilians were massacred
and people died of starvation and lack of
medical facilities. We the Eelam Tamils
suffered the worst in May 2009, when
twenty Nations headed by India, backed
the Sri Lankan President, Mahinda Ra-
japakse to wipe out the Tamils in the name
of wiping out the LTTE. It was a war with-
out a witness, the suffering we underwent
is still being continued uncared, unwept
and unsung by the world bodies. It is in
this context, we the Eelam Tamils who are
fighting for freedom are quite conscious of
of clean hands in the fighting with its repressive
measures against the media and civil society."
The Sri Lankan government established a Les-
sons Learnt and Reconciliation Commission
(LLRC) in May 2010 to counter calls for ac-
countability. However, the commission has se-
vere shortcomings, including members who
have not demonstrated impartiality or independ-
ence, the absence of a witness protection pro-
gram for those who testify, and wide reliance on
testimony from government officials and military
personnel to the exclusion of outside partici-
pants.

the suffering of the South Sudanese peo-
ple. We the Eelam Tamils are not a minor-
ity in the island of Sri Lanka, we are a
nation by any definition. What we had,
what we lost we want to regain and re-
assert. It can be defined as restoration or
reconstitution. The term that we are a mi-
nority is a misnomer. Our struggle to start
with was inside parliament and gradually
our struggle became extra parliamentary
and turned into a non-violent mass strug-
gle based on the Gandhian pattern. When
successive Sinhala regimes turned a deaf
ear and a blind eye to our struggle, our
struggle emerged as a militant struggle, to
preserve the Tamil identity and also our
very survival.
The TGTE was formed in 2010, to meet
the changing pattern of our struggle. From
the very inception we have declared that
the TGTE is transparent. It believes in
democratic procedures and is determined
to shape and win over world opinion in our
In June, United Nations Secretary-General Ban
Ki-moon established a three-member panel to
advise him on possible accountability mecha-
nisms for Sri Lanka. The Sri Lankan govern-
ment immediately denounced the panel, and a
senior government minister led protests outside
the UN headquarters in Colombo. The govern-
ment has not approved the panel's request to
visit Sri Lanka.
"The government commission includes senior
officials who publicly defended the govern-
ment's conduct of the war," Pearson said. "How
can a panel tainted from the beginning with
such pro-government bias be reasonably ex-
pected to be independent and impartial. This
panel should be seen for what it is: a cynical at-
tempt to whitewash the truth."
The government has also sought to silence the
media, civil society, and the political opposition.
The media is extremely reluctant to publish arti-
cles critical of the Rajapaksa government, and
many journalists who fled the country remain in
exile. Shortly after the presidential elections in
January 2010, the government raided the of-
fices of opposition presidential candidate Gen.
Sarath Fonseka. Fonseka was arrested and
court martialed on charges of fraud, and sen-
tenced to 30 months in prison.

their favour, and now are on the verge of

In 2010, after considerable international pres-
sure, the government released most of the
280,000 ethnic Tamil civilians displaced by the
war who were being held in military-controlled
detention camps, euphemistically called "wel-
fare centers." But many face serious livelihood,
housing and security problems. Several thou-
sand people suspected of involvement with the
Tamil Tigers are in detention without charge,
and are denied access to lawyers and the Inter-
national Committee of the Red Cross.
In a clear signal that Rajapaksa had no intention
of changing his governance style, the parlia-
ment in September passed the 18th Amend-
ment to the Constitution, which effectively strips
the police, judiciary, electoral commission, pub-
lic service commission, and the National Human
Rights Commission of their independence,
Human Rights Watch said.
"There is no reason to believe that Sri Lanka will
return to a rights-respecting government any
time in the near future," Pearson said. "Until
wartime abuses are prosecuted, minority griev-
ances are addressed, and repression against
the press and civil society ends, only the presi-
dent and his family members in power have rea-
son to feel secure in Sri Lanka."

South sudan voted for independence from the
north, in a referendum reported Reuters today.
According to the Reuters report 98.83% had
voted for separation from the north.
The Sudanese war which was known as the
llongest running war after WWII, came to an
end in 2005 with a peace accord.
IIn 2009 the sudanese President Omar Al
Bashir was indicted by the international criminal
court for war crimes and crimes against human-
ity.

South Sudan almost unanimously voted to de-
clare independence from the north in a referen-
dum, officials said on Sunday, sparking mass
celebrations in the southern capital Juba.
Thousands cheered, danced and ululated after
officials announced the first official preliminary

results that overall showed a 98.83% majority
for separation, according to the vote's website.
"This is what we voted for, so that people can
be free in their own country.... I say congratula-
tions a million times," south Sudan President
Salva Kiir told the crowd.
The vote was promised in a 2005 peace deal
that ended decades of north-south conflict,
Africa's longest civil war, which cost an esti-
mated two million lives.
Mr. Kiir, the head of the former southern rebel
Sudan People's Liberation Movement (SPLM),
praised his former foe, Sudanese President
Omar Hassan al-Bashir, for agreeing to the
2005 accord.
"Omar al-Bashir took the bold decision to bring
peace. Bashir is a champion and we must stand
with him," said Mr. Kiir, speaking in a mixture of
English and the local
South Sudanese celebrate as preliminary re-
sults indicate 98.83% voted for independence.

According to the terms of the accord, south
Sudan will be able to declare independence on
July 9, pending any legal challenges to the re-
sults.
Northern and southern leaders still have to
agree on their shared border, how they will split
oil revenues after secession and the ownership
of the disputed Abyei region.
"I am so happy. Imagine having schools, no
fear, no war. Imagine feeling like any other peo-
ple in their own country," student Santino Anei,
19, told Reuters.
United Nations Secretary General Ban Ki-moon
welcomed the peaceful vote but told an African
Union summit in Addis Ababa he was still con-
cerned about the unresolved issues.
Washington's Sudan envoy Scott Gration told

Reuters at the summit the "tough part" of the
peace deal was still to come.
"These issues, whether it be borders or citizen-
ship or oil revenues, cannot be solved unless
there is an effort [by north and south] to work to-
gether in a partnership," he said.
Secession campaigners described the vote as a
chance to end years of perceived northern ex-
ploitation. Mr. Bashir, who campaigned for unity,
later announced he would accept a separation
vote.
Chan Reek Madut, the deputy head of the refer-
endum commission, told the crowd 99.57% of
voters in the 10 states of south Sudan voted for
independence.
Commission spokesman George Makuer said
the 98.83% figure published on the website in-
cluded votes from southerners in north Sudan
and eight other countries.
