On Sunday January 24, 2021, at approximately 9:00 p.m., I received a call from Robert King, Senior Policy Advisor on Public
Safety for Mayor TED WHEELER. King told me that WHEELER was involved in an incident at a Southwest Portland
restaurant in which WHEELER used pepper spray against an unknown person. King told me that WHEELER was with former
Portland Mayor SAM ADAMS at the time of the incident and he asked that I call WHEELER to get a statement regarding the
incident.

WHEELER called me shortly after and relayed the following statement to me, which he also emailed me:

At approximately 8 PM as I was leaving the Hillsdale McMenamin's pub I was confronted by a middle-aged white male. He
appeared to be videoing with a cell phone. He indicated that he had been photographing me while I was inside the restaurants
tent. He accused me of sitting in a restaurant without a mask. In fact, I was in the tented area of a restaurant sitting at a table,
and I informed him the current Covid regulations allow people to take their mask off for the purpose of eating and drinking.
He then accused me of other things to which I indicated he did not I understand the rules and should probably have a better
understanding if he was going to confront people about them.

He followed me to my car while continuing to video.. I attempted to get closer to my car and get into it. He came closer. He
had no face mask on and got within a foot or two of my face while he was videoing me. I became imminently concerned for
my personal safety, as I had recently been physically accosted in a similar situation. In addition, I was concerned about
contracting Covid given that he was right in my face that he was not wearing a face mask. I believe that I had taken my face
mask off as I Attempted to enter the car, but I don't specifically remember. I clearly informed him that he needed to back off.
He did not do so I informed him that I was carrying pepper spray and that I would use it if he did not back off. He remained at
close distance, I pulled out my pepper spray and I sprayed him in the eyes. He seemed surprised, and backed off. He made a
comment like "I can't believe you just pepper sprayed me." He walked away from my car, the individual with me suggested that
I leave for my safety, before I did so I threw a full water bottle towards him so that he could wash out his eyes with water. I left
the scene. Immediately thereafter I notified my chief of staff and deputy chief of staff Of the situation.

I asked WHEELER if he recognized the man from any previous encounters and he told me that he did not recognize him.
WHEELER described the man as a white male in his 40s, shorter than 6'00" tall, medium build, wearing a dark-colored, heavy
jacket, and possibly wearing glasses.

I confirmed with WHEELER the SAM ADAMS was present and I asked WHEELER if he saw anyone else around the area
that may have witnessed the encounter. WHEELER told me he thought there may have been a family with children near the
door but was unsure if they saw the incident.

I asked WHEELER if he had anything else to add right now and he told me that he did not. I confirmed with WHEELER a
phone number for ADAMS, then gave ADAMS a call to get a statement.

ADAMS told me that he and WHEELER left the restaurant out a side door to the parking lot and saw the unknown male
waiting outside the door as they left. ADAMS told me that the man was filming them with a cell phone and made statements
about them not wearing masks while inside the restaurant. ADAMS told me that WHEELER explained to the man that rules
allowed for the removal of masks for eating or drinking and the man replied something to the effect of, "But you weren't six
feet apart." ADAMS told me that the man said something about having pictures.

ADAMS told me that he walked to his car while WHEELER walked to his car and the man kept following WHEELER.
ADAMS saw that WHEELER had opened his car door but had not gotten inside and saw that the man was very close to
WHEELER. ADAMS heard WHEELER warn the man about pepper spray but the man did not back away, so WHEELER
sprayed him with pepper spray.

ADAMS told me that after being pepper sprayed, the man backed away and was talking to his own camera about being pepper
sprayed "for no reason" and ADAMS told me that he stated to the man, "Actually you were really close." ADAMS told me
that the man walked back towards the restaurant and WHEELER tossed him a water bottle. ADAMS told me both he and
WHEELER left the area.

I asked ADAMS if he saw the man in the restaurant tent prior to seeing him in the parking lot and he told me that he didn't
notice him inside. I asked ADAMS if he saw anyone else outside that may have witnessed the incident and he told me that he
did not. I asked ADAMS if he recognized the man from any prior contacts and he told me that he did not recognize him.

ADAMS described the man as a male white in his mid-to-late 40s, 5'4" to 5'5" tall, wearing glasses, and dark clothing.

ADAMS told me that he'd attempted to video record the incident but recorded only audio instead, which he sent me. I listed
to recording, which was 1:31 long, and could hear a male voice talking to WHEELER and ADAMS. In summary, the parts
that are audible are consistent with the above statements by WHEELER and ADAMS. This recording will be submitted as
evidence and may be transcribed at a later time as part of this investigation.

I contacted the Bureau Of Emergency Communications (BOEC) to determine if any calls were received from the restaurant or
about this incident and none were located.

I called the McMenamins Hillsdale Brewery & Public House to determine if any employees had any information about the
incident and if there was surveillance video in the area but the business was already closed for the night.

I checked Twitter to see if there were any recent postings about "Wheeler" and "pepper" and did not locate anything.

As of this writing, the identity of the man involved in this incident is not known.
