NOTICE OF AGGRAVATING CIRCUMSTANCES

AND NOW, this A, 021, pursuant to Pa.R.Crim.P. 802 and subject

to its provisions, a review of the evidence available to the Commonwealth up to this date

indicates the existence of the below set forth aggravating circumstances in which the

Commonwealth intends to submit at the sentencing hearing:

1. As to Count 1, Criminal Homicide - Victim Anson Landon Mitchell Stover:

a. The Defendant committed a killing while in the perpetration of a felony. 42

Pa.C.S. § 9711(d)(6);

b. The offense was committed by means of torture. 42 Pa.C.S. § 9711(d)(8);

G. The victim was a child under 12 years of age. 42 Pa.C.S. § 9711(d)(16).

2. The Attorney for the Commonwealth will provide prompt written notice to the Defendant

and to the Court of any additional aggravating circumstance or circumstances which

become known to the Commonwealth after the time of the Defendant's arraignment
