The undersigned affiant, being duly sworn, deposes and says:
1.) That I, Deputy Chief Scott R. Todd 044, am a member of the Derby Police Department and have been since
212411992. At all times mentioned herein I was acting as a member of said department. The following facts and
circumstances are stated from personal knowledge and observations as well as information received from other
police officers acting in their official capacity and from official police reports and statements made by prudent
and credible witnesses.

2.) On l0ll3ll0 at2012, this agency received a phone call from Leo Moscato, director of the Derby Parking
Authority, claiming that he had been assaulted in a stairwell of the Derby Parking Garage by Parking Authority
Chairman John Dorosh. This became Derby PD case number 10-11922. PTL Bartone was initially assigned to
investigate this case, but this officer took over the investigation on l0ll4ll0 due to the fact that John Dorosh is
also a Derby police officer.

3.) On l0ll4ll0 at approximately 1430, Tremain Grandy, DOB 214172, walked into the lobby of the Derby police
department and handed the dispatcher a hand written statement claiming that he was a witness to Moscato's
alleged assault. Grandy claimed that he was walking through the parking garage on 10/13/10 at approximately
2015 hows when he saw Moscato in a dispute with an "unknolvn gentleman". This man allegedly "put his hands
around Mr. Moscato (sic) face and shove his head into the wall". I contacted Grandy after reading this statement
and requested that he come to the police statement'to give me an official statement. He agreed to come right
down.

4.) Grandy came to police headquarters on l0/14170 at approximately 1530 and came into the detective bureau to
speak with me. I read Grandy the warning listed at the top of our statement page which includes a Miranda
advisement and also states in part "any statement(s) made herein whioh I do not believe to be true, and which
statement is intended to mislead a public servant in the performance of hisftrer official function, is a crime under
C.G.S. section 53a-157". Grandy told me that he understood the advisement and proceeded to give me a swom
statement. In this statement Grandy claimed that he was in the parking garage female on 10/13

at around 2000 when he heard an argument on the level above him. He said that he walked up one level to see
what was going on. He saw Moscato and an unidentified male standing near Moscato's office door. The
unidentified man had his hand on Moscato's face and was pushing Moscato's head. Grandy claimed that Moscato
was trying to defend himself. He said that he thought the guys were fooling around so he left the parking garage.
Grandy stated that he retumed to the garage about ten minutes later and saw a police officer and asked him what
was going on. Grandy claimed the officer said that there was an incident but didn't say much more. Grandy
claimed that he then went back to his apartrnent building and went to his friend Shaun Burns' apartment. He told
Shaun that he had just seen Moscato "getting his ass kicked" and relayed the story to Burns. The next moming
Shaun came to Grandy's apartment and told him that Moscato was looking for him. Grandy went to see Moscato
at the parking garage, and at Moscato's request prepared the hand written statement that he initially tumed in to
our dispatcher. At the conclusion of,his written statement, I had Grandy read the statement to himself. I then had
him read the following out loud prior to signing the statement: "By affixing my signature to this statement, I
acknowledge that I have read it and/or have had it read to me and it is true to the best of my knowledge and
belief'. I then had Grandy sign his statement.

5.) There were obvious inconsistencies between Moscato's version of events as dictated to PTL Bartone, and the
version of events that Grandy claimed to have seen. Knowing that the parking authority maintains a video
surryeillance system in the garage, a search and seizure warrant for the system was obtained and executed by
Derby detectives on 10/15/10. A search of the video showed that Tremain Grandy entered the parking garage at
2016 hours on 10/13. This is at least eight minutes after the alleged incident occurred. The incident, according to
Moscato, allegedly occured on the basement level of a stairwell. Grandy never went anywhere near that stairwell
while he was in the gange.It was obivous from reviewing the video that Grandy could not have seen any
altercation between Moscato and Dorosh

6.) I contacted Grandy and asked him to come back to the police station for another interview and he agreed. On
10/18/10 at approximately 2015 hours I agatnmet with Grandy in the detective bureau of the police station. I
advised Grandy of his Miranda rights and had him sign a notice of rights form. I asked Grandy if he was willing
to talk to me about the previous statement that he gave regarding the alleged assault and he agreed. I explained to
Grandy that I had reviewed the video surveillance and it was clear to me that he could not and did not see any
fype of altercation between Moscato and Dorosh. I told him that the alleged incident didn't even occur in the
location that he claimed to have seen it. Grandy initially stuck with his story, but after a few minutes of
questioning he admitted that he had fabricated the story. Grandy agreed to give me a second statement to explain
what actually occurred. In the second statment Grandy admitted that he lied in the first statement. He said that he
never saw Moscato get assaulted. He said that he entered the parking garage on the night of the l3th to go to his
car and retrieve something. He said that he overheard Moscato tatking to someone and telling them that he had
been assaulted. Grandy walked over to the booth attendant, Mark lzzo, and asked him if Leo was all right.lzzo
told him that he didn't know what had happened and he didn't want to get involved. Grandy left the parking
gaftge and walked to the gas station to play his numbers. When he went back to his apartrnent building he saw

Shaun Burns and told him that Moscato had got his ass kicked. He based that statement on what her ov.erheard
Moscato telling someone else. He also said that Burns did come to his apartment the next morning to tell him that
Moscato was looking for him. Burns told Grandy that he (Burns) had told Moscato that Grandy "saw the whole
thing" referring to the alleged assault. Grandy walked to the parking garage and went into Moscato's office to see
what he wanted. Moscato told Grandy thathis head had been pushed into the wall during the assault, and
Moscato asked Grandy to write a statement on his behalf detailing what Grandy had seen. Grandy said that he
"just wanted to shut him up" (referring to Moscato) so he agreed to write a statement for him. He made
everything in the statement up based on what Moscato had told him. He said that he felt sorry for Moscato and
thought that he was doing him a favor by writing the statement. Grandy adamantly denied being offered anything
in exchange for fabricating his story.

7.) That based on the above information this offrcer, Deputy Chief Scott R. Todd, believes that probable cause
exists for an arrest warrant to be issued for Tremain Grandy, DOB 21411972, for the charge of False Statement in
the Second Degree, 53a-157b, and respectfully requests that such warrant be issued.
