In other National Underground Railroad Freedom Center news, the Freedom Center has recently entered into an 
agreement with JP Morgan Chase Bank to write off approximately _____ of debt incurred to construct the facility. The 
Freedom Center continues to work with the federal government to take ownership of the facility in the next 18 to 24 
months, and removing debt from the Freedom Center’s balance sheet is seen as a positive step toward that end.  
However, the large one‐time payment to settle the debt may strain the Freedom Center’s cash flow.  Commission staff 
has requested updated cash flow projections from Freedom Center management and will continue to monitor the 
organization’s finances.

NURFC Release and Encumbrance
Commission Resolution R‐10‐04 conditionally approved the release of $850,000 and conditionally approved 
the execution of legal documents with the National Underground Railroad Freedom Center Inc. (“NURFC”).  
The Controlling Board release and encumbrance of funds will need to be in the name of NURFC.  If, prior to 
disbursement of these funds, another entity takes ownership of the facility or negotiates with NURFC to be the
recipient of the state funds (subject to Commission approval), the agreement(s) will need to contain language 
that directs NURFC to pay the amount to the third party after the state makes payment to NURFC.  This is 
because once the funds are encumbered to NURFC and we cross a fiscal biennium, we cannot change the 
payee without legislative action to re‐establish the appropriation.

I have reviewed and added notes to the appropriations sections of the resolutions for the following projects:

• Salem Comm. Theatre 
• Cozad‐Bates 
• NURFC 
 
An important note related to all of my comments.  Where there is a disagreement between the Resolution or PASR and 
the Intranet/Detail Form, it is essential that the source data – the Intranet – be updated so that all future runs of reports 
have the correct information.  We all use Intranet data in various reviews of project related items (e.g., Controlling 
Boards, future projects, etc.) and need the data to be accurate.  I am happy to show folks how to do things in the 
Intranet if necessary. 
 
I have made a few other random notes in other sections and the PASR as I stumbled across things.  Please do not 
interpret this to mean that I did a comprehensive review of the PASR or the sections of the Resolution that do not 
directly relate to appropriations. 
 
Finally, I have done nothing with Resolution numbers yet, as we are not scheduled to assign numbers until early January.

monitoring red flags.  Since re‐appropriations will be coming up this summer and if there are other projects which are

As discussed (for Myra’s benefit), we are not currently producing statements of any kind, nor have we had any requests 
to do so since I’ve been here.  We can produce a simple, manual statement for NURFC on demand or on a cycle (no 
more frequent than quarterly) if they have a need.  Tony will advise us of NURFC’s request.

Facility of six months of (a) real property taxes, (b) all utility charges and (c) premiums for insurance required
by Article X. Such funds may only be used by the Commission to pay the cost incurred in providing alternate
performance of the Project Sponsor’s obligations to pay such costs. Escrow Funds in the Capital Donations
Fund will be held and invested by the Treasurer of the State in accordance with rules and regulations governing
that office, at no cost or expense to the Project Sponsor. Interest on the escrow funds will accrue solely to the
benefit of the Project Sponsor to be used in accordance with this Article. To the extent moneys in the escrow
account are not used for their intended purpose, the money shall be returned to the Project Sponsor upon
termination of this Cooperative Use Agreement.

The budget cut targets are actually 10% or 16% (I also shared with Kathy). I would be shocked if we get any kind of
feedback from OBM in the coming days, and we may not even know the results at our 2/26 meeting.

Depending on how things develop in the coming days, we could possibly know about a new appointment to the
Commission, but I would not hold anything up for it. Just may be worth a check-in before sending out.

We also typically “tease” the upcoming meeting, but since we do not have a draft agenda set by the Chairman, it would
need to be pretty general.

need to include a brief description of potential for budget cuts. Something along the lines of:
Governor Taft held a press conference on XXX to announce steps he is taking to ensure that the state budget remains
balanced in the event of a recession. Each state agency has been asked by the Office of Budget and Management
(OBM) to identify how it would manage its work, assuming cuts of 10 % and 15% of budget lines that are funded by the
general revenue fund for both FY 08 and FY09. For the Commission, this means cuts of $17K to $28K to internal
operations in each year, for a total of $35K to $56K. Commission staff has responded to OBM, suggesting that any cuts
be front loaded to FY 08. Commission staff believes that the 10% cut can be handled by a combination of forgone payroll
due to slow approvals for hiring at the outset of FY 08, along with shifting consulting services originally planned for FY 08
to FY O9. The 15% cut is more problematic for FY 09, and would lead to reductions in service to our clients because
certain contracted consulting services would have to be reduced or eliminated. We do not contemplate reductions in staff
since our staff are already working in excess of 40 hrs per week and, as salaried employees, are not compensated for this
extra work.

Two sports projects assigned to the COMMISSION NEWS


Commission revealed preliminary designs to
the public during the month of June: Governor Strickland signed the state’s operating budget bill for
the 2008-2009 biennium into law on June 30, 2007. A House-
Senate conference committee kept provisions included in the Senate
version of the bill that restore the Commission’s project management
funding to the appropriation level of fiscal years 2004-2005. The
Commission’s first priority will be to hire additional project
management staff to oversee the more than 250 projects that have
been assigned to the Commission.

Commission Member Harry Lehman has been appointed to the


board of the School Employees Retirement System by Ohio
Toledo Ice Arena (Lucas County) Treasurer Richard Cordray. Mr. Lehman will fill an unexpired term as
the treasurer’s investment designee, effective immediately. His term
will run through December 2, 2008.

The Commission reimbursed five local project sponsors totaling


more than $5.7 million on paid invoices during the month of June.

PROJECT NEWS

Officials from the Western Reserve Historical Society, which operates Hale Farm and Village, have indicated
plans to move forward with their project to renovate two wings of the Jonathan Hale House, the primary building at
the historical village. The project received a $250,000 appropriation in Am. Sub. H.B. 16 of the 126th General Assembly,
and received Commission approval in May 2006; however, construction plans were put on hold when bids came back
higher than anticipated. The project sponsor received revised bids that meet the project budget, and anticipates
construction will begin as soon as the county issues a building permit, which is expected to be this summer.

Commission staff requested a variety of submittals and reporting requirements of the Johnny Appleseed
Heritage Center, Inc. (JAHCI) in correspondence dated June 20, 2007. The letter reiterates the need for JAHCI to
adequately and fully address prior questions posed by Commission staff regarding its financial recovery plan. In addition,
the letter outlines additional reporting requirements, including a progress report summarizing the results of a fundraising
campaign, and operating revenue and expense reports, by September 15, 2007. Additional documentation is being
required as soon as July 1, 2007.

At the request of the Commission, the Board of Directors of the Muskingum Watershed Conservancy District (MWCD),
from whom JAHCI leases the facility, is considering a resolution that approves the reduced level of cultural programming
now being offered by JAHCI and waiving the requirement for an outdoor drama specifically related to Johnny Appleseed.
In addition, the resolution would authorize MWCD to work with the Commission to explore contingency options, which
could include contracting with a new operator, should JAHCI be declared in default by the Commission. The resolution is
expected to be adopted by September 2007.

Commission staff will review the information received from JAHCI and will report to Commission members on progress
and recommended actions as appropriate.

Executive-level comings and goings were reported at several Commission project sites over the last several
weeks. The Dayton Art Institute has announced its hiring of David Brigham as Director and CEO. Brigham will take the
helm on August 20, 2007, and is most recently executive director of the Allentown Art Museum in Pennsylvania (read full
article). Leadership at two historic theaters is changing hands: Stambaugh Auditorium director Steven Small resigned,
effective May 25, 2007, and executive director Costin Manu of the Sandusky State Theatre (SSTI) announced his
resignation (read full article). Manu reportedly will continue to serve as a consultant to Sandusky State Theatre, and
leaves the theater with a new operating plan in place and a 2007-2008 season on the schedule. Finally, two high-level
executives are leaving the National Underground Railroad Freedom Center: president Spencer Crew and executive vice
president of advancement Love Collins III are leaving the Cincinnati institution for new jobs (read full article). Both
Stambaugh Auditorium and the Freedom Center received new appropriations in the December 2006 Capital Bill.

Franklin County officials publicly unveiled plans for the new Columbus Clippers baseball stadium, Huntington
Park, to be built in the Arena District near downtown Columbus. Designers are planning a ballpark to seat 10,000 fans,
with the closest seats located just 48 feet from the bases. Driven in part by the small 8-acre footprint the stadium will
occupy, 360 Architecture, in association with Moody Nolan, has designed an intimate but state-of-the-art stadium that will
include suites, club seating, and a rooftop patio available for parties. County officials intend to keep Clippers games
affordable, retaining $3 - $6 general admission ticket prices, $3 event parking, and the popular “Dime-A-Dog” nights (read
full article). Huntington Park received a $7 million appropriation in the December 2006 Capital Bill. County officials have
submitted materials to Commission staff, which are currently in assessment for potential placement on the August 2007
meeting agenda. The Commission has engaged sports facility consultants Brailsford & Dunlavey for services including
analysis of economic and fiscal impact, market and financial feasibility studies, and construction plans, specifications,
contracts and schedules.

Arena plans were also unveiled in Toledo, as Lucas County officials revealed preliminary designs for a new
downtown sports arena to the public on June 13, 2007, and announced plans to seek community input in several public
forums. The future arena, which has a $5.5 million state appropriation, is expected to seat up to 10,000 people. County
officials are emphasizing the importance of community input to create a final design, hoping to build broad-based support
for arena events, which will include minor league hockey, concerts, and more (read full article). This project is also moving
forward through the Commission assessment process, including analysis by sports facility consultants Brailsford &
Dunlavey.

Commission staff met with representatives of the National Underground Railroad Freedom Center regarding the
institution’s most recent capital appropriation of $2 million in Am. Sub. H.B. 699 of the 126th General Assembly.
Funding models submitted by Freedom Center representatives in February 2007 indicate that the institution has not made
progress toward completing its capital campaign. Prior approvals from the Commission for the expenditure of state funds
were based upon the understanding that the Freedom Center would set aside funds from its endowment/investment
account that would stand in the place of its capital fundraising shortfall, and that within a short period of time the Freedom
Center would complete its capital fundraising campaign, producing project funding to equal the total project costs.

Two years later, the Commission staff assessment indicates that the project is not fully funded. Total project costs to build
the Freedom Center were nearly $117.7 million, and the organization’s total received and confirmed funding sources are
approximately $110 million, including state appropriations, resulting in an apparent funding gap of $7.75 million. Although
the Freedom Center completed a successful $8-million fundraising campaign in 2006 to reduce operating debt,
Commission staff remains concerned that no further fundraising progress has been made with regard to the capital
project. Commission staff have suggested an expedient solution to achieve full funding for the project, in which the
Freedom Center may identify a guarantor for the $7.75 million funding gap. Such an action would permit Commission staff
to recommend the Freedom Center for placement on an upcoming Commission meeting agenda for approval of the recent
$2 million appropriation. Freedom Center officials will meet with Commission staff again in July to discuss the status.

Several Commission-funded projects are the recipients of appropriations in the state’s 2008-2009 operating
budget bill. Operating funds were granted to a number of Commission partners, including: $100,000 per year of the
biennium for the Cincinnati Arts & Technology Center, the Contemporary Arts Center, the Great Lakes Historical Society
and the Steamship William G. Mather Museum. The Tecumseh! outdoor drama received $60,000 per year, and $350,000
per year went to both the Cincinnati Museum Center and the Western Reserve Historical Society. The list also includes
Toledo’s Marina District “Riverfront Park” project, which has a $4.9 million state appropriation through the Commission.
The project earned a $1.5 million state grant, putting the City of Toledo closer to assembling the required funds to begin
construction on the park, in cooperation with developer Dillin Corp. Plans for the park call for several community gathering
spaces that can be used for outdoor performances, public art, festivals, and other cultural activities. Missing from the list is
the National Underground Railroad Freedom Center; in the original version of the budget, $250,000 per year was set
aside for the museum, but was removed in the House version of the bill. All of the above operating funds are assigned
through other state agencies. The Commission’s statute prohibits the Commission from providing operating funding.

NEW PROJECT PROFILE

The Massillon Museum is a local art and history museum that holds major
collections of photography; costumes and textiles; china, glass and pottery;
domestic appliances; and circus memorabilia. Housed in a 1930s building that was
originally a dry goods store, the museum was renovated in the early 1990s and
opened as the Massillon Museum in 1996. An appropriation of $275,000 in Am. Sub.
H.B. 699 of the 126th General Assembly will assist the Massillon Museum with
necessary upgrades to its storage area, HVAC system, lighting and security.

The French Art Colony received a $100,000 appropriation in the December 2006
Massillon Museum Capital Bill. Housed in an 1855 Greek Revival building listed on the National
(Stark County) Register of Historic Places, the French Art Colony is located in Gallipolis' Historic
District along the Ohio River. This community arts center offers exhibitions and
workshops, hosts meetings and special events, and sponsors a variety of arts
classes for all ages. Local sponsors plan to use the $100,000 appropriation for
necessary renovations to parking areas, walkways, and ADA-compliant entrances, as
well as improvements to the building's front porch and patio.

CINCINNATI (AP) - Two top executives are leaving the National Underground Railroad Freedom Center in Cincinnati.

The center announced yesterday that president Spencer Crew is leaving for an endowed faculty position at George
Mason University in Virginia. Love Collins the Third, executive vice president of advancement, is leaving for a fund-raising
job at Benedict College in South Carolina.

Freedom Center officials haven't decided how to replace the high-paid executives, whose salaries were questioned amid
the museum's financial problems.

The Freedom Center opened in August 2004 and lost more than five million dollars in its first 18 months, leading to
layoffs.

A museum spokesman says the executives' professional standing justified their salaries.

Commission Projects Seeking The fourth quarter Commission meeting is set for November 29 at 10 a.m. at the
Additional Capital Appropriations Commission offices (20 East Broad Street, Suite 200). Commission members will
in the 2007-2008 Capital Bill: receive their meeting notebooks by November 6. Executive Director Kathy Fox will
schedule a briefing call with each member to determine if additional materials are
needed in order for the members to deliberate and make decisions on November 29.

Certain materials to support the meeting agenda items will be available via
computer through an electronic link found at:

set up for you to access materials for this and future Commission meetings. Paper
copies of these materials will be sent to any commission member upon request.
Pro Football Hall of Fame - $2.5m
Although there are just two project approval-related resolutions to consider –
Armory Youth Center (London) and COSI Toledo – the Commission’s fourth
quarter meeting will include a full agenda. The Commission will hear from
representatives of the Sandusky State Theatre and the Johnny Appleseed Heritage
Center and Outdoor Drama on the status of the operations of those facilities. The
Commission will also be asked to approve updated project assessment guidelines and
other administrative matters.

Legal agreements for all five projects that were approved by the Commission at
the May 2006 meeting have been signed, continuing our success in executing
project legal documents within six months of Commission approval. Agreements
were completed in October for the Hale Farm and Village (Bath) and the Western
Reserve Historical Society’s (WRHS) East Boulevard Phase I project (Cleveland).
Agreements have been executed with two of the four projects approved at the August
Cincinnati Museum Center - $1.0m 2006 meeting: Foundation Community Theatre (Canton) and the WRHS East
Boulevard Phase II project. The agreements process is ongoing with Chester Academy
and the Oxford Community Arts Center. Additionally, legal agreements have been sent
for signature to representatives of the Cincinnati Museum Center, the local sponsors of
the Charles A. Eulett Education Center–Edge of Appalachia Museum project (see
project note below).

The Commission reimbursed 21 projects more than $1.97 million on paid


invoices during the month of October. The total amount reimbursed includes:

ƒ $ 109,620 – Western Reserve Historical Society. (Cleveland)

ITEMS OF INTEREST

Community "wish lists" seeking capital appropriations for the 2007-08 biennium
total more than $1 billion statewide for what is expected to be $90-$120 million
Schuster Center - $5.5 m
available for community capital projects, according to a recent report in
Gongwer, the news service that covers issues in and around Ohio's government
and political systems. Commission projects from the state’s major metropolitan areas that are seeking additional
appropriations include:

ƒ Akron-Canton Area: Pro Football Hall of Fame ($2.5 million); MAPS Air Museum ($2 million); McKinley Memorial
($500,000);
ƒ Franklin County: Columbus Museum of Art ($1 million); COSI Columbus ($1 million);
ƒ Cuyahoga County: Rock and Roll Hall of Fame ($3 million); Steamship William Mather ($1.5 million); West Side Arts
Consortium ($1.2 million);

communities’ wish lists for the capital bill:

ƒ Fulton County: Sauder Village ($1.2 million);
ƒ Hamilton County: Cincinnati Symphony Orchestra ($3 million); Riverfront Park on The Banks ($2 million); Cincinnati
Zoo ($1 million); Jewish Community Center ($750,000); Clifton Cultural Arts Center ($250,000);
ƒ Knox County: Kenyon College Horvitz Center ($900,000); and
ƒ Summit County: MLS Soccer Stadium ($3 million);

Leadership changes continue at Ohio’s cultural venues. In the past year, 16 cultural institutions have had to replace
or prepare for the pending departure of their top executive, including at the Beck Center for the Arts, Cincinnati Art
Museum, Cincinnati Ballet Center, Cincinnati Zoo and Botanical Gardens, Cleveland Museum of Art, Cleveland Institute of
Music, Contemporary Arts Center (Cincinnati), COSI Columbus, Dayton Art Institute, National Underground Railroad
Freedom Center, Taft Museum of Art, Stambaugh Auditorium, Reese–Peters House, Pro Football Hall of Fame, Westcott
House and the Western Reserve Historical Society. This follows a national trend documented by CompassPoint’s 2001
and 2006 studies on non-profit leadership, both of which found that 75% of non-profit executive directors planned to leave
their organizations within five years. The trend also appears to be a reflection of the corporate world. The Oct. 30 issue of
Business Week reports 1,112 corporate chief executives have left their positions this year, including those at Ford Motor
Company, Kraft Foods, Nike and RadioShack. The total is on pace to exceed last year’s record 1,322 exits.

In an effort to promote Issue 18, the local cigarette tax on the November 7 ballot to fund the arts in Greater
Cleveland and Cuyahoga County, 17 area arts and cultural organizations offered events at no cost or reduced
rates on October 18. The aim of the day’s performances was to show voters a sample of Greater Cleveland’s arts and
culture in an effort to gain support for the ballot issue. Issue 18, which calls for a tax of 30 cents per cigarette pack, is
expected to raise more than $20 million annually for arts and cultural organizations if it passes.

STAFF NEWS

Commission Executive Director Kathy Fox is one of 12 central Ohio “Women You Should Know”
featured in the Women for Economic and Leadership Development (WELD) 2007 calendar. Commission
member Julie Kunkel was featured in the inaugural WELD calendar in 2005. The 2007 calendar will be
premiered at a reception on November 8 at the Rebecca Ibel Gallery at Miranova in Columbus. Please
contact Kathy if you are interested in attending.

As reported by Commission Assistant Director/COO Dave Wartel at the August 2006 meeting,
staff resources are being redirected to fund an additional project analyst/manager. This will be
accomplished through consolidation. Annie Fullerton, current legal and executive assistant, has been
planning for retirement and has selected the end of the calendar year as her target date. Support staff work will be
consolidated into a single position, administrative coordinator.

OHIO HISTORICAL SOCIETY NEWS

The Ohio Historical Society’s Board of Trustees elected its officers for 2006-2007: Dr. Richard Ruppert of Toledo as
president; David Baker of Marietta and Jon Elsasser of Zoar as vice-presidents; Marian Vance of Springfield as secretary;
and Robert Jeffrey of Columbus as treasurer.

Cultural Facilities

Akron Art Museum: The $40 million addition to the museum, scheduled to open July 15, 2007, will be named the John S.
and James L. Knight Building. The Knight Foundation has contributed $6 million toward the construction, including a $2
million grant announced in October. The state of Ohio’s $7.7 million in capital bill appropriations tops the list of major
contributions to the museum’s capital campaign that is funding the addition. The Commission has reimbursed the project
more than $5.7 million to date.

Beck Center for the Arts (Lakewood): According to recent news reports, the Beck Center will stay in Lakewood and
form a partnership with city schools to create an arts-education academy that would anchor a possible cultural district in
Lakewood's west end. The plans are a long way from fruition, according to published reports, with as much as $20 million
needing to be raised and decisions to be made about which buildings to demolish, renovate or construct. The Beck Center
has a $100,000 appropriation for capital improvements through the Commission. The funds will not be released until the
Beck Center’s finances are in order and future operations are understood. An initial $100,000 appropriation that was used
for an improvements project at the Center is currently being held in escrow. The escrow was agreed to by the
Commission and Beck Center officials as a way to assist in its financial recovery efforts. The agreement was approved by
the Commission at its May 2006 meeting, but has not been signed by officials of the Beck Center and National City Bank.
The Commission retains the first leasehold position on the property until the agreement is signed by all parties. (Link to

Charles A. Eulett Education Center–Edge of Appalachia Museum (West Union): Commission staff is working to
complete the execution of legal agreements for the project following dismissal of the federal lawsuit challenging property
rights where the education center is to be built, and approval of title work by outside counsel. The cooperative use
agreement and construction administration and funding agreement have been signed by the project sponsor, Cincinnati
Museum Center. The Commission approved the education and training center project, and the expenditure of $1.85
million in state funds, at its February 2006 meeting, and approved a three-month extension of time for execution of
agreements in August.

Cleveland Institute of Music: David Cerone, who has guided the Cleveland Institute of Music (CIM) as president since
1985, announced his retirement from the school as soon as a successor can be found. According to published reports,
Cerone, 65, told CIM Board President A. Malachi Mixon III that he intended to step down after the school's capital
campaign for expanded facilities had been completed. The campaign reached its $40 million goal at the end of August.
Mixon will chair a search committee to find a successor to be in place by the start of the 2007-08 school year. The CIM
project, which has $1.5 million in state appropriations, and the expenditure of funds was approved by the Commission at
its November 2005 meeting. The approval included the caveat that the project must be fully funded prior to
reimbursement. Commission staff is currently reviewing the CIM’s fundraising report, and comparing it with the actual
project construction costs in an effort to determine whether the project is fully funded or not.

Contemporary Arts Center (Cincinnati): Cynthia Goodman has been named interim director at the Contemporary Arts
Center (CAC) while CAC's board continues the search to replace former director Linda Schearer, who resigned last
month. Goodman is in the running for the permanent position. Shearer, director of the CAC since July 2004, resigned
Sept. 1 to pursue other interests.

COSI Toledo: The Toledo Blade has endorsed Issue 11, COSI Toledo's levy request that would generate $1.4 million
annually for the science center. From the editorial: "While we realize that the odds are stacked against passage of the
0.167-mill levy, known as Issue 11, we believe that COSI is a worthy enterprise that Lucas County voters should support."
COSI officials have characterized the organization’s funding model as “unsustainable.” Commission staff continues to
monitor the organization’s financial situation. Approximately $1.2 million remains from a $1.9 million appropriation to COSI
for new exhibit development and improvements. (Link to article.)

Great Lakes Historical Society (Vermilion): Officials from the Historical Society, which owns and operates the Inland
Seas Maritime Museum located in Vermilion, presented their vision for a new museum along the Lorain waterfront to
Lorain City Council in October. The proposed project will cost approximately $10 million, according to a published report
that attributed the figure to Historical Society Executive Director Chris Gillcrist. The report also stated that $5 million is
needed for exhibits, and the Historical Society would like to increase its current $1 million endowment to about $12 million.
The Commission approved in October 2003 a project at the Vermilion site for exterior and interior improvements. That
project was not undertaken by the Historical Society, and they instead have been pursuing the relocation plans. The
Commission would need to review and approve a project at the new site if the Society hopes to use $475,000 in state
funds for the project. (Link to article.)

National Underground Railroad Freedom Center (Cincinnati): The Freedom
Center, whose leaders are seeking $2.85 million in the next capital bill to help
offset the facility’s operating costs, has introduced audio tours of the Freedom
Center narrated by Hollywood stars Angela Bassett (far left) and Vanessa Williams
(left). The Freedom Center provides a phone-like device for visitors taking the
audio tour at no extra charge. The device can be held to the ear or plugged into
headphones, which the museum also provides. While the Center continues to
receive national attention, its financial performance has not met projections. The two-year-old Freedom
Center lost $5.5 million in its first 18 months, according to published reports. Commission project manager Colin McBride
will meet with the Center’s finance staff in early November, and will provide additional updates as they become available.
The state of Ohio has contributed $12.6 million toward its construction costs through the Commission, including $4.15
million in fiscal year 2006.

Steamship William G. Mather (Cleveland): The Harbor Heritage Society, which operates the Mather Museum, has
transferred its collections, assets and $600,000 annual business operation, including six full- and part-time employees, to
the Great Lakes Science Center (GLSC) as was forecast last month in this report. The transfer will not affect the Mather
Museum’s $100,000 state appropriation as long as the appropriation is used for improvements to the steamship. An
improvements project at the museum has not yet been presented to the Commission for approval.

COMMISSION NEWS

The fourth quarter Commission meeting is set for November 29 at 10 a.m. at the
Commission offices (20 East Broad Street, Suite 200). Commission members will
receive their meeting notebooks by November 6. Executive Director Kathy Fox will
schedule a briefing call with each member to determine if additional materials are
needed in order for the members to deliberate and make decisions on November 29.

Although there are just two project approval-related resolutions to consider –


Armory Youth Center (London) and COSI Toledo – the Commission’s fourth
quarter meeting will include a full agenda. The Commission will hear from
representatives of the Sandusky State Theatre and the Johnny Appleseed Heritage
Center and Outdoor Drama on the status of the operations of those facilities. The
Commission will also be asked to approve updated project assessment guidelines and
other administrative matters.

Legal agreements for all five projects that were approved by the Commission at
the May 2006 meeting have been signed, continuing our success in executing
COSI Columbus - $1.0m project legal documents within six months of Commission approval. Agreements
were completed in October for the Hale Farm and Village (Bath) and the Western
Reserve Historical Society’s (WRHS) East Boulevard Phase I project (Cleveland).
Agreements have been executed with two of the four projects approved at the August
2006 meeting: Foundation Community Theatre (Canton) and the WRHS East
Boulevard Phase II project. The agreements process is ongoing with Chester Academy
and the Oxford Community Arts Center. Additionally, legal agreements have been sent
for signature to representatives of the Cincinnati Museum Center, the local sponsors of
Schuster Center - $5.5 m the Charles A. Eulett Education Center–Edge of Appalachia Museum project (see
project note below).

The Commission reimbursed 21 projects more than $1.97 million on paid invoices during the month of October.
The total amount reimbursed includes:

ITEMS OF INTEREST

Community "wish lists" seeking capital appropriations for the 2007-08 biennium total more than $1 billion
statewide for what is expected to be $90-$120 million available for community capital projects, according to a
recent report in Gongwer, the news service that covers issues in and around Ohio's government and political
systems. Commission projects from the state’s major metropolitan areas that are seeking additional appropriations
include:

ƒ Akron-Canton Area: Pro Football Hall of Fame ($2.5 million); MAPS Air Museum ($2 million); McKinley Memorial
($500,000);
ƒ Franklin County: Columbus Museum of Art ($1 million); COSI Columbus ($1 million);
ƒ Cuyahoga County: Rock and Roll Hall of Fame ($3 million); Steamship William Mather ($1.5 million); West Side Arts
Consortium ($1.2 million);
ƒ Dayton Region: Schuster Center ($5.5 million); Carillon Historical Park ($1 million);
ƒ Hamilton County: Cincinnati Sports Facilities Improvements - Great American Ballpark and Paul Brown Stadium
($9.65 million); National Underground Railroad Freedom Center ($2.85 million); Music Hall: Over-the-Rhine ($1.5

In addition, the following cultural facilities and sports facilities were included in published reports about various
communities’ wish lists for the capital bill:

ƒ Hamilton County: Cincinnati Symphony Orchestra ($3 million); Riverfront Park on The Banks ($2 million); Cincinnati
Zoo ($1 million); Jewish Community Center ($750,000); Clifton Cultural Arts Center ($250,000);
ƒ Knox County: Kenyon College Horvitz Center ($900,000); and
ƒ Summit County: MLS Soccer Stadium ($3 million);

Leadership changes continue at Ohio’s cultural venues. In the past year, 16 cultural institutions have had to replace
or prepare for the pending departure of their top executive, including at the Beck Center for the Arts, Cincinnati Art
Museum, Cincinnati Ballet Center, Cincinnati Zoo and Botanical Gardens, Cleveland Museum of Art, Cleveland Institute of
Music, Contemporary Arts Center (Cincinnati), COSI Columbus, Dayton Art Institute, National Underground Railroad
Freedom Center, Taft Museum of Art, Stambaugh Auditorium, Reese–Peters House, Pro Football Hall of Fame, Westcott
House and the Western Reserve Historical Society. This follows a national trend documented by CompassPoint’s 2001
and 2006 studies on non-profit leadership, both of which found that 75% of non-profit executive directors planned to leave
their organizations within five years. The trend also appears to be a reflection of the corporate world. The Oct. 30 issue of
Business Week reports 1,112 corporate chief executives have left their positions this year, including those at Ford Motor
Company, Kraft Foods, Nike and RadioShack. The total is on pace to exceed last year’s record 1,322 exits.

In an effort to promote Issue 18, the local cigarette tax on the November 7 ballot to fund the arts in Greater
Cleveland and Cuyahoga County, 17 area arts and cultural organizations offered events at no cost or reduced

rates on October 18. The aim of the day’s performances was to show voters a sample of Greater Cleveland’s arts and
culture in an effort to gain support for the ballot issue. Issue 18, which calls for a tax of 30 cents per cigarette pack, is
expected to raise more than $20 million annually for arts and cultural organizations if it passes.

STAFF NEWS

Commission Executive Director Kathy Fox is one of 12 central Ohio “Women You Should Know”
featured in the Women for Economic and Leadership Development (WELD) 2007 calendar. Commission
member Julie Kunkel was featured in the inaugural WELD calendar in 2005. The 2007 calendar will be
premiered at a reception on November 8 at the Rebecca Ibel Gallery at Miranova in Columbus. Please
contact Kathy if you are interested in attending.

As reported by Commission Assistant Director/COO Dave Wartel at the August 2006 meeting,
staff resources are being redirected to fund an additional project analyst/manager. This will be
accomplished through consolidation. Annie Fullerton, current legal and executive assistant, has been
planning for retirement and has selected the end of the calendar year as her target date. Support staff work will be
consolidated into a single position, administrative coordinator.

OHIO HISTORICAL SOCIETY NEWS

The Ohio Historical Society’s Board of Trustees elected its officers for 2006-2007: Dr. Richard Ruppert of Toledo as
president; David Baker of Marietta and Jon Elsasser of Zoar as vice-presidents; Marian Vance of Springfield as secretary;
and Robert Jeffrey of Columbus as treasurer.

PROJECT NEWS

Cultural Facilities

Akron Art Museum: The $40 million addition to the museum, scheduled to open July 15, 2007, will be named the John S.
and James L. Knight Building. The Knight Foundation has contributed $6 million toward the construction, including a $2
million grant announced in October. The state of Ohio’s $7.7 million in capital bill appropriations tops the list of major
contributions to the museum’s capital campaign that is funding the addition. The Commission has reimbursed the project
more than $5.7 million to date.

Beck Center for the Arts (Lakewood): According to recent news reports, the Beck Center will stay in Lakewood and
form a partnership with city schools to create an arts-education academy that would anchor a possible cultural district in
Lakewood's west end. The plans are a long way from fruition, according to published reports, with as much as $20 million
needing to be raised and decisions to be made about which buildings to demolish, renovate or construct. The Beck Center
has a $100,000 appropriation for capital improvements through the Commission. The funds will not be released until the
Beck Center’s finances are in order and future operations are understood. An initial $100,000 appropriation that was used
for an improvements project at the Center is currently being held in escrow. The escrow was agreed to by the
Commission and Beck Center officials as a way to assist in its financial recovery efforts. The agreement was approved by
the Commission at its May 2006 meeting, but has not been signed by officials of the Beck Center and National City Bank.
The Commission retains the first leasehold position on the property until the agreement is signed by all parties. (Link to

Charles A. Eulett Education Center–Edge of Appalachia Museum (West Union): Commission staff is working to
complete the execution of legal agreements for the project following dismissal of the federal lawsuit challenging property
rights where the education center is to be built, and approval of title work by outside counsel. The cooperative use
agreement and construction administration and funding agreement have been signed by the project sponsor, Cincinnati
Museum Center. The Commission approved the education and training center project, and the expenditure of $1.85
million in state funds, at its February 2006 meeting, and approved a three-month extension of time for execution of
agreements in August.

Cleveland Institute of Music: David Cerone, who has guided the Cleveland Institute of Music (CIM) as president since
1985, announced his retirement from the school as soon as a successor can be found. According to published reports,
Cerone, 65, told CIM Board President A. Malachi Mixon III that he intended to step down after the school's capital
campaign for expanded facilities had been completed. The campaign reached its $40 million goal at the end of August.
