Below are my notes from yesterdays meeting with the staff of Speaker Pelosi. Please add anything you feel
should be included.

To ensure understanding, 50% of ICE removals are Criminal Aliens? Yes, up from about 34% at the same time
last year.

Are juvenile offenders captured through this process? No

Why is the program not deployed along the northern border? Based upon modeling, there is not enough
population density of Criminal Aliens to support deployment along the northern border at this time. Deployment
has been based upon the priority of areas where there is a high concentration of criminal aliens, and a stated SW
Border initiative by Secretary Napolitano. Our goal is to deploy nationwide by 2013.

Does this process allow for LE to pre-screen offenders using mobile handheld fingerprint devices? No. The
program is focused on specific booking locations. CJIS works with the state and locality to identify/designate
those sites by a specific coding number unique to that location .

Can a copy of the SC strategic plan be provided to the staff? Yes, we will get that to you. (Randi can you get that
to me electronically)[rgl]
RG -I don't remember that question. I thought they asked, "Did the initial appropriations provide statutory
authority to establish your office"?
Yes - the initial appropriations was based upon the submission of a strategic plan that was accepted and
subsequently appropriated. We can provide the initial language in the appropriations bill. OCR - please clarify
what ICE should provide, the initial Strategic Plan which is out of date and has been subsequently updated, a
more recent version of the strategic plan, or the actual language from the initial appropriation?

Just to confirm, criminal prints are taken at the time someone is charged with a crime?
Yes - prints are taken at the time someone is arrested/booked in accordance with local procedures, which do not
change as a result of this initiative.

Are there any plans to expand beyond the use of fingerprints, for example, using DNA?
No - our capabilities and plans do not extend beyond the use of fingerprints .

Please explain the outreach process? After ICE enters into an MOA with a state we work with the state to
establish a deployment plan for that state. WE then go out and invite LE entities that will be impacted by the
program to attend information sessions where we explain the program and how it works. We do not move
forward on activating the program in a jurisdiction unless an official from that jurisdiction has partiCipated in an
outreach session. In the case of California, Cal Doj has had representatives attend all of the outreach sessions.

Please explain the Opting Out process? Currently, a jurisdiction can ask not to receive the immigration related
response message. However, that message would still go to the local ICE office and if warranted that office could
take action . However, to Opt Out of not having prints from a jurisdiction run for immigration status is a discussion
between the jurisdiction and the state SIB. In the case of California it would be with Cal Doj. However, in a
recent letter from the State Attorney General Cal Doj has stated that all prints will be checked against the
immigration database.

Santa Clara has requested to Opt-out, but then AG Brown issued a memo stating that is not an option for
California jurisdictions. Is there any way to resolve the request?
As the State is the determining factor, ICE defer's to AG Brown's decision memo.

What would happen to a person arrested, with no criminal background, but they are in violation of a Visa
Overstay? If the persons prints are submitted and it is determined they are in violation, they could be placed into
removal proceedings if the local ICE office has the resources available at the time to pursue that case. However,
the ICE priority at this time is on Criminal Aliens.
