RE: Unauthorized Use and Publication of Copyrighted Photograph(s)

To Whom It May Concern:

Flynet Pictures, LLC (“Flynet”) represents the artist who created the photographs
described in Attachment A to this letter (the “Photograph(s)”). Flynet owns or represents
the party who owns the intellectual property rights, potentially including, but not limited
to, registered trademarks, common law trademarks, copyrights and other intellectual
property and proprietary rights in the Photograph(s). It has come to the attention of
Flynet that you are unlawfully using and publishing the Photograph on your website.

Accordingly, Flynet demands you immediately:

1. remove all infringing content from your website, including any and all instances
of the Photograph(s), and notify Flynet in writing that you have done so;

2. pay a licensing fee in the amount of _____________________ ; 1

3. immediately cease the use and distribution of Flynet’s copyrighted material;

4. undertake in writing to desist from using any of Flynet’s photographs in the future
without prior written authority from Flynet.

Please be advised Flynet is prepared to proceed with legal action in order to enforce
rights in the Photograph; including notifying your Internet Service Provider (see
Attachment B to this letter) of your behavior with a Digital Millennium Copyright Act
notification and filing a Copyright infringement case against you seeking maximum
possible damages. You may be liable for any profits you’ve received while the
Photograph was up on your website, statutory damages of $100,000 per work, costs and
attorney’s fees (see 17 U.S.C. § 504(c) and 17 U.S.C. § 505).

Should you wish to discuss this matter, please reply to this notification. If you do not
respond within five (5) business days from the date of this notification, Flynet will
assume that you have no desire to resolve this matter amicably and proceed accordingly.

Nothing in this e-mail should be construed as a waiver of any rights and remedies of
Flynet or the photographer, all of which rights and remedies are expressly reserved.

Digital Millennium Copyright Act “Takedown” Notice

My name is Daniel Krassner, Corporate Counsel for Flynet Pictures, LLC (“Flynet”) and
we’ve identified infringing content on a website that your company hosts.

A photograph was copied onto your servers without Flynet’s permission. The original
photograph, to which Flynet holds the copyrights, can be found at:

This letter is official notification under Section 512(c) of the Digital Millennium Copyright Act
(”DMCA”), and I seek the removal of the aforementioned infringing material from your
servers. I request that you immediately notify the infringer of this notice and inform them of
their duty to remove the infringing material immediately, and notify them to cease any further
posting of infringing material to your server in the future.

Please also be advised that law requires you, as a service provider, to remove or disable
access to the infringing materials upon receiving this notice. Under US law a service
provider, such as yourself, enjoys immunity from a copyright lawsuit provided that you act
with deliberate speed to investigate and rectify ongoing copyright infringement. If service
providers do not investigate and remove or disable the infringing material this immunity is
lost. Therefore, in order for you to remain immune from a copyright infringement action,
please investigate and remove or otherwise disable the infringing material from your servers
as soon as possible.

I am providing this notice in good faith and with the reasonable belief that the Website is
infringing on Flynet’s copyright interest in the Photograph. Under penalty of perjury I certify
that the information contained in the notification is both true and accurate, and I have the
authority to act on behalf of the owner of the copyright(s) involved.
