1. The competent authority has given the approval for opening of Adani
Logistics Ltd - ICD served by Kishangarh station on Jaipur Division of
North Western Railway as private siding for both inward & outward

container traffic in train load when consigned to & by M/s. Adani Logistic
Limited siding at Kishangarh.
2. In case of train load traffic which are entering directly into the siding
without terminating at the serving station duly fulfilling the requisite
condition, freight for traffic moved to and from the siding will be charged
on through distance basis. The chargeable distance from serving station
Kishangarh (KSG) to Adani Logistic Ltd –ICD (ALIK) is 6.370 Km.
3. For any shunting done on party’s account, Separate shunting charges are
leviable as per extant rules.

Sub:- Charging of fares for high capacity coaches /conventional
coaches and other matters.(Commercial Circular No. 73 of 2008)
iii) CIRS has already made arrangements in the system for recognizing high
capacity coaches and charging of fares accordingly. It may be ensured
that actual type of coach running on the train is fed in the system.
iv) In case journey involves travel in high capacity coach for one leg and in
conventional coach for another leg or vice versa , the fare shall be the
sum of the fares in respective high capacity coach and conventional
coach on telescopic basis. However, if the chargeable fare thus arrived
at is higher than the fare for conventional coach for the entire distance,
the fare for conventional coach will be charged.
vi) The discounts shall be applicable to all high capacity coaches of all
classes, irrespective of whether newly manufactured high capacity
coaches or conventional coaches whose capacity has been increased

through retro-fitment. This discount shall not be admissible in LHB
coaches of any class.

publication of books and periodicals for promoting social and cultural
values of the society .

(c) At stations where UTS is available, the passengers may be issued such
tickets. At station where printed retiring room tickets are stocked, the
passengers may be issued printed tickets on recovery of prescribed charges.
The amount thus collected is to be accounted for in the daily trains cash-cum-
summary book and this is to be reflected in the monthly local passenger
classification returns. At other stations, passengers may be issued money
receipts in form Com./M-2 and a separate money receipt book is required to
be kept for the purpose. The charges thus received are to be accounted for in
daily trains cash- cum –summary book under head “retiring Room Charges”.

3 The Income Tax Act has entrusted the Drawing and Disbursing officers
(Chapter XVII-B) to.
* Deduct Tax at Source at the time of payment,
* Adjust tax at deducted in Government account
through book entry’
* Issue TDS certificates to the deductees,
* File quarterly statements within specified times
.
4 Some other relevant provisions are :-
* All persons deducting or collecting tax at source are required to apply
for and obtain a Tax Deduction and Collection Account Number (TAN)
and to quote the same on TDS/TCS returns, certificates and related
documents (Sec.203A)
* A penalty of Rs. 10,000/- has been specified for failure to obtain TAN,
for non-quoting of TAN or for quoting rong TAN (Sec.272 BB)
* Quoting Permanent Account Number (PAN) of the person in whose
respect tax has been deducted is mandatory for the government
deductors under Section 139A(5B). Similarly, it is also mandatory for
the individuals in whose respect tax is being deducted to intimate their
PAN No.to the Government deductor under Section 139A(5A)
* Any failure in compliance of provisions of Section 139A may attract a
penalty of RS.10,000/- (Section 272B)
5 A detailed examination of the issue has brought-forth the following :
* There is lack of awareness among bill drawing and accounts officers
about the various transactions on which TDS is deductible. A chart
showing payments requiring TDS is enclosed as Annexure I.
* Section 194C of IT act requires TDS on payments exceeding
Rs.20,000 for executing work The provisions of Section 194C shall
apply to all types of Contracts for carrying out any work including

transport contracts, service contracts, advertisement contracts,
broadcasting contracts, telecasting contracts, labour contracts,
materials contracts and works contracts.
* It is seen that many times TDS is not made on outsourcing
contracts on the plea that these are contracts of sale. In case of
payment to suppliers. CBDT has clarified that though TDS is not
applicable on contracts of sale of goods, but the same is applicable
on all composite work contracts,service contracts, maintenance
contract, transport contract, material contracts, stores contracts,
turnkey contracts and material contracts where the dominant or
main intent of the agreement is not purchase of material but getting
work done.
* Further , in cases where specific plant and machinery, equipments
etc.are deployed under time contract for rendering services ,it would
not be a contract for service but that of letting out of the plant and
machinery, equipments etc and hence ,TDS would be deductible u/s
194(!) and not u/s194C.
* TCS on various receipts , including from auction of scrap , cotracts
for parking lots etc is required to be collected and deposited.
* All payments made to foreign firms / non-residents are liable to
withholding tax under section 195 of I.T.Act . All agencies entering
into such contracts need to take cognizance of this fact while
finalizing contracts.
* In case of payment of arrears of 6 th CPC ,as already clarified, the
deduction is to be made on 40% of the total arrears paid during the
current financial year.
6 Income Tax Department has also pointed out that some of the
accounts officers are yet to obtain Tax Deduction Account Numbers
while some others are not filing the quarterly TDS returns .This will
make it difficult for concerned deductees to get credit for TDS
deducted from current financial year onwards.
7 It is therefore desirable to immediately assess the compliance of
I.T.Act provisions on your railway and ensure that all functionaries
discharging disbursal functions immediately get registered and
obtain TAN as well as start the process of filing e returns, if not
already done , in a time bound manner .In case any doubt exists
about the role of bill drawing and disbursing offices for TDS related
functions, the same should be immediately clarified .
8 Wherever bill drawing offices and the disbursing accounts offices are
responsible for TDS , the compliance of section 139A (5A) regarding
the quoting of PAN number by all third parties on their respective
claims , when presented may be ensured. All units and formations
submitting employee/ party bills may be directed to ensure quoting of
PAN number on bills presented by them.

iii) Should the JTBS fail and \or neglect at any time to arrange for
uninterrupted service in the sale of tickets as per working hours
prescribed by the Railway Administration, the later shall have the right
to engage its own staff to work at the agency and all expenses incurred
in connection with the above and any other expenditure incurred by he
Railway shall be recoverable from the JTBS.
iv) The Railway Administration shall give publicity to the services covered
by this agreement in such manner as may be decided by them and the
publicity that the JTBS desire to undertake in this behalf shall be
subject to the approval of the Railway Administration.
v) Appointment of JTBSwill not confer any right on the person for
employment on Railway .The appointment is purely contractual in
nature and no facilities viz. absorption in Railway Service,
regularization of service, bonus, railway pass facilities etc. shall accrue
to the JTBS.
1.1) In the event of breach of any of the terms and conditions of this
agreement by the contractor, his servants or any person acting for the
contractor at any time failing to perform all or any of the services required
of him by this agreement within a time deemed reasonable or in a manner
satisfactory to the Railway Administration may without prejudice to the
Railway Administration may otherwise be entitled to any other right,
remedy or relief to which he or she otherwise be entitled under this
agreement or any law for the time being in force, revoke and determine
this agreement after the expiry of one month notice in writing to be sent by
registered post or delivered to the contractor of their intention of doing so.
1.2) The Railway Administration may also terminate the agreement forthwith by
writing under the hand of-------------------- of the Railway Administration if
the JTBS becomes bankrupt or insolvent or has any execution levied upon
him or his goods or property belonging to him .The JTBS shall stand
forfeited of all the money belonging or due to him from the Railway
Administration.
1.3) Except as otherwise provided for in clause in 1.0 either party of this
agreement may determine the same upon expiry of one months notice in
writing given to the other of its intention of doing so.
1.4) Save as otherwise provided in the contract, all notice to be given on behalf
of the President, Union of India and all other action to be taken on his
behalf may be given or taken on his behalf by the Sr. DCM of the Division
of--------------Railway or any officer mentioned in para1.0 of this
agreement.
1.5) Any notice, letter or other communication, which shall be sent by the
Railway Administration by Registered post addressed to the JTBS at his

Head Office at ------------------------------------------be deemed to have
delivered to the JTBS.
3.1) The JTBS shall forthwith deposit with the Financial Advisor & Chief
Account Officer----------------------Railway a sum of Rs. ------------------(in the
form of FDR of any nationalized bank ) refundable interest free security
deposit and Rs--------------- bank guarantee to the Railway for the due
fulfillment of each and all the said terms & conditions to be observed by
him.
3.2) On completion \ termination of the contract pending dues will be adjusted
from the security deposit and balance refundable to the JTBS.
3.3) The Security deposit is liable to be adjusted or realized towards payment
of any amount due to the Railway Administration by the licensee including
penalties and where this is done, the licensee may at the discretion of the
Government be allowed to commence sales only after the licensee has
provided further security deposit equal to the entire amount of security
required and on giving suitable guarantee for the future the government
shall not be liable to pay interest on the security deposit
3.4) Tickets would be issued against the amount of advance deposited for the
purpose, which should be replenished each time before issue of ticket
when the advance deposit touches 10,000/-(Rs. Ten thousand only)
3.5) The JTBS will be penalized up to Rs. 500/- in case of non payment of
Railway dues within the prescribed period Any failure on the part may
lead to the cancellation of the agreement.

4.0) PROCEDURE FOR KEEPING A RECORD OR TICKETS ISSUED BY
JTBS;
4.1) JTBSs will procure uts terminals for which all the costs initial as well s
recurring including equipments & channels hiring would have to be borne
by jtbs.
4.2) JTBSs will collect Re. 1\ per ticket as commission from the passengers.
4.3) JTBSs will be responsible for the safe custody of the ticket rolls .In case of
any loss on this account, necessary debit will be raised against him\her s
per extant instructions.
4.4) Proper record of ticket rolls issued to the JTBS will be kept by the
Commercial Department of the station serving the JTBS.
4.5) JTBS will submit the accounts of sale of ticket to serving station on daily
basis along with value of tickets sold.
4.6) Proper accountability of UTS ticket stationery shall be ensured.
4.7) JTBS will be authorized to issue cash ticket only not involving concession
except Senior Citizen concession.
4,8) JTBS will submit a daily statement to the Station Master / Manager or any
other nominated officer indicating the details of tickets sold along with the
value. Station Master / Manager or any other nominated officer will
maintain proper record of daily sale of tickets by JTBS.
4.9) A consolidated statement of ticket rolls supplied to and details of tickets
sold by JTBS will be submitted by Station master / Manager or any other
nominated officer to DCM / Sr. DCM every month.
4.10) JTBS will not issue tickets from station premises.
4.11) All computerized tickets wrongly printed or wrongly issued or otherwise
are classified as non- issued. In case of above problem/ defects, the
operator can non-issue the Tickets by pressing a single key provided in
the keyboard i.e.(,) Non Issued transactions should immediately follow the
transaction which are being non- issued
5 .0 REFUND
Refund of tickets issued by JTBS will be done by serving station as per
refund rules in force. The genuineness of the tickets issued by JTBS will
be checked by the station staff before making refund. JTBS will not be
authorized to make any refund.
6.0 INSPCTION AND AUDIT OF THE RESULT AND ACCOUNTS OF THE
AGENCY;
The books and account of the JTBS shall at all , proper times and
places be open to the inspection and internal books of the Chief
Commercial Manager / Financial Adviser / Chief Accounts Officer / Chief
Auditor / Divisional Railway Manager or any other officer or official
deputed by them in the same manner as is customary in the case of books
and accounts maintained at the Railway Station of the
----------------------Railway.

7.0 SUBLETTING;
7.1 The JTBS will not sublet assign or transfer the rights or obligations arising
out of the contact.
7.2) The contactor shall not sublet, assign or in any manner transfer to any
other person the whole or any part of the rights or obligations conferred or
imposed upon him by this agreement or any of the business connected
with the agency hereby constituted.
7.3) The Railway administration reserve the right of deduction of the Railway
dues from JTBS in case any fine payment made under an order/
judgment of any court/ consumer forum or law enforcing agency or any
person working on their behalf.
8.0 JTBS NOT TO COMPETE WITH THE RAILWAY;
JTBS shall not compete with the Railway Administration in any way
whatsoever, whether directly or indirectly, by establishing any other agency
for carrying passenger at station during the continuance of the
agreement .
9.1 This agreement shall be deemed to have come info force on and from
----------------------and shall subject to the provision for earlier termination as
herein provided remain in force for a period of two years which can be
extended yearly on the basis of satisfactory performance.
9.2) Any modification review and extension of agreement will be made only
with the mutual consent of parties.

10.0 ARBITRATION;
10.1) DRM will be the final authority for resoling any dispute between the JTBS
and Railway Administration. The appeal will lie to AGM/ CCM in Hqrs.

It has now been decided that this provision shall be extended to include a
leased parcel Van also Therefore, henceforth the 25 th Coach can be an
Inspection Carriage or a leased Parcel Van The running of 24+ 1 Parcel Van
(leased) will however, be subject to concerned CME/CEE (depending upon
traction certifying the adequacy of powering of train.

It has been decided that under ‘Parcel Management System (PMS)’ for
computerizationof parcel business on Indian Railways the following specification
for stationery for Parcel Way Bills (PWBs) and Gate Pass should be adopted:
Specifications:-
1. The computerized Parcel Way Bill (PWB)/ Luggage Ticket and Gate pass
should be a pre-printed format.
2. It should have perforation on two sides.

3. Parcel Way Bill (PWB)/ Luggage Ticket and Gate pass should be watermarked
with“INDIAN RAILWAYS” logo in small size, in an intricate pattern printed in
bilingual i.e. in English and Hindi on all the foils in thin prints in background.
4. The size of the paper for Parcel Way Bill (PWB)/ Luggage Ticket and Gate
pass stationeryshall be 10"x 7".
5. Parcel Way Bills/Luggage ticket and Gate Pass stationery should be 1 0"x
7"x 4 and 3 plymulti part, continuous stationery with self inking and sprocket
holes on either side.
6. Specifications, colour and size of paper for each foil of Parcel Way Bill
(PWB)/ LuggageTicket and Gate pass shall be as under:-

9. Each set of Parcel Way Bill (PWB)/ Luggage Ticket and Gate pass should
be machinenumbered with a unique 7-digit Stationery Number, preceded
by the alphabetical series.The machine number shall be printed at right-
side top corner on Parcel Way Bill (PWB)/ Luggage Ticket and Gate Pass.
10. The number printed on the right hand top corner of computerized Parcel
Way Bill(PWB)/ Luggage Ticket and Gate Pass in a box is essentially the
Computerized Printedstationery number. The Computer printed number
should match with the pre-printedstationery number on the Parcel Way Bill

(PWB)/ Luggage Ticket and Gate Pass. Thiswill enable to check any case
of mismatch.
13. Parcel Way Bills/Luggage ticket and Gate Pass should be treated as a
money value book for indenting, custody and issue purposes as contained
in para 812, 915 and 916 of Indian Railway Commercial Manual (IRCM).
2 It has, therefore, been decided to continue with the scheme for the
journeys commencing upto 31.05.2009 . All Zonal Railways which have
not sent the feedback of the scheme are requested to send the feedback
without further delay.

3 All the Zonal Railways and CRIS should ensure that the scheme does not
get extended beyond the above mentioned date unless expressly
instructed /extended by Railway Board.

“Transfer of licence to the spouse/legal heir would be
allowed only in the event of death. The licence can be
transferred in the name of spouse/legal heir for the
unexpired period of the agreement only on the personal
approval of the chief Commercial Manager/Divisional
Railway Manager/MD,IRCTC as the case may be in case of
small units and MD,IRCTC in case major units. Nomination
of the legal heir should be obtained from the licence holder
at the time of entering into contract. The Nomination should
be only amongst the family members.”
2 The matter has been reviewed and Board has given approval for the
amendment of the above clause. Accordingly, the above clause may
be numbered as 9 (a) and following three clauses may be added.
9 (b) Renewal of licence, where the license has been transferred to the
legal heir, in the event of death, may be permitted, only in the case
of Special Minor Units
9 (c) Facility of nomination for the purpose of transfer of licence should not
be made available to the legal heir.
9 (d) These provisions will be applicable only to the legal heir who are
continuing to operate the licence. However, the cases in which a
decision has already been taken and the licence has been terminated
should be treated as settled cases and may not be reopened.

Second Class :
(ii ) Suburban : There will be no change in the existing fares for travel
in Suburban Sections.
Upper Class :
(i ) The existing basic fares beyond Rs. 50.00 per passenger for Sleeper
Class Mail/Express and Ordinary Passenger Trains shall be reduced
by giving a discount of 2%.
(iii ) There will be no change in the existing fares of First Class Mail /
Express and Ordinary trains.
2.3 Fares for High Capacity Coaches : Discounts in fares for High
Capacity Coaches as mentioned in Commercial circular No.20 of
2008 shall be continued without any change.
3. Peak Season and lean season for the purpose of charging of fares under
variable Fare Scheme shall be as under:

Parcel Vans leased on round trip basis.

come into force with immediate effect.

(i) In case of perishable parcel traffic, indents for full parcel express train
shall be accepted from a single party and not from multiple
consignors.
(iii) In all such cases of placement of rake of Parcel Vans against a rake
indent, the freight shall be realized for indented number of parcel Vans
(VPHs/VPs/VPUs etc.) or the actual number of Parcel Vans supplied,
whichever is more. Supply shall not be less than rake load in any case.
A partly loaded rake of Parcel Express train may be allowed to run to
it’s destination station, however, empty Parcel Vans may be detached
only with the prior approval of Board.

and it has been decided that persons found on platform without any
ticket,/travel authority may be treated as trespasser and be charged as per
the provisions of section 147 of Railways Act which specifies that if any

Sanction of the Central Government is hereby accorded to revise the charges for
haulage of empty wagons on private account. The revised charges are as under:-

It has been decided by the Board that if a new crossing station has to be
constructed for providing connectivity to a siding, the cost of the same shall be
fully borne by the siding owner. Accordingly, it has been decided to insert a new
subpara as 3.3 under para 3 of Board’s letter No. 99/TC(FM)/26/1 dated
31.03.2005.
“3.3 Sidings should normally take off from the existing serving stations.
However, in case when it is operationally not feasible to provide a
connection from an existing serving station or a siding owner
requests for a connection from a location between two existing
stations at his own cost then a proposal for provision of a new block
station may be considered provided.
ii) The entire capital cost of the new crossing station including staff quarters,
loop lines, signaling, electrification and other infrastructure shall be borne
by the siding owner.
iii) The siding owner will also pay a lump sum amount which would be equal
to recurring cost towards maintenance and staff deployment for a period of
10 years on the basis of initial deployment of staff at the station. Such
payment shall be made before the commissioning of siding.

iv) The siding taking off from such a crossing station shall be constructed as
private sidings only.

2.0 The matter has been reviewed. It has been decided to extend the validity
of these concessions in freight for movement of iron ore traffic (Class
200X) booked from SWR communicated vide Rates Circular No. 63 , 72
and 74 of 2008 beyond 31.12.2008 and it will remain valid upto
31.03.2009.
3.0 All other terms and conditions as stipulated in the Rates Circulars referred
above will continue to apply unchanged.
3.1 This issues with the approval of Traffic Transportation Directorate and
with the
concurrence of Finance Directorate of the Ministry of Railways.

Sub:- Freight concession for Iron ore traffic (Class 200X) from S.C
Railway. (Rates Circular No. 02 of 2009)
1.1 Sanction of the Ministry of Railway is also accorded to grant 50% concession in
freight for movement of iron ore (Class 200X) booked from Hagari station and
BHSG siding served by Hagari station to VKT , provided the discounted freight
rate is not less than NTR at 350 km.
2.0 (i) Local notification will be issued by Zonal Railway with approval of GM
on recommendation of CCM, COM and FA & CAO . Local
notification will lay down specific OD flows, the distance slabs in
which each of them fall and the applicable rate of discount as mentioned
above.
(ii) The destination will be Kakinada Sea Port Limited siding ,Manubalu,
Chennai Harbour, Ennore port, Panambur,Vishakhapatnam port or
Venkatachalam.
(iii) The discount will be given to Iron ore booked at class 200 X at the time
of issue ofRR itself.
(iv) The net discounted freight rate per tonne over longer lead should not be
less than the net discounted freight rate per tonne over shorter lead.

(v) No concession other than concessions permissible under WIS and TIELS
will be admissible on this traffic.
(vi) All other applicable charges, if any , will be leviable.

3. Main Features: The policy has two models viz the Advance
Contribution Model and the SPV Model. The Advance Contribution Model shall
be the preferred mode for connectivity to ports, steel plants , cement plants etc.
4.4 4.4 Land: Wherever land has to be acquired, the same may be done
by IR at party’s cost, with the provision that funds for land acquisition will be
made available by the applicant. The ownership of the land shall however vest
with railways.
4.5 Financing : All contribution by the applicant shall be in the nature of
an advance. No interest shall be payable on the advance except in cases where
the party’s contribution is 90% and above. The percentage contribution of the
applicant shall be decided based on a number of factors including railways prior
financial commitments, traffic projections etc. but in no case less than 50%.

In case of projects where the applicant may not be directly using
rail services, the Zonal railway shall calculate the total freight traffic booked via
the project line and calculate the refund at the end of the every month by
applying the freight rebate which shall then be refunded to the applicant.
4.7 Ownership : Ownership of the line will remain with railways from the
beginning.
4.8 Estimated Cost : Every project that shall qualify under the scheme
shall have undergone a PETS which should be not more than six months old . An
MOU shall be signed between the railways and the applicant laying down the
broad terms of agreement only after which necessary approvals will be
processed by Railways. Thereafter the Final Location Survey (FLS) will be
Undertaken at the cost of the party.
4.9 Construction : When undertaken by railways :
However the applicant could also undertake construction of the railway line in
those cases where it is contributing 100% of the project cost
* The estimated cost of the project , based on FLS, has to be vetted by
the Zonal railway concerned, which shall certify that the standards of construction
laid down are as per the extant rules in force it will also clearly lay down the
facilities that shall be provided.
* The project cost shall be frozen after detailed estimates are prepared
based on FLS, This will be the “agreed cost “ between the applicant and
railways.
*After completion of the project, the actual expenditure incurred by the
applicant will be verified by the Railway. This verification will be based on the
certified audited accounts of the applicant. Freight rebate will be applicable on
actual cost or agreed cost ,whichever is less.

*The period of construction shall also be specified and shall be
calculated from the date land is made available to the applicant.
*The construction of the line shall be done under railway’s supervision
as per extant rules in force or through a PMC approved by IR.
* The project cost shall include the cost of supervision.
4.10 Railway shall undertake construction in cases where the contribution of
the party is less than 100% of the project cost but the period of
construction shall depend on availability of flow of railway funds and
therefore cannot be guaranteed.
4.12 Railway shall have the right to provide connectivity to other parties from
the said line In case the line is still under construction a new party could
be asked to share the cost of the new line in a manner to be mutually
decided. The decision of railway shall however be final.
4.13 In case sidings take off from the new line the applicant (s) shall be at
liberty to avail the assisted siding terms.
*Lines taking off from the mainline and terminating into a dead end
terminal be it a port steel plant etc.
5.1 An SPV shall be formed between railways and the applicant and
railways share in equity will generally be 26%
Land shall be acquired by zonal Railway at SPV’s cost but ownership of land will vest
with IR.
The project cost shall be frozen after detailed estimates are prepared based on FLS .
This will be the”agreed cost’ between the applicant and railway.
SPV shall be granted a concession, a share in the revenues generated on the project
line, in lieu of construction, operation and maintenance of the line. The revenue
share under the concession shall be broadly as under, subject to modifications
based on financials of the project.

b) For other than project related traffic /diverted traffic: 80% apportionment less
O&M charges due on the project for 25 years.
In case the new line becomes a shorter route for existing traffic, railways
shall reserve the right to levy a surcharge on an inflated distance basis.
However , in both the cases the concession shall lapse as soon as the NPV on the
project equity reaches zero at a discounted rate of 14%.
The line and the land shall be owned by MOR from the very beginning.
O&M shall be undertaken for the SPV by the railways for which SPVshall
reimburse the costs.
Construction could be done by the SPV itself through competitive bidding or by
railways or RVNL for SPVat the cost of SPV.
6 For the Advanced Contribution Model, Railway board shall circulate the
model concession agreement to the zonal railways for entering into
agreement with the applicant.
8 This policy is being issued with the concurrence of Works and Finance
directorate of Railway board.

1.0 Please refer to ECR’s letter No. ECR/CRM/FMS/2/ Weightometer dated
05.01.09 on the above mentioned subject where in ECR has requested for
dispensation of conditions nos. (i) to (iii) mentioned in Rates Circular No.
50/2008 dated 25.09.08 for the use of weightometer.
2.0 The matter has been examined and it is advised that the request for
dispensation of conditions nos. (i) to (iii) mentioned in Rates Circular No.
50/2008 dated 25.09.08 for the use of weightometer, has not been agreed
to.
3.0 It has also been decided to extend the use of weightometer/Belt Weigher
for the purpose of weighment of loose consignments at Dudhichua (ECR)
for the period of 03 (three) months beyond 14.01.2009.
4.0 All the terms and conditions as stipulated in Rates circular referred above
should be scrupulously followed.

5.0 In case all the terms and conditions as stipulated in Rates circular referred
above are not fulfilled, the weighment at weightometer will not be treated
as first weighment at par with the weighment at in-motion weighbridge. In
such case, RR will be prepared on the basis of weighment at associate in-
motion weighbridge.
6.0 Railway shall furnish monthly appreciation report in this regard.

1.0 In terms of Board’s letter under reference, sanction was conveyed for grant /
extension of freight concession for movement of iron ore booked at Class
200X from West Central Railway , East Cost Railway , South Western
Railway, South Eastern Railway, South East Central Railway and South
Central Railway respectively , subject to fulfillment of certain terms and
conditions. These concessions are valid up to 31.03.2009 , except for South
Eastern Railway where concession is valid till 31.01.09 vides Rates Circular
No. 83/2008.

3.0 In addition , the amount of freight concession granted on iron ore traffic
(Class 200X) booked from various railway , granted vide various circulars
referred to in above including the extension of concession to South Eastern
Railway, has been further reviewed .
Sanction is accorded to reduce the amount of concession granted on iron ore
traffic (Class 200X ) booked from various railway vide circulars under
reference by Rs. 100 per tonne. However, if the amount of freight concession
in terms of Rates Circular under reference, works out to less than Rs. 100
per tonne, no concession shall be granted at all in terms of instructions
referred above.
4.0 All the terms and conditions as stipulated in the Rates Circular referred
above will continue apply unchanged.
5.0 These instructions will come into force from 01.02.2009 and will remain valid
up to 31.03.2009.
6.0 This issues with the approval of Traffic Transportation Directorate and with
the concurrence of Finance Directorate of the Ministry of Railways.

Say , 20% concession in freight is allowed for slab 351 km to 450 km, subject to
condition that discounted freight should no be less than NTR at 350 kms.
For 350km, base freight of iron ore at class 200 X is Rs. 1008.0 per tonne. By adding
7% busy season surcharge, NTR comes to Rs. 1078.6 per tonne. Therefore, net
freight for slab 351-450 kms after concession cannot be less than Rs. 1078.60 per
tonne.
Say, for traffic with lead of 370 km, base freight for iron ore (Class 200 X ) is Rs.
1058.4 per tonne. By adding 7% busy season surcharge, NTR comes to Rs. 1132.5
per tonn. By allowing concession of20% , discounted freight comes to Rs 906 per
tonne, but the net freight is restricted to Rs 1078.6 per tonne . In the instant case,
actual amount of concession in freight would have been Rs. 53.9 (1132.5-1078.6)
per tonne as per the existing instruction.
In view of the instructions contained in this circular since the amount of concession
is Rs. 53.9 per tonne (which is less than Rs. 100) no concession will be granted .
Thus the customer will be charged at NTR of Rs. 1132.50 per tonne.
Illustration II
Say, 20% concession in freight is allowed for slab 351 km to 450 km, subject to
condition that discounted freight should not be less than NTR at 350 kms.
For 350 km, basefreight of iron ore at class 200X is Rs. 1008.0 per tonne. By adding

Say, for traffic with lead of 400 km, base freight for iron ore (Class 200X) is Rs.
1134.0 per tonne. By adding 7% busy season surcharge , NTR comes to Rs. 1213.4 per
tonne. By allowing concession of 20% discounted freight comes to Rs. 970.72 per
tonne, but the net freight is restricted to Rs.1078.6 per tonne. In the instant case, actual
amount of concession in freight would have been Rs. 134.80 (1213.4-1078.6) per tonne
as per the existing instruction.
In view of the instructions contained in this circular , since the amount of concession
isRs. 134.80 per tonne( which is more than Rs. 100 ), the amount of concession will be
restricted to Rs. 34.80 (134.80-100) . Thus the customer will be charged at discounted
freight of Rs. 1178.60 (1213.4-34.80) per tonne.

2. Accordingly the matter has been examined. It has been decided to issue
consolidated and revised instructions regarding Shunting Charge in
supercession of all earlier instructions.
3.2 Shunting Charge is not calculated on the basis of trip time (Trip time method
is applicable only for the levy of Siding Charge). Shunting charge is levied on the
basis of actual shunting time and prevailing ‘All India Engine Hour Cost(AIEHC)’
for ‘Train Engine’ or ‘Shunting Engine’ as the case may be. All India Engine Hour
Cost is circulated every year by Railway Board. The prevailing cost is mentioned
in Rates Circular No. 18 of 2008

3.4.1 In case of Shunting Engine, Shunting Charge is calculated for the total time
taken by the Shunting Engine from the time of its departure from the serving
station to the time it returns back to the serving station after finishing the shunting
work.
3.4.2 Wherever one locomotive is required for shunting purpose, then one
Shunting Engine should be used and Shunting Charges should be calculated for
one Shunting Engine. If situation warrants for the use of double/multiple Shunting
Engines, then double/multiple Shunting Engines will be used and Shunting
Charge should be calculated for double/multiple Shunting Engines.
3.5.1 In sidings where Train Engine is used for shunting on customers’ account,
Shunting Charge should be calculated for the total time of availability of the Train
Engine at the siding from arrival to departure,
even if shunting time is less than the total time during which Train Engine is
available within the siding.
3.5.2 If a rake is hauled by double/multiple locos of inward train and Train Engine
is to be utilized for shunting purpose, railway should make active use of one
Train Engine only and Shunting Charge should be calculated for one Train
Engine only. However, if situation warrants use of double/multiple Train Engines
then double/multiple Train Engines will be utilized and Shunting Charge should
be calculated for double/multiple Train Engines.
3.6 For the purpose of calculation, the shunting time would be rounded off at the
end of 10-day period and bills shall be preferred accordingly.

a part of WIS rakes. Railway shall take over the rakes with out brake Van
subject to an undertaking by the firm to abide by policy issued by Railways in
this regard and make payment in lieu of Brake Vans as decided from time to

1. Detailed policy guidelines were issued vide Railway Board letter of even

2. Distance-wise lump-sum rates under this system were notified vide Para

3. It has been decided to revise the lump-sum rates for 2009-2010. Revised

from 1st April 2009.

for grant of facility of tareweighment of empty wagons supplied to identified collieries
subject to fulfillment of certain terms and conditions. The instruction was later
modified in terms of Board’s letter of even number dated 13.06.2006 and
21.08.2007.
2.0 The matter has been reviewed. In supersession of all instructions issued on the
subject, sanction is hereby accorded for grant of facility of tareweighment of empty

wagons supplied to identified collieries subject to fulfillment of following terms and
conditions:
(i) CCM and COM of Zonal Railways will notify the collieries to which this facility is
given after taking into consideration the lay-out of the loading lines as well as the
location of the in-motion-weighbridges as well as operational feasibility.
(ii) Only those collieries will be notified where in-motion weighbridge are installed
just ahead of the loading lines so that before the rake is placed for loading, the
rake can be weighed and the weighment recorded automatically while the rake
is in motion.
(iii)The empty wagons should be weighed in presence of Railway staff and the actual
tare of wagons found on weighment should be recorded and or certified by him .
(iv) After the loading is completed, the entire rake will be again weighed on the in-
motion weigh bridge and computerized record print out will be obtained.
(v) Actual weight of the consignment will be arrived at by subtracting the weight of
the wagon in empty condition so recorded on the weighbridges of the colliery
siding from the weight of the wagon recorded in loaded condition.
(vi) Actual tare (found after weighment) and stenciled tare of the wagons should be
specified both in Railway Receipt and Weighbridge register.
(vii) (a) The permissible carrying capacity of the wagons for the purpose of
charging as well as levy of punitive charges for overloading will be as under:

(b) However, in case weighment of empty tare has been done and it is not possible
to weigh the loaded wagons for reasons like weighbridge going defective after
weighment of empty rake, the permissible carrying capacity shall be worked out
as under :-
Adding the difference between the actual tare and the stenciled tare to the
permissible carrying capacity if the actual tare is less than the stenciled tare
weight,
Or
Subtracting the difference between the actual rare weight and the stenciled tare
weight form the permissible carrying capacity, if the actual tare weight is more
than the stenciled tare weight
(C) However, if weighment of the empty tare is not possible for any reason such as
non- functioning of the weighbridges, the charging will be done as in normal
cases.”
(viii) In normal circumstances, en-route re-weighment of these wagons should not
be done. However, if it is done in any exceptional circumstances, the weight of
the consignment should be arrived by subtracting the actual tare (found after
weighment in empty condition and specified in RR) from the gross weight found
after re-weighment.
3.0 Zonal Railways will send the list of identified collieries to Board. They will also
send half yearly appreciation report of the scheme. They may also indicate
whether there in any difficulty in implementing this scheme.
4.0 The punitive charges for overloading will continue to be governed by “Railway
(Punitive charges for overloading of wagons) Rules, 2007” as amended from
time to time.
5.0 These instructions will come into force w.e.f 27.2.2009.

Sub:-Notification regarding opening of M/s Gateway Rail Freight Ltd Siding at
Sanehwal Station.
With immediate effect, a private siding known as M/s. Gateway Rail Freight Ltd.
Siding at Sanehwal Station of RPJ-LDH section over FZR division is opened for both
inward & outward of all goods traffic in train load when consigned to & by M/s. Gateway
Rail Freight Ltd. Siding at Sanehwal Station.
The following siding charges, as per the usage of the engine will be leviable in
addition to fright upto Sanehwal Railway Station irrespective of number of wagons placed
or with drawn in a shunt.
The Siding charges should be locally recovered and should not be shown in invoice
or Railway Receipts. For any shunting done beyond the point of inter charge, Separate
shunting changes are leviable.
In case of train load traffic which are entering directly into the siding with out
terminating at the serving station duly fulfilling the condition laid down in Rates Circular No.
67 of 1987 (Para 17 of N.Rly Rates Advice No.17 of 1987), the freight charges will be
levied upto the buffer end of the sidings duly adding a distances of 1.332 Kms upto the
distance of serving station and separate siding charges need not be levied.

The Private Siding of M/s Vimla Infrastructure (India) Pvt Ltd, served by
Bhupdeopur station situated in Bilaspur – Raigarh section on Bilaspur division is
opened as an independent booking point for handling full rake for all descriptions of traffic
except POL.
As the siding is qualifying for “Through distance charging” , the freight will be
charged up to buffer end of the siding by reckoning the distance as Bhupdeopur +1.80
Kms. The siding will work under the specifications &conditions of TIELS guidelines (issued
vide Railway Board’s letter No.2005/TC(FM)/1/8 dt.06.03.06) for loading &unloading
operations without any financial benefits. For calculation of demurrage charges, the free
time prescribed in TIELS shall be applicable.

iv) Environmental issues, if any are kept in mind before notifying .

The Private Siding of M/s NTPC-SAIL Power Co. Pvt. Ltd(NSPCL) served by
Kumhari station situated in Raipur – Durg section on Raipur division is opened provisionally
for handling full rakes of Coal & POL traffic . However, after completion of electrification of
the siding , final notification will be issued.
As the siding is not electrified at present, the placement of rakes will be done by
diesel engine and the freight shall be charged up to Kumhari station.. Shunting charges
shall be levied for placement of rakes up to the siding for diesel engines on the basis of
All India Engine Hour cost in vogue. In case of utilization of Railway engine during loading /
unloading operations at inside the siding, the shunting charges shall be levied additionally
for this purpose also.
For calculation of demurrage charges, the free time notified under Para-6 of the
TIELS Policy guidelines, issued vide Railway Board’s letter No. 2005/TC(FM)/1/8 dt.
06.03.06 shall be applicable.

It is notified for information and guidance of all concerned that the shunting neck of
M/s. FCI siding at Jharsuguda station is open for dealing with Inward /Outward booking of
goods traffic in rake loads only. The rate of siding charge will be leviable for such traffic on
per trip basis as notified from time to time for FCI Sdg at JSG.
The rate of siding charge will be levied addition to the freight charges from /to the
serving station i.e Jharsuguda station. No supplementary charge on the siding charge is
leviable. As loading /unloading will take place on Railway land all goods shed rules
including Demurage/Wharfage charges will be levied. Siding charges should be collected
locally by the serving station by submitting bills.

1-Sub-Opening of a new private siding for M/S Jai Prakash Associates Ltd, Cement

M/S Jai Prakash Associates Ltd. /Chunar, a new siding owner is ready to dispatch
their finished products by rail immediately. Keepin in view the additional originating
revenue traffic, the said siding is opened on ‘ trial ‘ basis with immediate effect as
independent booking point (IBP) for outward traffic in train load for stations on non –
electrified territory for which freight is to be charged on through distance basis inclusive of
the length of siding as under :-
(i) The Charges of the freight on through distance basis will be applicable w.e.f. the
date of siding opened.
(ii) Placement of empty rakes for loading and movement of loaded rakes ex siding will
be done by the diesel engines only during the “ trail” period.
(iii) Final notification will be issued after completion of Electrification of the siding.
(iv) Other instructions applicable to the sidings already notified as independent booking
point (IBP) will be applicable to this siding also.
(v) The chargeable distances as mentioned in column No.6 are applicable during trial
period. Since these distances are under confirmation by H.Qrts. Engineering &
Accounts Department of this Railway, any variation in fright on account if any
modification in these distances will be paid by the party.

In a partial modification in foot note No. (V) given in Rates Branch Circular No. 160 of
2008- Goods. The distances displayed for calculation of through distance freight up to
buffer end of M/s jai Prakash Associates Ltd. Cement Siding/Chunar, may be read as
under:
‘ (V) The above distances mentioned in column No.6 are verified by H.Qrt.Engineering
department & vetted by HQ. Accounts Department of this Railway.’
Other terms & conditions will remain unchanged during this trial period.
(I) In terms of provision contained in North Central office Rates Branch Circular No 118
of 2008 (Goods) dated 30.09.2008. group III Goods sheds will be treated as CRT
with validity up to 30.09.2009. As per Rates Branch Circular No. 159 of 2008
(Goods) dated 10.12.2008 and Corrigendum No . 166 of2008 (Goods) dated
18.12.2008 all group I&II stations/goods sheds will be permitted as CRT , only for
chassis stuffing / destuffing of containers. Divisison will be submit a report on the
utilization of group III stations/goods sheds as CRT latest by 31.07.2009 for onward
submissison to Board. All the terms and conditions as circulated in aforesaid
circulars dated 30.09.2008,10.12.2008&18.12.2008 will be remain unchanged .

Government of Kerala have issued a Gazette (Ex ordinary ) Notification vide their
letter GO.(P) No. 2127dated 22.09.2005 for change of name of “Varkala Railway station as
“Varkala Sivagiri”
In this connection , Ministry of Home Affairs Government of India have also
accorded their approval for the change of name of Varkala Railway station as “Varkala
Sivagiri with immediate effect .
The spelling of the new name of the “ Varkala Sivagiri Railway station in Regional
language, Roman and Devanagiri script , as approved by Survey General of India , is furnished

“With the Approval competent authority, the Bhilai Retractories Plant siding served
by Marauda station is re-opened as a half rake handling point with immediate effect.”
The rakes will be placed at MXA station till insertion of cross over and the
placement and drawing out of rakes will be done by the power of BSPC/BRP. After
insertion of cross over, these operations will be done by Railway engine.whenever,the
Railway engine will be utilized for placement and drawing out of rakes, the shunting
charges will be levied as per all India Engine Hour cost in-vogue.

1. Consequent upon the conversion and anticipation of its opening of Akola- Hingoli
section , the distance to be adopted for passenger traffic up to 31.03.09. Annexure -1 shall
be followed . This will come into effective from the time its opening.
2. For Goods Traffic on Akola- Hingoli section – Annexure –II shall be followed upto
31.03.09. This will come into effective from the time of its opening.
3. For all types of Traffic (i.e) passenger , other coaching & Goods Annexure – III shall
be followed with effective from 01.04.2009.
Accordingly Local distance Table No. 5 and Junction Distance Table No.. 5 will stand
modified.
