Last week, Council Speaker Christine Quinn, Bronx Borough President Ruben Diaz, Jr., and City Council Member Fernando Cabrera stood with dozens of Bronx tenants, attorneys from Legal Services NYC-Bronx (LS-NYC Bronx) and advocates from the Urban Homesteading Assistance Board (UHAB) and the Northwest Bronx Community and Clergy Coalition (NWBCCC) to announce a new legal strategy that could serve as a valuable weapon for tenants living in distressed apartment buildings that are going through foreclosure. A motion being filed by LSNYC Bronx, on behalf of tenants living in a portfolio of ten distressed apartment buildings, argues that once a foreclosure action is initiated, and a court-appointed receiver is in place, the mortgage holder can be held liable for maintaining building conditions.

Thanks to innovative attorneys at Legal Services NYC - Bronx (LS-NYC Bronx) a new strategy has been unleashed which may be successful in getting banks and Commercial Mortgage Backed Securities (CMBS) to take responsibility for maintaining and repairing the physical conditions in overleveraged properties that are going through foreclosure. North West Bronx Community and Clergy Coalition (NWBCCC) and the Urban Homesteading Assistance Board (UHAB) have been organizing tenants in a collection of 10 highly distressed and severely overleveraged buildings located in the Kingsbridge section of the Bronx. The rent-regulated properties were purchased by a Los Angeles based private equity firm, Milbank Real Estate, in 2007 for more than $40 million. Conditions in the buildings have gone from bad to horrible-- the 542 apartments in the Milbank portfolio have more than 4700 outstanding code violations. In 2009 the lender declared the loans in default and initiated foreclosure proceedings. Milbank Real Estate has been missing in action, apparently having retreated back to sunny LA.

On behalf of the Milbank tenants, LS-NYC Bronx intervened in the foreclosure proceedings and asserted that the lender--in this case a CMBS controlled by Wells Fargo and Special Serviced by LNR Partners is responsible for maintaining the buildings according to local housing code standards while the foreclosure is in process. If the legal claim is successful, the courts could require the CMBS to expend substantial resources to bring these properties back up to code. There are currently almost 5000 apartments in NYC that are in foreclosure as a direct result of Predatory Equity investment, and news reports indicate that similar spikes in multi-family foreclosures are occurring in low-income neighborhoods across the country. According to NWBCC, We are very hopeful that this new strategy will serve as an important tool in forcing the lenders and Wall Street banks who made these risky investments to finally take some responsibility for the destruction they have left in their wake.

Bronx Tenants Announce Lawsuit Against Landlord


By: Vivian Lee | NY1 About 30 tenants were joined by attorneys from the Urban Justice Center and the Northwest Bronx Community and Clergy Coalition to announce a lawsuit against the landlord of 2710 Bainbridge Avenue. Residents in the Fordham building said the landlord ignored numerous requests for major repairs. At a protest outside of their building today, the residents said that the landlord has refused to fix crumbling walls, moldy tiles, clogged drains and cracked windows. A fifth-floor tenant said one of his windows was broken by someone coming down the fire escape, and remained unfixed a year-and-a-half later. Other tenants said they have resorted to replacing the windows with plywood to keep out the cold. They said the lack of repairs has put their lives at risk. All of our outlets dont work. You hear rats fighting in the wall. You can hear them, said tenant Peggy Vargas. I mean, I run out of the apartment sometimes Im so scared. The doors are not locked. I come in late and I dont know whos going to hit me. I pay $1,150 in rent. The Department of Housing Preservation and Development said the landlord has about 200 serious violations filed against him, worth about $350,000 in penalties. We found ourselves today not able to wait any longer, said Bronx Assemblyman Jose Rivera, who joined the tenants at the protest. Weve been working with organizers from the Northwest Bronx Community and Clergy Coalition to take on Frank Palazzolo, who is one of the worst landlords that New York City has ever seen, said Urban Justice Centers Garrett Wright. This morning we filed a lawsuit in Bronx Housing Court, seeking to have the court appoint an independent administrator take over the property here and start making the repairs that are badly needed here. According to the HPD, the building is part of the alternative-enforcement program, which tries to group the worst landlords together and tries to get them to make repairs. However, tenants say that since the building has been part of the program since 2008, they have not seen any repairs made.

Tenants in Worst Landlords Bronx Buildings Take Wall Street Not Their Landlord to Court
By By Elizabeth Dwoskin | The Village Voice On the heels of the Voices 10 Worst Landlords series, tenants in 10 foreclosed buildings in the Bronx run into the ground by dishonoree Milbank Real Estate are going to court with a new strategy that directly targets Wall Street. Backed up by local pols, theyre asking a judge today to force mortgage-holder Wells Fargo itself to take direct responsibility for, and shell out millions to fix, nearly 4,500 housing code violations. The buildings are in foreclosure proceedings in Bronx Supreme Court after Milbank, run by L.A. brothers Aaron and Solyman Yashouafar, defaulted early last year on a $35 million mortgage. A court-appointed receiver is operating the buildings. But they have slid further into decay, say sources close to the situation, because Wells Fargo isnt forking up the cash to maintain them even at their previously poor level. The Milbank tenants have suffered the consequences of Wall Streets reckless lending practices for too long, Jonathan Levy, deputy director of the Legal ServicesNYC Bronx Housing Unit, says. The lenders must be held accountable for the costs of repairing the damage. Since the Voice series (Part 1, which includes Milbank; Part 2), the Times and heavyweight politicians have hopped on board to support the Milbank tenants new strategy. City Council Speaker Christine Quinn, Bronx Borough President Ruben Diaz Jr., and Council Member Fernando Cabrera conducted a press conference today with the tenants, their advocates at the Urban Homesteading Assistance Board, and their lawyers. The new strategy, in this case a motion thats part of the foreclosure proceedings, could have wide-ranging impact on other overextended landlords that were able to get loans from reckless banks. If the court holds the bank responsible, a Times story says, the move could discourage other banks from entering foreclosure proceedings on other properties, leaving buildings to sink deeper into limbo. The Milbank buildings could hardly sink any deeper. The buildings are unlivable, tenants say, and the Voices own on-site inspection backs that up. The Yashouafar brothers held the buildings for barely two years before defaulting on their loan. They also own other buildings in the Bronx. A few months ago, Joe Cicciu, the court-appointed receiver, told the Voice, Its triage, you know? I almost feel like Im on a battlefield with the wounded coming in. Not everyone is shot up, sometimes these are only flesh wounds. So we go to some of those apartments and try to fix things, patch things up, to give people a chance to live in decent apartments. But for people with the collapsing ceilings, we are trying to relocate them into vacant units. The problem is, most of the vacant units need a gut renovation! And we dont have the dollars for that anymore. This new court action doesnt name a dollar figure, but Cicciu previously told the Voice, If were talking about bringing the buildings up to the quality that they are supposed to be, then were talking about tens of millions of dollars.

DHCRs new Easy-Rent-Reg is a web-based system that allows owners to complete and submit registrations on the web, print tenant forms, and certify registrations online. Buildings will be processed quickly, efficiently, and mistake-free. Easy-Rent-Reg is secure and simple to use. It streamlines the entry process, automates certification and submission, produces printed forms, and allows building and apartment information to be updated as changes occur during the year, making it easier for future annual filings. Information is stored on a DHCR server, eliminating the need for users to perform their own back-ups. Suit Filed on Behalf of Queens Restaurant Workers


Last week CDP and the Urban Justice Center will be Served! Campaign announced a lawsuit on behalf of two former employees of Guang Zhou Restaurant in Queens, seeking unpaid wages, back pay, reinstatement, and damages from the workers former employer. The suit alleges that the workers were paid as little as $1.68 an hour, were never paid overtime despite

frequent 55-hour weeks, and were retaliated against for complaining about their rights. Guang Zhou is also being investigated by the National Labor Relations Board, which filed charges against the restaurant in March 2010 for violating labor law by preventing employees from organizing. National Institute of Justice (NIJ) seeks to fund research proposals that explore and explain the links between place and crime in the specific context of the recent wave of residential property foreclosures. In this context, proposals may address either short-term or long-term patterns linking place and crime. Applications proposing research should explain how the proposed project will fill a critical gap in the fields knowledge and practice as well as identifying policy implications related to criminal justice. Between 1970 and 2000, the home foreclosure rate in the United States did not rise above 1.1 percent. Between 2001 and 2006, the foreclosure rate increased to as high as 20 percent. This abrupt shift in the 30-year pattern of foreclosures led researchers and policymakers alike to question the effects of this issue on urban problems, including crime. Enterprise Green Communities offers grant opportunities to help cover the costs of planning and implementing green components of affordable housing developments, as well as tracking their costs and benefits. They offer up to $75,000 in planning and construction grants, up to $5,000 to coordinate green design charrettes, and up to $5,000 for post-construction sustainability training. This is certainly the case with many mortgage lenders. Credit scores aid lenders in predicting how creditworthy a borrower is or how likely they are to repay the debt. Many lenders also incorporate risk based pricing into their credit decisions based upon the credit score. With this knowledge, homeownership educators and counselors are better prepared to help clients improve their credit scores and positively impact their financial status.
