LEASE AGREEMENT

This agreement is made on the 22ndof July, 2010at ______________(hereinafter referred to as the Lessor) of the one part; And.., of Nationality: ., (hereinafter referred to as "the Lessee) of the other part. WHEREAS the Lessor owns,____________________be referred to as the Premises. A. The Lessor and the Lessee HEREBY AGREE AS FOLLOWS: (1) The Lessor agrees to let the Premises and its furnitures as to the attached list, and the Lessee agrees to rent the Premises from the Lessor under the terms and conditions hereof. (2) The term of this Agreement is _____(____) months commencing on the DATE and terminating on theDATE (3) The Lessee who is not in breach of default of this Agreement and wishes to renew this Agreement will be entitled to notify such intention to the Lessor at least 30 days prior to the expiry of this Agreement. In making the renewal, rental and other fee or charges as well as the terms and conditions hereof to will have to be mutually agreed upon before the expiry of this Agreement (4) The rent shall be _Amount_______ (_____________) per month inclusive of electricity, water, internet, UBC cable and common area management fee and air-condition maintenance 1 time per year, rent is payable within the ________ day of each month. **As the lessor and lessee mutually agreed , the lessee can start moving into the premise from the execution date of this agreement and the first due date of rent shall be within 7(seven) days after the execution date. (5) Upon the execution of this Agreement, the Lessee deposits with the Lessor _______(_______) hereinafter referred to as the Security Deposit. The Security Deposit shall be returned to the Lessee within 30 days without interest after vacating the Premises, if not applied towards payment of rent or other indebtedness, arrears, or towards damages suffered by the Lessor. The Lessor hereby acknowledges receipt of the Security Deposit.

(6) The inventory of items attached to this agreement forms part of the agreement.

B. The Lessee AGREES AS FOLLOWS: (1) To pay the rent within the dates stipulated in this agreement. (2) To keep all floors, floor coverings, walls, ceilings, windows, doors, furniture, domestic appliances, and all fixtures and fittings in or on the Premises in good condition, normal fair wear and tear are excepted. (3) To permit the Lessor or his agent to enter the Premises for the purpose of inspection at all reasonable times during daylight hours and to permit, during the 30 days before the expiration of the Agreement, the Lessor or his agent to show the Premises to prospective tenants at reasonable times, provided that prior arrangements are made with the Lessee. (4) Not to make any alterations or additions to the Premises without prior consent in writing from the Lessor. If the Lessee makes any alterations without the written consent of the Lessor, the Lessee must, if the Lessor so desires, at the request of the Lessor, restore the Premises to their former condition, and he is liable to the Lessor for any loss or damage that may result from such alteration or addition. Any fixtures installed by the Lessee shall be at his own expense and, if not removed at the end of the Agreement term, shall become the property of the Lessor. All furniture and appliances brought into the Premises by the Lessee and/or his family shall at all times be the property of the Lessee and shall be removed at the end of the lease term. (5) Not to neither assign nor sublet the Premises or any part thereof. (6) Not to do nor permit to be done on the Premises anything which may cause a nuisance or interference to neighboring premises or their occupants. (7) To notify the Lessor or his representative of any damage or defect on the Premises. (8) To make good any damage to the Premises caused by the negligence or misconduct of the Lessee, his family, or servants. (9) The Lessee is bound to take as much care of the Premises leased as a person of ordinary prudence would take of his own property. Cares include , but not limit to, the following - Not to leave air condition, TV, Washing /Dryer , Iron and running water tap unattended when there is no one in the premise - To do ordinary maintenance and petty repairs, costing less than ______ per occurrence.

(10) That at the end or sooner termination of the tenancy, the Lessee will return all the keys of the Premises to the Lessor. And the lessee shall handover the property and other leased assets in the clean-well maintained , ready-to-use condition back to the lessor.Any change arising from failing to handover the premise and said assets shall be the lessees responsibility or deductible from deposit (11) To use the premises for dwelling purposes only. (12) To keep no smoking inside the unit. (13 )The LESSEE agrees that the lessor is not in any event what soever or responsible in anyway howsoever caused for : a) Any personal injury or death that may be sustained or caused by the Lessee, His/Her family ,his/her guests,visitors and invitees or any other person who may be upon the premises. b) Any loss or theft of or damage or injury to any property including motor vehicles and the contents thereof, which may be in or about the premises;without limiting the generality of the foregoing,such damage shall include any damage caused to any property situate in or about the premises from gas, steam,water,water works, wind,rain or snow which may issue or flow from any part of the premises or from the pipe and plumbing works of the same or from any other place or quarter. c) Any damage caused by or attributable to the condition or arrangement of any electrical or other wiring. d) Any damage caused by anything done or omitted to be done by the Lessor; OR e) Any Loss or spoilage of food and other consumable items due to the failure or impairment of electrical system and the Lessee hereby releases and forever discharges the Lessor, his/her successor and assigns, from all and any actions,claims and demands for damages including exemplary and punitive damages, loss and injury, however arising,which may hereafter be sustained by the Lessee or his/her personal property. (14) The number of domicile occupiers is limited to this PREMISES is ____ people/person

C. The Lessor AGREES AS FOLLOWS: (1)The Lessor warrants and guarantees that he has the unrestricted right to let the Premises. (2) To pay for all utilities including electricity, water, telephone, UBC cable TV monthly charge consumed (used) on the premises during the term of this Agreement. (3) That if the Lessee pays the rent on time and observes and meets the conditions contained herein, the Lessor shall allow the Lessee to peacefully occupy and enjoy the Premises during the term of this Agreement and any extension thereof, without any interruption or impairment whatsoever by the Lessor or his agent.

(4) To issue receipts to the Lessee promptly upon receipt of each payment of the agreed rent. (5) To keep the Premises in good repair, except in the case where the Lessee causes damage. In the case that there is any repairs required to the premises, the Lessee will notify the Lessor of the costs of repairs, and the Lessor allows the Lessee to subsequently deduct this amount from the next months rent, if the amount has been agreed upon prior to the repair. (5) The Lessor warrants and guarantees that he is the sole owner of the Premises and has right, without any restriction, to rent the Premises. It is further specifically understood and agreed that the Lessor will inform fully any person or persons to whom he may purpose to sell or trade the condominium, of the terms of this lease and that any sale made will be subject to the limitations, conditions and restrictions of this lease. D. Termination/ Renewal AND Dispute settlement (1)If the Lessee acts contrary to the terms of this Agreement, the Lessor may notify the Lessee in writing of any breach of this Agreement. If the Lessee fails to correct the breach within 7 days, the Lessors may terminate this agreement and the Lessee shall vacate the Premises within fifteen (15) days of said notice.The lessor shall have the right to demand any compensation from damages or lossessuffered by the lessee or any other expenses incurred as a result thereof (2) In the event that the Premises are rendered uninhabitable due to fire, flood or structural damage, the Lessee shall have the right to terminate this Agreement and the Lessor shall return the Security Deposit, provided that this damage has not been caused by the Lessee. (3) If the Lessee wishes to terminate the lease agreement for any reason during the 12 (Twelve) months of the Lease, the Lessor shall be entitled to take possession of the entire deposit as a penalty. (4) The Lessee shall make a written notice to the Lessor not less than 30 days before the expiry of the Agreement in regards to renewal of this lease. The renewal shall be for an additional up to 12 months. However, the terms and conditions provided in this lease agreement are subject to changes upon a renewal. (5)In a dispute between the Lessor and the Lessee which gives rise to any action in court, the losing party will pay the court costs and reasonable attorney fees of the successful party

E. Place of Payment Every payment to be made by the Tenant to the Landlord hereunder shall be made to the Landlord in wire transfer to Bank: Branch: Bank account no: Bank account holder name:

This Agreement is made in duplicate with identical wording. Both parties have read and fully understood the contents and agree to comply with all terms and conditions. Therefore, in WITNESS HEREOF, both parties have hereunder affixed their signatures in the presence of witnesses on the date and at the place first above written.
