In Homestead, Florida, Posse Comitatus is dead. The Air Force now responds to civilian crime in the small city, population around 30,000. On July 15, military police known as Security Forces patrolmen detained a criminal suspect at a Circle K in until Miami-Dade police arrived. In 1878, following Reconstruction, the Posse Comitatus Act was passed. It limited the powers of the federal government to use the military for law enforcement. The statute prohibits Army and Air Force personnel and units of the National Guard under federal authority from acting in a law enforcement capacity within the United States, except where expressly authorized by the Constitution or Congress. Infowars.com has reported numerous violations of Posse Comitatus since September 11, 2001. In 2009, the National Guard provided securityin Kingman, Arizona. The Coast Guard, under the Department of Homeland Security, is now exempt from the Act. The military participated in a checkpoint along with Tennessee cops and Homeland Security in April of 2009. The governor and state representatives were not aware of the illegal collaboration when contacted by the Alex Jones Show.

NORTHCOM announced in 2008 it would use battle-hardened troops from Iraq for civil unrest and crowd controlin the United States. On September 30, 2008, the Pentagon announced the 3rd Infantry Divisions 1st Brigade Combat Team would be an o n-call federal response force for natural or manmade emergencies and disasters, including terrorist attacks,the Army Times reported. The mission soon expanded from disasters to every day police activity.

The firewall between military and civilian police duties was demolished with the passage of H.R. 5122, also known as the John Warner National Defense Authorization Act for Fiscal Year 2007. It allowed the president to declare martial law under revisions to the Insurrection Act, and take charge of United States National Guard troops without state governor authorization when public order has been lost and the state and its constituted authorities cannot enforce the law. The bill was repealed in 2008, but this has not stopped the military, numerous federal agencies, and the Department of Homeland Security from blurring the distinctions between military, federal and local police responsibilities. According to John R. Brinkerhoff, acting associate director for national preparedness of FEMA from 1981 to 1983, the Posse Comitatus Act is not only irrelevant but also downright dangerous to the proper and effective use of military forces for domestic duties. Brinkerhoff cites the Quadrennial Defense Review for 2001 that has declared homeland security to be the primary mission of the Department of Defense. Brinkerhoff is a longtime martial law advocate. He borrowed his ideas on martial law from then FEMA director, Louis O. Guiffrida. In 1970 at the Army War College, Guiffrida outlined his plan for martial law in case of a national uprising by black militants. The paper advocated the roundup and transfer to assembly centers or relocation campsof at least 21 million American Negroes,the Miami Herald reported on July 5, 1987, during the Iran-Contra hearings. Canceling Posse Comitatus is not about a benevolent Pentagon helping strapped local officials and over-burdened local cops save people from car accidents or the ravages of hurricanes and tornadoes. It has little to do with rioting Negroes. I ts about imposing martial law. Propaganda campaigns portraying uniformed soldiers wielding the jaws of life soften people up for the presence of troops on the streets. Military checkpoints in California and Tennessee have nothing to do with drunk drivers or seat belts. They acclimate the public to soldiers manning checkpoints like they do in Iraq and Afghanistan. TheQuadrennialDefenseReviewfor2001sdeclarationthathomelandsecurityistheprimary mission of the Department of Defense is particularly dangerous now that the government with the help of the corporate media has shifted the threat of terrorism from distant cave-dwelling Muslims to local far rightextremists.

If you are apprehendedby one of these soldiers, Id suggest walking away from them. If they draw on you or physically restrain you, Im no lawyer, but Id think theyd be liable under civil penalty for kidnapping/false imprisonment. If you stay around until the police arrive at their request, you legally did so willingly. Unfortunately Im not familiar with Floridas citizens arrest laws, but in most places this is generally true. The article was posted on the Homestead ARB webpage and I sent the article to INFOWARS because the skycops pull people over on the public road in front of the base (Verified by Miami-Dade as such) and detain them until civilian law enforcement arrive. Their training is primarily oriented to infantry defense of an Air Field. AF Office of Special Investigations (AFOSI) personnel are CLEET certified Federal Law Enforcement Officers. As such AF Security Forces have the ability to detain you, just like a Mall or Renta-cop, but they cannot arrest you. Especially off of a Federal Military base. National Guard are under the jurisdiction of their respective State Laws and serve the Governor of their State. All US Army Military Police and US Navy Master at Arms or Shore Patrolmen are CLEET certified Federal Law Enforcement Officers.

Police make for poor infantry and infantry make poor policemen. Legally, for a US Military LEO to participate in or conduct any kind of Law Enforcement act off Federal property requires the written consent of the State Governor and the County Sheriff. Log in to Reply

Something this authorfailed to do in the least. Had he even done a cursory read of the Posse Comitatus Act he would have found the National Guard is EXEMPT from the Act when operating in their own state and under state control. In fact, one of the express missions of the Guard is to preserve the laws of the state during times of emergency when regular law enforcement assets prove inadequate. It is only when federalized pursuant to an exercise of presidential authority that the Guard becomes subject to the limitations of the Posse Comitatus Act. So the author uses some flunkys article about the Guard violating the PCA in Kingman AZ who obviously knows nothing about how the Guard operates and doesnt bother to research if that guys articlewas factual? Too much information from too many sources who have little knowledge ultimately result in a piece like this. Biniecki said the meeting between the two men turned sour when the suspect became belligerentand refused to obey the officers verbal orders. The incident further escalated and the officer attempted to gain control of the suspect by the use of a Taser,Biniecki said.

The stun gun did not subdue the suspect who continued resisting the officers commands,the sheriff said. Ultimately, the officer retreated with the suspect in pursuit, Biniecki said. The pursuit prompted the officer to resort to the use of his or her service weapon, he said. Douglas Kramer said his son was not violent by nature. When you hear that a police officer shot a man, you think he was some kind of hoodlum,Douglas Kramer said. But he was not that. He said his son had no criminal record, and worked at the Chase Bank in Sandusky. He worked at a Burton Chase Bank branch for about four years until he transferred to the Sandusky branch in October where he was a personal banker, his father said. Kent Kramer grew up in Kingston, graduating from Kingston High School and Adrian College, his father said. A taser could not bring him down and he was attacking a cop. Somehow this does not sound like a normal traffic stop. I will be interested to see the results of the autopsy tozicology analysis. This was before the resaults were comming in they never found tasser marks in the autoposy also there was no wheapon of any kind ,He was completly unarmed

They can arrest you for speaking out about their crimes, but they dont have any idea what to do about the radiation, pollution, poison, natural disasters etc. There is no organization. they have proven time and again that they are inept, and should not be trusted. Maybe some of these new law enforcers should be enforcing the law on wall street or in DC. Maybe some of them should be getting degrees in engineering, health, technology, or rebuilding the infrastructure. Why feed off of the people already living in poverty? Why bite the hand that feeds you? None of this B$ makes any sense. We live in 2011 not 1850. People may be brain washed or brain dead, fluoridated but we really cant afford this anymore. We need to be able to at least acknowledge the factsand the obvious problems that are impossible to ignore. If people dont see this baloney, we probably dont have to worry about them voting anyway. They are probably too stupid and pre-occupied to care about anything besides their daily survival. I dont think well have to worry about too many of these people voting. And even if they did I hear the electorate is all that matters. Ive also heard rumours that elections are rigged. If facts are facts, there shouldnt be anything to argue about. I dont understand why all this garbage is still happening. The whole system needs to be evaluated and re-organized.
