Definition: Sexual Harassment Sexual harassment is a form of discrimination, in the United States, that violates Title VII of the

Civil Rights Act of 1964. Sexual harassment occurs when one employee makes continued, unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature, to another employee, against his or her wishes. According to a current issues update from the U.S. Equal Employment Opportunity Commission (EEOC), sexual harassment occurs, "when submission to or rejection of this conduct explicitly or implicitly affects an individual's employment, unreasonably interferes with an individual's work performance or creates an intimidating, hostile or offensive work environment." Examples of Sexual Harassment Sexual harassment can occur in a variety of situations. These are examples of sexual harassment, not intended to be all inclusive. y Unwanted jokes, gestures, offensive words on clothing, and unwelcome comments and repartee. y Touching and any other bodily contact such as scratching or patting a coworker's back, grabbing an employee around the waiste, or interfering with an employee's ability to move. y Repeated requests for dates that are turned down or unwanted flirting. y Transmitting or posting emails or pictures of a sexual or other harassment-related nature. y Displaying sexually suggestive objects, pictures, or posters. y Playing sexually suggestive music. When an employee complains to a supervisor, another employee, or the Human Resources office, about sexual harassment, an immediate investigation of the charge should occur. Supervisors should immediately involve Human Resources staff. Employees need to understand that they have an obligation to report sexual harassment concerns to their supervisor or the Human Resources office.

Sexual harassment, is intimidation, bullying or coercion of a sexual nature, or the unwelcome or inappropriate promise of rewards in exchange for sexual favors.[1] In some contexts or circumstances, sexual harassment may be illegal. It includes a range of behavior from seemingly mild transgressions and annoyances to actual sexual abuse or sexual assault.[2] Sexual harassment is a form of illegalemployment discrimination in many countries, and is a form of abuse (sexual and psychological)

andbullying. For many businesses, preventing sexual harassment, and defending employees from sexual harassment charges, have become key goals of legal decisionmaking. In contrast, many scholars complain that sexual harassment in education remains a "forgotten secret," with educators and administrators refusing to admit the problem exists in their schools, or accept their legal and ethical responsibilities to deal with it (Dziech, 1990). Often, but not always, the harasser is in a position of power or authority over the victim (due to differences in age, or social, political, educational or employment relationships). The harasser can be anyone, such as a client, a co-worker, a parent or legal guardian, a teacher or professor, a student, a friend, or a stranger. The victim does not have to be the person directly harassed but can be anyone who finds the behavior offensive and is affected by it. Adverse affects on the target are common The victim can be any gender. The harasser can be any gender. The harasser does not have to be of the opposite sex. The harasser may be completely unaware that his or her behavior is offensive or constitutes sexual harassment or may be completely unaware that his or her actions could be unlawful.[3]

   

Misunderstanding: It can result from a situation where one thinks he/she is making themselves clear, but is not understood the way they intended. The misunderstanding can either be reasonable or unreasonable. An example of unreasonable is when a man holds a certain stereotypical view of a woman such that he did not understand the womans explicit message to stop.(Heyman, 1994)

Sexual harassment can also occur in group settings as part of rituals or ceremonies, such as when members engage newcomers in abusive or sexually explicit rites as part

Hostile Environment Sexual Harrassment In employment law, hostile environment sexual harassment refers to a situation where employees in a workplace are subject to a pattern of exposure to unwanted sexual behavior from persons other than an employee's direct supervisor where supervisors or managers take no steps to discourage or discontinue such behavior. It is distinguished from quid pro quo sexual harassment, where a direct supervisor seeks sexual favors in return for something within the supervisor's powers, such as threatening to fire someone, or offering them a raise. Quid pro quo has been recognized as actionable for decades, but courts have only recognized hostile environment as an actionable behavior since the late 1980s as they made findings that the loss of

employment or constructive dismissal has been caused by such behavior. Some situations that have been ruled to constitute such a hostile environment are:
