GUIDELINESFORTHEINSPECTION OFUNIVERSITIES/INSTITUTIONS BYTHEBARCOUNCILOFINDIA

The Inspection of Universities is one of the most important functions of the Bar CouncilofIndia.Inspectionisthejobofspecialistsanditis,therefore,necessaryfor the Bar Council of India to properly and adequately inspect a University for the purpose of recognizing its degree in law as the requisite qualification for the enrolmentofindividualsasadvocates.Professionisdistinguishedfromserviceinits needforimpartingspecialeducationformakingprofessionals.InIndia,theinspection of Universities, before the recognition of their degrees as adequate professional qualificationforenrolment,bytheBCIisthereforeofutmostimportance. What is the purpose of inspection: Inspection has the following purposes (a) evaluating the capacity of any institution, established or functioning under a University, to impart legal education as per the standards prescribed (this initial inspectionistobeconductedbeforegrantingpermissionfortheestablishmentofsuch aninstitutionunderaUniversityforimpartinglegaleducation),and(b)evaluatingthe existingcapacityofaninstitutiontocontinuerunningsuchacourseasalsotoidentify therequirementofobtainingfurtherresourcestodeveloptheInstitution(theneedfor suchsubsequentandregularinspectionsrequirestobeperiodicallyreviewed). What is inspection: Rule 2(xii), of the Rules of Legal Education, 2008, defines InspectionofaUniversitybytheBarCouncilforrecognizingitsdegreeinlaw,inan inclusivemannerstatingthatinspectionincludes(A)callingforallrelevantrecords, documentsandcorrespondencestoevaluatethecompetenceoftheUniversitytorun professional courses, (B) visiting places of the Centres of Legal Education including buildings housing classes, library of the Institution, halls of residence and all other places as may be required by the inspection team inspecting the University and its affiliated Centres of Legal Education where the courses of degree in Law are conductedorproposedtobeconducted. Role of the University in BCI Inspection: The proviso to the said definition of InspectionincludestheresponsibilityofaUniversityinsuchaninspection,andstates asfollows:Providedthat,asandwhentheBarCouncilofIndiacommunicatestothe Universityforthepurposeofinspection,theUniversityshallalsodirecttheconcerned officer in charge of Inspection of Centers of Legal Education to instruct all persons concernedforfacilitatingtheInspectionbytheInspectionteamoftheBarCouncilof India. Two stages of Inspection: Inspection by the BCI has the following two stages of Inspection, (1)Thefirststageofinspectionistheevaluationofdocumentaryevidencetoascertain thecompetenceofanInstitutionwithreferencetosuchmattersas,ithavingproper infrastructure, land and building; proper facilities for residency of faculty and students, if the Institution is a residential one; requisite number of qualified faculty; autonomous functioning under the administration of a Principal/Head/Dean, as the

case may be, and a properly constituted Governing Council. It has also to be proved that the Institution fulfills the standards of affiliation under the University and conditions of approval as prescribed by the Bar Council of India. The Inspection Committee shall also evaluate adequacy of Capital fund, library and technology acquisition,legalaidcentresandmootcourts.Itisrecommendedthatthisevaluation is done at the Administrative Office of the University itself, by inviting the Institution/Institutions requiring inspection, in the presence of the University officials. Such documentary analysis, review, presentation and scrutiny can be centralizedforallInstitutionsfunctioningunderaparticularUniversityandrequiring inspectioninaparticularyear,attheUniversityheadquarters,andconductedinone go,. (2)The second stage comprises field visits and deliberations with all interested parties,thePrincipal,Governingbodymembers,ifavailable,facultyand students.In thisregard,theCommitteemayevenvisitthelocalBartoevaluatethepossibilityof theBarsinvolvementineducationandtrainingaswellasinthelegalaidcenterofthe Institution. This exercise of Physical verification of resources and fact finding may requirethesubmissionofaspecificreportonalltheseissues.Itisnotnecessaryforall themembersofaninspectioncommitteetovisitanInstitution,thoughitispreferred.

CompositionofInspectionTeamoftheBCI
Chairman/ViceChairman/MemberoftheBCIChairmanoftheteam[tobe appointedbytheChairman,BarCouncilofIndia] Member of the State Bar Council, in whose jurisdiction the Institution lies member of the Committee [to be nominated by the respective State Bar Council] ASeniorProfessorofLaw,servingorretiredfromaneighbouringUniversity In case the application is for an Integrated Course, one expert from each Stream applied for, must be included as a member of the Inspection Team as indicatedbelow: ASeniorProfessorofSocialScienceorLiterature,fromanyotherUniversityof thatState,servingorretired,incasetheproposedintegratedcourseisinsocial science. ASeniorProfessorofScience,fromanyotherUniversityofthatState,serving orretired,incasetheproposedintegratedcourseisinScience ASeniorProfessorofCommerceorManagementfromanyotherUniversityof that State, or from any other University of a neighboring State, serving or retired, in case the proposed integrated course is in Commerce or Management,

It is imperative that no member of the Inspection Committee has any conflict of interestwiththeUniversityoranyinstitutionoftheUniversity,whichcouldaffectthe membersabilitytoarriveatafairandobjectiveassessmentofanyissue,atanystage oftheinspection,and/oradecisioninthisregardattheBarCouncilofIndia.Inthis regard,conflictofinterestshallmeantoincludesuchinstancesashavingmembership ofabodyorauthorityoftheUniversity,havingrepresentedtheUniversity,oranyof its institutions, in a professional capacity, or having any undertaken an assignment (temporary or permanent, part time or full time, regular or periodical against any remuneration, fees or financial benefit) in the University, or any of its institutions. However,occasionallyactingasaguideortrainertostudentsoftheUniversity,inthe course of their internship as students of law, may not be treated as conflict of interest.

ChapterII

APPLICATIONFORINITIALAPPROVAL
1. A New Institution seeking approval for its affiliation with the University, and proposing to establish and run a Law School or a course in law, shall submit an Application inForm No[IA & Form I B]of Annexure III ofthis Manualspecifiedin Part I of the Rules of Legal Education within such date as is notified under the EducationRules. TheApplicationshallaccompanysuchotherschedulesandinformationparticulars,as is required, to substantiate presentation in the above Form and other provisions of theEducationRules. TheApplicationshallbeaccompanied/supplementedby,anAffidavit,affirmedbefore a First Class Executive Magistrate, in the manner prescribed by the Bar Council of IndiainAnnexure[I]tothisManual,bythePersonauthorizedbytheInstitutionand alsotheRegistraroftheaffiliatingUniversityconcernedorbyapersonsoauthorized bytheRegistrarinwriting. TheapplicationshallalsoaccompanyaComplianceReport,asprovidedinAnnexure[ II]tothisManual,bytheperson/ssubmittingtheaffidavit. TheApplicationshallaccompanytheInspectionfeesasstipulatedbytheBarCouncil ofIndiaundertheRules. IncaseofstatefundedInstitutionsorInstitutionsseekingfundsfromtheState/Union Government, a Statement from the relevant Government for No Objection to the applicationoraSpecificPreliminaryApprovalorSanctionfortheestablishmentof theInstitution.UniversityFaculty/Departmentwould,however,notrequirethesame but has to submit the resolutions from various authorities required for the establishment which shall also be accompanied by Act, Rules and Regulations of the University. OncetheSecretaryoftheBarCouncilofIndiafindstheapplicationcompletewithall requiredinformationandreports,heshallplacetheapplicationbeforethemeetingof theLegalEducationCommitteeoftheBarCouncilofIndia,fortheCommitteetodirect thevisitbytheInspectionCommitteeandsubmissionofaReport. The Secretary shall then inform the Head of the Institution and the Registrar of the affiliating University, the date and time of the Inspection Committee to visit the UniversityandtheInstitutionforInspection.TheInstitutionandtheUniversityshall takeallnecessarystepstofacilitatetheinspection. University Faculty/Department proposing establishment shall also follow a similar procedure,whicheverisapplicableandrelevant.

PERIODICINSPECTION

AnInstitutionapprovedbytheBarCouncilofIndiaisrequiredtobeinspected periodicallyaccordingtotheRules.Inthisregard,suchanInstitutionshall submitanApplicationinFormNo[IA]andForm[IB]ofAnnexureIIItothis Manual,totheBCIbythedateasmaybenotifiedbytheBCIfromtimetotime. Acopyoftheaforementionedapplicationforinspection,withcopiesofall enclosures,shallalsobesubmittedtotheInspector/Registraroftheaffiliating University. AnAffidavitaffirmingthestatementsasprovidedinAnnexureIofthis Guideline/Manual AcomplianceReport,asprovidedinAnnexure[II],andanAffidavit,as specifiedinAnnexure[I],shallbesubmittedwiththeApplication. Copiesoftheaffiliationletter(ifitisanaffiliatedInstitution)fromthe University,NOCfromtherelevantgovernment(ifitisaStateownedorfunded Institution)mustbesubmittedwiththeapplication. UniversityDepartment/Faculty/Schoolshallfollowsimilarprocedureexcept conditionsrequiredonlyforaffiliatedInstitutions.

ChapterIII
A. FilefortheInstitutionwiththeBCIInspectionTeamshallcontain TheInspectionCommitteeshallbesuppliedwiththefollowingdocumentsand informationfromtheOfficeoftheSecretaryoftheBarCouncilofIndiato facilitateinspection. 1. CopyofthecommunicationwiththeRegistrarrequestinghim,orhis authorizedrepresentative,toremainpresentduringtheinspectionfor facilitatingtheinspection.ArepresentativeoftheRegistrarmustbe authorizedinwritingandthesamemustbecommunicatedtotheSecretary oftheBarCouncilofIndia. The Secretary of the Bar Council of India shall communicate to the Principal/Head/Dean,oftheInstitutiontobeinspected,asalsotheRegistrarandthe Vice Chancellor of the affiliating University the requirement of bringing/making available to the Inspection Committee, the following particulars and documents, registers,booksofrecordsetcavailableforthepurposeofdocumentaryinspection.: Documents: 1. ProcedureofInspection

The Committee shall formally meet, along with representatives of the University and the Institution/s concerned, at the University Premises.. The Inspection shall take two procedural forms, firstly the committeeshallthoroughlyscrutinizethedocumentsinpossession of the Committee. Secondly the committee shall scrutinize the documents presented to the committee by the Institution and the Universityauthorities.. The committee may seek additional documents that can be producedthereoratthetimeofphysicalverificationonsite. IfmorethanoneinstitutionbelongingtoaUniversityisrequiredto beinspected,thedocumentaryevidenceofallsuchinstitutionsmay be called for and evaluated at the University office, one after the other,inpresenceoftheUniversityauthorities. TheCommitteeshallcriticallyreviewthedocumentaryevidenceon standardprescriptionsforaffiliationoftheUniversityandapproval of the BCI. The deficiencies, if any, would be forthwith identified andnoted. TheCommitteemay,ifrequired,advisetheInstitutiontosubmita Due Diligence Report conducted by a member of the local Bar regardingtitleinaproperty. All presentations, explanations, submissions and expressions of opinion shall be reproduced in writing, authenticated by the signature of the author or of such person authorizing such presentation,explanation,submissionorexpressionofopinion.

StandardAcademicInfrastructureFacilities
Three Years Course (Unitary Course) for those who have obtained a graduationdegreeinArts,SocialSciences,Commerce,Literature,Science, Management, or in any other branch of knowledge, is suitable for Universities catering to students from rural and semiurban areas. In these local areas students generally undergo college education with the hopeofbetterprospectsforearningalivingthereafterastheyareeligible forallgovernmentserviceshavinggraduatedinsuchacourse.Incaseone isunabletogetemploymentintime,someofthestudentsenrollinLaw Courses with a hope of selfemployment. Law Schools wanting to serve this section of students may not have the facility of garnering huge resources to run an institution. Even state governments do not have enough resources to support many of such Institutions. With proper planning it would be possible to have a Law School with the proper infrastructureaccordingtothestandardslaiddownasfollows.Itmustbe kept in mind that a Law School with poor faculty and teachinglearning programcanonlyproducepoorlawyers,hencealleffortsmustbemade toobtainatleasttheminimumstandardasprescribedbelow: ____________________________________________

WhatneedstobeinspectedandHow

A.InstitutionalCharacter 1. Character of the Institution: Documents have to prove the nature and character of the Institution. The Inspection has to determine the character of the Institution and not the Management. Often it is observed that a Society/Trust/NPO manages the Institution and the Institution does not have any legal structure. The report of the Inspection has to clearly identify the characterandstructureoftheInstitution. 2. Management of the Institution: Documentary evidence has to be recorded aboutthemanagementoftheInstitutionandtheroleoftheStateGovernment / University in the management of the Institution. The structural pattern and the chief of the Management are required to be clearly identified so that the responsibilitycanbedirectlyfixed. 3.AutonomyoftheInstitution:Thedaytodayoperationhastobereposedon theDean/HeadoftheDepartment(incaseofUniversityFaculty/Department), the Principal of the Institution who shall be chief Executive Officer and bear directresponsibilityfornonfulfillmentofstandardsprescribed. 4. Collection of Management chart and Regulations/Document on management, if any: Documentary evidence is required to be produced and the BCI Inspection team to be satisfied about all the requisite evidence being produced. B.PropertyoftheInstitution: 6. Property of the Institution: The authority of the Institution shall have to establish the legal status of Property of the Institution by producing the documents. Institutions and the Management structure must not be confused in so far as the proprietarial rights are concerned. Copy of the title deed (in caseofownership),deedofgift(ifgifted),deedoflongtermlease(ifleasehold) hastobesubmittedtotheInspectionCommittee. 7.StatusoflitigationandDDR:ADetailedstatusreporthastobeprovidedfor examinationbytheCommittee. 8. Comparing with the standard required: Inspection Committee shall then comparetheexistingfacilitywiththestandardrequirementasstipulatedinthe Manualandevaluatetheposition.

C.Faculty: 9. Present status: The Committee has to take the existing stock of the available faculty with particulars about the existing faculty and the Principal/ Head/Dean of the Institution with service conditions. Resolution of the ManagementCommitteeabouttheserviceconditionsistobeproduced. 10. Comparative data: The standard requirement as per the Manual and the existingfacilityaretobecomparedandrecommendationformulated. 11. Qualification and selection procedure: Committee would require documentary evidences about the qualification and selection procedure and may like to examine individual files of the Faculty, if needed. Committee may alsorequirestatementsforfacultyattendingtrainingcourses. 12. Course design & day to day schedule: Committee may require curriculum designandthedaytodayscheduleoftheclassesrun. 13.PayRegister:TheCommitteemayliketoinspectPayregistertoascertainpay and allowances, retirement benefit and social security available in the institution. D.HeadoftheInstitution 14. Appointment: A duly qualified Principal (for a College), University (Dean), Autonomous Institution (Director) is to be appointed for the Institution. The Committeeshallalsoexaminethetermsofappointment. 15.ChiefExecutivepower:TheHeadoftheInstitutionshallhavefullexecutive powerincludingentirefinancialresponsibility. 16. The Inspection Committee shall also evaluate the standard of library management and records maintained under approvedThesaurus. 20. Elibrary: Library of each Institutions must have at least 10 (ten) internet libraryaccesspointswithdesktopfacilitiesandsomeopenpointsforlaptops. ElibrarylikeWestLaw,LexisNexis,orAustralianLawonlineaccessetc.must beavailablethroughinternetfacilities.Itwouldbealwayspreferabletohave WiFiintheInstitutionscampus. 21.ReadingRoom:Theremustbeadequatereadingroomfacilityavailabletothe studentsatleast1012hoursdailyincludingonholidayssothatstudentscan availtheopportunityforstudyregularly.ItisoftensaidthatSciencestudents learn mostly by doing in the laboratory and law students have to learn in Library by way of reading. Adequate facilities for the readers must also be available,suchasdrinkingwater,toiletry,etc. 22.LibraryStaff:TherehastobeaqualifiedLibrarianforthemanagementofthe Library.TherehastobeatleastonetrainedlibrarianineachInstitution.The librarianisrequiredtobeassistedbysupportingstaff. 23. Facilities in the Library: Sanitation, drinking water, rest room facilities are alsotobeevaluated.
