Terms and Conditions 1. All equipment hired from PENTAGON PLANT & TOOL HIRE will leave PENTAGON PLANT & TOOL HIRES premises clean and in perfect working order. On the return of the equipment, with the exception of wear and tear, any repairs that need to be made to the equipment will be for the account of the customer. 2. The customer acknowledges that he/she is responsible for the collection & return of the equipment hired from PENTAGON PLANT & TOOL HIRE and will ensure that a proper signature from a duly authorized person at PENTAGON PLANT & TOOL HIRE is obtained. This signature confirms the collection and the return of the equipment. To avoid additional hire charges, all equipment hired by PENTAGON PLANT & TOOL HIRE to the customer, must be returned by the customer to PENTAGON PLANT & TOOL HIRE by no later than 8:30am on the date specified on PENTAGON PLANT & TOOL HIRES delivery note. 3. PENTAGON PLANT & TOOL HIRE and/or its officers, servants, duly authorized agents, do not accept or take any responsibility, nor can they be held liable for any damage/injuries /loss to any persons or property, arising from the hire of equipment (whether as a result of negligence on the part of the customer or any of its duly authorized agents or for that matter from any cause whatsoever). 4. All equipment hired by the customer from PENTAGON PLANT & TOOL HIRE is done so entirely at the customers own risk. The customer therefore indemnifies PENTAGON PLANT & TOOL HIRE, its agents, employees and servants against any claim of whatever nature, which may be brought against any of them arising out of such an event. 5. The customer accepts full responsibility for any loss or damage to equipment after it has been hired from PENTAGON PLANT & TOOL HIRE and collected from the PENTAGON PLANT & TOOL HIRES premises. If any equipment is lost while in the customers possession full hire is payable until the equipment is either returned or paid for at PENTAGON PLANT & TOOL HIRES full retail price. 6. If equipment reserved by a customer from PENTAGON PLANT & TOOL HIRE is not immediately available, the customer cannot hold PENTAGON PLANT & TOOL HIRE responsible for any losses and/or consequential damages suffered by the customer resultant there from. 7. PENTAGON PLANT & TOOL HIRE has the right of access to any location in which equipment hired from PENTAGON PLANT & TOOL HIRE may be situated, and is authorized to reposes said equipment should the customer contravene any of these conditions or fail to make timeous payment and thereafter, despite demand, remains in default. The expenses incurred by PENTAGON PLANT & TOOL HIRE in effecting the above will be for the account of the customer. 8. The customer, by hiring the equipment and taking possession, thereof acknowledges that he/ she is fully acquainted with the capabilities, specifications and operations of every piece of equipment hired. 9. The customer undertakes at all times to ensure that: a. oil and lubricant levels are maintained; b. all fuel for petrol engines will only be obtained from PENTAGON PLANT & TOOL HIRE; c. no air filter will at any time be removed from any equipment; d. any extension cord used for any electrical equipment will only be used in accordance with PENTAGON PLANT & TOOL HIRES handy guide. 10. In the event of PENTAGON PLANT & TOOL HIRES customers failing to make payment in terms hereof, overdue payments shall bear interest at a rate equal to 2 percentage points above the prime overdraft rate as calculated by Commercial Bankers from time to time and all amounts owing by the customer to PENTAGON PLANT & TOOL HIRE shall forthwith become due, calculated from the day which payment in terms of this Clause should have been made, to date of payment. 11. Unless otherwise agreed in writing, the prices at which the equipment is hired shall be at PENTAGON PLANT & TOOL HIRES ruling prices as at date of delivery of the equipment, whether notified to the customer or not. 12. The customer acknowledges that he has read, understood and is bound by PENTAGON PLANT & TOOL HIRES standard terms and conditions which are attached to its credit application and to its invoice of which this notice forms an integral part.
