TERMS & CONDITIONS FOR REGISTRATION / BOOKING / ALLOTMENT


1. The final allotment shall be subject to execution of the prescribed Plot Buyers Agreement between Vatika Ltd. and the Allotee of the plot. The Allotee shall be required to execute the agreement and pay the stipulated installments within 15 days of being asked to do so by the Developer. The final sizes of the plots may vary from the sizes indicated in this Booking Form on account of either design or statutory conditions. Any variation of + \ - 15% shall be deemed to be within acceptable range and the Applicant shall be bound to accept the change in area. The cost of the plot shall be adjusted (the applicant shall be refunded excess amount or be required to pay additional sale consideration), on pro-rata basis based on the change (decrease or increase) in the plot area. The above-mentioned Sale Consideration for the plot is inclusive of Government or Municipal Charges / E.D.C / I.D.C at rates prevailing as on the time of execution of Plot Buyers Agreement. In the event there is an upward revision in these charges from the date of booking till the date of possession of the plots the same shall have to be borne by the Applicant (on pro-rata basis in proportion to the plot size) as an enhancement in the sale consideration of the plot. Such an enhancement if any shall have to be paid along with the final installment at the time of offer of possession. The above-mentioned Sale Consideration does not include a) Club Membership (optional); b) parking (optional), c) Interest Free Maintenance Security Deposit (IFMSD) towards maintenance security to be levied uniformly for all plots in direct proportion to the plot area. The IFMSD shall have to be paid along with the final installment at the time of offer of possession. The IFMSD is projected at Rs. 150 per Sq.yds of Plot area at Current Prices. In the event the Allottee does not pay the installment amount within (15) days of the stipulated date mentioned in the Installment Notice issued by the Developer a penal interest calculated @ 18% compounded quarterly shall be payable for the entire period of the delay upto 30 days thereafter the Developer in its discretion may without notice to the Allottee cancel the Allotment & refund the amount paid by the Allottee after deducting Earnest Money which shall be 20% of the Total Sales Consideration, penal interest applicable and other expenses and charges incurred as may be applicable. In the event of any booking amount cheque (partial or full amount) getting bounced for any reason what-so-ever, the booking shall be treated as cancelled. The reinstatement of the booking shall entirely be at the sole discretion of the Developer and in the event of the Developer agreeing for the same, a penalty of Rs. 2,000/- (per bounced cheque) and interest @ 18% p.a. for the delayed payment shall be payable by the Applicant to the Developer. In the event of any installment amount cheque getting bounced for any reason what-so-ever, a penalty of Rs. 2,000/- (per bounced cheque) and interest @ 18% p.a. for the delayed payment shall be payable by the Allottee to the Developer. Levy of administrative charges of Rs.5000/- in case of request put forth by the applicant for Name addition or deletion and change of payment plan. 1.Allotment to Non Resident and National of Indian Origin shall be subject to Indian Laws 2.For non-residents/ foreign nationals of Indian origin all remittances, acquisition/ transfer of the said unit and compliance with the provision of Foreign Exchange Management Act, 1999 or any other statutory enactments shall be their own sole responsibility.
