INTRODUCTION
USGBCwritesandmaintainstheLEED2009MPRSupplementalGuidancetohelpyouunderstandif
yourbuildingorspacecanmeettheMinimumProgramRequirements(MPRs).TheSupplemental
GuidancebuildsontheMPRsbyestablishingexceptions,providingdirectionforspecificsituations,
definingkeyterms,anddescribingtheintentbehindeachMPR.Itisthedynamicpartnerofthe
MPRs:itwillevolveovertimetorespondtoachangingandcomplexindustrywhilethe
requirementsthemselveshighlightedingreyboxesthroughoutthisdocumentwillremainthe
same.
EveryprojectteamregisteringaLEEDprojectisnotexpectedtoreadthisSupplemental
Guidanceinitsentirety.Ifyouareregisteringaproject,firstreadtheMPRsthemselvescarefully.
IfyouquestionyourprojectscompliancewithaparticularMPR,thendipintothisguidancetofind
outmore.

AbouttheMPRs
TheMPRslistthebasiccharacteristicsthataprojectmustpossesstobeeligibleforcertification
undertheLEED2009ratingsystems,thereforedefiningabroadcategoryofbuildingsand
spacesthattheLEED2009ratingsystemsweredesignedtoevaluate.USGBCstaffand
committeemembersdevelopedthemoveraperiodofninemonths,andtheLEEDSteering
Committee(LSC)officiallyapprovedtheminApril,2009.InNovember2009,theLSCandthe
USGBCExecutiveCommitteeapprovedofadditionalMPRlanguagethatclarified,butdidnot
addto,theexistingrequirements.Whennewratingsystemversionsbecomeavailable,the
MPRswillbecompletelyrevisedandreapproved.Youcanfindthe2009MPRsatthefollowing

Thisdocumentwillbeupdatedonaquarterlyschedule,alongwiththeaddenda,toprovideany

documentthatiscurrentatthetimethatyouregisterit.Itisyourresponsibilitytobefamiliar

HowtoSubmitQuestionsAbouttheMPRs
USGBCcannotwriteguidanceforeveryeventuality,however,thisguidanceisnotmeantto
excludeabuildingorspacethatcouldbefairlyevaluatedthroughtheLEEDcertificationprocess
iftheexclusionisbasedonatechnicality.Ifyouareunsureofwhetherornotyourprojectisin
compliancewithanMPR,youareencouragedtomakeadecisionbasedonthelanguage
providedhereandyourownsoundjudgment.Then,writeanexplanationofyourrationalethat
includesadescriptionofhowyourprojectmeetstheintentoftheMPR.Uploadthisexplanation
toProjectInformationForm1inLEEDOnlinev3,anditwillbereviewedwhenyousubmityour
firstroundofforms.AnyproblemswithMPRcompliancewillbeaddressedduringthatround.If
youwantanofficialdecisiononcompliancebeforeregisteringaprojectorbeforeyourfirst
submittal,pleasesubmitaformalinquiryforaProjectCIRand(ifdesired)aLEED
Interpretation.Decisionscannotbegrantedthroughregularcustomerservice.Readabout
ProjectCIRsatgbci.orgunderbuildingcertification,resourcesandfees.ReadaboutLEED

IfMPRComplianceIsCalledintoQuestion
IfGBCIlearnsthataLEEDprojectisorwasinviolationofanMPR,certificationmayberevoked,
orthecertificationprocessmaybehalted.Thesesituationswillbehandledonacasebycase
basisaccordingtoGBCIschallengepolicy,whichiswithintheCertificationPolicyManualat
gbci.org.Toavoiddelays,youshouldkeepGBCIabreastofanythingaboutyourproject,
includingchangesthatoccurduringtheconstruction,performanceperiod,orcertification
processthatmightcallintoquestionMPRcompliance.

DealingwithProhibitiveCharacteristicsNotAddressedbytheMPRs
TheMPRsdonotspecificallyprohibitanyandallcharacteristicsthatmightmakeaproject
unsuitableforevaluationundertheLEEDratingsystems.Ifyourecognizethatyourprojecthas
suchacharacteristic,pleasemoveforwardwithgreenbuildingstrategiesbutrefrainfrom
attemptingLEEDcertification.
Thedecisionnottoattemptcertificationisatyourdiscretionalone*.GBCIwillnotpreventa
projectteamfromattemptingcertificationforabuildingorspacebecauseofanunusual
characteristicthatisnotaddressedbytheMPRs.
DealingwithBuildingTypesNotSpecificallyAccommodatedforintheLEEDRatingSystems
TheLEEDratingsystemsdonotspecificallyaddressmanybuildingtypes,suchas
manufacturingfacilities.Buildingstypesthatarenotspecificallyaccommodatedformaystill
applyforLEEDcertificationiftheymeetalloftheMPRs*.
*UnrelatedtoMPRs,LEEDInterpretation#10080postedMay2nd,2011specificallyprohibitsthe
certificationofparkinggarages.ThisdocumentdiscussesthisissueinmoredetailunderMPR2.
HowtoSelectaRatingSystem
TheMPRsdonotdealspecificallywithratingsystemselection,i.e.,choosingtheproperLEED
ratingsystemforagivenprojectalthoughitcaninformtheselectionprocess.Pleasefindspecific
guidanceonthistopicintheRatingSystemSelectionGuidance,foundontheratingsystempageat
usgbc.org.PleasereadboththeMPRsandtheRatingSystemSelectionGuidancebeforeregistering.
PrecertificationandRecertificationProjectsareSubjecttotheMPRs
PrecertificationandrecertificationprojectsarenotexemptfromanyMPRs.Projectspre
certifyingunderLEEDCSmustmeettheMPRsapplicabletoallLEEDCSprojects(althoughdata
reportingtosatisfyMPR#6onlyhappensafterfullcertification).Projectsrecertifyingunder
LEEDEB:O&MmustmeettheMPRsthatareapplicabletoallLEEDEB:O&Mprojects,andthat
areinplaceatthetimeoftherecertificationregistration.
HowtoDocumentComplianceWiththeMPRs
TheLEEDprojectownermustpersonallyconfirmthattheprojectcomplieswitheachofthe
MPRseitherbycompletingcheckboxesandaninitialboxintheProjectInformationForm1in
LEEDOnlinev3,orbysigningaletterthatstatescompliance,whichisthenuploadedtothat
form.Unlessthereisaspecialcircumstance,youarenotrequiredtosubmitadditional
documentationtoprovecompliance.
HowtoDealwithMultipleBuildingsSituations
AllbuildingsandspacesmustmeetalltheMPRsattheindividualbuildinglevel.Ifyouare
workinginamultiplebuildingsituation,thisdocumentwillhelpyouunderstandhowyour
project(s)cancomplywiththeMPRs.TheGuidanceforMultipleBuildingsandOnCampus
Projectsalsoliststhisinformation,alongwithcertificationinstructionsforcertifyingmultiple
buildingssimultaneously.Itisavailableatwww.usgbc.org/campusguidance.

1.MUSTCOMPLYWITHENVIRONMENTALLAWS.

MPRLanguage
AllRatingSystems:
A lapse in a projects compliance with a buildingrelated environmental law or
regulationthatresultsfromanunforeseenandunavoidablecircumstanceshallnot
necessarilyresultinnoncompliancewiththisMPR.Suchlapsesshallbeexcusedso
longastheyareremediatedassoonasfeasiblypossible.
New Construction, Core & Shell, Schools, Commercial Interiors, Retail New
Construction,RetailCommercialInteriors,Healthcare:
TheLEEDprojectbuildingorspace,allotherrealpropertywithintheLEEDproject
boundary,andallprojectworkmustcomplywithapplicablefederal,state,andlocal
buildingrelatedenvironmentallawsandregulationsinplacewheretheprojectis
located.ThisconditionmustbesatisfiedfromthedateofLEEDprojectregistration
orthecommencementofschematicdesign,whichevercomesfirst,uptoanduntil
thedatethatthebuildingreceivesacertificateofoccupancyorsimilarofficial
indicationthatitisfitandreadyforuse.
ExistingBuildings:O&M:
The LEED project building, all other real property within the LEED project
boundary,anyprojectwork,andallnormalbuildingoperationsoccurringwithinthe
LEEDprojectbuildingandtheLEEDprojectboundarymustcomplywithapplicable
federal, state, and local buildingrelated environmental laws and regulations in
place where the project is located. This condition must be satisfied from the
commencement of the LEED projects initial LEEDEB: O&M performance period
throughtheexpirationdateoftheLEEDCertification.

INTENT:
ThepurposeofthisMPRistohighlighttheimportanceofenvironmentallawsandregulationsthat
applytoLEEDprojects.Suchlegislationestablishesabaselinestandardforsustainability.

SPECIFICALLOWEDEXCEPTIONS:

Shorttermlapsesincomplianceareacceptable
AsstatedintheMPR,GBCIwillnotimmediatelyrevokeacertificationifalapsein
compliancewithanenvironmentallawresultingfromanunforeseenandunavoidable
circumstancesoccurs.However,projectteamsmustdemonstrateadedicatedeffortto
returnthebuildingtocomplianceassoonasfeasiblypossible.Asaprecautionandatthe
projectteamsdiscretion,thebuildingownermaynotifyGBCIofanylapseincompliance
andeffortstobringthebuildingbackintocompliance.UsetheSpecialCircumstances
sectionofProjectInformationForm1inLEEDOnlinev3forthispurpose.Ifthelapseoccurs
aftercertification(applicableonlytoEB:O&Mcertifiedprojects),theprojectteammay
contactGBCIthroughregularcustomerserviceatgbci.org.

USGBCwillrecognizeexemptionsgrantedbyauthorities
Ifgovernmentalauthoritiesexempttheprojectfromabuildingrelatedenvironmentallaw
foranyreason,thenthatprojectisexemptfromthisMPRinregardstothatparticularlaw.
Intheeventthatthisoccurs,adescriptionofthesituationleadingtotheexemptionand
proofoftheexemption(suchasanofficialletterfromthegrantingauthority)mustbe
providedintheSpecialCircumstancessectionofProjectInformationForm1inLEEDOnline
v3.

USGBCwillrecognizesettlementsgrantedbyauthoritiesonacasebycasebasis
Itisrecognizedthat,inthecaseofanallegedenvironmentallawviolation,buildingowners
sometimesagreeonasettlementwithagovernmentalagencytomakereparationsfortheir
actions.Thesesituationsaretreatedonacasebycasebasisintermsofcompliancewiththis
MPR.PleasecontactGBCIviathecontactuspagesatgbci.orgtodeterminecompliancein
thissituation.

SpecialconsiderationsforLEEDforCommercialInteriorsprojects
OnlythegrossfloorareawithintheLEEDprojectboundaryofaLEEDCIprojectmust
complywiththisMPR,NOTthebuildinginwhichtheprojectislocated.

Specialconsiderationforprojectswithunfinishedspaces
Forprojectswithunfinishedspaces(typically,LEEDCSprojects),interiorfitoutwork
conductedpostcertificationisNOTsubjecttothisMPRunlessstrategiesimplementedin
thefitoutspacecontributetoearnedprerequisitesorcreditsforthatprojectviathetenant
salesandleaseagreementorownerletterofcommitmentpath.

Howtoidentifybuildingrelatedenvironmentallaws

DEFINITION
ForthepurposesofthisMPR,anenvironmentallawisconsideredtobeastatute,rule,
treaty,convention,executiveorder,regulation,orordinancethatseekstoprotectthe
naturalenvironmentand/orhumanhealthwhichmaybenegativelyimpactedby
activitiessurroundingthedesign,construction,development,and(forthoseusingEB:
O&M),operationofabuilding.

LOCATION
ThisMPRappliestoALLLEEDprojects,regardlessoflocation,andincludesallexisting
buildingrelatedenvironmentallawsinthejurisdictionwheretheLEEDprojectis
located.ForUSprojects,thisincludeslawsatthefederal,state,andlocallevel.

CATEGORIES
CategoriescontaininglawsthatfallunderthepurviewofthisMPRinclude,butarenot
limitedtothefollowing:wetlands,noise,runoff,asbestos,airquality,pollution,sewage,
pesticides,safety,andforestry.

EXAMPLES
ThislistincludesexamplesofUSfederalbuildingrelatedenvironmentallawsand
regulationsthatUSGBCgenerallyexpectswillfallunderthepurviewofthisMPR.This
listisnotintendedtobeexhaustive,onlyillustrative:itspurposeistofurtherorient
projectteamsastothemeaningofthisMPRandtoassistprojectteamsindetermining
whichlawsfallunderthepurviewofthisMPR.Itistheprojectteamsresponsibility
toknowwhichlawsapplytothebuildingandtoverifythattheprojectisin
compliance.

TherelationshipbetweenMPR1andSSCredit1:SiteSelection
TheintentandrequirementsofSSc1inwholebuildingdesignandconstructionrating
systemsdiffersfromthatofthisMPR.ThisMPRrequirescompliancewiththelaw,andSSc1
rewardsvoluntarylandusechoices.ApointmaybeearnedunderSSc1iftheLEEDproject

INTENT:

locations.PartialbuildingsorspacesareunsuitableforLEEDcertificationbecause,whenanalyzed
undertherequirementsofLEEDprerequisitesandcredits,theycreateresultsinconsistentwith
thoseofwholebuildingsorspaces.Also,partialcertificationcaneasilyappeartoencompassan
entirebuildingorspace,sendingafalsemessagetousers.
PermanencyisanimportantrequirementbecauseasignificantpercentageofLEEDprerequisites
andcreditsaredependentonlocation,makingamobilebuildingorspaceunacceptable.The
stipulationforalreadyexistinglandrespondstothefactthatartificiallandmassesdisplaceand
disruptmarineecosystems.Buildingsthatgeneratetheneedtodevelopsuchlanddonotmeetthe
overallintentoftheLEEDratingsystem.Anythinglessthanadistinct,complete,andpermanent
projectonexistinglandwillnotbeabletoaccuratelydemonstratecompliancewithLEED.

tocomplywithMPR#2ifcertainconditionsaremet.Theconditionslistedbelowarewrittentopreventtwo
kindsofproblemsthatattachedbuildingscanleadto:compromisedtechnicalintegrityofLEEDcertification,

Plannedobsolescence
WhileUSGBCdoesnotencourageplannedobsolescence,theamountoftimethatabuilding
orspaceisintendedtoremainstandingdoesnotaffectcompliancewiththisMPR.The
purposeistodeincentivizedprojectteamsfromattemptingtocertifyastructurethatis
intendedtobemobileoverthecourseofitslifetime.Multipartyownership
Multiplepartyownershipofacertifyingbuildingorspaceisacceptable.Proper
accountabilityforMPRandratingsystemconformancemustbeinplace.

NoexceptionsforprojectswithEQp2conflicts
Someprojectbuildings,suchascasinos,typicallyhavedifficultyachievingLEED
certificationduetoasmokingpolicythatconflictswithIndoorEnvironmentalQuality
prerequisite2,EnvironmentalTobaccoSmokeControl(EQp2).Therewillbenoexceptions
tothisMPRtoallowforpartialbuildingcertificationofsuchbuildings.Projectteamsare
encouragedtocarefullyreviewoption2inEQp2toexploreopportunitiestoachieveLEED
certificationdespiteasmokingroomlocatedwithinaproject.

Multiplebuildings
WhilethisMPRstatesthatLEEDprojectsmustincludeatleastone.buildinginits
entirety,theimplicationisnotthatmultiplebuildingsmaybeincludedwithinasingle
LEEDproject.ALEEDprojectmayonlyincludeONEbuildingunlesstheprojectqualifiesfor

Superstructurescanbeoftenbeperceivedaseitherastringofmultiplebuildingsorasa
singlebuilding,usuallyduetolightphysicalconnections,suchasasinglehallway.Sucha
superstructuremay,forthepurposesofLEED,beconsideredasinglebuildingifallthe
followingcriteriaaremet.
a) Spacethatcanbeincludedinthegrossfloorareaoftheprojectandservesapurpose
otherthanparkingorthecirculationofpeopleiscontiguousthroughoutthestructure.
b) TheabilityoftheLEEDcertificationreviewertofairlyevaluatethecertifyingbuilding
isnotcompromised,norisundueburdenplaceduponthereviewer.Thismeansthatall
buildingcomponentsoftheLEEDprojectthatareaddressedbyLEEDprerequisites
andpursuedcredits(systems,materials,etc)canbetreatedasone,suchthatseparate
reviewsofthesameissuesarenotrequiredfordifferentportionsofthesuper

1. The LEED project boundary must include all contiguous land that is associated
with and supports normal building operations for the LEED project building,
including all land that was or will be disturbed for the purpose of undertaking
theLEEDproject.
2. TheLEEDprojectboundarymaynotincludelandthatisownedbyapartyother
thanthatwhichownstheLEEDprojectunlessthatlandisassociatedwithand
supportsnormalbuildingoperationsfortheLEEDprojectbuilding.
3.LEEDprojectslocatedonacampusmusthaveprojectboundariessuchthatifall
the buildings on campus become LEED certified, then 100% of the gross land

Occasionally,projectteamsusefacilities(includingparking)thatareoutsideoftheLEED
projectboundarytodemonstratecompliancewithparking,bike,oronsiterenewable
energycredits.ThisisallowablewhenthefacilitiesservetheLEEDproject,andatleastone
ofthefollowingtwoconditionsaremet:
a) ThefacilitiesarenotapartoftheLEEDprojectconstructionscope
b) ThefacilitiesarephysicallyseparatefromtheLEEDprojectbylandnotownedbythe
LEEDprojectowner(or,ifonacampus,physicallyseparatesuchthattheinclusionof

neednot(andmaynot)beincludedinthecalculationsforWaterEfficiency
prerequisite1,andcannotbeusedtoearnthiscreditforanadditionalLEEDproject
unlesstherequiredshowertoFTEratioismetforbothprojects.

Realpropertynolongerattributedtoacertifiedbuilding

certification.Anewparkinglotwithfiftyspaceswillbesharedbythetwostores.
Thecertifyingstoreestimatesthatitwillusetwentyparkingspacesonaregular
basistoserveitsemployeesandcustomers.Therefore,theprojectteammustdraw
itsLEEDprojectboundarytoincludetwentyspacesandfortypercentofthe
supportinghardscape(driveways,sidewalks,etc).

EXAMPLE

Aconstructionprojectonacollegecampuswillresultinanewstudentcenteranda
newstormwaterinfrastructuresuchasdrainagepipesandaretentionpond.The
infrastructurewillservethenewbuildingaswellasotherbuildingsoncampus.Itis
attheprojectteamsdiscretiontoincludethisinfrastructureintheirLEEDproject
boundaryornot.However,ifitisincludeditmustbeincludedconsistentlyforall
applicableprerequisitesandattemptedcredits.

Determiningcompliancewithfluctuatingoccupancyrates
AllbuildingsexceptforhotelsareconsideredtobeincompliancewiththisMPRifmore
than50%ofitsfloorareaisfullyoccupied(i.e.,inastateoftypicalphysicaloccupancy),as
timeaveragedovertheperformanceperiodforallprerequisitesandattemptedcredits,
includingthe12monthsleadinguptotheinitialsubmittalofapplicationforreview.The
thresholdforhotelsis55%.

EXAMPLE
Ahotelhas100equallysizedrooms,andnocommonspaceasidefromasmalllobby.
Sincethehotelwasbuilt,sixtyoftheroomshavebeenfullasanannualaverage,taking
intoaccountallseasons.Therefore,itisconsideredtobeincompliancewiththisMPR
becausesixtyexceedstheminimumthresholdof55%.
EXAMPLE
Thereisaschoolwithnineequallysizedclassrooms,andcirculationspaceequaltothe
squarefootageofoneclassroom.Fouroftheclassroomsarenotbeingused,butthe
otherfivearebeingfullyused.Therefore,occupancyfortheentirebuildingisat60%.If
attendanceinthethreeoftheclassroomsdropsto50%each,thenoccupancyforthe
entirebuildingdropsto45%,andcompliancewiththisMPRisinquestion.

includes supplying information on a regular basis in a free, accessible, and secure
online tool or, if necessary, taking any action to authorize the collection of
informationdirectlyfromserviceorutilityproviders.Thiscommitmentmustcarry
forwardifthebuildingorspacechangesownershiporlessee.

INTENT:
ThegoalofdecreasedenergyandwateruseconsumptionisamajorcomponentofLEED
