Whereas, substances containing methylone, rnephcdrone, methoxymethcathinone,
flurororcthcathinonc or rnethylencdioxypyrovalcrone (MDPV, collectively "bath salts", <1re being used as
recreational drugs producing i "high" sirilJr to COGline and rneth<lnlphcliltlline; and,
Whereas, substances containing HU-21 a (molecular structure very similar to THO CP 47,497 and
JWH-018 (1-Pentyl-3-(1-naphthoyllindolc) known as the combination of herbs mixed with a lab
produced strain of marijuana is usually nlilrketed as K2, Spice, JWH-018 or incense are being lIsed as
recreationill drugs prodUCing a "high" similar tocann<lbis; ,md,
Whereas, b<lnning the lISC, purchase, sale or posseSSion of bath S<lits ilnd synthelic m<lrijuana will
help prevcnt drug lise and drug related crimes in the City of Columbia promoting the public health,
welfare, safety and general welfare of all citizens; NOW, THEREFORE,
BE IT ORDAINED by the Mayor ilnd Council this 27th day of September, 2011 that the 1998
Code of Ordinances of The City of Columbia, South Carolina, Chapter 14, Offenses and Miscellaneous
Provisions, is ilmended add Article XI to read as follows:
ARTICLE XI. "BATH SALTS" AND SYNTHETIC MARIJUANA
Sec. 14-311. Definitions.
As used in this article, the following term shall have thcllleaning indiciltcd in this section:
Methylone, mephedrone, methylmethcathinone, f/uoromelhcathinonc or methylcn diox)yrovaleron
(MDPv, collectively "bath sails" shilll meiln any milteriill, compound, mixture, or prepariltion, whether
produced directly or indirectly from ( substilnce of vegetable origin or independently by means of
chemical syntheSiS or by a corbinilt ion of extract ion ilnd chemical synthesis, that contains any qlJ;}ntity of
the following substances, or 1h,lt contains any of t he following substances' iln.110gs, 5,1t5, isomers, ilnc

salts
of isomers when the existence of the analogs, salts, isomers, ,md salts of isomers is pOSSible within the
speCific chemic.11 designation: mcthylone, mephedrone, rethoxymet hc.1thinonc, llurororethcathinone
or methylenedioxypyrovillerone (MDPV).
SynthetiC marijuana shall mean and refer to all chemicill compounds intended to replicate, mimic or
cause a simil;}r reaction to the effects of lllariJ<lr1il or c.1nnabis. Such compounds are known or
marketed under such names CIS THe. HLJ.21 0 Cannabicyclohexanol, JWH-018, JvVH-073, K2, Spice,
herbill incense, herbal smoking blends, Clnd other n,unes. Further, sylhetic marijuana Sh,ll1 be
considered an illegal narcotic as flirt her provided in the Columbia CityCodc.
Sec. 14312. Possession, distribution or consumption of methylone, mephedrone. methyllllelhcathinone,
fluoromethcathinone or methylen edioxYP)rov(!leron (MDPV), collectivel)

It is unlawful for a person to use, offer for use, purchilse, offer to pLrchilse, sell, offer to sell, or possess
synthetic marijuana bath salts unless prescribed by a licensed physici<n. Licensed health care providers,
pharmacists and medical or ph<rrnaceutical research facilities<tre exempted from the prohibitions against
using, possessing, selling or purch<sing bath s<tlts when used, purchased, sold or possessed for p<tient
treatment or medical or pharrnaceutical research.
Sec. 14313. Advertisement, sale, and usc prohibited.
The advertisement, sale and use of synthetic Jll<lriju<tn<l and bath salts is prohibited within the City of
Col umbia.
Sec. 14314. Penalty.
Any person who violates <lny provision of this Chilplcr for which no penalty is otherwise applicable or
provided shall be subject to the pCllillty provisions of section '-5.
