Q. No. 1: - Have you heard and understand the prosecution’s

evidence recorded in your presence?
Ans. Yes.
Q. No. 2: - It is in the evidence that Rafique and Mazhar were
having illicit liaison relation with Mumtaz Mai daughter
of Qadir Bakhsh and Shehnaz Mai daughter of Shafi?
Ans. It is incorrect.
Q. No. 3: - It is in the evidence that Muhammad Afzal deceased
was restraining the Rafique and Mazhar to visit Mumtaz
Mai and Shehnaz Mai?
Ans. It is incorrect.
Q. No. 4: - It is in the evidence that you along-with Muhammad
Shafi, Muhammad Rafique, Zaffar Iqbal, Allah Yar and
Mazhar Abbas committed the murder of Afzal
deceased?
Ans. It is incorrect. The investigation officer was mislead and
misguided by the Ashiq son of Qadir Bakhsh, Ansar S/o
Gul Muhammad, Gul Muhammad S/o Allah Yar, Javed
S/o Gul Muhammad, Muhammad Ashraf S/o Elahi
Bakhsh & Muhammad Akram S/o Wahid Bakhsh except
the version of investigation officer, there is no evidence
against me on the file. When the police was not going to
challan the real culprits nominated in the F.I.R. then the
complainant Muhammad Shehbaz filed a complaint
against Ashiq Muhammad S/o Qadir Bakhsh,
Muhammad Ansar S/o Gul Muhammad, Gul
Muhammad S/o Allah Yar, Javed S/o Gul Muhammad,
Muhammad Ashraf S/o Elahi Bakhsh & Muhammad
Akram S/o Wahid Bakhsh. It is pertinent to point out
that during the investigation conducted by Masood
Ahmad S.I., it was proved that Muhammad Ansar
 (accused nominated in F.I.R.) had a fight prior to the
occurrence with Afzal deceased and Ansar accused was
injured by the younger brother of Afzal deceased
namely Iqbal, with the ulterior motive and malafide
intention the case was not properly investigated. Even
the blood-stained shirt of Afzal deceased was produced
by the Gul Muhammad nominated accused before the
complainant Muhammad Shehbaz.
Q. No. 5: - What do you say about the reports of Chemical
Examiners and Serologist?
Ans. These report have no concern with me.
Q. No. 6: - Why the P.W.’s deposed against you?
Ans. No P.W. had made any statement or any episode of
evidence against me. All the P.W.’s involved Ashiq
Muhammad, Muhammad Ansar, Gul Muhammad,
Javed, Muhammad Ashraf & Muhammad Akram. Only
the Investigation officer tried to involve me and
Muhammad Rafique, Mazhar Abbas, Zaffar Iqbal,
Muhammad Shafi & Zaffar Iqbal on the behest of Ansar
etc.
Q. No. 7: - Do you want to say anything more?
Ans. I am innocent and involved in this case falsely due to
the party friction and political rivalry in the area. The
complainant nominated in the F.I.R. Ansar etc. as the
real culprits when the police became the partisan with
the Ansar etc. then the complainant Muhammad
Shehbaz filed a complaint against Muhammad Ansar
etc. It is pertinent to point out when Allah Yar, Zaffar
and Muhammad Shafi were arrested by the police, the
complainant filed a habeas petition against the police
and made a clear statement before the Hon’ble Court
that these persons are not the real culprits.
