Shahid, Manager Commercial Billing, Sui Southern Gas Company Limited Civic Centre, Karachi..Contemnor APPLICATION UNDER SECTION 3-5 OF THE CONTEMPT OF COURT ORDINANCE, 2003 READ WITH SECTION 3/4 CONTEMPT OF COURT ACT 1976. Respectfully sheweth:
1.

That the plaintiff filed the above suit in this Honourable Court wherein both the parties have settled their dispute on the terms that the plaintiff shall pay the disputed amount in easy installments at Rs.30,000/- per month along with current bills regularly without any default and this Honourable Court was pleased to passed an order dated 15-11-2010 allowed the plaintiff to pay the disputed amount at the rate of Rs.30,000/- per month on or before the 10th of every calendar month. After passing of the order dated 15-11-2010 the plaintiff was/is paying the monthly installments along with current bills regularly but now the contemnor refused to comply with the order dated 15-11-2010 and refused to issue bill as per order of this court. The contemnor always issued bill with total arrears/outstanding and not in accordance with the order of this Honourable Court.

Copy of the paid bill for the month of July, 2011 and the bill issued showing the total outstanding are attached and marked A/1 & A/2 respectively.

The contemnor has no respect for the order of this court and he deliberately disobeys the order of this Honourable court by not issuing bill in accordance with the order of this Honourable Court.

3.

That the intention of the contemnor is that to show the plaintiff as defaulter and to disconnect the gas connection which will cause serious mental torture to the plaintiff and would cause tremendous loss.

4.

That on the face of it the intention of the contemnor is malicious and spiteful and he is deliberately disobeying and disregarding the order of this Honourable Court which clearly shows contemnors disrespect to this Honourable Court and for the order passed by this Honourable Court.

5.

That the contemnor has deliberately and willfully disobeyed and ridiculed the order of this Honourable Court thereby committing gross contempt of Court and has thus rendered himself to be punished in the interest of justice. It is, therefore prayed that this Honourable Court may be pleased to

take appropriate action against the contemnor for contempt of Court by detaining him in prison and also saddling him with fine till he obeys the order of this Honourable Court.

AFFIDAVIT
I, Muhammad Imran son of _________________, Muslim, adult, resident of Karachi, do hereby state on oath as under:

That I am the plaintiff in the above case and am well conversant with the facts.

2.

That the contents of the accompanying application are correct and true and I pray that for the sake of brevity the same be treated and read as part and parcel of this affidavit.

3.

That the defendant/contemnor has willfully disobeyed and disregarded the order of this Honourable Court dated 15-11-2010 thereby committed gross contempt of Court and he is liable to be proceeded against accordingly.

4.

That unless the application is allowed I, shall suffer irreparable loss.

5.

That what is stated above is correct and true.
