If I voluntarily demote to a Permanent Intermittent Correctional Officer (PI CO), will I be eligible fora Permanent Full Time (PFT) position in a future wave? Yes. Note, however, that employees may move only one (I) time within a single wave. Can an employee that is currently under investigation, had an adverse action in the last three years, or has an overall sub-standard performance evaluation in the last 12 months transfer? Yes. Can an employee on probation or the apprenticeship program transfer? Yes, but the employee will be required to complete probation/program at the new institution. Can I submit a lateral transfer package to an institution not listed in this Transfer process? Lateral transfers pursuant to the contract are suspended during this Realignment process. If I volunteer to transfer or choose to demote will I be protected from any further layoff process? The First Opportunity-Voluntary Transfer Process, the Second Opportunity-OTAP/PICO Walk-Up Bid and the Third Opportunity-Statewide Bid are each designed to provide employees with the opportunity to protect themselves against layoff. Employees are empowered with information regarding their seniority scores, the amount of institutional overages and the amount of institutional vacancies, so that each person can analyze where and whether slhe should move (taking into account hislher seniority and whether a county is more or less likely to be impacted ultimately). If an employee moves to a location with a number of vacancies in a county where there are no overages, it is unlikely that s/he will be impacted by a layoff (as that county will not likely be in a layoff mode). Similarly, if a person with sufficient seniority takes anOTAPIPICO position, it is likely that employee will have mitigated layoff in an impacted county. However, there are no guarantees in this process. Depending upon demotional bumping and one's seniority score within an impacted county, an employee with low seniority within that county theoretically still could be laid off at the conclusion of the SROAJlayoff process andlor permanently involuntarily transferred.

Will previously scheduled vacations be honored at the new institution? No. Staff will need to apply for vacation time at their new institution. If I elect not to participate in the process and I am a Limited-Term CCI or Sergeant, will I still have return rights to my previous classification? Yes, this process does not change the current rules for limited-term employees. This process provides an option for those that may be impacted in the Realignment/layoff process. Limited-Term positions are considered vacancies and open for placements.
