REPUBLIC OF THE PHILIPPINES ) CITY OF VALENZUELA ) S.c. AFFIDAVIT OF ADVERSE CLAIM I, MARCO P.

DARLUCIO, of legal age, Filipino, and resident of 39 Atis St, Malinta Valenzuela City, under oath, depose and state that : On August 20, 2008, I entered into a Deed of Absolute Sale with Spouses Paolo Rozul and Abigail Rozul, both Filipinos and residents of 69 Sampaguita Street, Hacienda Village, Valenzuela City over a parcel of land located at Farmville Subdivision Valenzuela City, covered by TCT No. T45623.

2. In the process of transferring the ownership of the abovementioned property, I undertook the payment of the necessary taxes with the Bureau of Internal Revenue. Since I will need the Owners Duplicate of said TCT No. T-45623 to surrender the same the appropriate government agency and complete the process of transfer of ownership, we sought the same from the seller, the Spouses Rozul, who then handed me the said Owners Duplicate certificate of title. I then proceeded to the Valenzuela Register of Deeds to submit the Owners Duplicate title together with other documents.

I was then informed by the Register of Deeds that the Owners Duplicate of TCT No. T-45623 I had in custody is a false and unlawful copy of the original.

The basis for this declaration coming from the Register of Deeds was the fact that the original copy of TCT No. T-45623 does not resemble the certificate of title provided to us by the sellers, Spouses Rozul. On account of the foregoing circumstances, I am apprehensive and fearful that the amount paid for the property covered by TCT No. T-45623 may be lost. I am constrained to resort, declare and protect my rights to the property covered by the said certificate of title.

7. I am executing this Affidavit for purposes of attesting the truth thereof and to seek annotation of said Affidavit as an adverse Claim upon TCT No. T-45623. AFFIANT FURTHER SAYETH NAUGHT.
