Happy Thanksgiving and New Changes by Martin Flowers With the Holiday season right around the corner we would like to wish you a happy Thanksgiving from the Kendall Weekly Times and to introduce some new features we have implemented for better service to you our valued subscriber. In the past few weeks we have welcomed some new faces who have joined the Kendall Weekly Times Pat Gavros , Nadia Khani, and Glen Busch to the staff: Pat Gavros comes to the Kendall Weekly Times having been a published author, writing for local publications like the Voice, The Patch Network, and the Oswego Ledger. Pat is active in the local community and has previously organized a shoe memorial for 911 and is currently working on a correspondence program for our Veterans. Pat Resides in Oswego and is Owner of Branthony Publishing. Nadia Khani Nadia has spent many years writing and contributing to local news sources and blogs. Nadia is active in helping to serve the Aurora Interfaith Food Pantry and is accomplished in marketing and graphic

design. Nadia resides in Aurora and is mother to two grown sons who attend Northern Illinois University. Glen Bush Glen is a captain with the Hillside Berkley Fire department and is an avid sports fan. Glen touts be a Cubs fan but will remain in partial when it comes to the writing he promises. Glen has been instrumental in helping to organize ad coordinate at program with Bristol Bay Elementary school and the Troops serving overseas. Glen and the Kids at Bristol bay have participated in a letter writing campaign and Skype session to help support the Troops. Glen resides in Yorkville with his wife and family. We welcome them to the Kendall Weekly Times News Family. Decidedly Different Film-Going with a Twist in established Naperville/Aurora Theater! By Phil Blacklaw One can concede that popcorn and candy in a cinema can be quite blas after a while. Especially when an alternative exists with a restaurants breadth of food to partake of, or to relax in a theater with martini in hand. This singular treatand the treat of seeing luminary actors from across the decadesis fostered by Hollywood Palms Cinema. Featuring regular celebrities introducing their respective films....Tipi Hedren for The Birds, Rita Moreno for West Side Storymay seem to be a film enthusiasts dream incarnate. As such, publicity manager Angelique Barthels assertion that its the ultimate movie-going experience does not seem like hyperbole. When walking into the theaters atrium, its departure from traditional cinemas is stark. Faux ruins stretch to the ceiling, with palm trees, other exotic foliage, two waterfalls and a huge miscellany of vintage posters dating back to the silent era. From the outset, you know (to quote film canon) that you certainly are not in Kansas anymore. Although the Palms opened in 09, a sister location in Woodridge preceded it in 2003 (named the Hollywood Boulevard Cinema Bar & Eatery). Barthel says both theaters feature seat service from a full bar & menu, comfortable chairs, first run movies, classic movies series and the chance to meet your favorite celebrities. Here we are on the cusp of the holidays three long years into the Great Recession. The Super Committee wasn't able to come to an agreement on how to cut the deficit by $1.2 trillion dollars over ten years which shouldn't come as a surprise to anyone paying attention to politics for the last year. Sadly the Republican members of the Super Committee seem to have misunderstood their purpose was to help lower deficits not explode them. What else explains their offer to close $250 billion worth of tax loopholes in trade for a permanent extension of the Bush tax cuts which would add $4 trillion dollars to the debt over ten years? Regardless of who you think is responsible for the lack of a deal, or even whether focusing on debt reduction in the face of a financial crisis is a good idea in the first place, the American economy is stuck for the time being with $600 billion dollars worth of Dept of Defense spending cuts and a 2% across the board reimbursement cuts to Medicare providers over the next ten years. I say "for the time being" because already some Republican senators are trying to quash those DOD cuts and in reality no congress

Maybe I'm too pessimistic but I don't see the Republican party agreeing to extend those unemployment benefits and middle class tax cuts in the next few weeks and their support for anything else that might spur growth is nonexistent. With the Federal Reserve announcing another round of stress tests for big American banks exposed to what might be a break up of the Euro Zone next year that just might result in a depression in Europe things look pretty bleak for our economy as well. Which brings to me to subject at hand. What can we as individuals do about it? It's obvious until after next year's election there's not a whole lot we can do politically and as President Obama says we can't

From Oswego to Springfield, Illinois Institutes Day for Diabetes Awareness By Nadia R. Kanhai

Diabetes is a disease that affects nearly 10 percent of the residents of Illinois, said Cross. It not only affects those residents, but also their family and friends. Creating more awareness about this important issue will help others better recognize the signs of diabetes and hopefully lead to better treatment options.

Diabetes Awareness Day is observed all over the world, but this month, the awareness campaign grows roots in Oswego and all of Illinois.

Montgomery resident Martin Flowers helped push HR 557 to its unanimous adoption in the Illinois House of Representatives.

The importance of diabetes awareness can have a profound impact if we can reach just a few people to get them on track to a proper diagnosis, added Chapa LaVia. A proper diagnosis can lead to appropriate treatments that could not only improve our residents livesit may even save a life.

November 14, 2011, Illinois celebrated its first official Diabetes Awareness Day, with a ceremony at Oswego Public Library, featuring Reps. Tom Cross (R), Pam Roth (R), and Linda Chapa LaVia (D), as well as local officials, the American Diabetes Association, and local residents, including Martin Flowers.

Ghost Railroads Pardon the history lesson ,but did you know what an interesting variety of railroads helped the Chicago land area into the megalopolis it is today? Although some of the lines may have changed names, and not all of them are still in business, together they made Chicago into the rail center of the nation: a fact thats still true today. It takes a little looking to find evidence of what came before when it comes to rails that once crises-crossed the Aurora area. Not many people know, for instance, the birthplace of todays BNSF railroad was in Aurora .Indeed, the Aurora Branch railroad was genesis of the Burlington and Quincy ,known as CB and Q or just Q . The BNSF came later. Portions of the Aurora Branchs first line connecting it with the Chicago and Galena Union {now Union Pacific} at Turner Junction {now West Chicago} are still in use. And, over time, the Aurora Branch Railroad became CBand Q ,yet its shops remained in Aurora, playing an important role in

The Aurora Shops built early steam locomotives and rolling stock. Several examples of their homemade wooden cabooses are preserved around Kane and Kendall Countys. Also the shops claim credit for constructing the first car dome there. A sizeable percentage of the population in and around Aurora found employment with the Q, and being the first railroad in the area, most local industries became customers. Today nearly all of those industries are gone, however, part of the Qs shops complex still stands, used a commuter station and brewpub. Some of its History lives on throughout the place. Fewer people are still aware that the three other major railroads had a presence in the local area. It takes a lot of looking to find any remnants of the following three. The Chicago and Northwestern Railroad {now union Pacific} had tracks running west of the Fox River ,entering Aurora from the north end .Meanwhile ,the Elgin,Joliet,and Eastern {now Canadian National} around Rathbone Ave near the Aurora Montgomery border . Portions of both those railroads live on today as the Virgil Gilman Nature Trail. Travel by train was the norm many years back, with the previously mentioned railroads offering passengers services at one time or another. From Aurora, you could go just about anywhere by train, including every town in the surrounding countryside.

No less than interurban trolley lines to and from Aurora existed less than a century ago! There was the Aurora Elgin and Fox River Electric, Aurora Plainfield and Joliet , The Chicago Aurora and DeKalb, the Aurora Yorkville and Morris ,and the largest most successful of this long extinct bunch , the Chicago Aurora and Elgin. Part of the Roarin Elgin as the CAandE was known locally ,survives ad a bike trail ,too. The rest of Auroras interurban were ill-conceived, cheaply constructed lines that never developed sufficient business to survive. Now, as remnants of extinct railroads fade into oblivion ,a few of us continue trying to decipher their fascinating story. Theyre our ghosts!

Side Bar with Craig Cunngham Attorney At Law Child custody- the term conjures the clarion call of war. The custody battle creates the metaphor of family vs. family in a bitter fight to determine who will cause the most hurt from one another. Child Custody litigation brings issues to the forefront within the family dynamic that constitute the pain, the emotion, and the gut wrenching entanglement that permeates the depths of the inner soul. Child custody litigation is not for the faint at heart. I am a practicing attorney in the child custody litigation realm. Child Custody litigation requires that attorneys exemplify endurance, compassion, and an indepth understanding of human nature. Many factors go into the decision whether to begin child custody litigation. Illinois law provides for different variations of custody. Illinois provides for joint custody, but within joint custody, there is the separation of the residential parent and the non residential parent. This means that someone will be designated as the residential parent, and that is the place that the child will spend most of her time. The non residential parent typically pays child support to the non residential parent. However, both parents may have joint custody at law. Joint custody provides that the parents must agree and consult one another in the three areas at law; (a) health and access to health care; (b) religion and decisions related to religious education, and (c) education, which covers where the child

will attend school, and access to the childs records. One of the primary issues related to child custody litigation is whether to petition the Court to appoint a Guardian Ad Litem (GAL). The GAL brings many factors into the litigation, but allows for the opportunity of a third party to independently review the specific homes, and to help make the appropriate recommendation before the Judge, as to the appropriateness of which home shall have custody of the child. Often litigants overlook the benefits and the disadvantages related specifically to the conciliation and mediation aspects of Illinois law. The legislature codified the mediation statute at 750 ILCS 5/404, which states in pertinent part, (a) If the court concludes that there is a prospect of reconciliation, the court, at the request of either party, or on its own motion, may order a conciliation conference. The conciliation conference and counseling shall take place at the established court conciliation service of that judicial district or at any similar service or facility where no court conciliation service has been established. (b) The facts adduced at any conciliation conference resulting from a referral hereunder, shall not be considered in the adjudication of a pending or subsequent action, nor shall any report resulting from such conference become part of the record of the case unless the parties have stipulated in writing to the contrary. (West Publishing, 2011).

The Court ordered conciliation, though, is very different and not to be confused with the Mandatory form of Mediation established through Illinois Supreme Court 905. However, the 750 ILCS 5/404 rule does provide for the opportunity for the parties to enter into a less expensive form of custody litigation in which they might anticipate a third party to assist them to a conciliatory conclusion to their pending issues. The 750 ILCS 5/404 provision allows for domestic relations to be a more civil and amicable frame of collaborative divorce procedures that many have requested within the specific system of Illinois. The Court can provide assistance to litigants in making the child support litigation a less painful process, but the litigants have to want it. In the experience of this specific family law trial attorney, the litigants does not want this to be a less painful process, but instead want the litigation to be most painful, medieval , tortuous form of revenge they can conjure. Often litigants require vengeance against the other party rather than the resolution of the issues that brought the parties to the courtroom in the first place. Litigants murder the civility that should saturate civil litigation. I am encouraging a dialogue with others in the child

custody and family litigation community. I specifically want to know how many people have experienced the lack of civility within the civil litigation context, and I would like to know more about peoples experience within the mediation context that Illinois Supreme Court Rule 905, and the Supreme Court Rule 900 Series dictates. Illlinois Supreme Court Rule 905 states in pertinent part, (a) Each judicial circuit shall establish a program to provide mediation for cases involving the custody of a child or visitation issues (whether or not the parties have been married). In addition to the minimum requirements set forth in subparagraph (b)(2) of Rule 99, local circuit court rules for mediation in child custody and visitation cases shall address: (i) mandatory training for mediators; (ii) limitation of the mediation program to child custody and visitation issues; (iii) (unless otherwise provided for in this article) standards to determine which child custody and visitation issues should be referred to mediation and the time for referral, and (iv) excuse from referral to mediation if the court determines an impediment to mediation exists. The immunity and approval requirements of subparagraph (b)(1) of Rule 99 shall apply to mediation programs for child custody and

visitation matters. (West Publishing, 2011). Therefore, the mediation program works towards litigants solving their questions. Litigants must be aware of the benefits of the program. The litigants must realize this is the point at which they should address all questions, all issues related to the problems of both parties parenting their children. The litigants must embrace the task of performing the resolution towards a parenting agreement. The mediation rules provide for the resolution of the parenting agreement, but litigants prevent this resolution. The next series in this article shall provide litigants with tools on reaching this resolution, and providing for more successful and efficient litigation.

10th Time is the Charm for All Around Towne Holiday Faire By Nadia R. Kanhai Are you ready for the holidays? On Saturday, Nov. 5, visitors to Jan DuRalls th 10 annual All Around Towne Holiday Faire donated an estimated 900 food items to Aurora Interfaith Food Pantry during some festive shopping with friends and family. Beginning with a donation of food or funds, guests then browsed through a wide selection of local vendors wares, as they sought unique and useful holiday gift items. I have a great selection of vendors, said DuRall. Some have been with me for 10 years. DuRall birthed and nurtured the event as a way of giving back to her community. Now, she is handing the event over to her daughter and the Fox Valley Montessori School for 2012. Many of the students were present on Saturday, helping with the faire and livening visitors spirits with their energy and excitement. While holding the All around Towne Holiday Faire, DuRall was also hosting a scrapbooking event at the Hampton Inn & Suites in Aurora. Scrapbookers sat engrossed in their craft, happily cutting, pasting, and creating. The event runs Thursday through Sunday, so it keeps DuRall and her guests busy. DuRall has been scrapbooking and leading events throughout the country since 1986. While hosting the All Around Towne Holiday

Faire, she also hosted 28 scrap bookers. This years vendors came from the communities of Rochelle, Yorkville, Homer Glen, North Aurora, and Batavia. These vendors offered handmade and specialty gift items for children and adults, ranging from sweets to nutrition counseling and therapy, soaps to kitchen gadgets and cosmetics. MSG Grisham showed the students some of their letters hanging on the wall behind him as well as an Afghan headdress he received while over there. He thanked them all and their teachers for the care packages on behalf of the other soldiers as well. These soldiers were located in a remote portion of the country and had no ability or opportunity to communicate with the kids. He told them how difficult it was at times to find snacks, drink mixes, toothpaste and the like some 10,000 miles from home and how much their gifts meant to the soldiers who were also missing their homes and families. The students were very happy they had the opportunity to write to the soldiers. It means that we love them said one 1st grader who took part in the project. They are protecting us and we told them thank you. The 504th is in the middle of their deployment to the Afghan region and their return date back home has not been released.

Yorkville, IL: Students at Bristol Bay Elementary school made a phone call yesterday, but not like most phone calls. The students were given an opportunity to speak with MSG CJ Grisham who is currently stationed in Afghanistan via Skype. The Skype call was part of a larger school project which included sending care packages and letters to the soldiers of the 504th BfSB last month. The students, ages 6-12 were able to ask MSG Grisham about Army life, like food, work schedule and what Afghanistan was like. MSG Grisham told the students how he missed TV commercials for Pizza Hut and his home in Texas. When a student asked the 17 year veteran what his favorite food was, MSG Grisham replied Tacos!; which brought the students to roaring laughter. While some questions focused on combat and the war, overwhelmingly most students were more interested in the soldiers sleeping in transport containers,
