08 December 2011 IUU ALERT Kum Myeong 2 involved in IUU fishing in Sierra Leone Summary: The Environmental Justice Foundation (EJF) is working in collaboration with the Sierra Leone Government to address Illegal Unreported and Unregulated (IUU) fishing within their waters. EJF operates a community surveillance boat in Sierra Leone. Following a call from a local fisherman on 7th December 2011, EJF staff members travelled to the Sherbro River entrance where they observed the Kum Myeong 2 engaging in IUU fishing in the Inshore Exclusion Zone (IEZ). Identity, ownership and activities of the vessel The vessel was identified as the Kum Myeong 2 by comparing the EJF images with photos taken of the vessel in Las Palmas de Gran Canaria (see Appendix A). Photographs of the vessel are attached as Appendix A. A map detailing the vessels GPS position is attached as Appendix B. Legal basis for assertion that the vessels fishing activities constitute IUU fishing Illegal fishing is defined by Article 2(1)(a) of the EU IUU regulations as being where fishing activities are conducted by national or foreign fishing vessels in maritime waters under the jurisdiction of a State, without permission of that State, or in contravention of its laws and regulations. Recommendations to Sierra Leone Government EJF recommends that the following steps be taken: 1. 2. 3. That the Government obtains the Kum Myeong 2s Vessel Monitoring System (VMS) data in order to verify its position at the time it was observed and during other periods of fishing; and That the Government investigates the activities of the Kum Myeong 2 with a view to bringing legal proceedings against the vessels operators; and That the vessels Flag State be informed of its activities.

Recommendations to EU Member States EJF recommends that the following steps be taken: 1. 2. 3. 4. That the Kum Myeong 2s cargo is tracked and its potential entry into European markets prevented; and That the Kum Myeong 2 be investigated for possible inclusion in the European Community IUU Vessel List; and That the vessels crew be investigated and any national of an EU Member State identified, and that appropriate action be taken against such nationals; That any legal persons that may have assisted the vessels IUU operations be identified and appropriate action be taken against them.
