1 Rambus Inc.’s Daubert motion number 3 to preclude the Manufacturers’ damages


2 experts from relying on the certain agreements and negotiations, and to preclude W. Christopher
3 Bakewell from offering certain newly-formed opinions at trial came on for hearing on December
4 2, 2008.
5 Having read and considered all of the pleadings and documents filed in support of
6 and in opposition to Rambus’s motion, and having heard and considered the arguments of
7 counsel, the Court hereby grants Rambus’s motion as follows:

9 1. The Manufacturers’ damages experts may not rely at trial on the 2001
10 Amendment No. 1 to the Rambus-Samsung SDR/DDR IC and SDR/DDR Memory Module
11 Patent License Agreement, the 2002 Rambus-Mitsubishi Interim Agreement, the 2004
12 Amendment No. 2 to the Rambus-Elpida Patent License Agreement, the 2005 Infineon
13 Settlement and License Agreement, the 2005 Samsung offers and counteroffers, or any
14 negotiations pertaining to any of the aforementioned agreements in support of their opinions
15 regarding a reasonable royalty.
16 2. W. Christopher Bakewell is precluded from testifying at trial that the
17 appropriate royalty rate for Rambus’s technology is 0.75%.
