PAKISTAN THE FACTORIES ACT: 1934

Short title, extent and commencement: This Act may be called as Factories Act: 1934, It extend for st whole Pakistan and it will come into force on 1 day of January 1935. Definitions: In this Act, Adolescent means a person who has completed his age fifteenth year but has not completed his seventeenth year. Adult means a person who has completed his seventeenth year age. Child means a person who has not completed his seventeenth year. Day means a period of twenty four hours which starts at Mid-night. Week means a period of seven days which starts at Mid-night on Saturday. Power means electrical energy or other energy which is mechanically transmitted and is not generated by human or animal agency. Manufacturing process means any process for making, repairing, finishing, packaging or treating any substance with a view to use, sale, deliver and dispose it or for pumping oil, water and sewerage or for generating, transforming and transmitting power. Worker means any person who directly or indirectly involved in manufacturing process and the person who is not involved in manufacturing process or who is work as a clerk not to be a worker. Factory means a premise or place where ten or more workers are working and where the manufacturing process being carried out. Machinery means contains all plants whereby power is generated, transforming and transmitted or use it. Occupier of a factory means the person or agent who has final control over the affairs of the factory. Shift means where two or more workers carried on same kind of work during the different periods of the work. Prescribed means prescribed by rules made by the Provincial Government under this Act. Reference to time of day: Time means references to standard time which is five hour ahead from Greenwich Means Time (GMT). Seasonal factories: A factory which is completely engaged in one or more of the following manufacturing process namely cotton ginning, cotton or cotton jute pressing, the decortications of groundnuts, the manufacture of coffee indigo, lac, rubber, sugar (including gur) or tea or any of the aforesaid processes, is a seasonal factory. The factory in which manufacturing process is carried on for one hundred and eighty working days in the year and cannot be carried on except during particular season is also called seasonal factory.

Power to apply provisions applicable to factories to certain other places: The Provincial Government may, by notification in Official Gazette, announce that all or any of the provisions of this Act applicable to factories shall apply to any place wherein a manufacturing process is being carried on or is generally carried on whether with or without the use of power whenever five or more workers are working therein or have worked therein on any one day of the twelve months immediately preceding. Power to declare departments to be separate factories: The Provincial Government may, by order in writing, any department or branch of a factory will be treated as a separate factory. Power to exempt on a change in the factory: The Provincial Government may by order in writing, free such factory from operation of this Act in which an occupier is change or any change in the manufacturing process of the factory or to change the numbers of workers are less than twenty in the factory. Power to exempt during public emergency: The Provincial Government may, by notification in the Official Gazette free any factory from any or all of the provision of this Act during the public emergency. Notice to Inspector before commencement of work: Before starting the factory after commencement of this Act the occupier shall send the notification to Inspector containing: The name and the place of the factory. The addresses from which the communication can be occur. The nature of the manufacturing process carried on in the factory. The name of the manager appointed by the occupier. Such other particulars for the purpose of this Act. This notice send to the inspector by occupier within 30 days of beginning of this Act. When other person appointed as a manager the manager shall send to the written notice within the seven days. If during any period the manager cannot manage the factory and also have no other person available to act as a manager then occupier himself act as a manager. Inspectors: The Provincial Government may, by notification in the Official Gazette appointed a person as an inspector who will be considered as fit for this act, and also can appointed a chief inspector. The person will not be considered as an inspector which will be directly or indirectly interested in factory or manufacturing process. Every district Magistrate shall be an inspector for his district. The Provincial Government also can appoint a public officer as an additional inspector. Every inspector and chief inspector shall be considered as a public servant. Powers of Inspector: In behalf of this Act an inspector may within the local limits entre with such assistants if any, being persons in the service of the state or of any municipal or other public authority, as he thinks fit. Any place which he thinks fit used as a factory or capable of being declared to be a factory. Make such examination of premises and plants which may deem required carrying out the purpose of this Act. Also use other powers which are necessary for carrying out the purpose of this Act. Certifying surgeons: The Provincial Government may appoint a certifying Surgeon for the purpose of this Act, Certifying surgeon may authorize any registered medical practitioner to use his power under this Act. "Registered medical practitioner" means any person registered under any Act of the Central Legislature or any Provincial Legislature.

A certificate of fitness issue by such authorized practitioner is valid for three month after this period Certifying Surgeon himself confirmed it. Cleanliness: Every Factory shall be kept clean and free from any drain and other nuisance and particularly: Dirt and refuse shall be removed daily by sweeping. Every work room shall be cleaned at least once a week by washing. All walls, ceilings, partitions and top of rooms repainted and revarnished after every five years, also smooth hard surfaces shall be cleaned and whitewashing; color wash shall be carried out at least once in fourteen month.

Disposal of wastes and effluents: Valuable arrangement in every factory for the disposal of wastes during the manufacturing process. Ventilation and temperature: Provision shall be made for sufficient ventilation by the circulation of fresh air and also maintain the temperature of every workplace for the health of workers in the factory. Dust and fume: In every factory effective measurement to eliminate the dust and fume due to manufacturing process which is harmful for workers, also for any purpose combustion engine cannot be used unless the exhaust is conducted into open air and exhaust pipes are insulated to prevent scalding and radiation heat. Artificial humidification: If the humidity in the factories increased by artificially it shall be done under some rules i.e. set down and regulating standards of humidification test out to measure whether humidity of the air to be correct carried out. The water use for this purpose shall be purified. Overcrowding: Have no overcrowding in the factory. Every worker has at least three hundred and fifty cubic feet of space in existence on the date of commencement of Labor Law 1972 and at least five hundred cubic feet of space after the start of Labor Law 1972. Lighting: In every part of the factory sufficient and suitable lighting both natural and artificial shall be provided. Also precaution related to glare in every room of factory. Drinking Water: In every factory a suitable point shall be making for drinking water which is purified and renewal of water. Also mark Drinking Water in a language which is understandable by mostly workers. Latrines and urinals: In every factory should have separate latrines and urinals for male and female are situated which are easily access by all the workers.
