CALL TO ORDER At 4:00 p.m., Tuesday, October 11, 2011, Deputy Speaker Lorenzo R. Taada III called the session to order. NATIONAL ANTHEM AND PRAYER Pursuant to Section 72, Rule XI of the Rules of the House, the Members sang the National Anthem and thereafter, observed a minute of silent prayer. QUESTION OF PRIVILEGE OF REP. KHO (D.) Recognized by the Chair, Representative David L. Kho from Party-List Coalition of Senior Citizens in the Philippines Inc. spoke, in celebration of the International Week of the Elderly or Linggo ng Nakatatanda, about the senior citizens exclusive club which comprises seven million members who are educated, dedicated and well-experienced in their various advocacies and interest. He then focused his speech on the strict implementation of Republic Act No. 9994 such as: the putting up of senior citizens centers nationwide; establishment of livelihood training programs; medical and financial assistance to indigent senior citizens and their mandatory PhilHealth coverage; social enhancement and additional social pension coverage; and information and awareness drive on the rights of senior citizens. He thereafter disclosed that at least two of the more than a dozen bills they have sponsored have passed the committee level and subsequently sought the support of the Members on a bill which they have filed in partnership with the University of the Philippines Philippine General Hospital (UP PGH), seeking the establishment of an institute on aging research and development knowledge for senior citizens. REFERRAL OF REP. KHOS (D.) SPEECH On motion of Rep. Romero Federico Miro S. Quimbo, there being no objection, the Body referred the speech of Rep. Kho to the appropriate Committee.

RESUMPTION OF SESSION At 4:39 p.m., the session resumed. APPROVAL ON SECOND READING OF HOUSE BILL NO. 4667 On motion of Rep. Garin (J.), there being no objection, the Body voted on Second Reading House Bill No. 4667, entitled: AN ACT CREATING THE DEPARTMENT OF INFORMATION AND COMMUNICATIONS TECHNOLOGY, DEFINING ITS POWERS AND FUNCTIONS, APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES, as embodied in Committee Report No. 918 and reported out by the Committees on Government Reorganization, Information and Communications Technology and Appropriations. With a majority of the Members voting in the affirmative, the Body approved the same. ADOPTION OF HOUSE RESOLUTIONS CALENDARED UNDER THE BUSINESS FOR THE DAY Thereafter, on successive motions of Rep. With 268 Members responding to the Call, the Chair declared the presence of a quorum. (See Appendix 1) MANIFESTATION OF REP. MARIANO Upon recognition by the Chair, Rep. Rafael V. Mariano manifested his desire to rise on a question of personal and collective privilege. SUSPENSION OF SESSION On motion of Rep. Neptali M. Gonzales II, the session was suspended at 5:02 p.m. RESUMPTION OF SESSION The session resumed at 5:05 p.m. APPROVAL ON THIRD READING OF HOUSE BILL NO. 5023 With the indulgence of Rep. Mariano, on motion of Rep. Gonzales (N.), there being no objection, the Body proceeded to the approval on Third Reading of House Bill No. 5023, a certified urgent Bill, pursuant to Section 26(2), Article VI of the Constitution. Upon direction of the Chair, the Secretary General read the title of the Bill, to wit: AN ACT APPROPRIATING FUNDS FOR THE OPERATION OF THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES FROM JANUARY ONE TO DECEMBER THIRTY-ONE, TWO THOUSAND AND TWELVE, AND FOR OTHER PURPOSES. The Chair directed the Secretary General to call the Roll for nominal voting. Thereafter, pursuant to the Rules of the House, a second Roll Call was made. Datumanong voted no to House Bill No. 5023 and stated that he would submit in writing his explanation of vote, which the Chair noted; Rep. Emmi A. De Jesus voted no to House Bill No. 5023; Rep. Luzviminda C. Ilagan stated that Party-List Gabriela votes no to House Bill No. 5023 and reserved her right to explain her vote after the voting; Rep. The following Members explained their votes: 1. Rep. Emmi A. De Jesus explained in Filipino that she was against the measure because it supports the interest of local and foreign businessmen to the detriment of the social service sector and the thrust of generating jobs for the poor and marginalized sector. She noted that the huge amount of allocation for the PublicPrivate Partnership Program is intended for loan payments and support to the military, while the Conditional Cash Transfer Program is only a cover-up for other intentions in the guise of social service for the poor. Rep. Luzviminda C. Ilagan cast her negative vote and opined that the measure is antipeople because its expenditure program is a betrayal of the fundamental principles of good government and has failed to insulate the people from the impact of global economic crisis.

INQUIRY OF REP. LAGMAN Recognized by the Chair, Rep. Edcel C. Lagman inquired how his vote was recorded to which the Chair replied that it was recorded in the negative. EXPLANATION OF VOTES (Continuation) 3. Rep. Lagman initially reserved his right to submit in writing the explanation of his negative vote. He however underscored that the certification made by the President on October 10, 2011, on the urgency of House Bill No. 5023, was flawed because it did not comply with the clear and unequivocal conditions as provided for in Article VI, Section 26, (2) of the 1987 Constitution. He said that the Members should have waited for the number of days required by the Constitution before the Body voted on it on Third Reading. Rep. Teddy A. Casio voted no to the Bill not only because of the flawed process it had undergone but also of the flawed framework of doleouts, privatization, liberalization and prioritization of debt payments that have afflicted previ-

ous budgets and previous administrations. He said that he would have wanted a substantially bigger budget for the State universities and colleges (SUCs), hospitals and rural health units, slashed some CCT funds for the backlogs of basic education, nutrition program and regional health units and also slashed the budget for debt servicing and behest loans as he believes that the budget should be an instrument to fund adequate social services. 5. Rep. Maria Milagros Mitos H. Magsaysay voted no to the 2012 GAA because funds intended to build flood control and infrastructure projects have not been provided; the budgets for tertiary education scholarships, State universities and colleges (SUCs) and the TESDAs skills training program were either slashed or were not increased; and that her constituents deserve to benefit from the budget that Congress would pass. Rep. Rafael V. Mariano explained the socalled distorted priorities or 4Ds of the 2012 GAA: debt servicing; defense budget; dole outs in the form of CCT funds; and huge funds intended for the discretionary funds of the President. He then explained that he was voting in the negative to the 2012 GAA because the budget was not for reform, not for the people and not for development. Rep. Raymond V. Palatino explained his reasons for voting in the negative to the 2012 National Budget and claimed that it is a Budget that prioritizes appropriations to foreign debt, dole-out programs, bloated intelligence funds, while diminishing allocations for social services and fundamental needs of the people. Moreover, he pointed out that approving the 2012 National Budget, the House of Representatives would be merely kowtowing to the wishes of the Executive Department instead of exercising its constitutional duty to promote and advance the rights and welfare of the people. In explaining his no vote, Rep. Carlos M. Padilla maintained that in the budget message of President Aquino, the latter had put emphasis on transparency, accountability and participatory governance. He however stated that in the Presidents support to the approval of the

Budget, the House Members had been denied of their duty to propose amendments to the National Budget so that they could address the needs of the people. 9. Rep. Tobias Toby M. Tiangco, informed the Body of his predicament in voting on the 2012 National Budget, claiming that he was pressed for time to read 1,599 pages of the 2012 General Appropriations Act to make an informed decision within two hours. He maintained that it is his responsibility to his constituents to read the full contents of the 2011 GAB to determine the approved budgetary allocations that are due them and also to determine whether his proposed amendments, specifically to delete a particular budgetary allocation intended to benefit the Judiciary, Civil Service Commission, Commission on Audit, Comelec and the Office of the Ombudsman, had been implemented.

10. Rep. Antonio L. Tinio informed the Body that his proposed amendments to the 2012 National Budget had been incorporated in the measure, specifically the increase in the chalk allowance for teachers and the hiring of qualified and volunteer teachers. He however stated that he would still vote no on the measure since the 2012 National Budget, as a whole, is antipeople and contrary to the proposed 2016 Philippine Development Plan and the Presidents declarations of transparency and consultation. Rep. Tinio then manifested his intent to submit in writing the rest of his explanation. TRANSMITTAL OF HOUSE BILL NO. 5023 TO THE SENATE In view of the approval on Third Reading of House Bill No. 5023 which was certified as urgent by the President, on motion of Rep. Rodolfo C. QUESTION OF PRIVILEGE OF REP. ALCOVER Recognized by the Chair on motion of Rep. Farias, Rep. Pastor M. Alcover Jr. of Party-List ANAD took the floor and spoke about the recent violent acts perpetuated by the countrys communist rebels against businesses and innocent civilians as criticized by the international human rights watchdog Human Rights Watch and United Nations rapporteur Philip Alston. He then inquired what concerned government agencies, such as the Department of Justice (DOJ), the Commission on Human Rights (CHR), and particularly the Office of the President (OP) have been doing to correct the rebels propaganda that the government alone is responsible for the many extrajudicial killings. Rep. Alcover also criticized the ineptitude of the Aquino presidency in addressing the negative economic consequences of the rebels latest acts of violence as well as in taking full responsibility for what the government considered as security lapses. In this regard, he asked his colleagues to unite and make an urgent appeal for the Presidents decisive action on the matter. REFERRAL OF REP. ALCOVERS SPEECH On motion of Rep. Benjo A. Mariano of Party-List Anakpawis tackled in Filipino the continuing labor dispute involving the Philippine Airlines (PAL) in light of the recent implementation of PAL managements outsourcing plan that caused the dismissal of thousands of PAL employees. He also referred to the Supreme Courts recent dismissal of the case filed by the Flight Attendants and Stewardess Association of the Philippines

against PAL management, as well as the Court of Appeals decision to reopen the P730 million damage suit filed by PAL against the pilots who went on strike in 1998 to protest unfair labor practices against the company; lamented that the courts, the Department of Labor and Employment, and even Malacaang have all made favorable decisions for PAL, thus emboldening it to make actions that are detrimental to the welfare of the employees. He said that despite their situation, the PAL employees have continued to pursue their cause, and asked that his speech be immediately referred to the Committee on Labor and Employment. REFERRRAL OF REP. MARIANOS SPEECH On motion of Rep. Quimbo, there being no objection, the Body referred Rep. Marianos speech to the appropriate Committee. The Chair thereafter recognized Rep. Ma. RESUMPTION OF SESSION The session resumed at 7:18 p.m. Thereafter, on motion of Rep. Garin (J.), the Chair recognized anew Reps. Bello and Socrates to sponsor the measure and to interpellate thereon, respectively. INTERPELLATION OF REP. SOCRATES Adverting to Section 3 of the measure, Rep. Socrates opined that the freedom of choice is not threatened as there is nothing in the law that prevents couples from engaging in contraceptive sex. Rep. Bello underscored that the freedom of choice was the central principle of the Bill and that the government guarantees this freedom without coercion or persuasion. As to the underlying philosophy of the Bill to manipulate people to choose contraceptives, Rep. Bello replied that the promotion of a right or a freedom does not depend on any threat and that freedom of choice means freedom of informed choice. On the apprehension of Rep. Socrates that the Bill promotes contraceptive sex which is immoral as it involves the use of human sexual power in denial of its natural end, which is procreation, Rep. Bello replied that the issue had been discussed by religious people in that the use of contraceptives had not been seen to be an immoral method. He stated that Rep. Socrates should not impose his own personal ethical view on the people. Rep. Socrates argued that the RH Bill promotes immorality because it encourages sexual activities contrary to the natural purpose of sex which is procreation and also implies that sex between unmarried couples is ethical. In reaction, Rep. Bello underscored that the measure aims to promote responsible parenthood and to safeguard reproductive health among all types of couples, whether married or not, who are all entitled to benefit from government assistance. REMARKS OF REP. GONZALES (N.) Upon recognition by the Chair, Majority Leader Neptali M. Gonzales II requested Rep. Socrates to wind up his interpellation considering that he had already interpellated Rep. Bello for almost three hours and that the Body had other important measures to take up. MANIFESTATION OF REP. Recognized by the Chair, Rep. Pedro P. Romualdo requested if the debate between Reps. Bello and Socrates be just continued the next day since a very important bill has to be approved yet. REMARKS OF REP. GONZALES (N.) Rep. Gonzales (N.) remarked that under the Rules of the House, a Member can only interpellate for a period of one hour. He reiterated his request for Rep. Socrates to end his interpellation because he already consumed three hours, there were other Members who had reserved to interpellate on the RH Bill, and the Body still had to consider other bills of equal importance. REMARKS OF THE CHAIR At this point, the Chair took note of Rep. Gonzales (N.) remarks and also observed that Rep. Socrates interpellation has not tackled other specific provisions of the Bill. MANIFESTATION OF REP. KHO (D.) Thereafter, the Chair noted the manifestation of Rep. David L. Kho who cited the comment of an American chief justice that behind every argument is someones ignorance. INTERPELLATION OF REP. SOCRATES (Continuation) In ending his interpellation, Rep. Socrates reiterated his view that the RH Bill promotes promiscuity as it compels the State to fund the sexual activities of people who have no intention of using sex responsibly. He added that the measure will lead to the weakening of the institution of marriage. In response, Rep. Bello stressed that the point of Rep. Socrates is insulting to the intelligence and ethics of the more than 100 authors of the Bill. He emphasized that the measure aims to promote reproductive health and responsible parenthood. Bello and Ponce-Enrile focused their discussion on the effects of the Reproductive Health (RH) Bill on the countrys agricultural sector especially on the issue of food security if the number of people in the countryside, on which agricultural productivity depends, were to be reduced to a manageable level. The Sponsor stated that the RH Bill would, in fact, support a more productive agriculture sector by giving the people in the countryside the ability to plan their families and by aiming for a more balanced population-to-land ratio. He however added that equally important is the government support for agricultural modernization in order to raise the farmers productivity. They also discussed the proposed budget for the RH program, which Rep. Ponce-Enrile opined would be better allocated for the agriculture sector but which Rep. Bello clarified could be drawn from various sources like the allocations for unnecessary government programs and for payment of odious debts. Farias stated that the Body was in receipt of a Message from the Senate informing the House that on October 10, 2011, the Senate passed Senate Bill No. 2946, conferring upon members of the Sangguniang Bayan, Sangguniang Panlungsod and Sangguniang Panlalawigan the appropriate civil service eligibility under certain circumstances. Cognizant of the concurrence of the House Committee on Civil Service and Professional Regulation with the Senate measure, he moved that the Body adopt the same as an amendment to House Bill No. 4357. RECONSIDERATION OF THE TERMINATION OF THE PERIOD OF SPONSORSHIP AND DEBATE Rep. Farias stated that the parliamentary status of House Bill No. 4275 was that it was in the period

Without setting a precedent and with the concurrence of the leadership of the Majority, upon his motion and there being no objection, the Body reconsidered the termination of the period of sponsorship and debate on said measure to accommodate the reservation of Rep. Danilo E. Suarez who wished to interpellate the Sponsor. On a subsequent motion of Rep. Farias, the Chair recognized Rep. Sergio F. Apostol to sponsor the measure and Rep. Suarez to interpellate thereon. INTERPELLATION OF REP. SUAREZ Reps. Apostol and Suarez agreed at the outset that they would be discussing the Senate version of House Bill No. 4275 which was Senate Bill No. 2484. Thereafter, they debated on several issues including the following, among others: the provision of the Bill authorizing the Anti-Money Laundering Council (AMLC) to conduct ex parte bank account inquiries, which was already deleted through an individual amendment; the existing provision of the AntiMoney Laundering Act (AMLA) allowing the Councils ex parte application with the Court of Appeals for a freeze order on the bank deposit of a person who violated the AMLA; and the reasons for amending Republic Act (RA) No. 9160. Rep. Suarez then inquired whether the proposed revision of the AMLA was instigated by anti-money laundering laws of other countries. He also inquired on the veracity of the claim that the Philippines will have to be blacklisted if the said law is not amended. SUSPENSION OF SESSION On motion of Rep. Suarez, as seconded by Rep. Farias, the Chair suspended the session at 6:21 p.m. RESUMPTION OF SESSION At 6:26 p.m., the session resumed. INTERPELLATION OF REP. SUAREZ (Continuation) Upon resumption of session, Rep. Suarez inquired on several other pertinent issues regarding the proposed amendments to RA No. 9160. In reply, Rep. Apostol explained the reasons why the signatory countries to the United Nations (UN) convention on anti-money laundering will blacklist the Philippines if Congress fails to approve the amendments and upgrade the AMLA in compliance with existing international laws and standards; the procedures and requirements for having a bank account investigated by

WEDNESDAY, OCTOBER 12, 2011 the AMLC; the composition of the AMLC; and the relief provided by the courts to a person or entities whose bank accounts were subjected to an investigation and a freeze order by the AMLC. Furthermore, the Sponsor enumerated the activities covered by money laundering. SUSPENSION OF SESSION On motion of Rep. Farias, the Chair suspended the session at 6:43 p.m. RESUMPTION OF SESSION At 6:51 p.m., the session resumed with Deputy Speaker Remulla presiding. INTERPELLATION OF REP. SUAREZ (Continuation) After Rep. Suarez remarked that he wanted to protect the interest of depositors, Rep. Apostol said that the Committee would welcome proposals to cleanse the Bill of vague provisions on activities considered as money laundering and on the opening of bank accounts to allow the AMLC to investigate the proceeds from such activities. Thereafter, on motion of Rep. Benaldo, the Chair recognized Rep. Neri J. Colmenares for his interpellation. INTERPELLATION OF REP. COLMENARES Reps. Colmenares and Apostol discussed the wording of the term money laundering as defined under the AMLA; the determination of probable cause to determine the culpability of a person who knowingly or unknowingly accepts or acquires the money instrument or property that correlates to the proceeds of the crime; and the ex parte application of the AMLC for a bank deposit investigation. Rep. Apostol clarified that in instances when a person deposits a check in behalf of another who is accused of money laundering, the formers account cannot be opened for scrutiny, unless there is an ex parte application with the Court of Appeals. PARLIAMENTARY INQUIRY OF REP. ROMUALDO Recognized by the Chair, Rep. Pedro P. Romualdo noted that Reps. Apostol and Colmenares were discussing a provision of the Bill which he already proposed to be deleted by way of an amendment and which the Sponsor had accepted the other

WEDNESDAY, OCTOBER 12, 2011 night. He inquired into the parliamentary status of the Bill. REMARKS OF REP. COLMENARES Rep. Colmenares clarified that during his interpellation the previous week, Rep. Apostol had agreed to allow him to pursue his concerns at a later time. He asked for the indulgence of Rep. Romualdo and requested for a few more minutes of interpellation before the Body proceeds to the period of amendments. PARLIAMENTARY INQUIRY OF REP. ROMUALDO (Continuation) Rep. Romualdo said that he was merely raising a parliamentary inquiry because the Members had already introduced their individual amendments, and asked why the Body went back to the period of sponsorship and debate. REMARKS OF REP. GONZALES (N.) With the permission of the Chair, Rep. Gonzales confirmed the statement of Rep. Romualdo that his proposed amendments were already accepted by the Committee. He then explained why under two previous instances, the Body had to reopen the period of sponsorship and debate with the unanimous consent of the House, in order to accommodate certain Members, including Reps. Suarez and Colmenares, who had signified their intent to interpellate the Sponsor even after the Body had already considered and approved individual proposals during the period of amendments. Given the importance of the measure, the Majority Leader asked for the indulgence of Rep. Romualdo that the Body had to go back and forth to the procedure on the floor, and which he admitted was a departure from the usual manner by which they take up a legislative measure. QUERY FROM THE CHAIR The Chair inquired whether Rep. Romualdo was satisfied with the explanation of Rep. Gonzales (N.), to which Rep. Romualdo replied in the affirmative. MANIFESTATION OF REP. COLMENARES Rep. Colmenares said that he was just given a copy of the written amendments to the pending measure and for which reason he would like to end his interpellation. He thereafter manifested that the measure is dangerously flawed because of the proposed amendments to the AMLA to the extent that

31 the House might as well repeal the Bank Secrecy Law. MANIFESTATION OF REP. BAGATSING Rep. Amado S. Bagatsing manifested his intent to interpellate the Sponsor once Congress resumes its session after the break. Rep. Apostol however advised the former to proceed to his interpellation that day because he was ready to defend the Bill. By Representatives Belmonte (F.), Gonzales (N.) and Lagman REMARKS OF SPEAKER BELMONTE At this point, Speaker Belmonte recalled that in his State of the Nation Address (SONA) last July 25, 2011, President Benigno S. Aquino III denounced the prevailing culture of entitlement and the inequality it propagates in society and since then, the House of Representatives has worked hard to expedite the passage of reform measures seeking not only to challenge but more importantly, to change the said cultural anomaly. Thus, in record time, and despite many contentious issues which the Members had successfully resolved, he said that they finalized and approved the previous day the 2012 proposed national budget which sought to realize two objectives: first, to efficiently fund the social programs such as the expanded Pantawid Pamilyang Pilipino Program that nurtures the potentials of those previously neglected and currently marginalized; and second, to stifle the source of and the opportunity for corruption through

He expressed hope that when they return to plenary session after a brief break, they would be able to finally enact with the Senate concurrence the 2012 General Appropriations Act (GAA) to bring about stability amidst the great uncertainties caused by external developments. Speaker Belmonte likewise cited a number of significant bills which the Body had passed on Third Reading, covering among others: the proposed Hazardous and Radioactive Waste Management Act and banning of plastic bags thinner than 15 microns; the implementation of open learning through distance education; the fixing of the countrys maritime zones; and the enforcement of a fixed tenure for ranking military officers. Apart from the Members accomplishments in plenary work, he also mentioned the diligence and perseverance of the House committees in deliberating on numerous legislative priorities, which resulted in the following: 208 measures approved on Third Reading, nine bills approved on Second Reading, 166 resolutions adopted, four priority measures for committee report preparation, 25 priority measures approved at the committee level, another 25 priority measures for or under technical working group deliberation, and 20 priority measures for or under committee deliberations. He informed the Body that the conclusion of the First Legislative Summit on September 29, 2011 gave them an opportunity to explore and thresh out common legislative priorities with the Senate, to reduce deadlocks between the two Chambers, and to discuss the possibility of amending certain economic provisions of the Constitution to make the Philippine economy more competitive and responsive to the demands of globalization. Speaker Belmonte reiterated his gratitude to the Deputy Speakers and Majority and Minority Leaders and their deputies and assistants for facilitating the Bodys plenary work and made special mention of the Committee on Appropriations and its chairperson Joseph Emilio A. Abaya and his able vice chairpersons for competently sponsoring and shepherding the budget deliberations. He also thanked the Members whose presence and participation made it possible for the House to accomplish so much in so little time and the House Secretariat officials and employees and congressional staff for unselfishly sharing their time and skills. Lastly, he thanked the Filipino people for their continuous trust and confidence and assured them that the House would continue to strive for the better welfare of the nation. MOTION OF REP.
