1.1.1 Vehicle Categories

Motor vehicles constructed for the carriage of passengers: - with at least four wheels or - with three wheels and a maximum weight over 1 tonne - [articulated vehicles of two non-separable, articulated units shall be considered as single vehicles] M1 Vehicles designed and constructed for the carriage of passengers and comprising no more than eight seats in addition to the driver's seat. "vehicles designed to fulfil specific social needs" means diesel vehicles in category M1 which are either: a) special purpose vehicles as defined in Directive 70/156/EEC with a reference mass exceeding 2000 kg; or b) vehicles with a reference mass exceeding 2000 kg and designed to carry 7 or more occupants including the driver with the exclusion, as from 1 September 2012, of vehicles in category M1 G as defined in Directive 70/156/EEC; or c) vehicles with a reference mass exceeding 1760 kg which are built specifically for commercial purposes to accommodate wheelchair use inside the vehicle; Special purpose vehicle means a vehicle of category M, N or O for conveying passengers or goods and for performing a special function for which special body arrangements and/or equipment are necessary. 1.1.2.2 Introduction
This Regulation shall apply to motor vehicles of categories M1, M2, N1 and N2 as defined in Annex II of Directive 70/156/EEC with a reference mass not exceeding 2 610 kg . Simplification is introduced through integration of the test requirements for measuring diesel smoke contained in Directive 72/306/EEC (ECE R24) and CO2- Emissions and Fuel Consumption according Council Directive 80/1268/EEC (ECE R101) into the new Euro 5/6 Regulation and Directive 70/220/EEC (Euro 4) should be repealed.

In order to simplify EU legislation strong links between the European regulatory system and the framework of the United Nations 1958 and 1998 Agreements should be established. The recent Commission orientation to progressively replacing part of EU type approval legislation with the corresponding UN Regulations is implemented. The Euro 5/6 implementing legislation adopts a new PM mass emission measurement method developed by the UN/ECE Particulate Measurement Programme (PMP) and adjusts the PM mass emission limit to account for differences in results using the old and the new method. It also introduces a particle number emission limit at the Euro 5/6 stage (PMP method), in addition to the mass-based limits. The Commission intends to review in 2009 the issue of further improvements of emissions, with a view to proposing a further significant reduction of limit values (including NOx) that reflect the development in vehicle emission technology at that point in time and cost-effectiveness considerations.

1.1.2.3 Subject
Article 1 This Regulation establishes requirements for the type approval of motor vehicles and replacement parts, such as replacement pollution control devices, with regard to their emissions. In addition, this Regulation lays down rules for in use compliance, durability of pollution control devices, on-board diagnostic (OBD) systems, measurement of fuel consumption and accessibility of vehicle repair and maintenance information.

1.1.2.4 Scope
Article 2 1. This Regulation shall apply to motor vehicles of categories M1, M2, N1 and N2 as defined in Annex II of Directive 70/156/EEC with a reference mass not exceeding 2 610 kg . 2. At the manufacturer's request, type approval granted under this Regulation may be extended from vehicles covered by paragraph 1 to M1, M2, N1 and N2 vehicles with a reference mass not exceeding 2840 kg and which meet the conditions laid down in this Regulation and its implementing measures.

1.1.2.5 Definitions
Article 3 1) "hybrid vehicle" means a vehicle with at least two different energy converters and two different energy storage systems (on vehicle) for the purpose of vehicle propulsion; 2) "vehicles designed to fulfill specific social needs" means diesel vehicles in category M1 which are either: a) special purpose vehicles as defined in Directive 70/156/EEC with a reference mass exceeding 2000 kg; or b) vehicles with a reference mass exceeding 2000 kg and designed to carry 7 or more occupants including the driver with the exclusion, as from 1 September 2012, of vehicles in category M1 G as defined in Directive 70/156/EEC; or c) vehicles with a reference mass exceeding 1760 kg which are built specifically for commercial purposes to accommodate wheelchair use inside the vehicle; Special purpose vehicle means a vehicle of category M, N or O for conveying passengers or goods and for performing a special function for which special body arrangements and/or equipment are necessary. 3) "reference mass" means the mass of the vehicle in running order less the uniform mass of the driver of 75 kg and increased by a uniform mass of 100 kg; 8) "crankcase" means the spaces in, or external to, an engine which are connected to the oil sump by internal or external ducts through which gases and vapours can escape; 10) "on-board diagnostic system" or "OBD system" means a system for emission control which has the capability of identifying the likely area of malfunction by means of fault codes stored in computer memory; 11) "defeat device" means any element of design which senses temperature, vehicle speed, engine speed (RPM), transmission gear, manifold vacuum or any other parameter for the purpose of activating, modulating, delaying or deactivating the operation of any part of the emission control system, that reduces the effectiveness of the emission control system under conditions which may reasonably be expected to be encountered in normal vehicle operation and use; 12) "original pollution control device " means a pollution control device or an assembly of such devices covered by the type approval delivered for the vehicle; 13) "replacement pollution control device " means a pollution control device or an assembly of such devices intended to replace an original equipment pollution control device which can be approved as a separate technical unit as defined in Directive 70/156/EEC ; 14) "vehicle repair and maintenance information" means all information required for diagnosis, servicing, inspection, periodic monitoring, repair, re-programming or reinitializing of the vehicle and which the manufacturers provide for their authorised dealers/repair shops, including all subsequent amendments and supplements to such information. This information includes all information required for fitting parts or equipment on vehicles; 15) "independent operator" means undertakings other than authorised dealers and repair shops which are directly or indirectly involved in the repair and maintenance of motor vehicles, in particular repairers, manufacturers or distributors of repair equipment, tools or spare parts, publishers of technical information, automobile clubs, roadside assistance operators, operators offering inspection and testing services, operators offering training for installers, manufacturers and repairers of equipment for alternative fuel vehicles ; 16) "biofuels" means liquid or gaseous fuel for transport produced from biomass; 17) "alternative fuel vehicle" means a vehicle designed to be capable of running on at least one type of fuel that is either gaseous at atmospheric temperature and pressure, or substantially non-mineral oil derived.

1.1.2.6 In-service Conformity and Durability


Article 4 In-service conformity measures shall be checked for a period of up to 5 years or 100,000 km, whichever is the sooner. It is not required if the annual sales of a vehicle type are less than 5,000 across the Community. Durability testing of pollution control devices undertaken for type approval shall cover 160,000 km. To comply with this durability test, the manufacturers should have the possibility to make use of test bench ageing, subject to the implementing measures of the Directive. In-service conformity shall be checked in particular for tailpipe emissions as tested against emission limits. In order to improve control of evaporative emissions and low ambient temperature emissions, the test procedures shall be reviewed by the Commission. Manufacturers shall set out carbon dioxide emissions and fuel consumption figures in a document given to the purchaser of the vehicle at the time of purchase.

1.1.2.7 Requirements and Tests


Article 5 The use of defeat devices that reduce the effectiveness of emission control systems shall be prohibited except in the following cases: a) the need for the device is justified in terms of protecting the engine against damage or accident and for safe operation of the vehicle, or b) the device does not function beyond the requirements of engine starting, or c) conditions are substantially included in the test procedures for verifying evaporative emissions and average tailpipe emissions. Article 6 Access to vehicle repair and maintenance information Manufacturers shall provide unrestricted and standardized access to vehicle repair and maintenance information to independent operators through websites using a standardised format in a readily accessible and prompt manner, and in a manner which is non-discriminatory compared to the provision given or access granted to authorized dealers and repairers. information shall be submitted in a consistent manner, initially in accordance with the technical requirements of the OASIS format. Manufacturers shall also make training material available to independent operators and authorised dealers and repairers.

The 5.0 mg/km emission limit for mass of particulate matter referred to the Tables below shall be effective from the applicable dates for Euro 5 table above. The 4.5 mg/km emission limit for mass of particulate matter and the particle number limit referred to the Tables below shall be effective from 1 September 2011 for the typeapproval on new types of vehicles and from 1 January 2013 for all new vehicles sold, registered or put into service in the Community.

The Type 6 test measuring emissions at low temperatures set shall not apply to diesel vehicles. However, when applying for type-approval, manufacturers shall present to the approval authority with information showing that the NOx aftertreatment device reaches a sufficiently high temperature for efficient operation within 400 seconds after a cold start at - 7 C as described in the Type 6 test. In addition, the manufacturer shall provide the approval authority with information on the operating strategy of the exhaust gas recirculation system (EGR), including its functioning at low temperatures. This information shall also include a description of any effects on emissions. The approval authority shall not grant type-approval if the information provided is insufficient to demonstrate that the aftertreatment device actually reaches a sufficiently high temperature for efficient operation within the designated period of time. At the request of the Commission, the approval authority shall provide information on the performance of NOx aftertreatment devices and EGR system at low temperatures.

1.1.2.14 Idling CO
For the Type 2 test, at normal engine idling speed, the maximum permissible carbon monoxide content in the exhaust gases shall be that stated by the vehicle manufacturer. However, the maximum carbon monoxide content shall not exceed 0,3 % vol. At high idle speed, the carbon monoxide content by volume of the exhaust gases shall not exceed 0,2 %, with the engine speed being at least 2 000 min-1 and Lambda being 1 0,03 or in accordance with the specifications of the manufacturer.

1.1.2.15 Crankcase Emission


Type 3 test The manufacturer shall ensure that for the Type 3 test, the engines ventilation system does not permit the emission of any crankcase gases into the atmosphere.

1.1.4.3 Requirements for type-approval regarding the OBD system


Article 4 1. The manufacturer shall ensure that all vehicles are equipped with an OBD system. 2. The OBD system shall be designed, constructed and installed on a vehicle so as to enable it to identify types of deterioration or malfunction over the entire life of the vehicle. The OBD system shall comply with the requirements of this Regulation during conditions of normal use. 3. When tested with a defective component, the OBD system malfunction indicator (MI) shall be activated. The OBD system MI may also activate during this test at levels of emissions below the OBD thresholds limits. 4. The manufacturer shall ensure that the OBD system complies with the requirements for its in-use performance under all reasonably foreseeable driving conditions. 5. In-use performance related data to be stored and reported by a vehicle's OBD system shall be made readily available to national authorities and independent operators by the manufacturer without any encryption. 6. Vehicles shall only be type-approved as Euro 6 vehicles once OBD thresholds have been introduced with the exception of diesel vehicles using the thresholds. The obligations set out in Articles 4(4), 4(5), shall apply from 1 September 2011 for the new types of vehicles and from 1 January 2013 for all new vehicles sold, registered or put into service.

1.1.4.6 In Service Conformity


ANNEX II IN-SERVICE CONFORMITY Selection of vehicles for in-service conformity The manufacturer's sampling shall be drawn from at least [two] Member States with substantially different vehicle operating conditions. Factors such as differences in fuels, ambient conditions, average road speeds, and urban/highway driving split shall be taken into consideration in the selection of the Member States. The emissions testing may be done at a test facility which is located in a different market or region from where the vehicles have been selected. The in-service conformity tests by the manufacturer should be continuously carried out reflecting the production cycle of applicable vehicles types within a given in service vehicle family. The maximum time period between commencing two in service conformity checks shall not exceed 18 months. In the case of vehicle types covered by an extension to the type-approval that did not require an emissions test, this period may be extended up to 24 months. Appendix 1 4. IN-SERVICE TESTING 4.1. When a check on vehicles is deemed necessary, type 1 emission tests are performed on pre-conditioned vehicles selected. 4.2. Vehicles equipped with an OBD system may be checked for proper in-service functionality, of the malfunction indication, etc., in relation to levels of emissions for the type-approved specifications. 4.3. The OBD system may be checked, for example, for levels of emissions above the applicable limit values with no malfunction indication, systematic erroneous activation of the malfunction indication and identified faulty or deteriorated components in the OBD system. 4.4. If a component or system operates in a manner not covered by the particulars in the type-approval certificate and/or information package for such vehicle types and such deviation has not been authorized with no malfunction indication by the OBD, the component or system shall not be replaced prior to emission testing, unless it is determined that the component or system has been tampered with or abused in such a manner that the OBD does not detect the resulting malfunction. Tyres: From the relevant dates set out in Article 10(4) and 10(5) of Regulation (EC) No 715/2007 (implementation of Euro 6), The choice of tyres shall be based on the rolling resistance. At the request of the manufacturer, the test procedure specific to periodically regenerating systems shall not apply to a regenerative device if the manufacturer provides data to the approval authority that, during cycles where regeneration occurs, emissions remain below the emission standards applied for the concerned vehicle category after agreement of the technical service. 3.13.4. For a periodically regenerating device, during cycles where regeneration occurs, emission standards can be exceeded. If a regeneration of a pollution control device occurs at least once per type 1 test and the device has already regenerated at least once during vehicle preparation cycle, it shall be considered as a continuously regenerating system which does not require a special test procedure.

The whole vehicle durability test represents an ageing test of 160,000 kilometres driven on a test track, on the road, or on a chassis dynamometer. The manufacturer may choose to use a bench ageing durability test. At the request of the manufacturer, the technical service may carry out the type 1 test before the whole vehicle or bench ageing durability test has been completed using the assigned deterioration factors in the table above. On completion of the whole vehicle or bench ageing durability test, the technical service may then amend the type approval results by replacing the assigned deterioration factors in the above table with those measured in the whole vehicle or bench ageing durability test. In the absence of assigned deterioration factors for Euro 6 compression ignition vehicles, manufacturers shall use the whole vehicle or bench ageing durability test procedures to establish deterioration factors. The deterioration factors are used to establish compliance with the requirements of the appropriate emissions limits set out in Tables 1 and 2 of Annex 1 of Regulation (EC) No 715/2007 during the useful life of the vehicle. 2. 1.1.4.12.1 Standard Road Cycle (SRC)


As an alternative to the operating cycle described in UN/ECE Regulation No. 83 for the whole vehicle durability test, the vehicle manufacturer may use Standard Road Cycle (SRC) described in this Annex. Notwithstanding this measure, which is necessary for technical reasons, the manufacturer of fuels should nevertheless aim at a zero value where the stipulated maximum value is 2R and at the mean value in the case of quotations of maximum and minimum limits.
