Wendell Courtney, attorney for PSU and Second Mile.9 Resigned from Second Mile Nov 2011.10 Tim Curley, age 57, PSU athletic director, boss of Joe Paterno. Officially on administrative leave, while dealing with this legal distraction.11 He originally got this job in 1993.
Bobby Davis says he was sexually abused by Bernie Fine in the 1980s and 1990s. He reported it to the police in 2002, who said nothing could be done because statute of limitations had expired.

Paul McLaughlin, was abused by a special-education teacher, took his case to PSU officials in 2002, who brushed it off, acting like he was doing an extortion scam. 19 In a civil lawsuit that McLaughlin later filed and then settled in the state of New Jersey, he details allegations of abuse by John T. Neisworth and a California man, Carl Geoke.

Gary Schultz, a PSU vice-president.33 Officially resigned from PSU at same time as being charged. He had managed a staff of 2,500, had been in charge of Human Resources and the campus police. Mark Sherburne, athletic director in absence of Tim Curley.
J. Sedgwick Sollers, criminal defense attorney for Joe Paterno.34 Paterno has not been criminally charged in the child sex abuse case surrounding his former coach, Jerry Sandusky, and is reportedly viewed as a cooperating witness in the matter.
Graham Spanier, PSU president,35 hired Sep 1, 1995, fired Nov 9, 2011 by PSU Board of Trustees. Stephen Turchetta, assistant principal and football coach at one of Victim # 1s schools,36

Victims are not identified by name, which is customary when they are rape victims and/or children. (both in this case) Victim numbering is in sequence of when the investigation found out about them, not in chronological sequence of when incidents occurred with them. Victim # 1 was allegedly harassed by Mr. Sandusky from 2005 thru 2009. He asked his mother for help in 2008, who in turn asked a school for help, which led to the current investigation. Multiple people were witnesses to this abuse, including victim F.A. and two adults at his school. Victim # 2 identity unknown, in 2002 incident witnessed by a PSU assistant coach. Victim # 3 abused 2000 summer, between 7th and 8th grade Victim # 439 at age 12 or 13 in 1996 or 1997 Victim # 5 at age 7 or 8 in 1995 or 1996 meets Sandusky, then is abused over several years.

Accessory, aiding and abetting: A person, with knowledge of wrong doing, who
themselves did not do the criminal acts, but by their silence helped the crook escape to continue similar crimes.
public disagreement what that means, or implies. So I started a series mid 2010 on the Science of Accountability, via Haiti Rewired.42 Many news stories43 are blasting the apparent lack of Moral Accountability, or Governance at PSU, since the initial indictments are leveled there.
Alleged: People are Not Guilty, until the judicial system proves otherwise. They may be
alleged to have done various bad stuff, according to victims, witnesses, evidence, and be charged with whatever crimes, but they are still Not Guilty until proven Guilty, or found Innocent of the charges. The 1998 investigation opted to not charge Mr. Sandusky with anything.
Blame the Victim: A defense often used on behalf of perpetrators is that somehow the
victim is to blame. There are people who dont think Joe Paterno and others did nothing wrong, that firing them was excessive. Some of them are now in this blame game of holding the abused boys, and witnesses to blame for what happened to their beloved Paterno.44

Boston Red Sox, for 3 decades, employed a sexual predator who solicited sex from the
young boys he would hire to work the clubhouse during spring training. 45 Like the Catholic Church, top management did everything it could to silence critics, and keep this behavior continuing.
Only in 1991, when a young aide held up a sign during a nationally televised Red Sox-Angels game that read "Don Fitzpatrick sexually assaulted me" did the Red Sox act, paying out a $100,000 settlement.
Catholic Church has not been the same, nor will it ever be the same, not simply because
the church used its power and moral authority to betray its membership and protect the offending clergy until it no longer could but also because it forgot who exactly needed the protection.46 It was both a world wide scandal, and also it was notable for many cities. In Boston it was 6 decades of dozens of priests abusing hundreds of victims. 47 The more they covered it up, the more damage when the story finally came out.
Child abuse is the physical, sexual, emotional mistreatment, or neglect of Child Abuse statistics from US Justice Dept: Children who suffer abuse, sexual abuse
included, are 59 percent more likely to be arrested as a juvenile, 28 percent more likely to be arrested as an adult and 30 percent more likely to commit violent crime. These numbers tell us there is a good chance that lives have been ruined before even being given a chance. 48
Research shows that about one in six boys are sexually abused before they are 16 years old. The number for girls is one in four. The statistics do not include verbal harassment or other forms of non-physical sexual abuse, such as forcing a child to watch a sexual act. 49 More info about Child Abuse in America.50
Child Protective Services Law of Pennsylvania (23 Pa.C.S.)52 requires that when a
staff member reports child abuse, the university administration has a legal responsibility to report, or cause report to be made, within 48 hours, by telephone, and in writing to the Dept

of Public Welfare of the Commonwealth of Pennsylvania. An oral report should also have been made to the local Children and Youth Services. The exact phraseology of the law, and how it should be interpreted, is under some dispute. 53 Since the boys were not affiliated with the University, University officials perhaps were not required to report anything. There is the question of whether the obligation to report to authorities, is for the actual witnesses, or the institutions leadership.
Each count of perjury, carries up to 7 years in jail. In real terms, they would likely face between one month and 12 months in jail, under the sentencing guidelines. The failing to report charge, a summary offence, carries a maximum of 90 days in jail and a $200 fine.54 Theres a 2 year statute of limitations involved.55 The perjury charges could live on, even without the reporting charges.
"The abuse often leads to poor self-esteem, an inability to stand up for your own rights, depression, helplessness. ... Some victims find it difficult to get involved in meaningful relationships. They have trouble holding jobs. They strike out at their families because they feel ashamed of themselves, or they feel betrayed by their families or their institution, school, church, whatever it might be."58

The federal Clery Act, originally known as the Campus Security Act, requires colleges and
universities to report on an annual basis to the US Dept of Education, all criminal activity reported to campus police or other authorities. So a major issue is what discretion top authorities of institutions have with internal investigations of alleged improper behavior. Sometimes they will in fact be correct, that nothing happened.
The "Clery Act" is named in memory of 19 year old university freshman Jeanne Ann Clery who was raped and murdered while asleep in her residence hall room on April 5, 1986.60 It was passed in 1990. In later years there were a number of amendments to increase protection for victims, whistle blowers, and provide other logical measures.
Corroboration: To avoid he said she said conflicting testimony, there needs to be some
proof that what someone said is in fact valid. DNA evidence can help. Multiple witnesses can help, when it can be shown they are unlikely to be colluding with each other, 61 and have no other reason to dislike the person they are accusing. So a witness thought they saw some behavior. They could be mistaken what they saw, at the time. They may be unqualified to judge what they saw. When asked about it many years later, stuff can have fallen out of their brains. Thinking and talking about it over time, can also confuse memory.
Ethics: We can reason out how people ought to behave under various circumstances,
come up with a set of standards. See Morality.
Evidence: The sixth amendment62 to the US constitution includes right to face accuser.
The US Supreme Court has expanded that right so that when the accuser is evidence, the defense has right to cross-examine technician whoever interpreting that evidence.

Hate Crime = the criminal chooses the victims because they are in some category of
society, or age, or gender.
What did you personally witness, not what you think happened, not what someone else told you, what you saw, heard, tasted, touched, etc. In 2000 there were TWO people who saw Sandusky showering with a juvenile. Both of them
reported to the same supervisor. One of them pointed out Sandusky to that supervisor, before he left the parking lot with the kid. So you have THREE people who saw Sandusky at the facility, two of them witnessed showering, one witnessed the sex acts. Unfortunately, the last one is no longer mentally stable to testify, so we only have what the supervisor remembers being told, which is potentially hearsay now.
Intervention: You witness what you believe to be a crime. You attempt to stop it by
getting involved physically. This is fraught with danger. The crook can win the fight. Later you can be charged with a crime, and the original crook get off scot free. It is called vigilantism, taking the law into your own hands. Many people have witnessed what they thought was a crime, tried to stop it, later investigation determined the witnesses were mistaken. Involuntary Deviate Sexual Intercourse There is an enormous legal liability to civil law suits, where the families of victims can ask employers, to compensate the victims for their harm, and cost of medical care, thanks to staff of the institutions dropping the ball in protecting the children.64 Employers include: PSU, Second Mile, the elementary school.
The modus operandi for most sex offenders, who purport to assist, nurture and advise children. First sexual predators gain the trust of children and their parents. Then they take advantage.65

around children, the temptation to re-offend.66 Pedophile
Police: Once upon a time, the word of a police officer ranked higher than the person
apprehended. But now, so much has come out about some officers exceeding reasonable behavior, that good evidence is needed.
Power corrupts, with unmitigated temptation. The more power, the more temptation,
the greater risk of corruption.67 This is one reason why we constantly hear stories of corruption of political leaders, various celebrities. we should respond when we witness various suspicious activities.
Public Education: There is a need for improved education of the general public, how Rape = sex against the will of one party. Children cannot give consent.
Penn State and Second Mile could be charged under RICO crime statutes, for the organized crime of covering up child sexual abuse.68 RICO charges cover "racketeering activity" involving the affairs of an "enterprise" and usually apply to organized crime, such as gambling and drug trafficking. But in Pennsylvania, the law defines "enterprise" generously and includes "any individual corporation and any group of individuals associated in fact [who are] engaged in commerce." This includes "legitimate as well as illegitimate entities and governmental entities. Translation: So long as money is being made somewhere, an association of individuals or entities is an enterprise.
Salvation is here, a victim might think, when Sandusky and victim see that they have been
witnessed, but it is another form of abuse when that rescue never materializes.69
Serial criminal When there are a string of crimes of very similar nature, by same
person, sometimes statute of limitations does not apply to the first in the series. It is considered all one string of crimes, where the statute of limitations applies to the end of the crime wave.

pending, witnesses of the alleged crimes, and people who remember who talked with whom about what, are not supposed to be reading each others statements, what the news media has to say, or engage in interviews with the news media, because this could contaminate the clarity of their recollections. This also applies to information flow through a jury. They need to decide based on provable evidence and credible testimony, not be influenced by wild speculations. chronological.
We now know, that it was well known in some circles, for many years, that Sandusky was doing this stuff, so how come all other news media waited until the grand jury report came out, before jumping all over the story?71
Shrinking news budgets that have undermined investigative journalism. People, who cover a specialized beat, do not recognize how huge some odd-ball side story could be. A press-wary football program in a remote location. Police who reportedly dissuaded victims from talking to journalists. A lackluster response by Penn State that some have likened to a cover-up. A reticence to brand Sandusky as a pedophile without definitive evidence. You can have your requisite two or three sources and the story may be solid, but that wont hold up in a libel suit. Most of the local audience is more angry about Paterno being fired, than what happened to the boys.
This is typical news media. There is shocking stuff they do not cover.

I suspect reasons the news media is now swarming all over this story:
Me too once a handful of news media treat it as a big story, they all have to. Nov 4, 2011: The Grand Jury indictment had been filed under seal, but because of a computer glitch it had mistakenly been made public.72 This degree of gory detail is rarely made public. The arrested accused are big important people, in the sports celebrity world, at a well known institution. Scores of other people get arrested, or investigated, regarding very similar accusations, but dont even get a tiny mention by the media. Look at humanitarian NGO history for example. Sex for food, and sex for jobs, has been a staple diet for refugees for decades, part of the cost of getting the humanitarian aid that well meaning people around the world donate, unaware of the slimy way in which it is often delivered. In some cases, after years of abuse, some nation discovers that scores or their people were orchestrating this, and puts a stop to their share of the damage. 73 But our news media ignores this story. What makes this newsworthy is the high rank of the accused. Institutions, of the accused, immediate reaction is not to investigate, nor seek to protect victims, but to seek to discredit the accusers. Boston Red Sox now acknowledges they had a pedophile on the payroll, but for 30 years they had been firing anyone who complained about it. Catholic Church successfully fought for decades, to cover up crimes of priests in many nations, before they were overwhelmed with the evidence. Uruguay now knows its soldiers raped a Haitian teenager, but that nations first response was to threaten to sue for libel, anyone reporting the accusations, which tarnished the nations reputation.
There are stories in which we are told this is the worst ever. Statistically it seems incredible that every story is the worst ever, unless human beings are being incredibly venal and stupid, which unfortunately is true. This investigation is continuing. There were other similar scandals earlier, in which nothing was done about what was found out. This reminds me of the Catholic Church scandal, VA Tech shooting, and the situation in Haiti. Many people knew pieces of a story, but were unable to connect the dots because of a mixture of different authorities told different things, laws, cover-ups, how testimony by witnesses is often treated or not believed, victims feeling too embarrassed to report incidents, and a lack of organization of records to show patterns of bad behavior by same people. the Altoona Mirror took a look at how students at the university are dealing with the negative attention. Students seemed angry at Penn State officials for the cover up, while troubled by the hit 74 the universitys image is taking because of the scandal. Center Daily Times:75 Christian Science Monitor76 Culpeper Star Exponent described how the Sandusky allegations are typical of most
childhood sexual abuse cases. Nearly everything from the amount of sexual abuses Sandusky allegedly committed to the time it took for him to be charged with a crime fit in line with multiple 77 studies on the subject.
ESPN78 Fox News79 claims to be fair and balanced. I do not believe they are either, but I try to be fair and balanced with everyone, including them. Grand Jury report80 Los Angeles Times81 New Yorker82 Patriot-News, the largest daily newspaper in Harrisburg, Pa., had a full front page editorial on

Tuesday which addressed the scandal. The opening lines are: There are the obligations we all have to uphold the law. There are then the obligations we all have to do what is right. The editorial calls for Penn State President Graham Spanier to step down, and for PSU to not extend Paternos contract. However, it does argue that Paterno should not be fired or step down and be allowed to retire at the end of the year with dignity.

When an employee observes misbehavior at a company, it is normal practice to report that up through the hierarchy of the company, sometimes to a department in charge of managing particular kinds of problems, such as Human Resources. When should an employee also make reports directly to police or child protective services? I have wrestled with this type of issue multiple times in my career. 99
Child-advocacy experts say the purpose of such laws is to either clear the individual of any charges or ensure justice is done.100
Who Knew What When, and how rapidly did they react? (1 Nov 11)
The boys all testify they were uncomfortable with what happened, did not welcome it, but too young to know what to do about it. 1998 a mother questions wet hair of boy upon return of being with Mr Sandusky, contacts Penn State University police. Police investigate incidents with two different boys (Victim # 6 and B.K.), where Sandusky had admitted to showering with both of them. State child protective services and university police get Sandusky to promise no more showers with boys. DA declines to charge Sandusky with anything. A key player, guiding what to do in this case is, Wendell Courtney who was attorney for both the University and The Second Mile. However, An investigator for
Children and Youth Services broke the news to the mother: It was all a big mistake, the mother said she was told.101 She had imagined Sandusky saying he showered with the boys. Nothing happened.
In 2008, after 3 years of fighting off Mr Sandusky advances, the boy identified as victim # 1 asks his mother for help. The mother contacts the school, which had personnel who already knew about Mr. Sandusky suspicious behavior. The school contacts the police. This launches an investigation which ultimately leads to the recent arrests. 2006 or 2007: Joseph Miller, a wrestling coach at a Clinton County elementary school enters a weight room at school and finds Victim # 1 and Mr. Sandusky in physical contact. I have yet to learn if any action resulted from this witnessing, at the time, other than much later Grand Jury testimony. 2000 Janitors James Jim Calhoun and Ronald Petrotsky witness Sandusky showering with a boy. Calhoun sees more details, actual rape occurring. He is badly shaken by what he witnesses. Both promptly report details to their boss Jay Witherite. No further action is taken. The janitor staff fears they could be fired as whistle blowers.

He is badly shaken by what he witnesses. He phones his father, John McQueary, seeking guidance what to do. Mike and John visit Mikes boss, Joe Paterno on Saturday to report the incident. Joe then phones his boss Tim Curley, and meets with him on Sunday. No action is taken to identify the boy, or report this to police or child protective services, as required by Pennsylvania law. In 1990 Congress passed the Clery Act, mandating that colleges and universities, which receive public funds, make an annual report to US Dept of Education, providing statistics about crimes on campus. In subsequent years there were amendments to increase protections for victims of sex crimes.105 This means that the Elementary School is off the hook under the Clery Act, but the 1998, 2000, and 2002 incidents at PSU are covered. Also some of the Syracuse incidents are covered. In 1992 Congress amended the Clery Act to provide basic rights to victims of sexual assault on campus. 1994: A boy identified only as Victim # 7 meets Mr. Sandusky through The Second Mile at age 10. The boy now in 2011 is age 26. Victim # 7 testifies about multiple incidents of attempted inappropriate sexual contact by Mr. Sandusky. Victim # 7

Victim # 4, now age 27 in 2011, became a fixture in the Sandusky household and attended many football events over the years. Mr. Sandusky allegedly helped Victim # 4 get marijuana. Either before or after alleged sexual assaults, the victim receives expensive gifts from Mr. Sandusky. More details in the Grand Jury report.107

He said he would not shower with children again.110 State Department of Public Welfare investigator Jerry Lauro told the
grand jury that Sandusky said he showered naked with the youth and hugged him, "admitted that it was wrong," and promised not to shower with any child again.111
Apparently that is the end of that case. No warning to The Second Mile, No constraints on Mr. Sandusky movements on any campus, around any other children. 1999: Penn State's trip to the Alamo Bowl in 1999 has attracted the interest of Texas. San Antonio police Sgt. Chris Benavides, and police department spokesman Officer Matthew Porter, said Nov 10, 2011 their department is "looking into the possibility that an offense may have happened" with victim # 4, while the football team was in town.112 The PA grand jury report says Sandusky took one boy he allegedly molested to that game and threatened to send him home when the victim resisted his advances. 1999: Jerry Sandusky Retires from his coaching position at Penn State University. For earlier picture, see my G+ sharing.113 I have since added more detail here. 2000 Summer, Victim # 3, between 7th and 8th grade at the time, and now age 24 in 2011, meets Mr. Sandusky. He claims his genitals are touched and there are bear hugs in the shower. More details in the Grand Jury report.114 Victim # 3s testimony included what he knew about Mr. Sandusky and Victim # 4. 2000 Fall, A janitor James Jim Calhoun witnesses Mr. Sandusky in the shower at the PSU football complex with Victim # 8, whose identity is still unknown. The boy was pinned against the wall while Mr. Sandusky performed a sex act on him. The janitor fled the scene in panic, but immediately tells other janitorial staff and his boss, what he had witnessed. His supervisor tells him how to make an official report. Such a report is never made; there is discussion among janitorial staff of concern about their jobs if they report such incidents.115 This is the same shower, where the graduate coaching assistant witnessed the same type of activity 2 years later. This 2000 Fall incident was also witnessed by janitor Ronald Petrotsky, who described the boy as aged 11 to 13, also reported to the same boss, Jay Witherite, what he witnessed. Today, Jim suffers from mental disease and cannot testify, but multiple people are able to testify what he told them at the time of the incident. 2001: Citadel Military College, in South Carolina, learns of accusations of inappropriate

reports) witnesses March 1, what he later reports is Jerry Sandusky raping what looks like a 10 year old boy, now labeled by the Grand Jury as victim # 2 (that they found out about). The young assistant fled the scene in panic, then phones his father for guidance on how to proceed. The assistant, and his father, report it to Joe Paterno March 2, who in turn reports it to athletic director Tim Curley, March 3. Then the assistant is called to repeat what he witnessed to VP Gary Shultz, mid March. This info is in turn reported to the University President, and to Second Mile charity. Exactly who told whom what, and who was in which meeting, is conflicting testimony from the participants. Sanduskys university and charity access to children and facilities are allegedly restricted. No reports are made to the police, nor to child protective services, in violation of Pennsylvania law. Identity of the child victim is still unknown. Mr. Curley also shared that the information had been internally reviewed and that there was no finding of wrongdoing. At no time was The Second Mile made aware of the very serious allegations contained in the Grand Jury report. 121 2003: Several news media said they first investigated the Bernie Fine accusations in 2003, but decided not to run the story because there was no independent evidence to corroborate the allegations. In 2005, Ray Gricar, the DA who had decided in 1998 not to charge Sandusky, went missing, mysteriously and suspiciously.123 In 2005, Ricardo Guevara, a teachers aide at Miramonte elementary school, was
convicted in 2005 of lewd acts with three girls. He was caught putting his hand into the pants of one girl in the courtyard of the campusbut only after three earlier sets of complaints against him by students were discounted by Los Angeles school officials.124 2005 Bobby Davis reports the allegations to Syracuse University. Syracuse hires an outside firm to conduct and investigation,125 concludes it was "unable to find any corroboration of the allegations."126
2005 or 2006: Victim # 1 meets Mr. Sandusky. In 2007, they start spending time together during the track season at the boy's high school, with the boy staying overnight at Mr. Sandusky's residence in State College, during which sexual activity allegedly occurred. Mr. Sandusky gave the boy expensive gifts . See the grand jury report for many more details about the relationship between Mr. Sandusky and Victim # 1.127 2006: California passes Matts Law making it a felony if hazing leads to serious injuries or death.128 2006 or 2007: Joseph Miller, a wrestling coach at a Clinton County elementary school enters a weight room at school and finds Victim # 1 and Mr. Sandusky lying on their sides in physical contact.129 Later the boy gives testimony about inappropriate advances by Mr Sandusky leading to them being in this position. It is unclear to me, from the news stories I have read so far, if anyone at the school reported this to police or child protective services, prior to the mothers efforts in late 2008.
For earlier picture, see my G+ sharing.130 I have since added more detail here. In 2007, Sanduskys attorney, Joe Amendola represented former Penn State tailback Austin Scott
after another student accused Scott of rape in 2007 (the case was later dropped), got a teen-age 131 client pregnant during the mid-1990s. 2007: A Hazing incident at Rider University in NJ, led to the death of one pledge, and serious injury of another.
Throughout 2007 and 2008: Mr. Sandusky allegedly performed a sex act more than 20 times on Victim # 1. In 2008, Congress amended the Clery Act to protect whistle blowers, too late for the 2000 janitors. 2008: information is coming out about a case which may be other than Victim # 1. A Nov 9, 2011 report raised questions about the initial response of officials at Central
Mountain High School in Clinton County in 2008 when the mother of one of the accusers, a 15-year-old boy, confronted them with allegations against Sandusky.132 According to the grand jury, Sandusky, who was working as a volunteer coach at the school, abused the boy over a two- to three-year period before the boy revealed the abuse to his mother. The report in the Harrisburg Patriot-News quoted the mother as saying school officials "told me to go home and think about what I wanted to do, and I was not happy. They said I needed to think about how that would impact my son if I said something like that. I went home and got [my son] and we came to [Children and Youth Services] immediately," said the woman, who was not identified.133 By law, CYS agencies must report such allegations to law enforcement authorities.
Spring 2008: Victim # 1 terminates contact with Mr. Sandusky while a freshman at
Central Mountain High School in Clinton County. Later in 2008, or early in 2009: Victim # 1's mother contacted the school, which barred Mr. Sandusky from the school, and reported the situation to police. November 2008, Mr. Sandusky informed The Second Mile that he had learned he was being investigated as a result of allegations made against him by an adolescent male in Clinton County, PA. Consistent with that commitment and with The Second Mile policy, we immediately made the decision to separate him from all of our program activities involving children. Thus, from 2008 to present, Mr. Sandusky has had no involvement with Second Mile programs involving children. 134 2009: The latest investigation, led by Pa AG, which led to 2011 indictments, began.135 There are conflicting stories as to what exactly, in 2008 or 2009 triggered the investigation. Was it a mother complaining to a school, a mother complaining to child services? Did it happen in late 2008 or early in 2009? Between January 2008 and July 2009: There were 57 calls from Mr. Sandusky's cell phone to Victim # 1's home phone, and 61 calls from Mr. Sanduskys home phone to Victim #1s home phone. There were no phone calls from Victim # 1 to Mr. Sandusky in that time period. An age 15 youth, identified as F.A., testified that he had both witnessed inappropriate contact between Mr. Sandusky and Victim #1, and himself had to fight off inappropriate contact upon himself, by Mr. Sandusky. Off-topic perhaps, but I believe relevant to the big picture: Jan 2010 was the Haiti earthquake.136 In my studies of the disaster, which is the attempted humanitarian rescue of that nation, I have found multiple stories of charities, allegedly existing to aid disaster victims, which instead were breeding grounds welcoming pedophiles, rapists, and people engaged in sex slavery rings. There is little or no regulation of non-profits. Audits of major NGOs have found no correlation between what they say they are doing, and what can be proven they are doing. This story, of Mr. Sandusky and his Second Mile charity, I am unhappy to share, is not an aberration. The only difference is, the news media is covering this Penn State scandal. September 2010: Mr. Sandusky retires from The Second Mile.

The grand jury finds his testimony to be very credible. In late 2010, the Los Angeles Miramonte elementary school scandal in 2010 came to
police attention, thanks to an alert CVS photo-lab technician. Otherwise, the abuse would probably continued for years, without detection by school authorities.137
The Second Mile was first contacted by the Attorney Generals office in early 2011. Since then, we have done everything in our power to cooperate with lawenforcement officials and will continue to do so.138 Jan. 12, 2011: Mr. Curley and Mr. Schultz testify before grand jury. Schultz acknowledged similarities between the 1998 and 2002 incidents, and said that how the 1998 incident was handled, was approved by Wendell Courtney who was attorney for both the University and The Second Mile. March 2011: Harrisburg (Pa.) Patriot-News reports that grand jury is investigating
Sandusky on allegations of indecent assault against a teenage boy. The Patriot-News reports that five people with knowledge of the case said the grand jury has been meeting for 18 months and has called witnesses including Paterno and Curley. 139 Penn State declines comment. April 2011: Pittsburgh radio host Mark Madden wrote a story revealing Penn State for
much of the cover-up of Jerry Sandusky's alleged child rape that has been exposed in November 2011. While it didn't raise many eyebrows back then, six months later it looks 140 to be incredibly accurate.
October 2011:
A woman witnesses suspicion of a co-worker interest in child porn. Since the co-worker works with young children, she reports it to her bosses at Three Rivers Health Solutions in Missoula Montana, who tell her NOT to call the police, because of insufficient evidence. She reports it anyway. The police find sufficient evidence to arrest the man, but the witness is fired for being a whistleblower.141 Nov 4, 2011: The Grand Jury indictment had been filed under seal, but because of a computer glitch it had mistakenly been made public.142 Nov. 4, 2011: Charges filed against Mr. Sandusky related to sexual abuse of eight boys, and against Mr. Curley and Mr. Shultz for lying to the grand jury, and failing to report the incidents to the proper authorities. Nov 6, 2011: Sandusky is released on $100,000.00 bail, after being arrested on 40 counts.

Nov 11, 2011: Mary O'Connor, a spokeswoman for the Tampa (Fla.) Police Department,
said police are looking into what might have happened during a Penn State trip to the Outback Bowl in Tampa, but haven't decided whether to open a criminal investigation. The grand jury report says the trip was in 1998, although Penn State actually was there in 166 1996. An internal investigation decided to do nothing, about strong suspicions about child abuse by a counselor at the military school's camp.
Nov 14, 2011: Jack Raykovitz, chief executive of the Second Mile for the last 28
years, resigned.168 The charity said that it's launching an internal investigation of its procedures and policies and that it aims to have those findings by year's end. Second Mile said in today's statement that it has engaged new general counsel to take over for an attorney who resigned amid the uproar.

will help the Dept of Education try to determine if Penn State officials failed to report sexual assaults on campus as required by federal law. The department launched its investigation last 171 week.

Sandusky had access to kids, so that constrains investigations. How many years are places supposed to keep what records? I believe there are multiple statutes of limitations, such that
very few types of records are mandated to be kept, such as those associated with IRS audits, and supply chain of products relevant to consumer safety.

Nov 17, 2011: Police were investigating an assistant basketball coach at Syracuse University on allegations of child molestation. Syracuse placed longtime assistant coach Bernie Fine on administrative leave "in light of the new allegations and the Syracuse City Police investigation," the school said. Fine is accused of molesting a former Syracuse ball boy, Bobby Davis, who is now 39, in 1980s and 1990s. here: Everything documented in a high profile situation likely will find its way into the public arenaparticularly if tax payer dollars are involved, but even if not, its a very transparent world. So maybe should try to avoid foot in mouth embarrassing statements. Despite complexity and conflicts in the Penn State debacle, the officials making the decisions did not have the clarity of vision to see how their action and inaction would be communicated and seen. Replacement leadership was doing some of the right stuff, for the best interests of the institution.

PSU Alumni are deeply troubled by the revelations.241 More than 500,000 alumni
collectively gave $195.3 million to Penn State last year. Will they continue to give with the scandal enveloping the university? PSU Alumni raise $430,000.00 to help victims of sex abuse.242 Moody's Investors Service, a credit rating agency which performs analyses on commercial and government agencies. On Nov. 11, the service said it might downgrade the credit ratings of Penn State. The university currently has $1 billion in debt outstanding with a high credit rating of Aa1. In its statement, Moody's said it will evaluate "the potential scope of the reputational and financial risk" of the Sandusky scandal.243 PSU has a total operating budget of $4.6 billion.
Campus police face regulations under the federal Clery Act, which requires them to publicly report campus crimes and warn students when they happen. The Department of Education is now investigating Penn State for possible Clery Act violations. Universities also face an array of civil requirements under Title IX

Because of a state law and its unusual status as a state related but not fully public institution, university police records are not open to the public, as municipal police reports would be.
Appoint a task force this week to engage external legal counsel to conduct an independent review of the Universitys policies and procedures related to the protection of children. This action is not intended to interfere with the ongoing judicial process. Publicize findings of the independent review. Review police reporting protocols with administrators. Enhance educational programming around such topics.
The Board of Trustees had a phone meeting Tues Nov 08, 250 plans in person meeting Wed Nov 09, to discuss implications of the child sex-abuse scandal, and the university's response.
Many board members are said to have been furious that they have been kept out of the loop at key points since the charges against Sandusky were filed on Friday Nov4, including the fact that Spanier sent out a statement offering "unconditional support" for Athletic Director Tim Curley and college vice president Gary Schultz, both indicted for perjury and not reporting a sexual assault in the case. 251

University and The Second Mile, was heavily involved in coordinating the investigation, according to grand jury testimony by PSU officials.259 In the 2002 case, someone at Second Mile knew that Mr. Sandusky had engaged in unusual behavior with boys. CEO Jack Raykovitz was identified in grand jury testimony by PSU officials, as who was informed. He also testified, but their story was that nothing serious had occurred. This is part of the conflicting stories problem. In 2008, Victim # 1 seeks help. This leads to his school contacting the police, who launch an investigation which ultimately leads to recent arrests. While claiming innocent of the charges, Sandusky notifies Second Mile, whose public statements now say that out of caution to protect the boys, they severed his contact with the boys, pending resolution of the investigation.260 Second Mile may go out of business. 261 In a statement on their web-site, Second Mile claims all inappropriate behavior occurred outside of any Second Mile activities, but urge anyone with relevant knowledge to contact the authorities: investigators from the Office of Attorney General at 814-863-1053 or Pennsylvania State Police at 814-470-2238. Should a judge who reportedly has volunteered for the same organization that former Penn State coach Jerry Sandusky is alleged to have used to meet and abuse young boys have recused herself from his arraignment? For example, we get spam, where often it is evident that the persons sending the spam are engaged in some kind of crime, which law enforcement has the power to do something about, but I believe that the police do not want to be receiving reports from millions of people about each instance of a bogus e-mail. There are many other constructive things people can do to combat cyber crime but most people apparently aid and abet the spammers and hackers by taking no action beyond seeking to block such attacks directly upon themselves. This is a behavioral culture, that can undermine teaching future generations of the importance of reporting alleged crime witnessing. I believe that, except for secret federal laws, ignorance of the law is no excuse. However, state legislatures are constantly passing new laws, without the news media or the governments doing a good job of informing the public of the changed legal climate. Many of the new laws make sense, but many do not.
Changes in the laws, I would like to see. For crimes against children, statute of limitations frozen until they turn age 21, then let it run. If someone reports something suspicious, and it turns out to be a false alarm, you do not charge the person doing the reporting, with any kind of false police report. You only charge someone if they said something which was both factually incorrect, and you can prove they knew it was incorrect, at the time.

With natural evolution, the speed is inversely proportional to the size, life span, and complexity of the living organism. Microscopic life evolves on a time scale, where new diseases arrive every few years. For larger creatures, it can be millennia before a new creature is viable. We humans have created computer viruses, which can evolve
artificially. We have also created mediums through which ideas can evolve.
Evolution is both natural, and can be man directed, by honoring heroes as behavioral examples for future generations to emulate, and deriving wise systems of oversight and peer review, to promptly catch break-downs of standards, and do something constructive about them. We look back in history to see how ancestors behaved badly, their reasoning, why that reasoning is unacceptable today. That is an example of man directed evolution, where people used their minds to reason out that certain behavior was immoral, unethical, we can do better. Sometimes society improves, evolves so that on average, we are all better people. Sometimes it backslides,

devolves. I believe that in recent years, there has been this reverse movement, particularly in positions of leadership in politics, Wall Street, and some other types of institutions.
One reason is that Power corrupts, with unmitigated temptation. The more power, the more temptation, the greater risk of corruption.267 This is one reason why we constantly hear stories of corruption of political leaders, various celebrities. Our current society is doing a poor job of having systems to catch such failures in our behavior standards.
Sandusky case, people aware of the allegations, involving Conlin years ago, did not go to police. When we look at the people identified so far, involved in this case, they are all men, except for the Attorney General. Sometimes the boys will be boys attitude contributes to the covering up of rape, sexual assault, bullying, and other illegal and immoral activities. The Sandusky case is Commonwealth of Pennsylvania v. Sandusky, MJ-49201-CR-6362011, Centre County, Pennsylvania, Magisterial District Court 49-2-01 (State College).272 Sandusky is facing forty charges involving the sexual abuse of children, all boys between about seven and twelve years old. He claims he is innocent of all charges.273 As the investigation adds info about particular incidents, numbering the victims, they are not in chronological sequence of incident, but as facts about them and allegations about incidents are uncovered.
Sandusky's attorney Joe Amendola has said his client, who left Penn State coaching in 1999, was shaken by the charges but knew they were coming. "He's maintained his innocence," Amendola said.274
Some news media is now questioning whether she should have suspected something over all those years.275

Much of Sandusky's grooming (and some of the assaults) of his victims ages 8 to 15 occurred in Sandusky's own home, at family events, or at times and in ways that you'd think any observant family member -- or even anyone associated with him -- would have surely stopped herself to think, "Hmm, isn't that behavior a little strange?" And what was child protective services doing when Mr. and Mrs. Sandusky were adopting kids 276 left and right? Isnt there supposed to be home inspections, to find out if any kids are at risk?

According to Center Daily Times:285 Caroline Roberto, representing Penn State Athletic Director Tim Curley, issued the following statement following his arraignment on charges of perjury and failure to report: Tim Curley is innocent of these charges. We will vigorously confront these challenges in court. Now I have three observations. First, as you heard in the courtroom, the duty report charge is a summary offense. Thats like a speeding ticket. Under the law, a duty to report didnt even apply to Tim Curley or to his situation at Penn State. In this case, the offense occurred in 2002, and theyre trying to charge Mr. Curley with perjury for something he said nine years later. It is a distraction in this case, the charge of perjury, and it is unconscionable that the AGs office would level such a weak case against a man of integrity like Mr. Curley. I will tell you, and you should know that this perjury charge is a red flag for all of you today that the charges against Mr. Curley are weak. After 18 months investigation, if this is all the AGs office could bring we are ready to go toe to toe with them in court. Were ready to fight this case, and were ready to win.
Pittsburgh lawyer Thomas J. Farrell, who represents Schultz, has said he will seek to have the reporting charge dismissed, because, to his reading, the mandated reporting rules only apply to people who come into direct contact with children. He also said the statute of limitations for the reporting charge is two years. The alleged abuse occurred in 2002.287

Farrell, the attorney representing Gary Schultz, issued this statement following Schultz's arraignment on charges of perjury and failure to report: Rather than follow the law, the AG has fabricated a fiction here. And number two, they did what they are supposed to do under the statute. They reported these allegations to their boss, the president of Penn State University, as well as the executive director of the Second Mile. They did exactly what Mr. McQueary did, which was report to Joe Paterno, his boss. They did exactly what Mr. Paterno did, which is reported to Mr. Curley. Theres no reason they should be charged with this offense, a summary offense. Ill tell you whats going on here. The prosecution is [holding] it to the grand jury to manufacture a charge. Its a form of prosecutorial misconduct called a perjury trap. You bring someone into a grand jury to investigate something that cant be prosecuted, something that isnt a crime, and then you take that persons inconsistencies or inaccuracies, or failure to remember what happened nine years ago. Then you manufacture a charge out of it. Thats what the Attorney General has done to these men. These men are the best of men. Mr. Schultz was in charge of the Penn State police and over his career insisted that time and again they investigate misconduct, alleged misconduct by professors, by coaches, by star football players. It was all investigated thoroughly. Most importantly he told the truth. He told the truth, as did Mr. Curley. You folks may have seen Mr. Paternos statement. Mr. Paternos statement matches their statement. They were given a general allegation of inappropriate conduct. Thats what Mr. Paterno told them. Thats what Mr. Paterno told you folks yesterday. And thats what he testified to in the grand jury. Theyre innocent. He later added, addressed to the Penn State community: Its difficult because these are such good men. This will do nothing to their reputations.
"What happened here was 'grooming,' where these predators identify a child, become mentors ... then give them gifts, establish trust, initiate physical contact, which eventually leads to sexual contact," Noonan said.290

Corbett had convened a grand jury, and his prosecutors had taken testimony. Frank Noonan, at the time, was Mr. Corbetts chief investigator. But when Corbett ran for governor, and even after he took office, he was obligated to keep the investigation secret, even as he saw the university officials at the center of the investigation doing little to address the substance of the inquiry.
The only people Corbett could talk to about it were the few people he had brought with him from the attorney generals office; grand jury secrecy laws barred him from discussing it with outsiders, including university trustees he had appointed.291

There needs to be a Public Health campaign, to inform adults of our responsibilities to report crimes and suspicions of crimes, of what kinds, to what authorities. We need easy access to a digest of new laws and regulations, that can impact people by the nature of our lives. At the beginning of most every class in academia, at all levels, there needs to be a presentation by a representative of law enforcement or the judiciary on what activities are appropriate and what are inappropriate in the conduct of the students gathering info for their class. What may be downloaded from the Internet; where may photographs be taken, or drawings made, or audio recordings; what places in the public may not be used by the public; what actions are allowed for the police, but for no one else.

I remember first being told some of this stuff in the school yard of elementary school. The first time I did not believe it, thinking it was urban legend or science fiction. I remember being told how bad illegal drugs were, but never being told how you could tell what they looked like, smelled etc. It was like adult urban legend or science fiction. I was probably better off being ignorant, since I never developed serious bias against people whose values or behavior fell outside what I was taught from official and unofficial sources. Thus it is perfectly understandable to me that some of the young adult witnesses of Mr Sandusky alleged deviant behavior, would not have the foggiest notion what the heck was going on, and what to do about it. A big difference today, is that schools are teaching students to do what adults tell them to do, with serious consequences for disobedience.
Before you NEED to know how to call for help, make sure front of your phone book has phone #s you may need, in addition to 911, such as child protective services, poison control hot line. Witness a rape in progress: get help for victim as fast as possible. 297 If an incident is occurring in front of you, call 911. If a child tells you he or she is being abused, don't panic, don't act shocked. Make sure the child feels supported and protected. Say, "You did the right thing in telling me." Give the child the benefit of the doubt. Contact police first, they will investigate then decide when child protective service should enter the picture. Focus on the child's needs, not the reputation of the accused abuser. You might be the only person the child confided in. A lot can get lost in translation. More than one person can report abuse, and it's not uncommon to get multiple reports for one child. Each person can hold a piece to the puzzle.298 If the alleged molester is a member of the clergy, DO NOT report the abuse to church officials. If the alleged molester is a coach or teacher, DO NOT report the abuse to the school authorities. Some churches and organizations worry more about lawsuits and bad publicity than about kids, and sometimes the alleged molesters helpers are in positions of authority within the institution, able to block investigations. Just call the police. If someone else says they witnessed a rape: tell them to get off phone with you, call police;

This area of confusion is not getting addressed in most of the debate, rather proposals for new laws focus on whether the witness should bypass employer and report directly to police, or whether the top management of institution have the responsibility to decide whether to get the police involved.
The administration knows what officialdom needs to be notified for what kinds of events, and is supposed to do so promptly. It seems to me that the grand jury, and current investigation, has this interpretation. That is why Curley and Schultz were arrested, why Spanier is still under suspicion. The original witness is not in trouble, under the law, because he was not authorized to make decisions on behalf of the institution, he was a worker bee, like the janitors. If this law was on the books in 2000, then under this interpretation, Jay Witherite had an obligation to report up the chain of command, what the two janitors had reported to him.

The witness was distraught at what he had witnessed. He went to his office, phoned his father for guidance, John McQueary. Next morning, Mike phoned Paterno at home, then went to visit him, accompanied by his father, to report what he had witnessed. Paterno in turn, called his boss, invited him to his home, to pass on the information. On Sunday, according to Paterno, he briefed the athletic director, Tim Curley, about the conversation with the assistantexactly what he told him is in some dispute. The authorities now say that Paterno did exactly the right thing, he promptly reported up the chain of command.310 Sports fans apparently expect more. They think he should have known what was going on, in the area he was in charge of.
In contemporary 2011 public statements, Parerno shares Curley and Schulttz statements that they dont remember the shocking same details as the witness told the grand jury.311 But at the time, after being briefed by the witness and his father, he knew it was serious enough to call his boss, and brief him, that weekend.312 Also, under oath to the grand jury, he shared what he remembered. He said he told Curley that Sandusky had been seen fondling or doing something of a sexual nature, with a boy in the showers. A week and a half after the incident, the graduate assistant was asked to a meeting with Curley and Gary Schultz, a university vice-president. The graduate assistant testified that he told them that he had witnessed what he believed to be Sandusky having anal sex with a boy. They tell the grand jury a rather different story. A couple of weeks later, athletic director Curley let the graduate assistant know that theyd said something to people at a foundation Sandusky supported, The Second Mile, which was meant to benefit boys in difficult situations (this is how he seems to have found his alleged victims). In grand jury testimony, Curly identifies Dr. Jack Raykovitz, Executive Director of Second Mile, as who specifically was told, and fleshed out other details which he had only summarized to the graduate assistant. In testimony by different people, theres conflicting stories about what meetings were held, who was told what, who was at which meetings. Since the 2002 events were being testified to in 2010, memories can get faded. 313 We have no idea how often this kind of story has to be dealt with by University administration officials, so it is reasonable that one incident can have details falling from their recollection. Just as the Grand Jury has to deal with whos testimony is most believable, University administration had a similar task.

Mr. Curley and Mr. Schultz said PSU President Graham Spanier was told that an incident had occurred in the shower but was not given the full details initially reported by Mr. McQueary.314
Just stop doing it here, on the main campus. However, for the next six years, Sandusky brought boys to events on other campuses of Penn State.316 Also, Sandusky was not banned from main campus, just from bringing kids from his charity to the football facilities to do what he was alleged to be doing with boys, there. Fair and Balanced Fox News reports Sandusky was seen on the main campus as recently as the week before the story broke.317

The grand jury report says the boy involved in the 2002 case had not been identified. Sanduskys Lawyer says that boy has now been identified, and the boy says nothing happened.318 But we have no way of knowing how many boys involved in 2002. Maybe something happened with one of the others. Proving a negative is always a challenge.
While an investigation is in progress, people are sometimes instructed not to speak with the news media about their testimony, so as not to muddy the waters, confuse the story. I am sure McQuery will be called upon to testify in up-coming trials, unless there is plea bargaining, which does not yet seem likely. Thus he should NOT be speaking with the media. But instead of saying that, there is this game of PR which backfires. As the story broke Nov 2011, McQueary's father told reporters his son could not be reached for
comment because he was on a recruiting trip. As in talking to families? The faculty doesn't deserve this. The researchers who this very week announced progress in preventing kidney failure don't deserve this. Neither do the 80,000 students or the 550,000 living alumni, including a nationwide high of 22,000 in Allegheny County.
