AUCTIONEERS NOTES TO BIDDERS This book has been designed by Auctions International, and approved by the City of Tonawanda Treasurer, as a guide to help you decide which properties you might be interested in bidding on at the auction. The properties will be sold in the order they are listed. Properties are sold subject to Tonawanda City Council approval. Successful bidders will be required to place a deposit on any property they are the highest bidder on, plus a buyers premium to be paid to the auctioneer. At the auction, we will accept cash, money orders, company / personal checks (with valid ID) and any form of certified funds. Deposit monies will be held in escrow until common council approval. Any bids that are declined by the City will be refunded in full. We have done our very best to insure the information contained in this catalog is accurate and up-to-date. HOWEVER, it is completely up to you, the bidder, to inspect the properties for yourself, in person, BEFORE YOU PLACE ANY BIDS! Information contained in this catalog is deemed accurate, BUT NOT GUARANTEED! Sometimes potential customers at the auction are hesitant to place any bids because they didnt inspect the properties before the sale. DO YOUR HOMEWORK! Weve complied some useful contact numbers at the bottom of this page. USE THEM! Pick up the telephone, make some calls, and do good research on the properties you are interested in. This could be a great opportunity for you to purchase property at a much lower price than the retail market. But, if you havent inspected the property, you are taking a chance, and may be disappointed after the auction. Please read the terms and conditions of the auction carefully (following this page). The premises described below will be sold under the direction of Joseph M. Hogenkamp, City Treasurer, upon the following terms: Sale of the property will be awarded to the qualified person or persons submitting the highest dollar amount, subject to provisions herein:

Ten percent (10%) of the purchase money of said premises will be required to be paid in cash or check to the City Treasurer at the time and place of sale. Additionally, a buyers premium of 10 % of the bid will also be due, separately payable to Auctions International. The balance of said purchase money will be required to be paid by check, payable to Tonawanda City Treasurer at his office at City Hall, 200 Niagara Street, Tonawanda, NY within thirty (30) days of the bid date, or sooner, upon delivery of the Bargain and Sale Treasurers Deed. Upon payment, the City Treasurer will provide a copy of the Treasurers Deed and the City Treasure will file the original Deed in the Erie County Clerks Office. Said Deed shall be subject to any easements and restrictions of record. Every Deed shall contain a covenant to the effect that the City of Tonawanda shall in no event be or become liable for any defects in the title so conveyed for any cause whatsoever, or that no claim or demand of any nature shall ever be made against the City of Tonawanda arising from such sale or any proceedings leading thereto. The City Treasurer is not required to send notice to the purchaser. The City Treasurer, within his sole discretion, may deem it proper to extend the time for completion of said purchase. In case any purchaser shall fail to comply with the above terms and condition of this sale, the purchaser will forfeit their down payment and their right to the property bid upon and has no further claim against the City of Tonawanda, its agents, servants and employees. The purchaser of said premises will, at the time and place of sale, sign a memorandum of their purchase and an agreement to comply with the terms and conditions of sale herein contained, and pay, in addition to the purchase money, the recoding fee and deed stamps for each parcel separately sold. The original Bargain and Sale Treasurers Deed will be returned to the purchaser after it has been duly recorded at the Erie County Clerks Office.

The City will not provide a title search or survey. The property is to be sold without any warranties in AS-IS condition and all responsibilities, including the physical condition of the property, become those of the purchaser upon transfer of the Deed. The property is being sold subject to: (A) Rights of the public and others in and to any part of the premises that lies within the bounds of any street, alley, or highway; and restrictions and easements of record. (B) Any state of facts that an accurate, currently dated survey might disclose. (C) Rights of tenants, if any. It shall be the responsibility of the purchaser to evict or remove any parties in possession of premises being foreclosed herein. There shall be no adjustment on a pro-rata basis in favor of the purchaser for any rents that are paid for a period after the date of this sale.

Only qualified purchaser will be allowed to bid on the property. Those persons who owe the City of Tonawanda real property taxes shall be non-qualified. All properties sold subject to the City of Tonawanda Common Council approval.
