Members of the ND State Republican Party Erin Bertel immediate past Chair of District 46 Breach of State Statute, D46 By-Laws at D46 Reorganization Meeting on January 19, 2012 January 23, 2012

To members of the State Republican Party Executive Committee regarding illegal irregularities that occurred at our Reorganization Meeting held on Thursday, January 19, 2012. I formally request that the NDGOP Executive Committee membership revoke the District 46 Reorganization that occurred on January 19, 2012 at Fargo South High School and so order a new Reorganization of the 46th Legislative District meeting to be monitored by the state NDGOP leadership. At this time we believe the actions of Representative Jim Kasper and others have negated the validity of the outcome of District 46s Reorganization meeting. My reasons for this request are based on the following violations of but not limited to State Law, ByLaws of the 46th Legislative District and Roberts Rules of Order. 1. URC Chair and D46 Member, Vicki Fredrikson, for providing unethical and illegal statements to all Republican Party members present at the URC general assembly and the Members of District 46. These statements and actions were not made in the best interest of the NDGOP, the Republican Party and all Districts in Cass County. Penalty of such violations are grounds for removal of the URC Chair. 2. URC Chair and D46 Member, Vicki Fredrikson, for failure to defend the use of the URCs recommend and published allocations of precinct committee persons per precinct (via Pam Younggren and Cass County Auditor, Mike Montplaser). These statements and actions were not made in the best interest of the NDGOP, the Republican Party or District 46. Penalty of such violations are grounds for removal of the URC Chair. 3. National Committee Woman and D46 Member, Sandra Boehler for twice denying opportunities to all Republican Party members present at the URC general assembly and the Members of District 46 under obligation to stand up for the best interest in the NDGOP, the Republican Party and District 46 to declare actions to be unethical and illegal. National Committee Woman Sandra Boehlers failure to defend her National obligation to uphold North Dakota State Law, the Constitutional rights of the people of Cass County and of District 46. Penalty for such violations are grounds for removal from the National Committee. 4. National Committee Woman and D46 Member, Sandra Boehler for interfering with D46 Executive Committee positions in vying for the Vice Chairwoman position. These actions were not made in the best interest of the NDGOP, the Republican Party or District 46 and are in direct conflict with her position as National Committee Women. Penalty for such violations are grounds for removal from the National Committee. 5. Representative, Jim Kasper for denying opportunities to all Republican Party members present at the URC general assembly and the Members of District 46 under obligation to stand up for the best interest in the NDGOP, the Republican Party and District 46 to declare actions to be unethical and illegal. statements and actions were not made in the best interest of the NDGOP, the Republican Party or District 46. Penalty for such dishonorable violations are grounds for removal of office and negation of the election process Representative, Jim Kasper for providing highly unethical, unlawful statements, and illegal actions to the Members of District 46 and D46s Executive Committee . Jim Kaspers actions to re-allocate precinct committee members-- against Cass County Auditor information released allocations-- are in direct violation of North Dakota State Law. Representative, Jim Kaspers failure to defend and uphold North Dakota State Law, District 46 By-Laws, and the Constitutional rights of the people of District 46, these actions were not made in the best interest of the NDGOP, the Republican Party or District 46. Penalty for such violations are grounds for removal of office and negation of the election process. Representative, Jim Kasper acting as the District 46 Chair using his proposed list to influence is illegal doing so compromised the District Chairs neutrality. These statements and actions were not made in the best interest of the NDGOP, the Republican Party or District 46. Penalty for such actions are grounds for removal of office and removal of the election process. Representative, Jim Kasper holding the position of District 46 Chair is an illegal action that violates the By-laws of the 46th Legislative District. These statements and actions were not made in the best interest of the NDGOP, the Republican Party or District 46. Penalty for such violations are grounds for removal of office and removal of the election process. Representative, Kathy Hawken for denying opportunities to all Republican Party members present at the URC general assembly and the Members of District 46 under obligation to stand up for the best interest in the NDGOP, the Republican Party and District 46 to declare actions to be unethical and illegal. Representative, Kathy Hawkens failure to defend and uphold North Dakota State Law , District 46 By-Laws, and the Constitutional rights of the people of District 46. These statements and actions were not made in the best interest of the NDGOP, the Republican Party or District 46. Penalty for such dishonorable violations are grounds for removal of office and negation of the election process. Representative, Kathy Hawken appointed D46 Parliamentarian actions to improperly address motions made by members of District 46 and declare untruthful and illegal facts to the Members of the 46th Legislative District. Representative, Kathy Hawkens failures to defend and uphold North Dakota State Law and Constitutional rights of the people of District 46 violates North Dakota State law and Roberts Rules of Order. These statements and actions were not made in the best interest of the NDGOP, the Republican Party, or District 46. Penalty for such actions are removal of office and removal of the election process.

Other actions requested by the executive board: It is the expectation that the executive leadership of the NDGOP will immediately revoke the reorganization that occurred and reinstate the former District Executive officers, order a new reorganization meeting, censure those individuals that participated specifically: Representative Jim Kasper, Representative Kathy Hawke, Vicki Fredrikson, Sandy Boehler, Chris Dietch, Mark Johnson, Hal Ecker, Sandy Kasper, Sylvan Melroe, Marsha Carlson, Evelyn (Evie) Iverson and Margaret Mowery and to establish a protocol where the state NDGOP will send monitors to the new reorganization meeting to ensure that the process of reorganization is protected and not compromised.

Regarding the specified individuals I request you inform me whether or not they will be permitted to participate, in any manner other than silently casting their vote. If not, I request you inform me of the steps, if any, which will be taken to censure, specified individuals. Earlier I was contacted with an offer. The offer was not one that would bring District 46 into compliance with either State Law or our Republican Partys By-Laws, in its reorganization efforts. I was asked to write a statement outlining, in detail, the actions I believe resulted in an invalid reorganizational effort. I am in the process of doing so. Because of the seriousness of this matter and my intention and responsibility to ensure the improprieties that occurred on January 19, 2012 are properly corrected that statement will require several days of preparation. It is my intention to fully document exactly what occurred and what failed to occur; to discuss my conclusions with other participants to guarantee they are accurate and nothing has been omitted; to have my statement reviewed so I can properly distinguish what was or may have been improper in regard to State Law and State Party By-Laws. Following the meeting on Thursday the 19th of January significant things have occurred. Some of those happenings may have direct bearing on what is or will be necessary to correct the outcome of District 46s attempted reorganization effort. The result of these violations have severely harmed the North Dakota Republican Party and the constituents of District 46 by denying them access to the rights and privileges of the aforementioned North Dakota State Law, By-laws of the 46th Legislative District and Roberts Rules of Order. The consequences result in a party process that ignores the voters and the Constitution. Ultimately if this reorganization is allowed to stand, confidence in the system will be lost and faith in the Republican Party Leadership to maintain fairness and integrity will be forever tarnished. At this time I wish to simply inform the State Executive Committee that, in my opinion and that of many other District 46 Republican Party members, District 46 has no valid or legitimate Executive Committee and no valid District Committee. Further, I believe either District 46 has no legitimate legal existence or its governing structure prior to January 19, 2012 remains the legal governing body. It is my belief the latter is the case. Pending the full detailed report to the State Executive Committee I request you either confirm my conclusions or in the alternative identify who you recognize as the legitimate governing body of the District 46s Republican Party. In the event you agree with my position on this matter, I will take the appropriate steps to call for another reorganization meeting, taking steps to ensure to guarantee a proper and legal reorganization meeting. It should be noted that this letter represents the point of view and position of those individuals present at the meeting that voiced their dismay of the horrific event that they observed. It is our position that the Republican Party has only one course of action available to them in regards to this situation. Failure to act will continue to cause irreparable damage to the voters of District 46 and all Republicans in the State of North Dakota. It is important that I am notified of your response in an extremely timely manner. Please contact me immediately upon your response.
