10/8/1983) on charges of Child Abuse on 2/25/2012 at 1550 hours. Both arrests stem from the same episode,
which originated as an incident of road rage on US Highway 36 in the City and County of Boulder, State of
Colorado, and ending at 3910 Table Mesa Drive in the City and County of Boulder, State of Colorado.

Narrative
On 02/25/12 at approximately 1534 hours, Boulder Communications aired a tone alert regarding a felony
menacing involving a handgun, and I (Officer Kirshbaum) was dispatched to the call. The reporting party, later
identified as Bently Jay Woods (DOB 08/15/1972), reported that the driver of another vehicle pointed a handgun at
him in the area of US Highway 36 and the Foothills Parkway exit, located in the City and County of Boulder, State
of Colorado. The vehicle Woods described was a white four door Dodge bearing Oklahoma Cherokee Nation
license plate 24813C. Woods continued to provide updated locations to Communications, and described the
driver as wearing a red shirt. At 1543 hours, other Officers had located and stopped that vehicle in the parking lot
of 3910 Table Mesa Drive in the City and County of Boulder, State of Colorado. I arrived on scene as Officer R.
Lord was ordering the driver out of the vehicle, later identified as Jimmy Lee Fleetwood (DOB 3/8/1984). Jimmy
was wearing a red shirt. Lord then ordered the front seat passenger out of the vehicle, later identified as Michael
Fleetwood (DOB 8/25/1988). I could see that there was an adult passenger in the back seat (passenger side), and
I heard an officer announce that there were children in the back seat, and I heard an officer announce that there
was a handgun in the back seat of the vehicle.
Lord ordered the rear seat passenger out of the vehicle, later identified as Lauren Whitney Fleetwood (DOB
10/8/1983), and then Officers Lord and R. Smith and I approached the rear of the vehicle. In the back seat were
two children, later identified
are Jimmy and Lauren.
I observed Smith pick up a silver and black semi-automatic handgun from the rear passenger seat, directly next to
where was seated. were in Child Restraint Systems as required by State Law. Lord and
Smith then helped out of the vehicle, and they were placed into the care of other officers.
Smith cleared the handgun to make sure that it was safe, and discovered an empty chamber. I heard on the radio
that Officer Smetzer was in contact with Woods at a separate location.
I observed a magazine, with bullets in it, on the floor directly behind the driver's seat. I photographed the vehicle,
the gun, and the magazine, and observed the license plate on the vehicle to be exactly the plate that dispatch had
originally aired. During my photographing, I also found a single bullet on the back seat, directly under where
had been seated. I extracted the bullets from the magazine, which had a 16 bullet capacity. There were
15 bullets in the magazine. Officer Frasier took the handgun and bullets to submit to the Property and Evidence
Division of the Boulder Police Department.
Smetzer drove Woods past the area that Jimmy, Lauren, and Michael were, and Smetzer advised over the radio
that Woods had positively identified Jimmy as having been the person who pointed a gun at him.
Jimmy was transported to the Boulder County Jail by another officer, and Lauren was transported to the Boulder
Police Department where I interviewed her at 1655 hours in an interview room. Lauren was seated facing the
door, which was open. I read Miranda Advisement to Lauren, and she agreed to talk to me. She signed a Boulder
Police Department Advisement/Waiver Form which has been submitted to the Records Division of the Boulder
Police Department under this case report number.
During my interview with Lauren, she informed me that she and Jimmy had just moved to , Colorado three
weeks ago from Oklahoma, and that "Jimmy's having a hard time adjusting to city life". She stated "we're scared
to death of where we live", and said that there are gang members who live in their apartment complex and that
they have already witnessed a pool of blood on the ground in the area of their apartment. Lauren told me that
Jimmy's brother Michael had come to visit to help Jimmy get adjusted to city life, and that they all came to Boulder

to visit one of Michael's friends.
I asked her to describe what happened between the car she was in and the other car, and she told me that the
other car was "weaving in and out of traffic, blocking us from getting around him". She said that Jimmy sped up to
get away from him because "he was chasing us and following us". Lauren said that at one point Jimmy said he
was going to stop the car and ask the other driver why he was following them, so Jimmy stopped. Lauren stated
that Jimmy and Michael got out of the car but the other car drove away. Lauren said they drove away as well, but
then the other car returned and began following them again. Jimmy stopped the car a second time and saw that
the other driver was on the phone, but rolled down his window to "ask him what is going on". Lauren said the other
driver told Jimmy "well, you pointed a gun at me".
I asked Lauren why the other driver would say that, and she told me "I don't know".
I asked Lauren if there had been a gun in the car she was in, and she told me yea. I asked her where, and she
told me "I had it under my leg in the back seat". "I don't know where the clip was". I asked Lauren if she knew how
the single bullet had ended up on the back seat next to or under where had been sitting, and she told me
it "might have been during the move".
I informed Lauren that dispatch had been told details about the gun being silver and black, and that we had found
a silver and black gun in the back seat of their car, directly where she was sitting. She told me the gun was hers,
and that she and Jimmy carried it with them all the time because they were so afraid of gang related violence. She
said that she bought it approximately a year ago in Oklahoma. Lauren repeatedly denied having seen anyone in
the car point the gun at anyone else. When I told Lauren that I did not believe the explanation of events she was
telling me, she then stated that the gun was originally "in between the driver's seat and console", and that "at
some point when that guy was chasing us, he (Jimmy) handed it back to me and I put it under my leg".
I asked Lauren if Jimmy had said anything to her when he handed her the gun, and she told me no. She told me
that she heard Jimmy ask her at one point to call the Police, but that she did not know the number for the Police
since she did not know the area at all.
I asked Lauren who had the gun when they all left their apartment earlier in the day, and she said "Jimmy did".
I asked her again about the single bullet on the back seat, and she said "maybe it fell out from being tossed
around". When I asked her a second time where the clip was, she said "I think it was under the seat".
I ended my interview with Lauren at 1750 hours, transported her to the Boulder County Jail, and arrested and
jailed her on a single charge of Child Abuse (criminal negligence) for knowingly placing a gun and ammunition in
close proximity young children.
At the Boulder County Jail, I met with Jimmy and read Miranda Advisement to him. Jimmy immediately stated that
he wanted a lawyer and did not wish to talk to me.
I arrested and jailed Jimmy on charges of Felony Menacing, Child Abuse (criminal negligence), and failure to
properly adhere to Colorado Child Restraint Laws.
This case status is cleared with two adult arrests.

Narrative
Responding units located the suspect vehicle just east of Broadway on Tablemesa. I was asked to meet with the
victim of the menacing in the 400 block of 41st Street.
At approximately 1548hrs I met with the victim, Bently Jay Woods (DOB: 081572) in the 400 block of 41st Street.
This location is approximately two blocks from the location of the arrest. Woods advised he was driving Boulder
bound on US36 when he noticed a vehicle weaving in and out of traffic behind him. Woods exited US36 onto
northbound foothills and observed the white vehicle follow him northbound on Foothills Pkwy. Woods advised the
vehicle drove up and began tailgating him very closely. Woods tapped his brakes to alert the driver behind of his
proximity. Woods was looking in his rearview mirror and observed a white male with a red shirt and tattoos over
his arms lean forward and point a handgun at him. Woods told me he feared for his life and was afraid for his
safety when he saw the gun.
Woods told me the vehicle passed him and took a right (eastbound) turn onto Baseline. Woods followed the
vehicle through several neighborhoods and lost sight of it when it was located by Police.
I asked Woods what color the handgun was. Woods advised it appeared to be silver with some black on it. He
described the driver of the vehicle as a white male wearing a red shirt and with tattoos on his arms. I asked him if
he would recognize the male again if he saw him. Woods advised he would.
Officer Burke set up a 'show-up' of the suspect. Woods sat in my vehicle and I explained that we would be looking
at several people that may or may not be in handcuffs. I advised Woods not to associate guilt with the presence
of Police around the people and to rate the person on a 1 to 10 scale with 1 being absolutely not the person to 10
being absolutely the person involved in the menacing. We entered the area and Woods observed a male in a blue
shirt. He immediately said "That guy in the blue shirt, that's the passenger." Woods then observed the male in
the red shirt and said, "That's the guy with the gun. That's absolutely him." I asked him to put him on the scale
we discussed. Woods confirmed, "Ten. Definitely ten." I relayed that information to Officer Burke.
Woods began filling out a voluntary statement and was visibly shaken by the experience and I offered him victim
advocates that he declined.

Summary Narrative
This supplemental report will document my involvement in this case. I (Officer Frasier) spotted the suspect vehicle
at 43rd St/Table Mesa, turning west bound on Table Mesa. I initiated the "hot stop," and arrested the suspect. I
assisted the primary officer on scene with processing the suspect vehicle, recovering a pistol and ammunition,
and later booked the pistol, its magazine, and ammunition into Property and Evidence.

On 02/25/2012, at approximately 1534 hours, I (Officer Frasier) left the PD with my patrol car and heard Dispatch
airing a tone alert for a Felony Menacing with a handgun, out of a vehicle, at Manhattan/Santa Clara. I drove south
on Foothills Pkwy and stopped at the off ramp of Foothills Pkwy/Table Mesa, observing the intersection. Dispatch
aired that the last location of the suspect vehicle, a white dodge 4-door with Oklahoma Cherokee Nation license
plate was further west of my location. Dispatch continued updating the location and I finally saw the
vehicle on the south side of the intersection of 43rd St/Table Mesa, turning left, west bound on Table Mesa. I was
able to get directly behind the suspect vehicle and had a second patrol car behind me. I initiated a "hot stop." The
suspect vehicle pulled into a parking lot on the south side of Table Mesa, just east of the Conoco gas station. The
suspect vehicle stopped in the middle of the almost empty parking lot. I attempted to use my Public Address
System to verbally contact the driver, but it did not work. I pointed my handgun at the suspect vehicle and Officer
Lord, who was just east of my location started talking to the driver of the suspect vehicle. Officer Lord talked the
suspect out of the vehicle and advised the driver, later identified as Jimmy Lee Fleetwood to walk backwards
towards my patrol vehicle.
I saw a child in the middle of the rear seat and aired this information on the radio.
I took over giving Jimmy Fleetwood verbal commands. I directed him behind my patrol car and placed him in
handcuffs. I told him to get into a kneeling position to search him for weapons. I asked Jimmy Fleetwood if he had

any weapons on him and he stated "no." I did not find any weapons on Jimmy Fleetwood.
Jimmy Fleetwood asked me what was going on and why we were doing this. I advised that police was dispatched
to a felony menacing. Jimmy Fleetwood asked me "what?" and I told him that a victim had called 911 and had
reported that out of his car, a handgun had been pointed at the victim. Jimmy Fleetwood said "I don't have a gun."
I asked Jimmy Fleetwood if there was any gun in his vehicle. Jimmy Fleetwood said "my wife has a gun." I aired
this information on the radio. Jimmy Fleetwood also stated that were in the car. I updated on the radio
that there were inside the vehicle. Jimmy Fleetwood started to look over to the male who had been
sitting in the front passenger seat of this vehicle and told me that this was his brother. Jimmy Fleetwood started to
become more and more agitated and loud, talking about . Jimmy Fleetwood asked me if I was taking him
to jail. I told him that we were still investigating and that I had to find out. I placed Jimmy Fleetwood inside of my
patrol car and buckled him up with the seat belt.
Jimmy Fleetwood told me that we should arrest the other guy. Jimmy Fleetwood advised that another car had
been following them. At one point Jimmy Fleetwood had stopped the car. His brother got out of the car "and the
other guy almost ran over my brother."
I contacted Sgt. Wyton on scene and briefed him about my observations. Sgt. Wyton told me to assist Officer
Kirshbaum, the primary officer, with processing the vehicle. A silver/black pistol was on the ground on the driver
side of the vehicle. Officer Kirshbaum took pictures of outside and inside of the vehicle. I saw a pistol magazine in
the foot section of the left rear of the vehicle. Officer Kirshbaum later asked me to book the pistol and the
ammunition. Officer Kirshbaum unloaded the magazine which contained 15 rounds. I placed each round into
individual envelopes and marked them. Officer Kirshbaum also gave me the magazine. Officer Kirshbaum
continued to process the vehicle and found a single round of ammunition on the rear passenger seat, close to the
middle. Officer Kirshbaum also handed me this round.
Jimmy Fleetwood continued to be loud and agitated in the rear of my patrol vehicle. I opened the door and
advised him that I would transport him to the jail. At that time I noticed that Jimmy Fleetwood was not wearing his
seatbelt anymore. I asked him why he had unbuckled his seat belt and he told me that I had never put it on before.
He complained about his handcuffs being to tight. Officer Kirshbaum assisted me in checking and adjusting
Jimmy Fleetwood's handcuffs. I then transported Jimmy Fleetwood to the Boulder County Jail.
I booked the pistol, a 9 mm, Smith & Wesson, SW9VE, the magazine, and a total of 16 rounds of 9 mm, Luger
ammunition into Property and Evidence. The 15 rounds which had been removed from the magazine were first
individually packed, and then packed together in one bigger bag. The single round which was found on the rear
seat was packed separately.

On 02/25/2012, at approximately 1535 hrs, I, Officer Richard Smith, heard officers being dispatched to the area of
Manhattan Dr and Santa Clara Dr, City and County of Boulder, State of Colorado, in reference to a Felony
Menacing that had just occurred. I responded to the area to assist.
I heard Officers find and stop an involved vehicle at 3910 Table Mesa Dr, City and County of Boulder, State of
Colorado. Upon my arrival those officers had already initiated a Felony Stop of that vehicle and were in the
process of removing the occupants. As I approached Officer Lord's Patrol vehicle, I heard that there were
in the vehicle as well as a weapon. After the three adult occupants had been removed from the vehicle, I
approached the vehicle with Officer Lord. Officer Lord approached the left side of the vehicle and I checked the
back of the vehicle through the back window. I then approached the right rear door which was still open. As I
approached the door I saw sitting in the back seat. The , was in the left rear
seat, and , was in the middle of back seat. I saw a black and silver handgun sitting on
the seat (right rear) directly next . The weapon was laying on it's right side. I could see that the
magazine had been removed from the weapon but the slide was closed and the barrel of the weapon was pointing
towards . For safety reasons, I grabbed the handgun and removed it from the vehicle. As I was
walking away from the vehicle I asked Officer Kirshbaum to cover Officer Lord. I then cleared the weapon by
locking the slide to the rear. As I did this I noted that the chamber was empty. I then placed the weapon in my
right leg cargo pocket. Officer Lord asked me to take one of and I escorted away from the
vehicle and had her sit in the back of Officer Lord's Patrol car. was visibly upset and was crying and
shaking. I tried to talk and calm down. were later placed into the back of my patrol
vehicle. I started the In Car Camera System to record them as they sat in my car.
Both of had asked for their Nintendo DS game systems which were still in their vehicle. I found one
blue Nintendo DS on the left rear seat where had been sitting and a pink Nintendo DS on the right rear

floorboard. I removed both of the game systems from the vehicle so that could play with them.
After providing both of with a snack (chips/crackers/and water), I was talking to them to keep them
calm. Both seemed to have calmed down by this point and we were talking about cartoons, pets, toys,
etc. While talking to about Nerf toy guns, stated that knew that had a gun and said
that had a gun to protect them (the family).
The were later released to their uncle who was on scene.

On 02/25/12 at approximately 1534 hours, Boulder Communications aired a tone alert in reference to a felony
menacing involving a handgun. The complainant/victim was following the suspect vehicle (described as a white 4
door Dodge) and giving updated locations to Communications. I responded to the area and the suspect vehicle
was stopped in the parking lot just to the east of the Conoco station on the southeast corner of Broadway and
Table Mesa.
The occupants of the vehicle were removed and one of them (Michael Fleetwood) was placed in the rear of my
patrol car after being handcuffed. I was standing by Fleetwood who was seated in the right rear passenger area of
my car. The right rear door was open as he had requested that I not close it. While I was waiting there with him,
Fleetwood made the spontaneous utterances "We didn't do anything wrong." and "We didn't pull no gun." Once

the scene was completely secured and it was safer to do so, I read Fleetwood his Miranda Rights and asked him if
he would be willing to speak to me and answer questions about this incident. He said that he would be willing to
do so.
I asked Fleetwood why he said that they had not pulled a gun, how he knew that there was a gun involved in this
incident. He said that the other person had been chasing them in his vehicle and that they had driven into a dead
end. Fleetwood told his brother ("Jimmy") to let him (Fleetwood) out so that he could find out why the guy was
chasing them. Fleetwood said that he had gotten out of the car and "that's when he almost hit me" (with his
vehicle). Fleetwood got back into their car and they got beside the other vehicle. Fleetwood said that he "threw my
arms out" as if to say what's going on? The driver of the other vehicle said, "You pulled a gun out on me!"
Fleetwood said that they did not pull out a gun, that the gun was in the back seat the whole time.

As we continued talking about the incident, Fleetwood advised the following information:
Fleetwood said that he had been on the telephone while he was travelling in the car with his brother "Jimmy" and
Jimmy's wife. Their vehicle swerved and he looked up and saw Jimmy "flip the guy off." He continued saying that
just before this happened, or right about that time, he had looked in the back seat and saw that
did not have his seatbelt on so he told him to put it on. Fleetwood then repeated what he had said about them
being chased by the other vehicle.
I asked him where at in the back seat the gun had been and Fleetwood replied, "I don't know, Lauren had it." I
asked him if he knew about the gun before this and Fleetwood said that he knew that they have it. He said that his
brother has it for protection and that he (Fleetwood) only handles it when he goes to pick up at the bus
stop during the week. He said that his brother and sister-in-law had recently moved here from Oklahoma and
there had just been a kidnapping near where they live. He also said that there are gangs near where they live so
his brother has this gun for protection and to protect his family.
The complainant had described the gun as being silver and black. The gun that was located in the vehicle had a
black frame and silver slide. I asked Fleetwood why the complainant would say that they have a gun and how he
would be able to describe what the gun looks like. Fleetwood did not know why he would accuse them of pointing
a gun at him. He said that the complainanat must have "got lucky." and that "all 9s (millimeter handguns) look the
same. When I told him that they do not all look the same, he said that "they all do where I come from."
I asked Fleetwood if he had seen or handled the gun at all today and he said that he had not. He said "I only know
they keep it unloaded" with "no clip in it."
When we were done, Fleetwood was released from the scene with his and car.
