Frontex Presentation
FRONTEX or The European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union, is a policy agency with headquarters located in Warsaw, governed by European public law, distinct from the EU institutions like Council or Parliament and is based on a individual legal system. It joins Community and EU units dedicated to the security of the external borders, to which EUROPOL,CEPOL,OLAF belong. FRONTEX was establiched by the European Council's Regulation Act No 2007/2004 with the enforcement date of 26.11.2004. The Regulation was a response to the request made by the European Council at Thessaloniki meeting on 19 and 20 June 2003. Here it was established that a more structured framework was needed relating to sea and land border,seaports and airports controls, in other word to create new institutional mechanisms to enhace operational cooperation which will come in the form of FRONTEX. This agency is based on the experience gained from a previous common unit tasked with the management of Member States external bordersand projects dedicated to issues like common training and risk analysis..This common unit called Common Unit of External Border Practitionersknown also as SCIFA+, was established in 2002 but it failed to fufill it's objectives due to limitations as regards to the coordonation on operational cooperation between Member States. It is just a instrument which facilitates the implementing of external boarders management measures throught coordonation of Member's actions, because the actual responsability of external border control and surveilance is in Member States' hands. As to its organisation, there are 3 basic branches: the Executive Director, his\her assistant - the Deputy Executive Director(DED) and the Management Board:

The Executive Director(ED) -currently Ilkka Pertti Juhani LAITINEN- is appointed by the Management Board for five years,according to his\her merit's, administrative and management qualification and expertise in the domain of external border management. Also he/she appoints an Internal Audit that has the task of managing the agency's resources.

The Deputy Executive Director- currently Gil ARIAS FERNNDEZ - can be appointed or dismissed only by the Management Board and has a 5 years term. It has

another branch subordinated called Executive Support which assist the Senior Management by providing expertise relating to it's tasks.

The Management Board's members are appointed every four years, and it is composed of a represantative from every Member State and two representative from EU Comission. The tasks of management board are to organise the internal structure of the agency, establish the work program and policy for the staff, adopt and maintain a finacial sistem after consulting with the EU Comission, evaluate every five years the implementation of the European Council's Regulation Act No 2007/2004 and to give recommendations based on the evaluations results,and to make general reports. These reports along with other informations about the agency's work are brought into open.

There are 3 divisions subordinated to the Executive Director: Operations, Capacity Building and Administration Each of them are composed of 3 or 4 units as follows:

Operation Division includes Joint Operations(based on Risk Analysis Unit results coordinates cooperation at Member States and Schengen external borders), Risk Analysis(with the accronym RAU, develops a common integrated risk analysis modelCIRAM-, asissts the border guards' training and gives risk and threat analysis to Operations Unit, EU Council, EU Commission and EU Member States' Border Guard Authorities) and FRONTEX Situation Center(with the acronym FSC; here there are evaluated and selected information that come in and exits the agency) Capacity Building Divison includes Training (offers standardized instruction and training tools for for the following training academies: Border Guard school of Vilnius in Lithuania, Police academy of Bratislava in Slovaquia, Bundespolizei academy of Lbeck in Gemany and ILEA academy of Budapest in Hungary) , Research and Development(makes researches regarding border control and surveillance and passes on the results to Eu Member States and Commision) and Pooled Resources(strengthens the reaction capability of Frontex, Member States and Schengen Associated Countries by managing the technical equipment and developing pools of border guards for Joint Operations); Administration Division includes Legal Affairs(it is represented by the Chief Legal Advisor of Frontex and is directly subordinated to Senior Management), Information and Communication Technology(with the acronym ICT,administrates and monitors ICT services, monitors security ICT systems) Finance and Procurement(headed by Chief Finance Officer, makes budget reports,establishes financial and procurement rules and procedures,

manages cash and administration of grants),Human Resources and Services(with the acronym HR,manages recruitment for FRONTEX vacancies, administrates salaries and staff rights,organizes trainings for staff). Besides carying out risk analisis and enhancing border control management, FRONTEX has other objectives like: heping Member States in training national border guards, looks into the progress of research regarding the control and surveilance of external borders, gives increased tehnical and operational assistance for those states in exceptional circumstances and last but not final, send Rapid Border Intervention Teams where are needed. In 2007 there was an Amending act No 863/2007 establishing the creation of Rapid Border Intervention Teams. RABITs are formed by experts who can offer fast technical and operational support to national border guards in cases of immigrant great fluxes or in threat circumstances. These experts are paid by the host state in which service they entered and are deployed in no more than five days from when the request of a Member State was made. The operational plan is made by the Member State with the help of Frontex and the Executive Director of the agency appoints one or more staff member as liaison officers to supervise the implementation of the operational plan and to transmit the results of its implementation to Frontex. The members of these teams, also mentioned as guest officers, must comply to Community law and the national law of the host State under who's responsibility they are also placed; they must wear their national uniform and a blue armband with the insignia of the European Union and Frontex; they can exercise their power only in the presence of border guards of the host Member State; they have access to European and host State's databes in order to supply border checks and surveillance; in case the guest officer causes damages, the host State cand appeal to the home member state for the reimbursement of the damages costs. With a constant growth rate, the Agency 's budget is ensured by Community contribution, voluntary contributions from Member States, incomes from services provided, contribution from countries associated with Schengen acquis( the agreement, convention along with the declarations of Schengen Executive Comitee). Frontex is sustaining bilateral colaboration with non-EU countries in order to develop and maintain a global management of border control. To that effect, there was a established a Western Balkans Risk Analysis Network and progress was made for establishing a similar network for eastern countries. Due to continuous imigrant fluxes especially at the southern EU borders maintaining partnerships with third countries and

establishing new ones remains one of the highest priorities of FRONTEX. For that purpose, arrangements were made with the Russian Federation, Ukraine, Croatia Moldova, Georgia, the Former Yugoslav Republic of Macedonia (FYROM), Serbia, Albania, Bosnia and Herzegovina, the United States, Montenegro, Belarus, Canada and Cape Verde as well as with the CIS Border Troop Commanders Council and the MARRI Regional Centre in the Western Balkans. Also, progress was made in estalishing new partnerships with another 8 countries: Turkey, Libya, Morocco, Senegal, Mauritania, Egypt, Brazil, and Nigeria. The Schengen Area is expected to increase in the future years, so the Agency must improve its operational plan in order to maintain the EU external board effective against illegal immigration and keep under control an expandig free movement of EU citizens.

Signing the Schengen Agreement in 1985 meant eliminating border controls for those states related to implementing the Schengen Aquis. This involves also an enhancement of the borders management to prevent illegal imigration, cross-border crime and threats to the European comunity. In the last three years there were several reccomendations to strenghten Frontex in order to increase the Agency's tasks effectiveness. It became known the need to increse the solidarity especially between the Member States at the Meditteranian were the possibility of unathorized immigration is high. As a part of Stockholm Programm, a programm with an an ction plan drawn on June 2010, developed to provide and maintain a secure area of justice, freeedom and security, Frontex must develop its borders management and VISA policies to ensure the protection of European citizens. According to an evaluation made by EU Commission the cooperation between Member States for immigration managing was limited due to the limitation of coordination between local authorities and lack of resources. Taking all this into consideration on February 2010 EU Commision made a proposal to EU Members to put pool equipments at the Agency disposal and to make the border guard familliar with a legal framework by outlining the importance of respecting the fundamental right when it comes to immigrants. For this Programm to be effective, there must be a constant and facile communication between EU Members and non-EU Countries and a solid partnership between them. A 2008 report shows a higher board-crossing pressure in the Meditterenian area comparing to other areas. While for other countries the illegal imigrants procent is neglijable, for Mediterranean countries numbers are worringly hight: at the sea borders Spain registered 16 000, Malta 2 000, Italy 35 000, and Greece 32 000 illegal border crossings. As a key instrument in providing a framework for Member States to cooperate with each other regarding border issues, Frontex needs to exceed its legal, operational or equipment deficiencies.

Romnia, membr a Uniunii Europene i viitoare membr a Spaiului Schengen, a fost acceptat n 2005 ca stat observator la lucrrile desfurate de ctre Agenia FRONTEX. Astfel a fost parcurs prima etap pentru dezvoltarea i intensificarea relaiilor de parteneriat ntre Romnia i Agenia FRONTEX. Odat cu aderarea la Uniunea Europeana Romnia a devenit membru cu drepturi depline n Agenia Frontex. De atunci Romnia a avut un rol activ n cooperarea operaionala promovat de Frontex. Spre exemplu, n 2011 Romnia a participat cu succes la Operaiunea Comun "POSEIDON 2011"n Marea Mediteranean, zona insulei Lesvos, Grecia, care a avut ca scop principal contracararea fenomenului de migraie ilegal la frontiera extern a Uniunii Europene. Romania, Member of European Union and future Member of Schengen Area, was accepted in 2005 as an Observator at Frontex Agency's undertaken actions. In this way was taken the first step into te development and enhancement of partnership relations between Romania and Frontex Agency. Along with its joining to European Union, Romania became member of Frontex with full entitled rights. Since then, Romania had an active role in the operatiional cooperation ecouraged by Frontex. For example, , in 2011 Romania succesfully participated at "2011 POSEIDON " Common Operation in the Mediterranian Sea, Lesvos island area, Greece, which had the main purpose of stoping the illegal migration fenomena at the external border o European Union. Beside the actions taken by Romania for its integration in the operational plan of Frontex lies: the creation in 2008 of the The Initial anc Continuum Training Scool of Border Police Personnel from Iasi, which was certified as FRONTEX Academy partner; the creation of the National FRONTEX Contact Point at General Inspectorate of Romanian Border Police, as part of European Affair Service and International Relations to facilitate the communication with the Romanian Border Police ant the other Romanian institutions; the provision of rapid operative assisstance when needed, in the form of Rapid Intervention Border Teams(RABITs); the implementation of a supervision operating system, based on the latest technology, which allows the early detection, the follow, recognition and identification of ships that undertake illegal trafficking actions in the Black Sea(SCOMAR), with the main objective of the the observation, surveillance and Romanian border control at Black Sea. By participating at numerous operations organised under Frontex and through the way of involvement of the border guards, Romania's implication in Frontex was appreciated by the Frontex experts, the Romanian Border police being considered one of the most active structure at Frontex Agency's level.

Tunisians thank Italy as EU responds to exodus By Associated Press Tuesday, February 15, 2011 - Added 11 months ago LAMPEDUSA, Italy Tunisian migrants marched through this tiny Sicilian island on Tuesday to thank Italy for welcoming them, but the government and EU moved to stem the exodus of North African migrants to Europe. Italy has asked that the European border agency Frontex launch a mission to beef up border controls off the Tunisian coast, and on Tuesday the EU Home Affairs Commission said talks were under way to launch one. The problem is a result of the clashes between police and protesters in Tunisia that forced its president, Zine El Abidine Ben Ali, to flee to Saudi Arabia on Jan. 14, and inspired the uprisings in Egypt and beyond. Some 2,000 of the 5,337 Tunisians who arrived in recent days remained on Lampedusa, a tiny island with a permanent population of about 6,000 that is closer to Africa than the Italian mainland, awaiting transfer to immigrant holding centers elsewhere in Italy. "We want to thank all the Italians and the people from Lampedusa because they gave housing and food to 5,000 people and they were very nice to us," said Zawhir Kermiti, a 32-year-old from Kerala, who was one of a few dozen people who marched Tuesday. He and others arrived in Sicily in fishing boats from Tunisia. Overnight, Italian authorities intercepted a boat of 32 people believed to be from Egypt off the coast of Ragusa on Sicily, indicating that the exodus was not confined to Tunisia alone. "The institutional earthquake that took place in Egypt could provoke significant immigration flows," Italian Interior Minister Roberto Maroni warned Tuesday. "Europe cannot remain indifferent: it must take a strong and decisive political decision." Italy has arrested 26 people who operated the boats and seized 41 vessels. Identity checks have found some of the arrivals were criminals who escaped from Tunisian jails in the chaos, Maroni said.

He spoke at a news conference in the Sicilian city of Catania, where he and Premier Silvio Berlusconi toured a NATO military residence with a capacity of 7,000 people that the government is considering turning into a "village" for possible asylum-seekers. Lampedusa Mayor Bernardino Rubeis has said that the Tunisians have mostly been respectful and that the situation is under control. "There is no security emergency because they are free to walk around the island, but they are respecting our territory, not creating any trouble," he said. On Tuesday, many of new arrivals awaited ferries to take them from Lampedusa to immigrant holding centers elsewhere in Sicily or on the Italian mainland. "It took 30 hours from Djerba to here. It wasnt very dangerous. We were 260 people on this boat," said Samir, a 24-year-old Tunisian who asked not to give his last name. Djerba is an island located off the coast of Tunisia. He spoke as he and others picked through the wreckage of their fishing boats that have been hauled out of the harbor and piled in a sort of boat cemetary near a soccer field. Among the debris in the boats are blankets, gloves and cell phone battery chargers. No boats arrived overnight on Lampedusa, primarily because of poor weather. But Maroni, who has said the exodus was of "biblical" proportions, said he had no illusions that the onslaught was over. "So far, the (Tunisian) border controls have stopped four boats and turned them back, but 47 more escaped the controls," Maroni said. He said he planned to meet with his counterparts in France, Spain, Malta, Greece and Cyprus in the coming days to decide on further immediate measures to take. He said Italy alone needed some 100 million from EU funds to confront the emergency over the next three months. EU Commission spokesman Michele Cercone said the EU had received a letter from Italy listing its needs and that the EU was looking to give Italy aid through its refugee and border fund. In addition, he said, Commissioner Cecilia Malmstroem is "in constant contact with the Frontex agency in order to get the agency ready to launch a mission in the area. Work is ongoing as we speak." On Monday, the EU announced a 258 million ($347 million) aid package to Tunisia from now until 2013, with 17 million ($22.9 million) of that to be delivered immediately. EU foreign policy chief Catherine Ashton, visiting Tunisia, said the funds were a gift, not a loan.

Italian Foreign Minister Franco Frattini met with Tunisian authorities Monday night in Tunis and concurred that Tunisia was responsible for patrolling its coast but that Frontex should beef up its presence in international waters. Tunisia had strongly rejected an offer by Maroni for Italian police contingents to help patrol the coast. Frattini said Italy cannot accept everyone who arrives, but at the same time must help Tunisia and other North African countries create conditions so young people dont feel the need to flee. "We cant package them up and send them back home," Frattini said Tuesday. "We have to help them reintegrate themselves" with economic help. After his visit, Tunisias TAP news agency reported that Italy would provide 5 million ($6.8 million) in emergency aid to Tunisia, as well as radar equipment and patrol boats to the Tunisian military, and offer a 100 million ($135 million) credit line. By Nick Squires, Rome and Peter Allen in Paris Nicolas Sarkozy has pledged to do all he can to drive out 26,000 Arab refugees who have entered, or are on their way to France, after they were given EU identity documents and residence permits by Italy, sparking a diplomatic row between the two countries. The French President and Silvio Berlusconi, the Italian prime minister held emergency talks in Rome yesterday after France threatened to overturn the Schengen border

treaty that permits passport-free travel through Europe by introducing border controls in response to Italy's decision to issue the migrants travel documents. The mainly French-speaking Tunisian and Libyan migrants are in possession of the temporary, six month, Italian residence permits allowing them to travel freely without passports or frontier checks in the EU's 25 member "Schengen" zone. Most of the refugees have complained about harassment in France, saying that their hopes of finding accommodation and jobs are next to nothing amid the official hostility to them. EU agrees rapid reaction anti-immigration units

BY RENATA GOLDIROVA BRUSSELS - In an effort to cut the numbers of illegal migrants arriving to Europe by sea, EU interior ministers have given the green light to setting up a rapidly deployable force of border guards which would assist countries facing an immigration emergency. "It is the best ever example of European solidarity," EU home affairs commissioner Franco Frattini said after the deal on the so-called rapid border intervention teams was struck on Friday (20 April). The rapid border intervention teams operational under the EU's external borders agency, Frontex - are foreseen as a pool of some 450 national experts, made available at short notice of up to five working days to any member state whose borders are under "urgent and exceptional" strain by illegal migration. Under the deal, all 27 capitals will be required to contribute to the EU teams. The prime goal is to combat illegal immigration in the Mediterranean and Atlantic coastal area, after last year saw an unprecedented amount of Africans taking the perilous trip, crammed together in small fishing boats, in search of a better life in Europe. More than 31,000 illegal immigrants reached Spanish territory in 2006 - six times more than in 2005 while Italy and Malta were also heavily targeted. Thousands are feared to have been lost at sea.

The idea of special EU teams already received the backing from the European Parliament's committee on civil liberties, justice and home affairs on 11 April. The parliament is expected to give its final blessing during this week's plenary session in Strasbourg. In addition, Frontex is to set in motion a permanent coast patrols network for the EU's southern sea borders amid fears that favourable weather could make 2007 another record year in terms of sea-borne migration. The patrols will begin work in late May to define and monitor flashpoint areas for illegal attempts to enter Europe. "We have succeeded in making another important step to protect the common external sea frontiers in the south," German interior minister Wolfgang Schauble said in response to the announcement, adding "this mechanism is a vital measure to counter illegal migration at the external sea borders jointly and in a coordinated manner." According to EU commissioner Frattini, Frontex - created in 2005 to coordinate EU border security now has at its disposal over 20 air planes, almost 30 helicopters and far more than 100 vessels as well as a variety of other equipment.

Rapid Border Intervention Teams, also called RABITs, became operational under Frontex Agency in 2007 and since then they were deployed at those borders where situations of illegal immigration are encountered. Such an area is the Mediterranean coast wich is the most vulnerable to flux immigrations from Africa or Turkey. Another area is the Atlantic borders. An example of such a border pressure can be seen in the last years when large numbers of immigrants fron Africa and Arabia came in different Europe states for a better life or driven out by an authoritian system, threatening the stability of Schengen treaty Such a case occured on april 2011, when approximately 26,000 Arab immigrant came to Europe. After they receive EU documents, they made their way to France and some of them, after complaining that they did not fount the accomodations they were looking for, tried to make their way to Britain by paying smugglers because it is not a Schengen meber and they did not have necessary documents.

So that the situation could be kept under control, Rapid Border Intervention Teams were called in the area. This amount of immigration flow tensioned the southern Europe governmentsm who asked the help of Northern countries to give a hand. Not only that but the relation between France and Italy are tense, afte the latter's government was accused of abusing the Schengen Treaty by issuing travel documents to migrants fleeing North Africa. Also France suggested to restore "temporary control at internal borders in the event of exceptional difficulties", giving as an example of such an exceptional event Italy's granting of temporary permits in response to a flux of refugees. An official report of FRONTEX reveals that for the first three months of 2011 33,000 people entered Europe illegally with 22,600 coming through Italy. Most of those were economic migrants from Tunisia and sub-Sahran Africa. The numbers were revealed by deputy director of Frontex Gil Arias Fernandez during a visit in Athens, the capital of the country wich up until this year was the main entry point for illegal immigrants into Europe. Mr Fernandez said that comparing to last year the illegal entries registered in Greece are lower then the numbers from the beginning of 2010, decreasing from 13.085 to 7,200. As been said, large numbers of immigrant come from Tunisia. The cause of this represents the Tunisian revolution which beagn in december 2010, and the situation hasn't come to an end not even now, Street demonstrations and other unrest continue. This campaign of civil resistance were precipitated by high unemployment, food inflation, corruption, a lack of freedom of speech and other political freedoms and poorliving conditions. In the middle of February, aproximately 4,000 mostly Tunisian refugees landed on the Italian island of Lampedusa, forcing the authorities to declare a state of emergency and allowing federal aid to the island. Interior Minister Roberto Maroni accused the EU of not doing enough to stem immigration and demanded them to do more. He said that the Tunisian system was 'collapsing'" and that he would ask the Tunisian Foreign Ministry for permission for Italian authorities to intervene to stop the flow in Tunisia The entire event was called a "biblical exodus." The negotiations between the two countries started with the Tunisian Foreign Ministry saying it was ready to work with Italy and others but that categorically rejects any interference in its internal affairs or any infringement of its sovereignty.

In response, Italy's Foreign Minister Franco Frattini said that both countries have a common interes, to stem the immigration, while he also offered logistical help regarding police staff and equipment. Until then the system of patrolling the coasts of Northern Africa has worked succesfully and Tunisia government then replied that it had troops patrolling southern fishing ports and that checkpoints had been lifted in coastal towns. By 14 February, at least 2,000 refugees had been sent to Sicily with the other 2,000 quarantined at a re-opened holding centre. On 2 March about 350 more people arrived on the island. In response Italy declared a humanitarian emergency. A frontex action in the Mediterranian represent Joint Operation Hermes, launched on February 20th. Theauching of the operation was delayed due to the request made by the Italian authorities for assistance with the influx of migrants from North Africa. The original task of this operation was to gather information necessary needed for analysis, to make assumptions concerning migrants' nationalities, and to enable early detection and prevention of possible criminal activities at the EU external borders; after the Lampedusa situation the operation focused on organising return operations to the countries of origin. The countries involved in this operation are Italy, France, Germany, the Netherlands, Malta and Spain With the help of Ferontex's RABITs the Mediterranian countrie manages to keep away the unwanted immigrants. Already it has been prooved that surely they do not find the treatment and help they were looking, ending with their civil rights violated or in improvised camps with no free movement. The only solution is for these unstable countries to receive EU support for improvement of the civils lifes.
