ASEAN/001 SOMA XXXIX Re: Burmese Military Regime The Association of Southeast Asian Nations, Reminding all States

Members of the United Nations have an obligation to promote and protect human rights and fundamental freedoms and the duty to fulfill the obligations they have undertaken under the various international instruments in this field, Recognizing that good governance, democracy, the rule of law and respect for human rights are essential to achieving sustainable development and economic growth and affirming that the establishment of a genuine democratic government in Myanmar is essential for the realization of all human rights and fundamental freedoms, Guided by the Charter of the United Nations and the Universal Declaration of Human Rights, and recalling the International Covenants on Human Rights and other relevant human rights instruments, Bearing in mind the Security Council resolutions that enforce the protection of unarmed civilians and children in armed conflicts, Affirming that the will of the people is the basis of the authority of government and that the will of the people of Myanmar was clearly expressed in the elections held in 1990, Deeply concerned at the situation of human rights in Myanmar, and in particular the recent suppression of peaceful demonstrations that have included beatings, deaths, and arbitrary detentions, Recalling that everyone has the right to participate in the government of his or her country, directly or through freely chosen representatives, and recognizing every citizens right to freedom of expression and the right to peaceful assembly, Calling upon the Government of Myanmar to cooperate with the international community in order to achieve concrete progress in areas such as human rights and political processes leading to a genuine democratic transition through concrete measures, Encourages national reconciliation and a transition towards democracy that involves the effective and genuine participation of political parties and other relevant stakeholders, Deeply regretting that the government of Myanmar did not take the necessary steps to ensure a free and fair electoral process leading up to the election of 2010, 1. Strongly urges the government of Myanmar to stop systematic violations of human rights, 2. Also strongly urges the government of Myanmar to stop carrying out politically motivated arrests and to release without delay all political prisoners, 3. Calls for fair and public hearings by competent, independent, and impartial tribunals established by impartial international body. 4. Also calls for full, effective investigation into all reports of human rights violations and for bringing those responsible to justice, 5. Strongly urges the government of Myanmar to end all forms of discrimination and to

protect civil, political, and economics rights of its citizens on the basis of the Universal Declaration of Human Rights, 6. Recommends that the Government of Myanmar and the International Labor Organization to intensify measures to end forced labor practices, 7. Strongly urges the Government of Myanmar to immediately stop the recruitment of child soldiers and to ensure the protection of children and unarmed civilians from armed conflict, 8. Also strongly urges the Government of Myanmar to practice the due process of law 9. Also strongly urges the Government of Myanmar to ensure a free and fair electoral process with full and genuine participation of all stakeholders, 10.Decides to remain actively seized in the matter
