NARRATIVE STATEMENT
In 2011, the Jackson County Attorneys Office finished the fiscal year at
92% of the forecasted budget. This was accomplished by tight fiscal controls
utilized by Office Manager/Legal Secretary Mynet Anderson leading the rest of
the office. At the request of the County Attorney, the Board of Commissioners
plused up the office budget to account by $60,788 in anticipation of the two
murder trials and one Sexual Deviate Personality/Sexual Psychopathic
Personally Commitment (SDP/SPP) that occurred in 2011. Both murderers and
the SDP/SPP individuals were prosecuted successfully.
The Juan Humberto Castillo-Alvarez murder trial saw expenditures of
$33,109.29 for special costs to the office. The defendant has also been
ordered to pay $2,639.30 of these expenses. The TyRon Louis Collins murder
trial had expenditures of $28,916.77 for special costs to the office. The special
costs for both murder trials were largely expended on travel and lodging for
witnesses and Attorney General Staff.
We had additional costs incurred for the SDP/SPP of $1,890.96. SDP/SPP
costs were mainly for professional medical opinion reports and testimony
required to prove the commitment. The legislature did the County no favors
by the budget compromise of July 2011 that changed the County Share of
SDP/SPP costs after an order is issued from 10% to 25%. Average costs for the
program are approximately $30,000 per month per person. These costs are
paid by Jackson County Human Services as commitment costs.
On the Civil side, the Jackson County Attorneys Office provided legal
advice and guidance on a number of special projects from the Enesco
contracts, land plats for the Oak Ridge Estates and subsequent sewer system
development, bid preparation for the single source waste management
conversion, the merger of the City Police force into the Sheriffs Office and
preparations for the ongoing proposed sale of the racetrack. This was done in
addition to reviewing 70 recurring regular contracts for the various county
departments.
The Jackson County Attorneys Office continues to work to recover costs
and expenses as allowed by law. For 2011, the County Attorneys Office
secured $109,790.32 drug forfeiture funds, $216.30 in DWI forfeiture funds,
penalty assessments in the amount of $2,000.00 and Restitution awards for
crime victims in the amount of $6,034.01. Additionally, the office secured
federal pass thru funds for child support in the amount of $3,815.56 and fees
from the City of Jackson in the amount of $284; totaling $4,099.56 for the
county general fund.
