Martiez gets a permanent heart on March 27


Recovery going well but 14-year-olds battle just beginning
to receive an artificial heart transplant. But the artificial heart Martiez got in Philadelphia, Pa. in February was a stop-gap measure to keep the recipient going while a match for a permanent heart, a human heart, continued. On March 7 that heart was found and Martiez, who had just recently been moved out of Intensive Care following his first transplant into his own room, was headed back for his second major surgery in just over a month. On March 7 we were alerted by family friend and Ressie Jeffries librarian assistant Carol Vorous that at 6:30 a.m. Martiez was being prepped Young Martiez Rowell-Bradshaw has a new heart. By Roger Bianchini Warren County Report On Tuesday, March 7, 14-year-old Warren County Middle School student Martiez Rowell-Bradshaw got the heart he has been waiting for. In early March we reported that Martiez made history, becoming only the second youth in the nation for the surgery that could not only save his life, but give him a long and productive one. His family alerted Vorous that by 6:30 p.m. that evening the surgery was over and Martiez appeared to be recovering well. They finally got him back to the ICU around two this morning. Just got a text from Kentia around 6 ... she said everything went well the rest of the night. So far so good, Vorous texted friends and the media. Our last update before publication came on March 9. Vorous said Maritiezs mom, Kentia, contacted her the previous day to say her sons recovery continued to progress normally and that his breathing tube was expected to be removed on March 9. Vorous and other staffers at both Ressie, where Martiez went to elementary school, and WCMS staff where he is now a student, have been involved in fundraisers for the family. Martiez is the oldest of six children and the travel, time off from work and other hardships around being with their child as he has struggled to survive have put a financial strain on the family. Vorous said five fundraisers have thus far raised $4,000. The family is very appreciative of everything that has been done for them, Vorous told us. They thank you for the love, support and prayers through this very difficult time. However, the family still has some specific needs that will require additional funds. Front Royal doctor volunteers to help the poor in Honduras


ing more closely, it turns out that the medical profession as a whole does quite a bit, pro bono, to alleviate suffering throughout the Third World. Our own Dr. Thomas Ball, a veteran volunteer for the Winchester Medical Center Foundation, which sponsors medical teams for the Shoulder to Shoulder program in Honduras, Ecuador and Tanzania, recommended his new resident physician, a recent graduate of Yale medical school, to go in his place last year. She did so, knowing little about her surroundings at the 4,000-foot level of the Honduras/Salvador border but finding her knowledge of Spanish a pretty big help. Also, she was one of a group of 1 ranging from medical students to qualified physicians. It was a first for Dr. Salmon, a change not only in the weather but also in the makeup of her new patients, many of them malnourished children, some suffering maladies weve long since forgotten, such as worm infestation. Pregnant women walked three hours to the corrugated shack-like clinic for treatments. Many of the adult population suffer upper respiratory complications and seek medicine and treatment. Natives of the area pretty much live on what they grow. If they earn a wage,

it may amount to not more than two dollars a day. Anna said about 75% of her patients were children. Anna Salmon, a self-described military brat, was born in Ohio but has roots in Virginia. Her father, now retired from the U.S. Air Force, and mother live in Gainesville. Her mother once was a nurse in Haiti, and her sister is currently a nurse in Harrisonburg. Anna is a graduate of Nokesville High School, and completed her undergraduate work at the University of Virginia, so she claims Virginia as her home state and was attracted to the residency at Front Royal Family Practice.

McDonnell) who recognize that these innocent babies in the womb can not protect themselves and that the state must intervene to protect those who are vulnerable and defenseless. The few hundred ladies who staged a ruckus in Richmond - allegedly to protect their privacy rights - were annoyed that the new law would require full disclosure of the type of growth that they choose to carve out. After 8 weeks of gestation, that growth has a tiny head, flailing arms and legs, and a beating heart. Dont you think that the state has a right to insist that a pregnant woman be given full disclosure in seeing this tiny human being by means of non-invasive ultrasound imaging? The state insists on full disclosure in a great many transactions in order to protect the affected parties. Should a womans choice to terminate the life of her prospective child (and that childs right to life) be subject to less stringent disclosure requirements than that required for credit card cash advances? The real issue is not one of a womans privacy or of invasive practices. The issue is the termination of a living infant (regardless of whether or not that infant can survive independently) and the requirement that the woman be made aware of the impact that her choice would have on that growth within her body. Many - if not most of us - believe that that tiny person with head, arms, legs, and a beating heart is entitled to at least this very minimal degree of state intervention even if it may seem to be an annoying invasion of privacy. However, more seriously we disagree that either we or the Capital News Service in Richmond have missed any point on these issues. Rather the CNS reporters have described relevant legislation and public reactions to it, as well as the stance of both sides of the political aisle on that legislation. Unfortunately, for advocates who are true believers with no inclination to discuss with an open mind such complex issues as what exactly defines human life and the legal rights tied to it, presenting more than the advocates side alone apparently indicates a journalistic failure of some kind. We also asked Mr. Woloshyn to provide links to support his contention that over half of the U.S. population supports the notion human life begins at conception and that an overwhelming body of scientific evidence supports that contention as well. He obliged and we discovered not surveys, but rather one Zogby phone survey of 1,099 people referenced on the pro-life Life News website to support the first claim concerning the supposed opinion of a majority of the U.S.s 314-million population. That survey was also made after its founder Zogby sold all interests in the company and retained no further con-nection to it or its methods. After reviewing the overwhelming body of scientific evidence provided by Mr. Woloshyn 16 phrases from a variety of scientific studies in one link we found that not one stated that human life begins at conception. Rather they all described conception as a key point in human development, that fertilization was a crucial landmark and other totally neutral statement on the issue of when human personhood begins. One link to The American College of Pediatricians did state support for Mr. Woloshyns stance. The groups website notes the organization was created in 00 with a specific agenda, stating, Of particular importance to the founders were (as it is today) the sanctity of human life from conception to natural death and the importance of the fundamental mother-father family (female-male) unit in the rearing of children. As a child, I couldnt understand why Easter never fell at the same time of the year like Thanksgiving, Christmas, or Squirrel Appreciation Day (Jan 1st, in case you want to store some nuts for next year). On top of that, there was all the hype about eggs and rabbits. Rabbits! Was that why Easter hopped all over the spring calendar from year to year? Theres an old story that also illustrates the mystery of Easter: A Sunday School teacher asked her class if they knew the origins of Easter. Its opening day for the Yankees and Giants, said one boy. No, said a girl, Its when we get nice new clothes and go find the eggs from the Easter Bunny. Added another boy, No, youre both wrong. After Jesus died on the cross, some of his friends buried him in a tomb they called a sepulcher. And three days later Jesus arose and opened the door of the tomb and stepped out. Yes, yes, said the teacher, Go on, go on! And if he sees his shadow, added the boy, well have six more weeks of bad weather. Had I heard that tale as a child, it would have only added to my Easter confusion because I probably would have believed it. I was quite gullible. I can still remember, one year, some kid telling me that during Lent the period leading up to Easter we were morally obliged to lend money to friends who asked for it. So when the kid asked, I lent. But as I later learned, if you neglected to ask for your money back before Easter Sunday, you lost it. I lost it. My parents didnt adequately answer all my Easter questions, either. They told me it fell on different days because it was the first

Sunday after the Paschal full moon following the northern hemispheres vernal equinox. To a 7year-old, I naturally thought they were pulling a fast one, in order to avoid buying any Easter goodies for me. As for the rabbits, their association with Easter was a mystery because I thought they had no religious significance. After all, the bible makes no mention of rabbits being used for burnt offerings; theres no reference to the Passover Bunny; and multitudes arent fed with five loaves and two hares. But Easter became more understandable as I grew older. I learned that the Easter bunny pre-dates Christian times and was part of spring festivals held by ancient civilizations to honor pagan gods. And since rabbits were known for their prodigious reproduction, they were natural symbols of rebirth and new life. The other bizarre Easter concept I wrestled with in my youth was the connection between rabbits and eggs. Rabbits dont lay eggs, no matter how much you encourage them. Reptiles (and birds) do, but my idea of an Easter gecko was never greeted enthusiastically whenever I suggested it. The rabbit-egg association is also an old one, dating back to Europe centuries ago. It seems German children believed that a magical, generous rabbit laid eggs in the grass, and that these were free for the taking. Olive By Roger Bianchini Warren County Report The Humane Society of Warren County is attempting to raise funds for emergency treatment and rehab to repair leg injuries to two dogs brought in recently and find these darlings homes. We are hoping to raise public support and funds to help fix both of them, HSWC Kennel Team Coordinator Marcy M. Gallo wrote us. One of the dogs, Miley, is a 4-1/ month old Chihuahua-pug mix who fell off a bed and fractured her front leg. Her owners could not afford the care she needed and so she was surrendered to the shelter. The fracture is so severe that she will need to have her leg amputated. Olive is our other poor girl who has a broken hip. She is a 5-monthold hound-pit mix who was hit by a car and brought to us by animal control. She was never reclaimed and is now waiting for a hip surgery. As you

What do the following have in common? Income taxes, March Madness, Facebook, the NFL Bounty system and Welfare reform? How about Oreo cookies, the sinking of the Titanic, our mild winter and falling out of your chair? When people know you write a column, some are more than happy to tell you what your next one should be about. Taking the offensive, I polled some of my readers and asked them, If you were writing my next article, what would it be about? Heres what they said, minus all of the obscenities. MW was thinking about the time of year. Why dont you write about the taxman? Wasnt there a Beatles song with that word in it? What was the name of it? MW The Taxman. Oh. MW Or March Madness. Thats timely. CD was thinking the same thing. How about March Madness? Thats appropriate. I see a theme developing here. LS always has plenty of suggestions for me, whether I want them or not. Unfortunately, diarrhea is the one that comes up just about every time. I think LS has some issues, digestive and otherwise. LS Write about Facebook and how people are always lying about themselves. Like the guy with four kids that he forgot to tell you about, and the fifth that hes paying child support for. Oh yeah, and hes unemployed too. I was sensing some hostility. Hostility and digestive issues. Not a good combination. LS Or how about those football players who were getting paid to hurt guys on other teams. More hostility. You mean the bounty system? LS Yeah. Or Welfare Reform? I grimaced at that one, al-

though I played along. I didnt want any of LSs hostility directed toward me. MT also mentioned March Madness. And what about all the things that are 100 years old this year? The Oreo cookie, the Cherry Blossoms in D.C., LL Bean and the sinking of the Titanic. Or our mild winter, and how that means more stink bugs. My blood pressure shot up with that one. JG wanted me to write about what happened to his boss last week. It was funny, and I saw the whole thing. We were in a training class. Fifteen minutes in, the poor guys left arm rest broke, and then his right one. And then the seat gave way. Before he knew it, he was on the floor. And he didnt say a thing. I think he was sleeping. The chair was a total loss, but he escaped unscathed. I hear hes been talking to an attorney. Ok readers, you asked for it. Every year, when March rolls around, people start thinking about taxes. It drives them mad. Personally, it makes me sick. I get diarrhea. And one night last week, although it seems like about a hundred years ago, I was dunking my Oreo cookies in milk and ordering stuff from LL Bean. I was checking out a friends Facebook page and everybody was talking about a funny video they saw on line. Some guy was at work, sleeping. The next thing he knew he was on the floor after his chair broke. I hear hes suing. Rumor has it the company put out a hit on him. A bounty. Meanwhile, writing in Shelter Tails, the HSWC executive director Lavenda Denney re-ported a 54 percent increase in the adoption rate at the shelter, and a new sponsorship pro-gram that may lead to a less expensive and an easier adoption process.

I think hes a good man, he told us. However, he added he hasnt worked directly with the Paul campaign in recent years, instead doing national field survey work. I spent almost a year in Iowa awhile back, he noted. Online we found a detailed survey Fusaro released in January 011 comparing the relative strengths, name recognition and potentials of all Republican presidential candidates initially in the field. Fusaro agreed with McHughs description of the makeup of the mass meeting majority block and his and Vicentes roles in assembling it. He said his involvement stemmed from awareness there were concerns about rules and policies being forwarded by the local committee. What happens locally impacts the structure and agenda of the party at the state level, Fusaro observed. He added he thought there were three tracks of concern of the majority block at the mass meeting: 1/ 6th District representation; / Ron Paul support; and 3/ issues at the local level. I came because of these concerns. Someone said, will you be acting chairman, and I said, fine, okay, Ill do it Ill be fair. I wanted to be a delegate at the 6th District convention. I wasnt mad at anybody. Fusaro acknowledged the rules dispute that prevented completion of the business of the meeting, leading to McHughs appeal of adjournment of the mass meeting (see related story). The third block organizer, Manuel Vicente, is employed in the admis-

sions department at Seton Home School, whose director Mary Kay Clark is the outgoing Republican Committee secretary. Vicente is also a first-time candidate for local office, on the ballot for the May Front Royal Town Council election. He did not respond to e-mail or phone messages about the mass meeting, his role or perceptions of it. Vicente has not previously been active in local politics. Neither McHugh nor Fusaro has been active locally in recent years. On March 15 that changed sort of. I mean Dom Repici, he and Steve Kurtz have done a fine job for the local stuff but thats peanuts, McHugh says of recent committee vice chair Repici and committee member Kurtz. The difference between constitutional conservative Republicans and country club Republicans is this country club Republicans view their committee membership as a property right; I view it as an act of service for all the Republicans that cant come to the meeting. Shortly after appearing at the March 3, Human Life International-organized, pro-life rally challenging the birth-control aspect President Obamas affordable health care act, McHugh reiterated that his immediate target in seeking the chairmanship of the Warren County Republican Committee is a Republican Primary challenge of 6th District U.S. Rep. Bob Goodlatte. In fact, McHugh was busy introducing Goodlatte challenger Karen Kwiatkowski to the pro-life rally crowd after the event. McHugh feels that Goodlatte has been entrenched in his seat too long and consequently has become too soft a conservative presence in Congress. While Goodlatte staff and his website deny that Goodlatte is soft on Obama-care or other conservative issues, McHugh called Goodlatte a supporter of President Obamas affordable health care mandates because he has voted to approve budgets of which funding it has been a part. Kwiatkowski calls Goodlatte a RINO (Republican In Name Only). And if Goodlatte hears footsteps behind him, including at the March 9 Republican Reagan Day Dinner in Warren County, it may be because McHugh takes his activism seriously. While living in Vermont in the 1980s and 1990s, McHugh told us he was jailed with a group of pro-life protesters attempting to challenge the legality of state abortion laws. As we interviewed him for this story, McHugh reveled in recalling that period of personal activism on the streets, as well as the in the courtrooms and jails of Vermont. Target Tampa?

Who does he support for the Republican presidential nomination? Anybody but Romney, McHugh told us. However, he did admit to getting a call from a state Paul rep from Virginia Beach after the mass meeting and subsequent press or political reports about it. Pauls not going to win but Rand Paul in 016, keep your eye on that, McHugh said of Ron Pauls son and current first-term, U.S. senator from Kentucky. Vacuum at the top The Grand Old Party does not have a leader. They have had four years to get a leader to defeat Obama and they have done nothing, long-time county Republican Prudence Mathews said in response to a question about what the local mass-meeting events of March 15 might mean. She added that the vacuum at the top is likely seeping down, creating situations like the March 15 mass meeting here. I dont have a problem with people forwarding their own candidate to beat Obama but fighting among ourselves, and that is whats happening, does not help, outgoing committee Chairman Henderson said. After over six months of campaigning and the spending of record-setting amounts of money in advertising much of it negative for state delegates across the country, the Republican Party appears increasingly divided. Its 01 presidential primary process has left: an unpopular front runner with a serious case of foot-inmouth disease, Mitt Romney; a seemingly endless supply of flavor-of-the-day challengers, from Sarah Palin (who once again quit early as she did as governor of Alaska to avoid media scrutiny or to her mind, persecution); Michelle Bachman (an antifederal involvement candidate whose family farm is supported in part by federal subsidies); Newt Gingrich (dont do as I do, do as I say when it comes to personal morality); Rick Santorum (a religious, social agenda zealot who thinks blahhh people are a drain on society); and even a token blahhh, I mean black challenger, pizza-marketing guru Herman Caine, thrown into the mix (just to prove Republicans arent at all racially motivated in their fervent personal hatred of or devotion to unseating Barack Obama); and then there is Paul the elder, the ever-lurking libertarian presence who has failed to win anywhere but just wont go away. Buoyed by post-Citizens United unlimited (and often anonymous) financial support, Romneys remaining challengers Paul, Santorum and Gingrich have all refused to drop out, possibly continuing the personal and political bloodletting right up to the August National Republican Convention. In fact, the day before the March 3, HLI pro-life/anti-birth control mandate rally in Front Royal, the national news media widely reported Santorum saying he would rather have Obama re-elected, than Romney gaining the presidency. Then a week later Santorum was reported saying he would accept the vice presidency on a Romney ticket. And you thought following the NCAA Division I Basketball Tournament was fun

Republican Committee rules dispute goes to state


Will chair be selected by membership only or another mass-meeting block?
By Roger Bianchini Warren County Report Whether it was motivated by state, federal or local politics or some combination thereof a dispute over rules, nominations and who will lead and influence agendas for the Warren County Republican Committee for the next two years remains unresolved. Despite allegations by some committee members that the end game for a majority block of apparent noncommittee members was the naming of delegates to the state and ultimately the national Republican Conventions, one organizer of that block, Mike McHugh, said the focus was on gaining the committee chairmanship with an eye toward the coming Republican U.S. 6th District convention and a challenge of long-time conservative incumbent Bob Goodlatte (see related story). The McHugh block brought an apparent 55-47 majority to the mass meeting. That was the margin of victory for Dennis Fusaro over committee member and county Commonwealths Attorney Brian Madden to assume the role of acting chairman to conduct the March 15 mass meeting. However the attempt to elect a chairman, as well as vice chair, and propel any future committee processes, agendas or rules stalled after that. While two executive committee members were elected Treasurer Trish Anderson was re-elected and former executive committee member Susan Conway was elected secretary (though she reportedly declined the position before the meetings conclusion) no chair, vice chair or magisterial district chairs were elected. Rules set forth in the call for the March 15 mass meeting by then Chairman Dave Henderson were that executive committee nominations had to be pre-filed. Only one candidate was pre-filed for nomination to the chairmanship being vacated recent Vice-Chairman Dom Repici. I wasnt aware of it in time, McHugh told us of the pre-filing qualification for the mass meeting. At issue for McHugh is that the nomination rules set by the chair for the mass meeting conflict with the committee bylaws, which allow nominations from the floor. We had to deal with the illegal call [to the mass meeting]. If youve been to the website the bylaws say nominations from the floor may not be barred. And the call said nominations from the floor will be barred. I didnt find out till it was too late, McHugh said of the altered rule for the mass meeting. As the dispute over call rules allowing only pre-filed nominations developed, Fusaro said, Some wanted to vote the only pre-filed chair nomination down and they realized they had the votes to do it. After it was apparent an impasse had been reached, the mass meeting was adjourned. Fusaro said at issue is whether a mass meeting that has failed to accomplish what is it was called to accomplish election of all executive committee members and magisterial district representatives can be adjourned. However, he agreed the initial decision on further nominations and officer elections will come from the existing executive committee. At this point that is the most recent past chairman, Dave Henderson and the only other elected officer, Treasurer Trish Anderson. But McHugh says he believes that even if his appeal is rejected, those with him can block the necessary /3s majority needed to elect officers at a regular meeting. We were told about 45 people registered and paid dues to become committee members on March 15. Though new members can be approved at any meeting, new members cannot vote until the meeting after they join the committee. All we need is one third to block it because the party plan requires two thirds but that is if the RPV rules in their favor. The RPV should rule in our favor because it was a clear violation in the call, McHugh said. And the key question I was asked was did you do anything to try to deal with the illegal call. And I said yea, we tried to suspend the rules. For McHugh it is the chairmans seat that is crucial. Committee chairmen traditionally wield significant influence, setting rules for specific Name of the game If some, like Ratigan, believe the March 15 mass meeting power play was out of line, others just see it as political business as usual. The GOP has a process various candidates try to get control its part of the process and not uncommon, former committee chairman and long-time Republican activist Matt Tederick said. I thought it was rather subdued compared to some Ive seen no one was shouted down. I thought it was professionally done granted when a majority takes over, the minority gets upset, Tederick said. meetings and bringing forward agendas for the committees membership to focus on, he told us.

Supervisors move toward salary increases without a tax hike
By Roger Bianchini Warren County Report Following a joint Special Meeting with the school board the morning of March 7 to discuss budget issues, the Warren County Board of Supervisors appeared to establish a consensus to accommodate two funding requests to enable the public school system to be included in a countywide employee pay upgrade. A -percent pay increase after several years of no cost-of-living or step increases is seen as necessary to keep not only county employee morale up, but to keep employees in the county, particularly in the public school system as other localities seem poised to improve pay scales that have been floundering in both a down economy and conservative funding environment at the state level. School Finance Director Rob Ballentine told the supervisors county public schools are seeing a $1,789,31 reduction in federal funding. However, he added that revenue loss is being offset somewhat by a downgrade in the countys Composite Index ranking that helps determine state funding levels for all public school systems ranking goes down, funding goes up I guess were not as collectively rich as we used to be. The proposed budget increases for the school system total $,783,631 but will be offset in part by returning a $38,47 surplus from public schools FY 011-1 budget. Of the request to increase last years local schools appropriation of $19,717,546 by $,558,571: $1,778,31 will cover state-implemented increases to Virginia Retirement System (VRS) rates. Of that amount, $30,63 will cover compensation to employees for a change requiring employees to pay a 5percent hike in employee benefit shares; $69,768 to cover the percent salary hike. Ballentine noted the county has the option of covering the 5-percent VRS increase in one year or spread it out by one-percent annually for five years. The first option, while costing more in the short-term, will actually save the county money over the long haul. In fact, doing some quick calculating North River Supervisor Dan Murray estimated an $18,000 annual loss in the first year of the year-by-year option. And Murray later told us, that figure would likely go higher annually in much the manner interest compounds as it was impacted by the higher salaries; and as County Finance Director Carolyn Stimmel pointed out, likely continuing increases in VRS rates. In later discussion after school officials left the meeting it appeared the board preferred to go with a first-year, one-percent hike with the possibility of doing the remaining four-percent next year in a better county revenue situation. However it is accomplished, the increased appropriation to schools, as well as to the countys own budget hike for staff increases will be accomplished without a discussed one or two-cent county tax hike (1 cent = about $350,000). Rather, the county will borrow around $ million from its General Fund, with the hope of paying itself back next year with the help of an anticipated revenue increase of $1.6 million from the Dominion-VEPCO gas-fired power plant planned to begin construction this year on the countys northside. Future revenues Tony Carter expressed reservations about depending on anticipated revenues before we get it. He noted that had north corridor revenues anticipated to fund the countys commitment to its capital improvement projects that included the two high schools, Bing Crosby and public library fallen through, a 17-cent tax hike would have been needed to cover the expense. However, the fact those corridor revenues did come through; coupled with the money already invested by Dominion, as well as the degree of pre-construction work already underway on Dominions power plant, seemed to ease Carter and the other supervisors minds. While borrowing the General Fund reserve under 15 percent of the total county budget risks a downgrade of the countys excellent bond rating impacting future interest rates, it appeared a one-

year turnaround to replenish the fund to the necessary level should not result in any downgrade. Addressing the issue, County Administrator Doug Stanley said a worst case scenario taking  percent out of the General Fund reserve to balance the FY 01-13 budget would leave $10,738,549 in the General Fund reserve, or 1.17 percent of the proposed annual budget. Stanley said those numbers could be impacted positively by additional revenues or reduced expenditures that may still be uncovered as the budget process progresses. Town still wrestling with building permit complaints


By Roger Bianchini Warren County Report On March 19 the Front Royal Town Council continued to ponder its place in ongoing disputes between property owners, businessmen and builders over what some perceive as too-harshly-applied regulations and too-lengthy timeframes in the county permitting process. Despite a work session appearance and explanation of procedures by County Building Official Dave Beahm and County Administrator Doug Stanley on March 5, the issue seems far from resolved. Good for them for trying to put out the fire, Shae Parker said of the countys explanation of its policy, but I dont theyre aware it is turning into an inferno. Were taking a beating on this, Mayor Tim Darr observed. And were not even in the process, Town Manager Steve Burke added. But were letting someone else represent our interests, Parker said of why that beating may be continuing. If we keep getting the same complaints Im willing to talk to each supervisor if thats whats necessary whatever it takes, the mayor said of resolving complaints generated by in-town businesses and property owners. Darr said since the March 5 work session discussion he had received four more phone calls and three other face-to-face complaints about the county process. If someone brings a business here and expects to get it going in one month and they get backed up two, three, four months maybe its their fault but we need to encourage the county to help correct this situation, Darr said. Tom Conkey complained that the county seemed more engaged in justifying its position and process than in correcting any issues that are leading to the complaints. That the bulk of those complaints in the past year appear to have been generated within the town limits is an ongoing sore point for town officials. At the top of that list on the business side have been two town restaurants, Joes Steakhouse and Element. As commented in the wake of the March 5 work session, Joes lost an entire season due to additional renovation requirements imposed that may have more than doubled their anticipated expenses. According to town officials, after over a year Element has yet to be able to open an outside deck due to county interpretation and enforcement of federal handicap access codes and state emergency egress issues. Conkey said he favored moving forward with establishing the towns own building inspection and permitting department within planning and zoning. However Hollis Tharpe questioned how council could know that its own department might not be worse or harsher in its interpretation of codes. Willing to take the chance that would not be the case, Parker suggested council seek a formal opinion from the Warren County Builders Association on the advisability of the town establishing its own permitting department. I have no problem with asking the question, Tom Sayre said. Sayre then lightened the mood by describing his amazement at the appearance of first holes on a residential property off Happy Creek Road on his drive into town, and then posts in those holes that he said went right up to the new sidewalk and town right of way Im wondering what is this?!!? Responding to Sayres amazement at the fence construction process so close to the town ROW, town Planning Director Jeremy Camp noted that in the wake of VDOT right-ofway acquisition from those properties for the recent expansion of Happy Creek Road, those homeowners property lines did go right up to the towns sidewalks and ROW. Thats why it took 14 years, the town manager said of the Happy

FRPD teams up with chamber to fight Distracted Driving


Front Royal Police Chief Richard H. Furr has announced that his department has partnered with the Front Royal/Warren County Chamber of Commerce to help promote Distracted Driving Awareness Month during the month of April. Chief Furr states, Distracted Driving is a cause in approximately 80 percent of all crashes and 65 percent of all near-crashes in a recent study by the Virginia Tech Transportation Institute. In todays society, drivers are more focused on doing other tasks within the vehicle other than watching the road. During the month of April, we want to remind motorists that driving is a task that requires 100% of their attention. The slightest distraction from that task can end tragically not only for the driver, but also for other motorists and pedestrians. Traffic Enforcement Officer Donald Orye adds Teenagers and young drivers are at risk the most. With the technology that is available today with cell phones, iPods, GPS devices, and other electronic devices, their attention is focused more on these items rather than driving. Drivers in this age group do not have the experience to try and multi-task while driving. By taking their eyes off the roadway to look at a cell phone for a brief moment, their attention has now been redirected. When they do bring their eyes back to the roadway, it will take almost  seconds for their attention to become focused again on the task of driving, Orye adds Young drivers are already at risk when they start driving. One study shows that 3 out of 5 newly licensed drivers will be involved in an accident during their first 6 months of driving alone. If they use a cell phone while driving, that risk is increased 3 times. So the odds are already against our young drivers. Nikki Foster, President of the Front Royal/Warren County Chamber of Commerce, has pledged to be a part of this campaign and is encouraging all of the Chambers members to take part. We are asking our members to take the steps to drive without being distracted. We want everyone to be safe while on the roadway and to be totally focused on their driving behavior. By Ryan Murphy Capital News Service RICHMOND, March 28 A legislative conference committee soon will begin deliberations to reconcile the House and Senate versions of the state budget, which would take effect July 1. We are cautiously optimistic that a solid, fiscally prudent budget will emerge from conference and be voted into law within the next few weeks, House Speaker William J. Howell, RStafford, said Tuesday, March 7. A number of sticking points could delay any agreement. They include road tolls in Northern Virginia and Hampton Roads, different provisions on Medicaid eligibility and the shuffling of money between education and transportation. The Republicanheavy conference committee could mean that a budget looking more like the House version will come out of the deliberations. With various localities and agencies waiting for final adoption of the budget, I hope that the conferees will produce a balanced conference report for final passage in short order, Howell said. Senate Democrats were able to use the evenly divided chamber to their advantage for the first time. As lieutenant governor, Republican Bill Bolling has been able to cast tiebreaking votes on legislation, essentially giving Republicans an unofficial majority in the chamber. However, he cannot cast the deciding vote on matters pertaining to the budget. Democrats pushed the advantage to force a budget more to their liking. It kept more money in education and pushed back tolls in Northern Virginia and Hampton Roads, according to Delegate Mark Sickles, D-Franconia. What the Senate has done is exactly what House Democrats were fighting for during each round of the budget process, Sickles said. Fatter Paychecks? Many Are Clueless


The payroll tax reduction has been extended under the Middle Class Tax Relief and Job Creation Act of 2012. Two percent of your deduction for Social Security (4.2 percent, down from 6.2 percent) has been picked up by the government again, and that amount will stay in your paycheck. If youre self-employed, your portion of self-employment tax drops from 12.4 percent to 10.4 percent, to account for that 2 percent. Workers who earn $50,000 would have seen $1,000 in their paychecks over the year the reduction has been in place. Divided by 24 (assuming twicemonthly pay periods) and that would have come to around $40 per paycheck. If your annual pay is $30,000, your savings from the reduction is $50 per month. Oddly enough, a poll by the National Foundation for Credit Counseling showed that 66 percent of workers didnt know their paychecks were larger, even though the extra amount had been in paychecks for a year. By Roger Bianchini Warren County Report We (Mandy & me) jumped at an offer to replace our normal Wayside Theater reviewer Malcolm Barr Sr. at official opening night of Greater Tuna on Sunday, March 5. Greater Tuna is a comedy about life and personalities in Tuna, Texas, a place that dont say its any differ-

ent or any better than anyplace else. The show, first performed by its two playwrights Jaston Williams and Joe Sears in 1981, has grown into one of the most produced plays at regional, community and college theaters across the United States. It even got a showing at the White House in 1989 during the presidency of Texan George H.W. Bush. Bush and wife Barbara showed they

werent too thin-skinned about the made-for-laughs portrayal of rural Texans and their personal and cultural foibles when Greater Tuna was invited back for an encore performance with one of three eventual sequels, A Tuna Christmas, in 1990. Even famed TV producer Norman Lear once brought the play into Americans homes on HBO. Well admit to being somewhat skeptical about the ability of any local

theaters cast and staff to do justice to such an undertaking as Greater Tunas fast-paced, two-man show. Our gut reaction was well, how are two guys short of DeNiro and Pacino gonna hold our attention for nearly two hours? Just over two hours later, including one intermission, we joined the Opening Night crowd cheering Eddie Staver III and Greg Pragels tour d force performances flawlessly de-

livered at a pace a cast of 10 might not have matched at a lesser venue. Appropriately, Wayside vet Staver and newcomer Pragel brought out wardrobe and production staff for a bow, and a well-deserved one at that. One fellow theater goer said they timed the costume changes sending Staver and Pragel back on stage as ever changing characters at 30second intervals as the show flowed seamlessly from scene to scene. A tour d force by all and a show we highly recommend. Perhaps the secret of the popularity and longevity of Greater Tuna is held in that observation delivered early in the show by Tunas OKKK radio news team of Arles and Thurston that Tuna is, more or less, like every place else. Those words acknowledge a universal theme hidden under the regional accents, dress and local color. For me, the theme is that under the window dressing we all put up around ourselves, down deep were all subject to the same fears, desires and temptations no matter who we are or where we come from. And listening to lines written over 30 years ago I was also struck by the notion that while things change, they stay the same. Duncans numbers, future town planning questioned

One former Front Royal Town Manager, Michael Graham, right, brought a message to council from another former town manager, Walter Duncan, on March 26. The message is, do due diligence rather than just ignore the information Duncan has accumulated on what he believes are decades of town citizens shouldering too much of the financial burden of economic development in the community, most of it on county land.

By Roger Bianchini Warren County Report Despite a fairly light agenda, the Front Royal Town Council heard one pretty pointed public hearing question and a public presentations request, both with pretty heavy implications during its meeting of March 6. Early in the meeting, speaking during the Public Presentations, former Town Manager Michael Graham urged council to do some substantive follow up on issues surrounding long-time revenue-expenditure inequities alleged in recent months by Walter Duncan. Actu-ally, Duncan, a 9-year-old former town manager and councilman, pointed out

in a March 3 memo to council that his initial presentation to them on what he perceives as the undue financial burden for economic development shouldered by town citizens, was given to them on May 3, 011, exactly 10 months earlier. Its been a long time since Ive been back here its almost a year and a half, Graham noted as he prefaced his remarks before the mayor and a council 3-, one-inthe-hole sub-majority that fired him. Graham noted the amount of research Duncan had done on water and corridor issues while he, Graham, was still in office. handed to us three days later cites a half century of town and out of town citizen payments for water-sewer-land; and a decade of payments for EDA funding. Those number are: from 1960-010, $49,661,798 (93.1 percent) paid by town citizens for water/sewer/land; from 1960-010, $3,695,375 (6.9 percent) paid by out-of-town, county residents for water/sewer/land; from 001-011, $6,150,159 ($47 per capita) by town residents for EDA costs; from 001-011, $4,100,106 ($177 per capita) by out-of-town county residents for EDA costs. Duncan notes his figures are based on the 010 Census showing a Front Royal population of 14,400 (38.4 percent of the county population); and an out-of-town county population of 3,135 (61.6 percent) of the countys total population of 37,535. Campaign issue Reacting to Grahams appearance and a post-meeting conversation with unnamed councilmen, town mayoral candidate Tim Ratigan, who is challenging incumbent Tim Darr, issued a March 8 press release on the matter. I am deeply troubled by comments made by some of the Councilmen after last Mondays meeting regarding Walter Duncans Cost Analysis on the water and infrastructure going out to the 5 corridor. The comments made would lead the average Front Royal citizen to believe that Mr. Duncans findings were incorrect or out of date. Given the fact that Walter Duncan is a former Front Royal town manager of 1 years and past councilman of eight years I find that assertion hard to believe. Ratigan urged council to heed Grahams suggestion it give a third-party consultant the opportunity to dispel or verify Duncans numbers. If the Mayor and Town Council will not give it serious consideration then I will by making it an issue and bringing it to the attention of the voters of Front Royal,

If that dust up wasnt enough, another member of the public questioned the advisability of a re-zoning matter back on the agenda after an earlier approval that was later found by the applicants attorney to be procedurally flawed. Revisited on March 6 was councils approval of a re-zoning of just over 98 acres for the HEPTAD subdivision planned as part of a Planned Neighborhood Development under Urban Development Area guidelines mandated by a bipartisan coalition of the Virginia General Assembly several years ago. While the current legislature removed the UDA mandate this session, inclusion of the HEPTAD development owned by current town EDA board rep Ron Llewellyn as part of then legally-required county development plan was negotiated last year after six years of off and on negotiations on proffers, including contributions to Leachs Run Parkway. The rezoning from Suburban Residential to a PND District (Planned Neighborhood Development) will increase the number of units and reduce the lot size into the type of clustered development with larger park areas of green space favored by current planning theory and environmental groups. The planning theory is to reduce stress on groundwater by eliminating development dependent on well and septic in more remote rural areas in favor of cluster subdivisions adjacent to existing development and central utilities. Town-county

Corridor, building issues continue to be town focus


By Roger Bianchini Warren County Report At the March 19 Front Royal Town Council Work Session Shae Parker revisited the last 5 Corridor Committee meeting and subsequent public comments by county representatives that they had not only been outnumbered, but essentially came under attack by the larger town contingent. That perceived attack centered on a potential boundary adjustment that would bring some of the 5 North Corridors commercial tax base into the town limits. Parker suggested a four to six week timeframe for feedback from the town manager on an opinion from the town staff side. He also suggested Town Manager Steve Burke work with County Administrator Doug Stanley on review of annexation studies by both the town and county dating to the mid1990s prior to the decision to go with the alternative of the existing 5 Corridor Agreement signed in January of 1999; as well as review a neighboring communitys (Winchester-Frederick County) study of costs associated with an annexation looked at several years ago. Parker noted three aspects of the mid-90s study here that looked at: land closer to the town line; extension to the county fairgrounds; and finally an extension that would have gone all the way to the county line to the north. Parker said that if the suggested third-party study proved not feasible for the Northern Shenandoah Valley Regional Commission (NSVRC) that any consultant that had done work for either the town or county in the last 0 years be disqualified. Questioned on the length of that timeframe, Parker pointed out the corridor agreement was signed 14 years ago and that both municipalities had consultants involved surrounding that period and since on related issues, including a 00 water study. At issue for some town officials like Parker and former councilman and town manager Walter Duncan are the towns provision of central water and sewer to facilitate commercial growth on county land to the benefit of community economic redevelopment, with what some perceive as an unequal return on that investment to the town and its citizens. Duncan has told council at recent work sessions that he believes town taxpayers have footed an unequal share of the financial burden from the start due to double taxation and their funding of the towns utilities. Also at issue are changes to the economic landscape since the corridor agreement was signed, particularly the 009-10 loss of the primary PILOT fee revenue source enabled by the corridor agreement, the meals-tax based payment in lieu of taxes fee tied to town utility bills. That revenue loss was the result of a legal challenge by the corridors three major chain restaurants, Cracker Barrel, Applebees and TGIFridays. The restaurants argued that the fee based on the towns four-percent meals tax created an undue financial burden, effectively taking their meals tax rate to 8 percent when coupled with the countys 4-percent meals tax. The county instituted its own meals tax in 00 as a means of providing revenue to pay the capital improvements bond issue that funded construction of Skyline High School, the expansion of then WCJHS into the new WCHS, as well as the renovation of Bing Crosby Stadium and new public library.

Front Royals Cash Mob braves stormy weather

He noted that after 11 years in Front Royal he was probably still not familiar with many businesses in town. He commutes to Alexandria and agreed that others who commute to work and live in the county likely have even less awareness of what downtown and other sections of Front Royal have to offer in products and small-town ambience. I wanted to bring awareness about independent, small stores where you probably can get things you can get at Wal-mart, Staples or other chains at the same price or maybe even a better price. These business owners have a vested interest in the community, unlike the big name chain stores. Jacob said he suggested participants commit about $0 to purchases and that cash is used to avoid the fees to merchants that credit card companies charge on all purchases using plastic. He said he does not profit from the event and hopes to contact more town merchants about participation in future events. He is open to ideas to get the Cash Mob ball rolling a little harder through town, he said. Rain has greeted both efforts, perhaps contributing to an adult turnout of five to 10 people with some eager to buy kids in tow. Jacob and his other cash mobsters braved intermittent light and heavy rain after meeting at 10:15 a.m. at the Village Commons Gazebo to learn of their destinations, which included the Second Chance Thrift Store, Sweet Times, Royal Oak Computers, The Good Life Bookstore and a wind-down stop at The Daily Grind to finish up. Jacob said that e-mail communications had led him to hope for a turnout of around 0 adults. Picking up a few stragglers at the first stop, Second Chance, we counted 10 cash mobbers at one time or another on the trek up and down East Main Street on what it turns out was International Cash Mob Day. Jacob said the idea of assembling a crowd to hit a few businesses with cash purchases has spread from the U.S. to Canada and Australia, hence the international designation. He got the idea to try and stimulate the local economys independently-owned small businesses after seeing a news report on MSNBC about the idea of Cash Mobs, a variation of Flash Mobs that assemble and perform at random locations. By Alex Morton Capital News Service RICHMOND, March 24 A Catholic lobbyist, a state legislator and other experts this week debated whether the federal law requiring employers to provide health insurance coverage for birth control violates the religious freedoms of faith-based institutions. Jeffrey Caruso, executive director of the Virginia Catholic Conference, called the law an infringement on Catholic institutions religious freedoms. Forcing church-operated hospitals and schools to distribute free contraceptives to employees goes against church principles, Caruso said. This issue is intrusive. But state Delegate Jennifer McClellan said employees of such institutions have the right to contraceptives under the health insurance act approved by Congress and President Barack Obama. Without insurance, more than half of women age 18-34 struggle to afford contraceptives, McClellan said. If you cant access it because of financial barriers, do you really have a right to it? The two sides squared off at a panel discussion hosted by the Religious Studies Depart-ment at Virginia Commonwealth University. The event, held in VCUs Student Commons Theater, was called Costly Coverage: Religious Freedom and Reproductive Rights in the Birth Control Debate. Caruso, whose office represents the Catholic dioceses of Richmond and Arlington on matters of public policy, said schools, hospitals and other institutions formed under a specific religion should be able to operate within their beliefs. Catholic institutions are being forced to violate their teachings by providing contraception, he said. William Hurd, a partner at the Troutman Sanders law firm and adjunct professor at George Mason University School of Law, agreed. Just because women are legally entitled to contraceptives doesnt mean contraceptives should be provided to women for free, he said. There is a big difference in saying that somebody has the right to do something, and saying that someone else must arrange to pay for it, Hurd said. But McClellan said birth control pills arent used only to prevent pregnancy. The Democratic lawmaker and attorney, who represents the 71st House District in Richmond, said she was prescribed the pill to help with ovarian cysts. If women do not have access to this medication, they are at risk for losing an ovary, McClellan said. She also said that when a religious institution takes on a public function, it loses its reli-gious purpose. Religious hospitals, for example, are performing public services and therefore should take public policy into consideration, McClellan said. Karen Raschke, a retired attorney

One of the best kept secrets in Warren County, the center prepares 6-1 graders to have a leg up when entering college or to provide them a technical trade for entering the workforce. In this two part series we will try to enlighten parents, students and the community alike to the wonders the Center has to offer wonders like Project Lead The Way (PLTW), which we have already visited, and the Innovation Zone.

PLTW classrooms are in more than 4,000 schools in all 50 states, serving more than 350,000 students. The programs goal is to ignite the imagination of our youth and to generate interest in STEM related fields. It uses real-world challenges and opportunities that face business and industry today and in the future. Engineering Tom Breed leads a spirited group of students that recently placed nd statewide at the national Real World Design Challenge, as well as others experimenting with creating eve-rything from a better snow shovel to rocket propulsion. New and exciting Public House and Inn opens in Flint Hill
A yapping good time for all and even a Pet Menu for the 4-legged
Marvin Swaner, who also pulled duty at Houlihans and oversaw the construction of a brand new, top of the line kitchen at Flint Hill. Last week, we sampled the dining room fare and toured the entire school house, finding in addition to the four bedrooms upstairs, a cosy bar on the ground level that led onto a large deck and what eventually will become several acres of lawn and gardens. While at dinner, we were handed a pet menu, though we didnt have either of our dogs with us and were somewhat surprised by the pet friendly environment. Friendly (and well behaved) fourlegged patrons on leashes are welcome, is the foot-note to the pet menu which ranges from a hot dog ($) to marrow bones ($4.95) to a 4-ounce grilled steak ($9.95) cut into bite-sized pieces (please specify doneness). A rule of the house is that you dont feed your dog from the table in the dining room or bar. Also, in good weather, theres plenty of room outside for dogs to play or lounge on the deck. If necessary, ask your server for poop bags, the message intones, (and) make sure you control your pets roaming. Misbehaving dogs will be asked to leave, which includes those that make mad dashes to chase squirrels, chipmunks or deer. Whether in jest or not, we didnt ask, but horses, while welcome to graze, are not al-lowed on the deck. On a day in March to be determined, Waybourn, Spaulding and Gruber are planning a formal gala opening of their new establishment. Meanwhile, the restaurant has received a kick start from several private parties (about 50 from Rappahannock Cellars were enjoying dinner the night we were there) while the tables flanking us were occupied by prominent Front Royal attorney Joseph Silek and his family. More than 100-years-old, the former school was more recently a bar and grill known as the Publick House. Today, following a multimillion dollar reconstruction, it has become the go-to place for area residents and tourists who seek good food - served either formally or casually - and four luxury suites for overnight stays at what can reasonably said to be affordable prices. Noting he lived on Happy Ridge Drive which is adjacent to the HEPTAD parcel, Occiogrosso admitted he hadnt had much time to research the rezoning proposal but said, I guess Im just wondering why we need to put in 450 dwelling units, four or five per acre when there are existing homes available for sale? Im well aware it will bring jobs into the community and what not, but Im just concerned I live right by the property and Im just concerned it will bring in, perhaps people who dont value the home like where I live at ... Happy Ridge it just concerns me. I moved here back in August 005 from New York love it here; am raising six kids, well two are grown, one stayed in the community and now he is raising his two children over on Washington Prior to the 5-1 vote (Sayre dissenting) approving the first reading of the rezoning, Shae Parker observed that the applicant could build 00 homes on the land by right with no proffers coming to the town. He also noted that the PND subdivision was designed to be a largely selfcontained neighborhood, rather than one whose people and habits will bleed into adjacent neighborhoods. We were later told council heard the same arguments against rezoning the property for the subdivision where Oggiogrosso now lives essentially, what kind of people will it bring in and what negative impact on existing neighborhoods will it have? It seems things really do change but stay the same, even here in River City, much like in Tuna, Texas (see Wayside Theater review).

Day at the Town Square parking lot near the Visitors Center and Gazebo. It will be part of Front Royals Appalachian Trail Community Designation Day festivities where both kids and adults can learn about nature, the Appalachian Trail, and planting, protecting and preserving the trees of historic downtown Front Royal. Trees R Cool is an annual day of fun where children find out lots of interesting facts about trees and their habitat. This years Trees R Cool activities will include a Questing Adventure. Kids and their parents can join my friends, the Tree Stewards, on an exploratory hunt solving clues to identify trees and shrubs at the nearby Happy Creek Arboretum -- one of my favorite places to hang out! In addition to questing, there will be fun games for kids of all ages and a chance to show off your artistic talents at the Tree Stewards arts and crafts table. If you like nature, fresh air, and participating in cool activities at the Gazebo on Main Street and by the babbling waters of Happy Creek, come join me and my Tree Steward friends for an exciting day of fun! I hear that the Boy Scouts and Girl Scouts have some great activities planned as well. Wear good walking shoes and bring a picnic lunch to enjoy all of the days happenings. Best of all its a free event planned especially for the children of Front Royal and Warren County. The Front Royal/Warren County Tree Steward program began in 1997 with volunteers dedicated to improving the health of trees by providing educational programs, tree planting and care demonstrations, and tree maintenance throughout the community. The group now consists of over 30 active members with several interns working toward becoming certified tree stewards from our annual All About Trees Class.
