Lesseeon or beforethemove-indateandremainsresponsible for all udlitiesthroughout
thetermofthe Lease.
Lesseeshallbe assessed a ulility transferfeeof$75.00p€r utility whichis not transfencdto Lessee,s nameby the
dateofmove-in. Lesseeagrees10payall utility chargesassessed by utility companies
in conneclionwith theuseof
all utility servicesprovidedto thepremisesduringthetermofthis Lease,as suchtermmaybe extended, or the
periodofoccupancyofthe premises by Lessee, whichcveris longer.Theutility chargesinclude,without
limitation,usagefeesandassessments, utility deposits,
latefees,fansfer fees,anddisconnect fees.IfLesseelails
to pay anyutility charges, andLessoris assessed by theulility companyfor suchcharges, thenLessormay pay
theseutility charges to suchutility companyandsubtracta like amountfrom Lessee'ssecuritydepositandexpect

f5, ACCEPTANCE,CARE, AND ALTERATION OF PREMISES. Lesseehasexaminedthe accepred


premises prior to theexecutionofthis Leaseandis satisfiedwith thephysicalconditionthereof,andhis execution
hereofshallbe conclusive evidenceof his acknowledgmen! thereofin goodorderandrepair,exceptasotherwise
statedhereon,andagreesthatno rcpresentation asto conditionor repairhasbeenmadeby Lessornor contained
herein,andthatno promiseto decorate, ahcr,repair,or improve,eitherbeforeor at theexecutionh€reof,not
coniainedherein,hasbeenmadeby Lessor.Lesseeshallnot hake anyalterations to thepremis€swithouttheprior
writtenconsentofLessor. Lesseeshailnot paint,stencil,wallpaper,or otherwiser€decorate thepremiseswith;ut
theprior writtenconsentofLessor. Lesseeaccepts responsibility
for thecostofcleaningand./or

or drainsthathavebecomeblockedor impededby thenegligence ofLesseeandLessee's guests,or by depoiiting

16.RXPAIRS. Any repairscosringlessrhan$50.00will bepaidfor by Lessee.Any repairscostmgmorethan


$50.00mustbe reportedto Lessorby certifiedmail.

17. LEASE RENEWAL AND NOTICE TO VACATE. Lessormay,but is not obligatedro, offer Lesscea
noticeto renewlhis Leasebeginningat theendofthe termofthe currentL€ase.This 4€w leasemav incluale
reasonable changes includingrentalamount.Lessormayolfer Lesseea new lease60 days(or suchiesser timeas
allowedby statute)bcforethe expirationofthe cunentLease.Less€eshallgiveLessora writtennoticeoftheir
intentto vacateat least60 daysprior to theirvacationfrom thepremises eitherby earlyterminationoflhis Leaseor
Leasetermexpiration.It is the Lessec'sresponsibility to ensurethatthisnoticeirasbeenreceived.Lessee'sfailure
to complywith thisrequirement to givewrittcnnoticeofinlent to vacateat least60 daysDriorto move-outshall
constitutea breachofthis Lease,{greement.

19. SURRXNDEROF PREMISES. Theprcmiseswill havebeensurrendered on thedareofthe earlierofthe

20. ABANDONMENT, Thepremiseswill havebeenconsidered abandoned when:(1) all residents

occupants
appear!o havemovedout in Lessor'sreasonable judgment;(2) clothes,fumiture,andpersonal
belongings
havebeensubstantially removedfrom theapartment, and(3) in Lessor'sreasonablejudgmentno one
hasbeenin thepremisesfor five (5) consecutivedayswhile renl is dueandunpaid.Surrender andabandonment
endsLessee'sright to possessionfor all purposes.

21.DISPOSALOF PROPERTY: Uponterminationofthe Leaseorifrhe premisesappearto be abandoncd, any


personalpropertyleft behindwill bc considered

22. SMOKE DETECTORS. Lessotwill fumishsmokedetectors asrequiredby statuteandwill provideworking


batterieswhenLesseefirst takespossession. Subsequently,Lesseeis responsibleto testandreplacebatt€riesas
needed.Lcsseemustimmediately reportanymalfunctioning or defectivesmokedetectorto Lessorin \lriting.
Smokedetectors cannotbe disconnected. Lesseewill be liableto Lessorandthirdpartiesfor anylossor damage
from fire, smoke,or rvaterifthat conditionarisesfrom Lessee'sfiom Lessee'sdisconnecting or failureto replace
batteries,
or failureto reportmallunctions.Lesseeis advisedto testsmokedelcctorsfrequently.

23. CONDUCT. LesseeandLessee's inviteesshallcomplywith all rulesandregulations now or thereafter


promulgalcd by Lessor,including,withoutlimitation,theprintedrulesandregulations attachedheretoand
incorporated hereinby refercnce.LesseeandLessee's invileescovenantto obeyall rules,lawsandordinances
applicableto thepremises andto engagein no activitiesin or on theprcmtses on an illegalnature,purpose,or
inlent. LesseeandLessee's inviteesfurthercovenantto not bedisorderly,boisterous, or unlawfulandshallnot
disturbthenghtsofothersin thecommunity,andshallbe responsible for tbe conductofLessee'sinviteeson and
aroundthepremises. ShouldLessorat anytime determine thatLessee's tenancyis undesirable by reasonofbreach
of anyofthe covenanls containedin this Leaseor rulesandregulations, includingwithoutlimitationanyillegal,
objectionable,or improperconducton thepartofLessee,Lessee's invitees,or by anyofthem causingannoyance to
others,thenin addition!o anyotherrcmedi€s,Lessormay terminatethis Leasein accordance with applicable
statutes.Lessorreserves therightto amendand,/or modifytherulesandregulations ofthe premisesat anytime.
Lessorwill notily Lesseeofsaid changes or amendments to therulesandrcgulations.

24. CRIMINAL ACTMTES. NcitherLess€enor Lessee's inviteesshallengagein or facilitateanycriminal


activityanylvhereon thepremises, includingbut not limitedlo anyviolentc.iminalactivityor drugrelatedcriminal
activity. "Violentcriminalactivity"meansanycriminalactivitythathasasoneof its elements theactualor
threaiened useof forceagainsta personor propertyofanother."Drug-related activity"meansthc illegai
manufacture, sales,distribution,us€or possessionofa controlledsubstance or marijuana.Violationofthis
provisionor it Lessorhasreasonable causeto believethatLesseehasviolatedthisprovisionconstitutes material
non-comphance with thetermsofthis Lease.Notwithstanding anyother provisionin this Lease,suchviolation
maybe groundsfor Lessee's eviction.

25. LIABILITY. Ownerand./or Lessorwillnotbe liablelo LesseeandLessee's inviteeslorany damageto person


or propertycausedby othcrpersons,
includingtheft,burglary,assault,vandalismor othercnmes.

or othercauses whatsoever or resultingftom anybreakage or malfunctionofany pipes,plumbingfixtures,air
conditioner, or appliances unlesssuchinjury or lossor damageis causedby thegoss negligence ofow'nerand./or
Lessor.Lesseeis rcsponsible for anydamage1oihe premises causedby Lesseeor Lessee'sinviteesand/ortheir
pets. This liabilityextendsto sewlcecallspertainingto appliances, plumbingpipesandflxtures,garbage disposals,
pestinfestation, rodent infestation,etc.when the malfunction is deemed to b€ causedby misuse by Lesseeor
Lessee's invitees.Lesse€agreesto indermify,reimbuseifnecessary, andholdowncr and/or Lessor harmless tiom
andagainstanyandall claimsfor damages to propertyor personarisingftom Lessee'suseof th€ premises, or from
anyactivity,work,or itemdone,permittedor sufferedby Lesseein or aboutthepremises-lfany damages to th€
premisesoccur,causedby Lesseeor Lessee'sinvitees,whichis deemedby Lessorto be willful or malicious,then
thisLeasemaybe terminared forthwithin accordance with applicablestatestatutes.IfLessor or any ofLessor's
employees renderany servicessuchasmovingautomobiles, handlingof fumiture,cleaning,or anyothetservicc
not contemplated in this Lease,suchemploy€es shallbe deemedthe agentofLessccrcgardless whetherpaymentis
arranged for suchse ice. LessorandLessor'semployccsarenotliablefordamage,loss, ortheft ofany of
Lessee's property.

26. DAMAGE OR DISTRUCTION OF PRIMISES. Lesseeshallimmediatelynotify Lessorin theeventof


damageto thepremises by fire, water,or oth€rhazard,or in the eventofmalfunctionofequipmentor utilities,
inctuding,withoutlimilation,plumbingor eleclricalwiring malfunctions.Ifthe damages as suchthatoccupancy
canbe continued, Lessorshallmakerepairsasneededwith reasonabl€ promptness andrentshallnot abaleduring
lhe penodofsuchrepairs.If, in Lessor'sopinion,lhe premises arcdamaged asto be unfit for occupancy,and
Lessorelectsto makerepairs,therentprovidedin thisLeaseshallabateduringtheperiodof time whenthe
premises arenot fit for occupancy, but in al1otherrespects thetermsandprovisionshereofshallcontinuein full
forceandeffect. ln the even the premises aredamaged or destroyedso asto be,in thesoleopinionofl-essor,
incapable ofbeing satisfactorily repaired,thenthis LeaseshallterminateandLesseeshallbe liableonly for rental
paymentsup to thedateofsuchdamageor destruction (providedthatLesseeor L€ssee'sinviteeswerenot
responsiblefor the damageor destruction).In the€ventanydamagecausedby Lesseeor Lessee's inviteesareof
eithera negligentor maliciousnature,this Leasemaybe terminated by Lessor.

27. REIMBURSEMENT BY LESSEtr. Lesseeagreesto reimburseLcssorpromptlyin the amountof anyloss,


propertydamage,or costsofrepairsor se ice (includingplumbingsystemfailure),suffercdat thepremisescause
by theacts,omissions,or negligcnce
ofor improperuseby Lessee, L€ssee'spets,or Lessee'sinvitees.By way of
example,Lesseeshallbe responsible for anydamageresultingfrom anywindowsor doorcbeingiefi openor
cookingunatt€nded. Lesseeshallberesponsible for anydamageto the leasedpremisesor otheraff€ct€dareaif
damageoccurs asa rcsultoflessee's failur€to keep thepremisesat a temperatuie of 55 degreesor higher.Such
reimbursement shallbedueimmediatelyupondemandofl-essor. Lessor'sfailureor delayin demanding damagc
reimbursements,late-paJrmcntcharges, retumcheckcharges, or othersumsduefrom Lessccshallnot be deemeda
waiverhereof;andLessormay demandsameat anytime,includingmove-out.ShouldLesseedamagethepremises
